Reference the application of Mr. E. C. Willett for a Department of the Army permit to maintain a basin and access channel and expand commerical marina facilities on Rush Creek and the North River, Harkers Island,`' eret .County, North Carolina. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: a. All work authorized by this permit must be performed in strict compliance with the permit plans. b. -All excavated materials will be confined landward of the mean high water (MHW) elevation contour and any regularly or irregularly flooded vegetated-wetlands. C. No excavated or fill materials will be placed at any time in any vegetated wetlands or waters. d. No vegetated wetlands will be excavated or filled. e. The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands is not authorized. f. Excavation will not exceed four (4) feet below the elevation of mean low water (MLW). g. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. Use of the permitted activity must not interfere with the public's right to free navigation on all navigable waters of the United States. -2- h. If the display of lights and signals on the authorized structure is not otherwise provided for by law, such lights and signals as may be prescribed by the U.S. Coast Guard will be installed and maintained by and at the expense of the permittee. i. The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. j. The activity will be conducted in such a manner as to prevent. a significant increase in turbidity outside the area of construction or construction-related.discharge. Increases such that the turbidity in the waterbody is 50 NTU's or less are not considered significant. Willett Carteret County Per the attached notarized statement from Mr. Willett and correspondence from the Carteret County Environmental Health Division, Mr. Willett has requested the connection of a proposed marina pumpout station to an existing septic tank system located at the old fish house on Mr. willett's property. This Office has no objection to this proposal provided that the following conditions are met. 1. Final engineered plans for the proposed pumpout station and collection system must be approved by the On-Site Wastewater Section of the Division of Health Services. 2. That the CAMA pen-nit contain a condition prohibiting the construction or use of bath house facilities at the marina. (Marinas with bath house facilities require a 30 gal./slip sewer allocation) 3. It has been determined that this septic= system has served up to a maximum Of twenty-five ( 5) employees in the past (maximum 625 qpd) for this system. We have no problem with assigning the flaw from past do -melt i uses to serve a pump cut station for a forty (40) slip boat marina (10 gal/slip) (400 gal) gpd ma.xirnum. The inspection revealed that waters and wetlands subject to DA permitting authority do exist on the property. During this site investigation the wetland/upland boundary was flagged for your information. Before you undertake any work in conjunction with your project, we suggest that this boundary be surveyed and plotted on your property map. Such mapping would help you avoid any unintentional disturbance of wetlands on the site and would assist in planning for the disposal of the dredge spoil from your project. Surveyed wetland lines, shown on property maps, must be field verified and confirmed in writing by our staff to be acceptable. PROJECT SUMMARY: The applicant received Permit #121-92 to construct a marina facility and stabilize the shoreline. The applicant is now proposing to maintenance excavate the basin and access channel in Rush Creek and North River and expand his marina so that approximately 40 boats could use the facility. w „ FIELD INVESTIGATION REPORT: E. C. WILLETT, CARTERET COUNTY PAGE #2 9. NARRATIVE DESCRIPTION: The project site is located on an approximately 4 acre spoil peninsula known as 'Rush Point', which is located on the extreme western end of Harkers Island and off SR1335. This property is bordered on the south by Back Sound, on the west by North River, and on the north by Rush Creek. The applicant has received two (2) CAMA permits which have authorized either shoreline stabilization or the construction of a marina facility. The latest permit (021792) authorized the reconstruction of docking facilities at the head of Rush Creek so that 10- 20 boats would be able to tie up at that location. The construction of this facility has not taken place. However, the applicant is now proposing to expand and change the configuration of this docking facility and to excavate a boat basin and access channel area. The proposed docking facility would consist of an approximately 480' long x 5' wide pier which would be parallel to the existing concrete bulkhead. This pier would be approximately 5' waterward of the bulkhead and in some places, would be constructed over coastal wetlands vegetated with Spartina alterniflora marsh. Several 5' wide access walkways will connect the pier with adjacent highground. Seventeen (17) finger piers would be constructed perpendicular to the pier with 55 adjacent mooring pilings. This docking arrangement would provide accommodations for 34 boats. The width of the boat slips will range from 11-14'. An approximately 530' long x 80' wide boat basin is proposed to be excavated in Rush Creek to a depth of 4' MLW and an approximately 975' long x 46' wide to 4' MLW deep access channel is proposed to be excavated in Rush Creek and North River. Spoil materials obtained from this excavation activity will be placed in 4 different locations on the site. The U.S. Army Corps of Engineers have determined that the disposal sites are located on upland property. Waters within Rush Creek are classified as 'SA' by the Division of Environmental Management and are closed to the harvesting of shellfish. The waters of North River are classified as 'SA' and are ,Wn to shellfishing. The waters of Back Sound are classified as 'ORW' & 'SA' and are also oven to the harvesting of shellfish. 