On December 7, 2004 this office received your application for Department of the Army
authorization to impact 1.01 acres of Section 404 wetlands adjacent to Pasture Branch, a
tributary to Queen Creek, associated with the construction of a proposed reclaimed water
sprayfield, located off Parkertown Road, west of Swansboro, Onslow County, North Carolina.
At the conclusion of the thirty day public notice period, we received three comments from
regulatory and or natural resource agencies. The commenting agencies, which have forwarded
correspondences to date includes the U.S. Fish and Wildlife service, the National Marine
Fisheries Service... and the Land Quality Section of the N.C. Department of Environment and
Natural Resources. The National Marine Fisheries Service comments and Land Quality
comments were received by e-mail and are attached. The U.S. Fish and Wildlife Service letter is
also attached for your review but prompts the need for additional alternative analysis
information. The Fish and Wildlife Service supported efforts to ensure the consideration of
upland sites for the proposed work. In your most recent correspondence to our office dated
January i2, 2005, your agent mentioned that several sites were considered for placement of the
wastewater pond. Offsite alternatives analysis needs to be considered for a complete alternatives
analysis review. Please discuss and disclose the other sites considered and how the proposed site
was identified as the most practicable alternative. This discussion should include but not limited
to available highground sites with no wetland impacts and economic considerations.
Our administrative process provides you the opportunity to propose a resolution and/or
rebut any and all objections before a final decision is made. In this regard, I would appreciate
being made aware of your intentions, in writing, on or before February 18, 2005.

Dear Mr. Treme:
You have our approval, in accordance with the attached conditions, to impact 195 feet of perennial
stream for the purpose of installing water and sewer lines' as you described in your application dated
November 21, 2003. After reviewing your application, we. have decided that this fill is covered by
General Water Quality Certification Number 3374, which may be viewed on our website at
http://h2o.enr.state.nc.us/ncwetlands. This certification allows you to use Nationwide Permit Number
12 when the Corps of Engineers issues it. In addition, you should get any other federal, state or local
permits before you go ahead with your project including (but not limited to) Sediment and Erosion
Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval
will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the
General Certification.
This approval is only valid for the purpose and design that you described in your application except as
modified below. If you change your project, you must notify us and you may be required to send us a
new application. If the property is sold, the new owner must be given a copy of this Certification and
approval letter and is thereby responsible for complying with all conditions. If total wetland fills for
this project (now or in the future) exceed one acre, compensatory mitigation may be required as
described in 15A NCAC 2H .0506 (h) (6) and (7). This approval shall expire when the corresponding
Nationwide Permit expires or as otherwise provided in the General Certification. For this approval to
be valid, you must follow the conditions listed in the attached certification and any additional
conditions listed below.

the attached certificate of completion to the 401/Wetlands Unit, North Carolina Division of
Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650.
Violations of any condition herein set forth may result in revocation of this Certification and may result
in criminal and/or civil penalties. This Certification shall become null and void unless the above
conditions are made conditions of the Federal 404 and/or coastal Area Management Act Permit.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its
conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water

Please find enclosed seven (7) copies of the Pre-Construction Notification Application
form, the General Permit from the U.S. Army Corps of Civil Engineers, and a check in
the amount of $475.00 for the above referenced project. We request written concurrence
from the Division of Water Quality that this construction be allowed under Nationwide
Permits 12.
The above referenced project is for the City of Salisbury and will involve the installation
of 8-inch to 12-inch sewers, including outfall sewers, which will extend sewer service to
an area that was recently annexed by the City. In addition to new sewers, there will also
be water lines that will be installed to extend water services to the annexed area.
The project has six (6) stream crossings, impacting 195 linear feet of streambed. There
will also be a construction corridor that shall fall within 10 feet of a stream bank.
At your earliest convenience, please review for approval this submittal and send us a

Description of Activity: Install approx. 30,600 LF of gravity sewer line and 18,055 LF of water line in an area
west of Salisbury that has been annexed by the city. As part of the project, it will be necessary to cross 6
stream channels (4 unnamed tributaries and 2 locations on Jump and Run Branch). The project has been
designed so that no wetlands in the area will be impacted.

Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map
and site plan must include a scale and north arrow. The specific footprints of all buildings,
impervious surfaces, or other facilities must be included. If possible, the maps and plans should
include the appropriate USGS 'T'opographic Quad Map and NRCS Soil Survey with the property

VI. Proposed Impacts to Waters of the United States/Waters of the State

YII. Impact Justification (Avoidance and Minimization)
