WATER UALITY SEC! 10N. , Reference your March 10, 1993 application for Department of the Army authorization for the Enola Water Improvements Project which includes the construction of a pump station and water tank and installation of 37,700 linear feet of water line which will provide water to area' `°„Cpusaty residents while abandoning the Henry River as an unfiltered water supply. Six stream crossings will be necessary across the Henry Fork, Stacy Creek, and two unnamed tributaries of Henry Fork. No wetlands will be impacted by the project. This project has been coordinated with the NC Wildlife Resources Commission (WRC). For the purposes of the U.S. Army Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal Register on November 22, 1991, lists nationwide permits. Authorization, pursuant to Section 404 of the Clean Water Act, was provided for the discharge of material for backfill or bedding for utility lines, including outfall and intake structures, provided there is no change in pre- construction contours. Your work is authorized by this nationwide permit provided it is accomplished in strict accordance with the enclosed conditions and with those conditions outlined in the enclosed March 12, 1993 WRC letter. This nationwide permit does not relieve you of the responsibility to obtain any required State or local approval. It is recommended that you contact Mr. John Dorney of the State of North Carolina, at telephone (919) 733-1786, to insure that you have complied with state water quality certification requirements. This verification will be valid for 2 years from the date of this letter unless the nationwide authorization is modified, reissued, or revoked. Also, this verification will remain valid for the 2 years if, during that period, the nationwide permit authorization is reissued without modification or the activity complies with any subsequent modification of the nationwide permit authorization. If during the 2 years, the nationwide permit authorization expires or is suspended or revoked, or is modified, such that the activity -2- would no longer comply with the terms and conditions of the nationwide cer;-7:. activities which have commenced (i.e., are under construction) or are under contract to commence in reliance upon the nationwide permit will remain authorized provided the activity is completed within 12 months of the date of the nationwide permit's expiration, modification or revocation, unless discretionary authority has been exercised on a case-by-case basis to modify, suspend, or revoke the authorization. Fullwood, Executive Director MEMORANDUM TO: Steve Chapin, Permit Coordinator Asheville Office, U.S. Army Corps of Engineers FROM: Chris Goudreau a District Fisheries Biologist DATE: March 12, 1993 SUBJECT: Review of a 404 permit application by the City of Morganton for the Enola Water Improvements project Mr. Larry Pressley, on behalf of the City of Morganton, is requesting a letter of concurrence from the North Carolina Wildlife Resources Commission (NCWRC) in order to obtain a 404 Permit from the U.S. Army Corps of Engineers. These comments are provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et seq.) and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d). The proposed project consists of construction of a pump station and water tank, and installation of 37,700 feet of water line. Six stream crossings will be necessary three on Henry Fork, one on Stacy Creek, and one each on two unnamed tributaries of Henry Fork. I visited the project site on March 11, 1993. Henry Fork is a Designated Public Mountain Trout Water, contains good habitat for aquatic organisms, including trout, and carries a moderate silt load. No wetlands were observed, nor were conditions likely to support any endangered, threatened, or special concern species. The NCWRC does not object to this project, provided the following stipulations are implemented: 1. The pipes should be buried below the surface of the stream bed so as not to create a barrier to fish movement or sediment transport. .A - \1 2. Heavy equipment should not be operated in the stream channel in order to minimize sedimentation and reduce the likelihood of introducing other pollutants into the stream. 3. Construction must be accomplished so that wet concrete does not contact stream water. This will lessen the chance of altering the stream's water chemistry and causing a fish kill. 4. Riprap placed for bank stabilization should not be placed below normal high water elevation so as to maintain natural substrate in the stream. Also, riprap should be kept to a minimum so as to retain riparian vegetation, which we prefer for bank stabilization where practical. 5. Erosion controls should be installed where soil is disturbed and maintained until project completion. 6. Waste earthen material from the project must not be placed in any stream or wetland or within the 25-foot buffer zone of any stream classified as "Trout" by the N.C. Division of Environmental Management. 7. Temporary ground cover (e.g. hardwood mulch, straw, etc.) should be placed on all bare soil during construction. Permanent vegetation in these same areas should be established within 15 days of ground disturbing activities to provide long term erosion control.
