S. Plant Violation of NPDES Permit and N.C. Water Quality Standards NCGS 143-215.1(a)(6) Permit No. NCG140943 Mecklenburg County, N.C. Dear Ml•. Batten: Chapter 143, Article 21 of the North Carolina General Statutes (G.S.) authorizes and directs the Environmental Management Commission of this Department to protect and preserve the water resources of the State. The Division of Water Quality has the delegated authority to enforce adopted pollution control rules and regulations. Ivlr. Samar Bou-Ghazale of this office met with Mr. Johnie Alexander and Mr. Loren Wild with Concrete Supply Company ou February 29, 2012 and conducted a site investigation at the subject site (Inspection report is attached). Also, present were Ms. Heather Sorensen and Mr, P. Ronald Eubanks, with Mecklenburg County Land Use & Environmental Services Agency. The investigation revealed several hundred feet of hardened concrete in Kings Branch Creek below the facility. March 9, 2012 Page 2 To comply with the requirements of your permit and NCGS 143-215.1, it will be necessary to immediately restore all affected areas to the conditions existing prior to the discharge; and to implement confective actions to eliminate the potential for recurrent illegal discharge activities. All hardened concrete in the stream charnel shall be removed and the stream restored. It is strongly recormnended that a person with experience in stream restoration be retained. Once a section of stream channel has been cleared of concrete, please contact DWQ to set up a site visit with you and your representative. Stream bank vegetation must be left in place and the disturbed areas must be kept to an absolute minimum. It is requested that you respond, in writing, to this Notice, hidicating the measures taken to collect and remove materials accumulated in the stream, to prevent future discharges, and to restore all affected areas. Your response should include a schedule of completion. Please address your response to Mr. Bou-Ghazale by no later than March 23, 2012. Please be advised that G.S. 143-215.6A provides for a civil penalty assessment of not more than twenty-five thousand dollars ($25,000.00), or twenty-five thousand dollars ($25,000.00) per day when the violation is of a continuing nature, against any person who is required but fails to act in accordance with the terms, conditions, or requirements of a permit required by G.S. 143-215.1. Present during the investigation were, Ms. heather Sorensen and Mr. P. Ronald Eubanks, with Mecklenburg County Land Use & Environmental Services Agency. Mr. Johnie Alexander and Mr. Loren Wild, with Conceret Supply Materials. It should be noted that this facility has been inactive for approximately 2 years. Everyone present at the meeting walked Kings Branch Stream below Concrete Supply Co-S Plant to observe the impact to the stream. Hardened concrete was observed in the stream bed for several hundreds feet. This facility has been at that location approximatelty 50 years according to Mr. Alexander, Mr. Alexander was informed that the removal of the concrete materials should be by hand and should extend all the way along the stream to the outlet of the big culvet downstream to the entrance of the commercial site. Regarding the containment area, it should be noted that the containment area should be repaired and should be watertight. Additionally, Stormwater sample is to be taken at the outlet of the stormwater pond. Em ❑ ❑ n Comment: Site investigation revealed discharge of "Darex II AEA" from the containment area, but it was contained on site. Comainement area is to be water tight. Also, it was learned that the samples were being collected from the stream located on the property instead of being collected at the plant discharge. Also, several hundreds of stream bed was impacted by concrete hardening. Concrete materials should be removed by hand using buckets, shovels, wheelbarrows, etc. Page: 2
