REGAN Secretary LINDA CULPEPPER Interim Director On April 4, 2018, staff from the State's Division of Water Resources (DWR) Winston-Salem Regional Office (WSRO) responded to an anonymous complaint alleging milk parlor and animal waste was running off property, across a neighbor's property, and into a nearby unnamed tributary (UT). The following summarizes the inspection and violations determined from the complaint investigation. Site Visit Observations: An in -ground, open concrete tank was overflowing with primarily milk waste determined by sight and odor. The overflow was such that DWR staff could not see top of tank. The overflow was traced offsite and to a nearby UT of Lick Creek. This portion of Lick Creek is designated as a Class C Water. Class C waters are protected for uses such as secondary recreation, fishing, wildlife, fish consumption, agriculture, etc. An accurate estimate of the total amount of waste reaching surface waters could not be calculated. Waste was not actively flowing into the UT during the investigation, but DWR staff noted evidence that the flow had been going on for some time and would flow into the UT during rain events. DWR staff did note a very well maintained vegetative buffer between the diary property and the UT. The majority of cow waste was dry stacked away from the concrete pit and did not appear to be running off -site. A copy of the April 4, 2018 inspection report is attached for your review, Violations: The discharge is a violation of NC General Statute NCGS 143-215.1(a) which states in part that "no person shall —make any outlets into the waters of the State" and Permit Condition I, 1. Snider— NOV May 8, 2018 Page 2 which declares that the facility should be operated as a non -discharge system to prevent the discharge of waste that reaches surface waters. Please be advised that future violations may result in enforcement action, including an assessment of civil penalties. Required Actions: Please provide a written response within thirty (30) days of receipt of this letter. Your response should include any actions already taken or plan to take to prevent future runoff from the facility.
