Hi Donna,
We are supposed to issue what they request if it meets the terms and conditions of the permit. I assume this does since
the only impact is to expand the roadway. If you look at the NWP language there is "District Engineers Decision" section
which states: " If a project proponent requests authorization by a specific NWP, the district engineer should issue the
NWP verification for that activity if it meets the terms and conditions of that NWP, unless he or she determines, after
considering mitigation, that the proposed activity will result in more than minimal individual and cumulative adverse
effects on the aquatic environment and other aspects of the public interest and exercises discretionary authority to
require an individual permit for the proposed activity."

Donna, I believe this was sent to you. The Corps (Dave Shaeffer) is handling as part of the hotel project. So this will be
under a NW 39 (1 assume). If you are going to continue handling that is fine, just let Tamp know, if anything is required.
19 ft of stream would make it below threshold, unless there are other issues.

On February 27, 2019 we received the application you submitted on behalf of Innkeeper Motor Lodge, Inc. to place fill
material in 19 linear feet of stream to facilitate the widening of W.T. Harris Boulevard in Charlotte, Mecklenburg County,
North Carolina. I have completed my initial review of the application and I have determined that it is incomplete. The
following information is necessary to complete this application:
a. In accordance with 2017 Nationwide Permit general condition 32(b)(4), the project description should be sufficiently
detailed to allow the district engineer to determine that the adverse environmental effects of the activity will be no
more than minimal and to determine the need for compensatory mitigation or other mitigation measures. It appears
that the proposed impacts are associated with the construction of a Hampton Inn and Suites. Please submit a complete
set of plans and a delineation of the entire project area including the site where the hotel would be constructed.
b. In accordance with 2017 Nationwide Permit general condition 32(b)(5), the PCN must include a delineation of
wetlands, other special aquatic sites, and other waters, such as lakes and ponds, and perennial, intermittent, and
ephemeral streams, on the project site. Delineations must be prepared in accordance with the current methods
required by the Corps. A delineation report was not submitted with the application.
If this is a standalone transportation widening project and not a result of a private hotel development, this should be
processed through our NCDOT or CDOT project managers (Cced).
Please provide the information requested above in ONE consolidated response within 30-days of the date of this
correspondence. If you do not respond within 30-days, the application will be administratively canceled. Please contact
me via telephone or e-mail if you have questions.
