Mr. Chris Phelps July 15, 2019 Page 3 of 3 In response to your additional information letter of June 13, 2019: 1. The City requests to change the language under Condition H.8.a. on the setback requirements from "Surface Disposal Site" to "Surface Disposal Unit". The current language could create confusion on where the setbacks should originate from since the SDU is located on a small section of the 129-acre site. Response: This change is agreed and the permit has been changed. 2. The City requests that Condition II.8.b. be removed in its entirety. This section does not apply to this SDU. Response: This change is agreed and it is noted that these setbacks were not part of earlier permits. The change has been made. If any parts, requirements, or limitations contained in this permit are unacceptable, the Permittee has the right to request an adjudicatory hearing upon written request within 30 days following receipt of this permit. This request shall be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings at 6714 Mail Service Center, Raleigh, NC 27699-6714. Otherwise, this permit shall be final and binding. If you need additional information concerning this permit, please contact Troy Doby at (919) 707- 3655 or troy.dobynncdenr.gov.
