Dear Mr. Johnson:
Reference your application received May 19, 1993, for Department of the
Army authorization to construct temporary cofferdams adjacent existing water
control structures at New Field Impoundment and North Pond Impoundment, Pea
Island National Wildlife Refuge, located off the west side of Highway 12,
adjacent the Pamlico Sound, Rodanthe,North-Carolina. The
proposed temporary cofferdams will facilitate temporary dewatering of the
sites in order to undertake structural replacements within the dike system and
to replace inoperable flap gates.
For the purposes of the U.S. Army Corps of Engineers' Regulatory Program,
Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the
Federal Register on November 22, 1991, lists nationwide permits (NWP).
Authorization, pursuant to Section 10 of the Rivers and Harbors Act of 1899
and Section 404 of the Clean Water Act, was provided for temporary structures
and discharges, including cofferdams, necessary for construction activities or
access fills or dewatering of construction sites; provided the associated
permanent activity was previously authorized by the Corps of Engineers or the
U.S. Coast Guard, or for bridge construction activities not subject to Federal
regulation.
Your work is authorized by this NWP provided it is accomplished in strict
accordance with the enclosed conditions. This NWP does not relieve you of the
responsibility to obtain any required State or local approval.
This verification will be valid for 2 years from the date of this letter
unless the nationwide authorization is modified, reissued, or revoked. Also,
this verification will remain valid for the 2 years if, during that period,
the NWP authorization is reissued without modification or the activity
complies with any subsequent modification of the NWP authorization. If during
the 2 years, the NWP authorization expires or is suspended or revoked, or is
modified, such that the activity would no longer comply with the terms and
conditions of the NWP, activities which have commenced (i.e.., are under

construction) or are under contract to commence in reliance upon the NWP will
remain authorized provided the activity is completed within 12 months of the
date of the NWP's expiration, modification or revocation, unless discretionary
authority has been exercised on a case-by-case basis to modify, suspend, or
revoke the authorization.

Dear Mr. Johnson:
I received yesterday your proposed mitigation plan
supplementing your letter dated September 14, 1993 for your
Milltail Road parking project. I have reviewed the plan proposing
to restore 0.5 acres of present agricultural land to a wetland
state, and find it to be acceptable mitigation for the 0.02 acre
wetlands fill proposed under the Alligator River NWR Nationwide
Permit Application dated August 30, 1993. As you discussed with
Steve Gabriel, the 0.5 acre wetland restoration is to take place in
Spring of 1994 and is to be in addition to the larger wetland
restoration project already planned by your office at that time.
With this mitigation plan made a part of the Refuge Nationwide
Permit application, I find the application to satisfy the policies
of the Dare County land use plan and to be consistent with the
North Carolina Coastal Management Program.
Pending all other necessary approvals, I would appreciate
notification prior to the start of construction. Should any
questions arise on this matter, please feel free to call.

Dear Sir:
Enclosed is an application for a nationwide permit to install
temporary cofferdams at three sites on Pea Island National
Wildlife Refuge in Dare County, North Carolina. The purpose
of these cofferdams is to allow placement of two water control
structures and repair of an existing inoperable flapgate. The
two water control. structures will allow water to be removed
from North Pond and New Field impoundments at a much faster
rate than possible with existing facilities. The repair of
the flapgate is necessary to maintain planned water levels for
vegetation management. Placement of the two structures is
especially critical due to expected increases in ocean
overwash at Pea Island. Without an increased ability to get
water out of the impoundments when overwash occurs and the
impoundments fill up, the chances of a dike being breached are
increasing. Please expedite this if at all possible.
Sheetpile bulkheading and small amounts of earth fill will be
used to construct the cofferdams. The fill and bulkheading
will be removed after installation of the structures and