10. ANTICIPATED IMPACTS: The proposed pier construction will encompass approximately 19,200 sq. ft. of Public Trust Areas and will provide mooring facilities for approximately 34 boats. The applicant has indicated that typical boat lengths will range from 16' to 35'. This proposed facility, coupled with existing boat slips, will provide mooring areas for approximately 40 boats at the property. The applicant has indicated that boats with heads will not be allowed to discharge into the boat basin, and, that no pumpout facility will be available. On-shore restroom facilities are also not proposed. FIELD INVESTIGATION REPORT: E. C. WILLETT, CARTERET COUNTY PAGE #3 The proposed excavation of Rush Creek and North River will result in approximately 86,150 sq. ft. of estuarine bottom being deepened to -4' MLW deep. The applicant estimates approximately 4,000 cu. yds. of material being removed during the excavation process, however, our calculations would indicate that approximately 3,000 cy. yds. of materials would be removed. The spoil disposal area would hold approximately 9,000 cu. yds., therefore, the spoil area should be adequate for the, expected silt, mud and sand material. The applicant has indicated that a dragline, and perhaps barge, would be used in the excavation activity. Care must be taken to avoid any spoil materials from reentering coastal wetlands or public trust areas. Also, if an adequate buffer is not maintained between the excavation activities and the coastal wetlands which exist along the shoreline sloughing off of wetlands could occur. PROJECT SUMMARY: The applicant received Permit #121-92 to construct a marina facility and stabilize the shoreline. The applicant is now proposing to maintenance excavate the basin and access channel in Rush Creek and North River and expand his marina so that approximately 40 boats could use the facility. FIELD INVESTIGATION REPORT: E. C. WILLETT, CARTERET COUNTY PAGE #2 9. NARRATIVE DESCRIPTION: The project site is located on an approximately 4 acre spoil peninsula known as 'Rush Point', which is located on the extreme western end of Harkers Island and off SR1335. This property is bordered on the south by Back Sound, on the west by North River, and on the north by Rush Creek. The applicant has . received two (2). CAMA permits which have authorized either shoreline stabilization or the construction of a manna facility. The latest permit (#121-92) authorized the reconstruction of docking facilities at the head of Rush Creek so that 10- 20 boats would be able to tie up at that location. The construction of this facility has not taken place. However, the applicant is now proposing to expand and change the configuration of this docking facility and to excavate a boat basin and access channel area. The proposed docking facility would consist of an approximately 480' long x 5' wide pier which would be parallel to the existing concrete bulkhead. This pier would be approximately 5' waterward of the bulkhead and in some places, would be constructed over coastal wetlands vegetated with Snartina alterniflora marsh. Several 5' wide access walkways will connect the pier with adjacent highground. Seventeen (17) finger piers would be constructed perpendicular to the pier with 55 adjacent mooring pilings. This docking arrangement would. provide accommodations for 34 boats. The width of the boat slips will range from 11-14'. An approximately 530' long x 80' wide boat basin is proposed to be excavated in Rush Creek to a depth of -4' MLW and an approximately 975' long x 46' wide to -4' MLW deep access channel is proposed to be excavated in Rush Creek and North River. Spoil materials obtained from this excavation activity will be placed in 4 different locations on the site. The U.S. Army Corps of Engineers have determined that the disposal sites are located on upland property. Waters within Rush Creek are classified as 'SA' by the Division of Environmental Management and are closed to the harvesting of shellfish. The waters of North River are classified as 'SA' and are ppen to shellfishing. The waters of Back Sound are classified as 'ORW' & 'SA' and are also oven to the harvesting of shellfish. 10. ANTICIPATED IMPACTS: The proposed pier construction will encompass approximately 19,200 sq. ft. of. Public Trust Areas and will provide mooring facilities for approximately 34 boats. The applicant has indicated that typical boat lengths will range from 16' to 35'. This proposed facility, coupled with existing boat slips, will provide mooring areas for approximately 40 boats at the property. The applicant has indicated that boats with heads will not be allowed to discharge into the boat basin, and, that no pumpout facility will be available. On-shore restroom facilities are also not proposed. FIELD INVESTIGATION REPORT: E. C. WILLETT, CARTERET COUNTY PAGE #3 The proposed excavation of Rush Creek and North River will result in approximately 86,150 sq. ft. of estuarine bottom being deepened to -4' MLW. deep. The applicant estimates approximately 4,000 cu. yds. of material being removed during the excavation process, however, our calculations would indicate that approximately 3,000 cy. yds. of materials would be removed. The spoil disposal area would hold approximately 9,000 cu. yds., therefore, the spoil area should be adequate for the expected silt, mud and sand material. The applicant has indicated that a dragline, and perhaps barge, would be used in the excavation activity. Care must be taken to avoid any spoil materials from reentering coastal wetlands or public trust areas. Also, if an adequate buffer is not maintained between the excavation activities and the coastal wetlands which exist along the shoreline sloughing off of wetlands could occur.
