CERTIFICATION
THIS CERTIFICATION is issued in conformity with the
requirements of Section 401 Public Laws 92-500 and 95-217 of the
United States and subject to the North Carolina Division of
Environmental Management Regulations in 15 NCAC 2H, Section .0500
to William Whitehurst Lake Association pursuant to an application
filed on the &. day of May, 1991 to construct a recreational and
fire supply pond.
The Application provides adequate assurance that the
discharge of fill material into the waters of an unnamed
trlbutary of Mears Fork Creek in conjunction with the proposed
pond in Guilford County will not result in a; violation of
applicable Water Quality Standards and discharge gui'delines.
Therefore, the State of North Carolina certifies that this
activity will not violate Sections 301, 302, 303, 306, 307 of PI..
92-500 and PI.. 95-217 if conducted ind accordance with the
application and conditions hereinafter set forth.
Condition(s) of Certification:
1. That the activity be conducted in such a manner as
to prevent significant increase in turbidity
outside the area of construction or construction
related discharge (increases such that the
turbidity in the stream is 25 NTU's or less are
not considered significant).
2. Any fill and pond shall occupy at most 1 1/2 acres
of wetland and be located near the junction of
Witty Road and Old Witty Road to allow fire truck
access and egress.
Violations of any condition herein set forth shall result in
revocation of this Certification.
This Certification shall become null and void unless the
above conditions are made conditions of the Federal Permit.

Dear Mr. Dorney,
The Summerfield Fire Department has discussed the lake
project located at Witty Road with Mr. Hoag and are
interested in seeing this lake being constructed. With the
addition of this lake, we will be able to provide better fire
protection to the properties in this area. We also feel that
this would improve our chance to reduce our insurance class
to a 6. In order for this to be possible, certain
requirements must be met. The lake must be at least 1 acre
in size and hold a minimum of 10,000 gallons of water year
round. The road access to the lake must be all weather and
provide enough room for an engine to get close to the water
and allow room for tankers to corne in and out at this point.
This engine location should be as close to Witty Road as
possible to reduce the amount of time getting to a main road ~~
and to reduce traffic congestion at the engine site. If you ~

A site inspection of the subject project was made on
June 5, 1991. The wetland is classified as a Bottomland
Hardwood. A box turtle was observed. I heard a lot of
frogs. Mr. Hoag indicated that an egret is using the area.
It appears that a beaver dam has backed up the water in the
area~ however, no new cuttings were observed. I told Mr.
Hoag that we would deny a certificate for the lake. He then
requests to build a pond 3 acres in size. Due to the
importance of this wetland, the WSRO recommends that the 401
certificate be denied. This wetland should be preserved and
possibly' the DOT could acquire it for mitigation purposes .
If you find time, please make a site inspection.

staff onsite of the proposed William Whitehurst Lake, located off Witty Road
adjacent to an unnamed tributary of Mears Fork Creek, north of Greensboro,
Guilford County, North Carolina. The purpose of this meeting was to discuss
plans for the proposed construction of the aforementioned lake, and to inspect
the site for waters and wetlands subject to Department of the Army permitting
authority.

The meeting revealed that you propose to constJ:'uc::t a dam and inundate nine
acres adjacent to an unnamed/above headwaters-tributary.of' Mears-Fork Creek.
Based upon information gathered at this visit, the entire worksite (dam and
lake) of this proposed lake is a wetland area. As the site is located above
tlie-headwaters of the unnamed tributary, ~his work may qualify for Federal
authorization pursuant to nationwide permit (33 CFR 330.5(a) (26)). Please
complete the enclosed pre-discharge notification (PDN) form and submit it with
a copy of your Section 401 Water Quality Certification from the North Carolina
Division of Environmental Management.
A Section 401 Water Quality Certification is required to validate
nationwide permit No. 26 in the State of North Carolina, and therefore, must
be submitted with the PDN application. We cannot proceed with the processing
of your application until we have received your completed PDN form and the 401
Certification. As discussed, you should contact Mr. John Dorney, N. C.
Division of Environmental Management, (919) 733-5083, to obtain the necessary
Section 401, Water Quality Certification.

North Carolina, has applied to the North Carolina Division of
Environmental Management for a Water Quality Certification
pursuant to Section 401 of the Federal Clean Water Act and
Environmental Management Commission rules in 15A NCAC 2H .0500
and 15A NCAC 2B .0109. The activity for which the certification
is sought is to build a pond on an unnamed tributary to Mears

SUBJECT:
A site inspection of the subject project was made on
June 5, 1991. The wetland is classified as a Bottomland
Hardwood. A box turtle was observed. I heard a lot of
frogs. Mr. Hoag indicated that an egret is using the area.
It appears that a beaver dam has backed up the water in the
area, however, no new cuttings were observed. I told Mr.
Hoag that we would deny a certificate for the lake. He then
requests to build a pond 3 acres in size. Due to the
importance of this wetland, the WSRO recommends that the 401
certificate be denied. This wetland should be preserved and
possiblX the DOT could acquire it for mitigation purposes .
If you find time, please make a site inspection.
