Some of the fields reported were permitted acres under the permit AWC970003 for AH&W farms. Mrs. Bracewell was the complainant, she reported that some of the manure being applied was running off into nearby ditchesthibutaries and impacting surface waters downstream. When asked to describe the water, she noted that there was no aquatic life in little warrior creek, and that she had noticed foam floating down the creek from the bridge located on Thankful Church Rd. No signs of algae, odor, or fungal material was reported. Action Taken : Directions : • ' From highway 421 North coming into Wilkesboro, turn left onto highway 16 south towards Moravian Falls, turn right onto highway 18 south through Boomer, NC. The locations are spread out along High Rock Rd., highway 18, and Thankful Church Rd. The main field in concern is located directly off of highway 18 at the comer of highway 18 and high rock rd., just past the culvert for little warrior creek. Six stream sites were elected using GIS Depth= -10 inches software and aerial photographs to determine potential sources for Width= -2 feet the alleged impact. A calibrated YSI meter was used for field Temperature= 17.4 degrees C parameters. No samples were taken. Additionally, site visits occurred Barometric Pressure= 736.2mmHg at 5 addresses that were reported as application events, including Dissolved Oxygen= 9.13 mg/L AH&W Farms. I spoke with Mike Pardue with Wilkes County Soil and Percent Saturation= 98.9% Water to confirm'rf any of these acreages were listed in the Specific Conductivity= 67.2 uSm permittee's most recent waste utilization plan, none of them were. pH= 5.71 Pictures were taken, culverts were identified near application fields, ditches inspected, and the application site itself was inspected for Site 2(tributary): issues that could have contributed to runoff, nothing irregular was Depth= -1.5 feet observed. A reminder that a representative Standard Soil and Fertility Analysis, including pH, copper, and zinc, still needs to be obtained for those fields receiving animal waste during 2003. Farms #97-03, W-ilkes County Dear Mr. Weston: This Notice is to summarize the animal waste management deficiencies observed during a June 19, 2002 Compliance Inspection performed by the Division of Water Quality (DWQ). A copy of the "Final Notes" inspection report is enclosed for your reference. While most all recordkeeping tasks and creel concerns regarding the timeliness of the animal wa animal waste application records indicate that there 2, 2002 application event. Failure to obtain a waste were greatly improved this year, we still have ng events. Specifically, a review of the farm's ry waste sample taken within 60 days of the April within 60 days of application is a violation of your Certified Animal Waste Management Plan (C), Cattle Waste Operation Permit (Section III, #4.) and North Carolina General Statute (NCGS) 143-15.10. After speaking today with the farm's certified operator, Glenn Weston, we understand that a dry waste sample is to be obtained this week in order to avoid the issuance of a "Notice of Violation" (NOV). Please note that, the waste samples obtained for the September 2001 applications were a few days outside of the 60-day window as well. Additionally, waste application records show that animal waste was applied onto field F-8 of Tract — 2400 in April of 2002. Since this field is not listed in your CAWMP the application of waste onto a field not specified in the CAWMP is a violation of the CA WINIP and the Cattle Waste Operation Permit (Section I, #2.) Be advised also, that the proposed application of animal waste onto soybeans is not included in the CAW'MP, either. Weston, hereinafter referred to as "OWNER", and the North Carolina Environmental Management Commission, an agency of the State of North Carolina created by G.S. 143B-282, and hereinafter referred to as the Commission: 1. "OWNER" and the Commission hereby stipulate the following: (a) "OWNER" has previously been deemed permitted in accordance with 15A NCAC 2H .0217 for the operation of an animal waste treatment works, but was unable to comply with 15A NCAC2H .0217 (a)(1)(E) requiring an approved animal waste management plan to be submitted by December 31, 1997. (b) Failure to obtain and implement a Certified Animal Waste Management Plan in accordance with 15A NCAC 2H .0217(a)(1)(E) is a violation of State Water Quality Regulations -and "OWNER" is within the jurisdiction of the Commission as set forth in G.S. Chapter 143, Article 21. (c) "OWNER" desires to continue to operate the animal waste treatment works as a Non -Discharge system. (d) "OWNER" has