Hey Frank,
I received your message from Trentt James. I asked Ms. Emily Greer with the US Army Corps of Engineers to comment
as well on your question in regards to the fencing (please see her email below). I have also asked other folks in our
office that handle 401 Certifications too, and they indicated that routine maintenance/debris removal of these ditch
fence crossings after significant rain events would be recommended.

If there isn't a discharge associated with installing the fence, then it is not regulated on 404 waters. We recently had a
similar request from another solar project where they wanted to fence across a stream form high bank to high bank.
Then they wanted to drive rebar into the channel bed and place a mesh fence "in" the channel to prevent any one from
shimmying under the security fence at the stream. We did not regulate it. We would have guidance on fence installment
if it was going through a wetland but would still not regulate the activity. Keep in mind that in these scenarios the
pilings are spaced far enough apart that they don't act as fill.

Mr. Trunck is a contractor for the Crooked Run Solar Farm project, and was asking about the construction of the security
fencing in relation to the existing ditching, and any concerns on fencing across the entire ditch.
