We are also requesting a 401 WQC from NCDWR for the above referenced impacts, as well as a Riparian Buffer Authorization for 13,627 sf of permanent impacts and 1,332 sf pf temporary impacts to Neuse River Riparian Buffers. The project is ±0.8 acres in size and is located at the western terminus of Westec Way, (Lat: 35.618824°N; Long:-78.809219°W) west of the intersection of Westec Way and Technology Park Lane in Fuquay-Varina, Wake County. The project is located in the Neuse River basin and onsite waters drain to Basal Creek [Bass Lake, (Mills Pond)]. The Water Quality Classification for Basal Creek [Bass Lake, (Mills Pond)] is B; NSW and the Stream Index Number is: 27-43-15-3. The cataloging unit for the site is 03020201. Proposed Proiect The purpose of the proposed project is to construct the extension of Westec Way to make it a fully functional road providing a connection from Technology Park Lane to NC 55 Hwy. The project consists of the construction of a ±400 If section of road which will provide the connection between the western terminus of the existing Westec Way and the portion of Westec Way being constructed as part of the Basal Creek Apartments project (AID: SAW-2008-00354 / NCDWR Proj #18-1004) which will extend to NC 55 Hwy (N. Broad Street). Once the connection is complete, Westec Way will provide an alternate access from Technology Park Lane to NC 55 Hwy west towards Holly Springs. Additionally, Westec Way will provide access to Dickens Road for eastbound traffic from the Basal Creek Townhomes subdivision. These alternate accesses to NC 55 Hwy West and Dickens Road will allow westbound and eastbound travelers to avoid the intersection at NC 55 Hwy and Dickens Road, thereby reducing traffic volume at this already congested intersection. The proposed road will extend through an existing beaver impoundment/herbaceous wetland. Two 48-inch RCP culverts will be installed within the road which will provide a hydrologic connection and convey flow and aquatic life passage between the beaver impoundment wetlands on both sides of the road. Headwalls and wing walls will be constructed on both ends of the culvert in order to stabilize fill and minimize impacts. A rip -rap dissipater will be constructed on below the downstream end of the culvert in order to dissipate energy and prevent erosion within the wetlands. During construction, work will be completed "in the dry" by constructing a temporary dam (sheet pile, coffer dam, etc) around the entire project area and water will be pumped out of the project area during construction. Downstream flow will be maintained by pumping water around the construction area during construction. Once construction is complete, the temporary dam will be removed and the area restored to natural grade and temporarily seeded, if possible, depending on the water levels. Project History Wetlands within the Westec Way Extension project area were delineated by WR in January 2017, and were field verified by James Lastinger with the USACE on 8/30/17 as part of the Basal Creek Townhomes project (AID: SAW-2008-00354). A copy of the email from Mr. Lastinger, dated 10/17/17, documenting that the delineation has been field verified has been provided as an Appendix. Please note that WR is not requesting issuance of a JD in conjunction with issuance of the IP. NCDWR issued a Buffer Determination Letter (RRO #17-248) for the Basal Creek Townhomes project area, which includes the Westec Way Extension project area. A copy of the Buffer Determination Letter has been provided as an Appendix. Alternatives Analysis Offsite Alternatives The eastern stub of Westec Way is existing, and therefore offsite alternatives, such as rerouting Westec Way is not a feasible alternative. Onsite Alternatives The alignment of the proposed connection of the two sections of Westec Way is dictated by the stub of the existing section of Westec Way, as well as the stub of the section of Westec Way to be constructed as part of the Basal Creek Townhomes project. Therefore, there are no feasible onsite alternatives for the proposed road extension, as the portions of Westec Way to be connected are already defined. Proposed Impacts The proposed impacts consist of ±0.59 acres of permanent wetland impacts and 0.07 acres of temporary wetland impacts, 13,627 sf of permanent riparian buffer impacts and 1,332 sf of temporary riparian buffer impacts. Please refer to the impact tables in the PCN form for a breakdown of each impact area and quantities. Permanent riparian buffer impacts for the perpendicular road crossing are less than 1/3 acre, and therefore are classified as "Allowable" in the Neuse River Riparian Buffer Rules Table of Uses. Your Su[cess. proposed temporary riparian buffer impacts are part of the construction of perpendicular road crossing, which is classified as "Allowable". Avoidance and Minimization Prior to site plan design, the applicant requested that a detailed wetland delineation be conducted so that impacts to wetlands and "waters" could be minimized. Since the project consists of the connection of two road stubs to create a fully functional road, impacts could not be avoided. Impacts were minimized by crossing the stream and wetlands as close to perpendicular as possible. Additionally, the culvert has been designed to be installed 12- inches below the substrate to allow for flow during periods of low water in the beaver impoundment. The rip -rap dissipater will be constructed below the downstream end of the culvert in order to dissipate energy and prevent erosion of the wetland. Head walls and wing walls have been designed on both ends of the culverts to stabilize road fill and minimize impacts. Additionally, wetland impacts have been minimized to design the backslopes at a 3:1 slope to return road fill to natural grade, which is the minimum slope allowed by NCDOT standards. Neuse River riparian buffer impacts have been minimized by crossing the stream/buffers at as close to perpendicular as possible. Permanent riparian buffer impacts are less than 1/3 acre, and therefore are classified as "Allowable". During construction, silt fencing will be installed around all areas to be disturbed to prevent sediment from escaping into undisturbed wetlands. Additionally, since the proposed road connection will be constructed through a beaver impoundment, a temporary dam (sheet pile, coffer dam, etc) will be constructed around the entire project area and water will be pumped out of the project area during construction so work can be completed "in the dry". Downstream flow will be maintained by pumping water around the construction area during construction. Once construction is complete, the temporary dams will be removed and the area restored to natural grade and temporarily seeded, if possible, depending on the water levels. Mitigation The applicant proposes to mitigate for the ±0.59 