Dear Mr. Townsend:
In a letter dated December 13, 2018, you were notified of two NPDES permit limit exceedance violations of
Total Nitrogen that occurred on June 28 and 30, 2017. Through communication with Tina Pedley, Sanford
Processing Plant Environmental Manager, the week of December 31, 2018, she informed this office that the
subject facility was operating under a Special Order by Consent that modified the NPDES permit limits for Total
Nitrogen to monthly average and daily maximum interim limits of 200 mg/L and 250 mg/L respectively. The
SOC was amended to extend the requirement to comply with final effluent limits from June 15, 2017 to August
15, 2017. Ms. Pedley informed this office the self -monitoring data reported in June 2017 were below the
interim limits in effect and established by the amended Order.
After communicating with the Division's central office permitting staff and reviewing the amended SOC, this
office has determined that the subject facility is not in violation of the self -monitoring requirement of its
NPDES permit. The NOV letter dated December 13, 2018, against NPDES permit NCO072575 is hereby
rescinded.