acres of permanent wetland impacts through the purchase of offsite mitigation credits at a 2:1 ratio, resulting in the purchase of 1.18 acres of riparian wetland mitigation credits. The applicant proposes to provide the 1.18 acres of riparian wetland mitigation through the purchase of credits from RES within the Neu -Con Wetland & Stream Mitigation Bank - Hannah Bridge Site. A copy of the letter of availability from RES has been provided as an Appendix. Your Success - buffer", which is classified as an "Allowable" activity in the Neuse River Riparian Buffer Rules' Table of Uses. Therefore, buffer mitigation is not required. Threatened and Endangered Species WR reviewed the NC Natural Heritage Program database, located at http://www.ncnhp.org/web/nhp/home, as well as NCNHP GIS data to identify if there were any known occurrences of endangered species on or near the proposed project. The review of the NHP data did not identify any recent occurrences of federally listed threatened or endangered species or critical habitat on the subject property or within 1.0 miles of the project, see attached NCNHP project review letter dated 06/27/19. Site reviews did not identify any potential habitat for bald eagle, red -cockaded woodpecker or Michaux's sumac. The project is located in the Neuse River Basin, and therefore is not located within the known range of the Cape Fear Shiner. Additionally, the project is not located within the known range of the Tar River spinymussel. The project site is within the known range of the Carolina madtom, Neuse River waterdog, Atlantic pigtoe, dwarf wedgemussel and yellow lance. The proposed project is located within an existing beaver impoundment within Basal Creek. There are numerous beaver dams between the project area and the downstream pond which has created a series of terraced beaver impoundments. Based on a review of historic aerial photography, the beaver impoundment has been in existence since 2009. As a result of the long term impoundment of water due to the beaver dams, the project area does not have the necessary flow, high oxygen levels or good/excellent water quality necessary to be considered potential habitat for these species. Additionally, the project area is located within the extreme upper reach of Basal Creek, and there are three large impoundments within Basal Creek between the project area and Middle Creek which would prevent migration of these species to sustain viable populations. Therefore, the beaver impoundment within the project area was not considered potential habitat for Carolina madtom, Neuse River waterdog, Atlantic pigtoe, dwarf wedgemussel and yellow lance. Therefore, WR concludes that the proposed project "may effect, but is not likely to adversely affect" federally listed species. The current request is for ±0.59 acres of permanent wetland impacts, 0.07 acres of temporary wetland impacts, 13,627 sf of permanent riparian buffer impacts and 1,332 sf of temporary riparian buffer impacts (see the attached maps and PCN for details). Broad Street). Once the connection is complete, Westec Way will provide an alternate access from Technology Park Lane to NC 55 Hwy west towards Holly Springs. These alternate accesses to NC 55 Hwy West and Dickens Road will allow westbound and eastbound travelers to avoid the intersection at NC 55 Hwy and Dickens Road, thereby reducing traffic volume at this already congested intersection. The proposed road will extend through an existing beaver impoundment/herbaceous wetland. Two 48-inch RCP culverts will be installed within the road which will provide a hydrologic connection and convey flow and aquatic life passage between the beaver impoundment wetlands on both sides of the road. The culverts will be installed a minimum of 12- inches below the substrate to ensure continued flow during periods of low water levels. Headwalls and wing walls will be constructed on both ends of the culvert in order to stabilize fill and minimize impacts. A rip -rap dissipater will be constructed on below the downstream end of the culvert in order to dissipate energy and prevent erosion within the wetlands. During construction, work will be completed "in the dry" by constructing a temporary dam (sheet pile, coffer dam, etc) around the entire project area and water will be pumped out of the project area during construction. Downstream flow will be maintained by pumping water around the construction area during construction. Once construction is complete, the temporary dam will be removed and the area restored to natural grade and temporarily seeded, if possible, depending on the water levels. Prior to site plan design, the applicant requested that a detailed wetland delineation be conducted so that impacts to wetlands and "waters" could be minimized. Since the project consists of the connection of two road stubs to create a fully functional road, impacts could not be avoided. Impacts were minimized by crossing the stream and wetlands as close to perpendicular as possible. Additionally, the culvert has been designed to be installed 12-inches below the substrate to allow for flow during periods of low water in the beaver impoundment. The rip -rap dissipater will be constructed below the downstream end of the culvert in order to dissipate energy and prevent erosion of the wetland. The project is located in the Neuse River Basin, and therefore is not located within the known range of the Cape Fear Shiner. Additionally, the project is not located within the known range of the Tar River spinymussel. The project site is within the known range of the Carolina madtom, Neuse River waterdog, Atlantic pigtoe, dwarf wedgemussel and yellow lance. The proposed project is located within an existing beaver impoundment within Basal Creek. There are numerous beaver dams between the project area and the downstream pond which has created a series of terraced beaver impoundments. Based on a review of historic aerial photography, the beaver impoundment has been in existence since 2009. As a result of the long term impoundment of water due to the beaver dams, the project area does not have the necessary flow, high oxygen levels or good/excellent water quality necessary to be considered potential habitat for these species. Additionally, the project area is located within the extreme upper reach of Basal Creek, and there are three large impoundments within Basal Creek between the project area and Middle Creek which would prevent migration of these species to sustain viable populations. Therefore, the beaver impoundment within the project area was not considered potential habitat for Carolina madtom, Neuse River waterdog, Atlantic pigtoe, dwarf wedgemussel and yellow lance. Therefore, WR concludes that the proposed project "may affect, but not likely to adversely affect" federally listed species. 6. Essential Fish Habitat (Corps Requirement) 6a.