secured assistance from a certified technical specialist to develop an animal waste management system which, once certified, will meet or exceed all applicable guidelines and standards and will be able to comply with all aspects of the Commissions animal waste general permit. (e) During the term of this Agreement there will be no increase in Steady State Live Weight (SSLW) at the facility. Any new construction will be designed to accommodate only the SSLW for which the facility was registered in accordance with 15A NCAC 2H .0217(a)(1)(D). (e) Since this Special Agreement is by Consent, neither party will file a petition for a contested case or for judicial review concerning its terms. (f). Nothing in this Special Agreement shall be taken as absolving or relieving "OWNER" from any responsibility or liability for discharges of animal waste to surface waters of the State of North Carolina. 2. "OWNER" desiring to comply with the Permit identified in paragraph l(a) above, hereby agrees to do the following: (a) Undertake all necessary activities in order to obtain and implement a certified animal waste management plan by December 31, 1998. (c) No later than fourteen (14) calendar days after the date identified in 2(a) above, - submit to the Director of DWQ written notice of compliance or noncompliance therewith. In the case of noncompliance, the notice shall include a statement of the reason(s) for noncompliance, remedial action(s) taken, and a statement identifying the extent to which subsequent dates or times for accomplishment of listed activities may be affected. 3. "OWNER" agrees that unless excused under paragraph four (4), "OWNER" will pay the Director of DWQ, by check payable to the North Carolina Department of Environment and Natural Resources, stipulated penalties according to the following schedule for failure to meet the deadline set out in paragraph 2(a) above. Failure to obtain and fully implement a Certified $100.00 for the first seven days Animal Waste Management Plan by the date past the date identified in 2(a) identified in 2(a) above: $500.00 for each additional day 4. "OWNER" and the Commission agree that stipulated penalties are not due if "OWNER" satisfies the Division of Water Quality that noncompliance was caused solely by: a. An act of God; b. An act of war; c. An intentional act or omission of a third party, but this defense shall not be available if the act or omission is that of an employee or agent of the defendant or if the act or omission occurs in connection with a contractual relationship with the "OWNER"; d. An extraordinary event beyond the "OWNER'S" control. Contractor delays or failure to obtain funding will not be considered as events beyond the "OWNER's" control; or e. Any combination of the above causes. Failure within thirty (30) days of receipt of written demand to pay the penalties, or challenge them by a contested case petition pursuant to G.S. 15013-23, will be grounds for a collection action, which the Attorney General is hereby authorized to initiate. The only issue in such an action will be whether the thirty (30) days has elapsed. 5. This Special Agreement and any terms and conditions contained herein, hereby supersedes 15A NCAC 2H .0217(a)(1)(E). 6. Approximately five (5) different scenario's attempting to` locate the Weston waste storage pond outside the 100 ft. setback failed thus revealing that the waste storage pond being located within 100 ft. of the stream was the only practical solution. This request can be supported with the following: a) existing locations of farm boundary lines, Caryle Weston home, farm buildings, produce business, grain storage bins, grain drying facility, gas and electrical utilities and the cost incurred of moving some of the above b) a large amount of fill material to be spoiled if the waste storage pond is moved outside of the 100 ft. setback raising the cost to an impractical level ... ex. 8400 cubic yards to be spoiled in one scenario c) a non -owned home being located within the 750 ft. setback on new and expanding operations d) the system desired is a gravity flow system requiring elevation differences obtained best with the waste storage pond within the 100 ft. setback. 2. The Soil & Water Commission allows for this exemption with supporting BMP's. We will construct a diversion between the waste storage pond and the stream and will add 1 ft. of additional freeboard to the structure. 3. Jeff Young is presently working on a final design for the overall waste management system that was agreed to by all present at the August 12, 1997 meeting. 00 ft Page 2 Mr. Carroll Pierce 4. Contacts were made with DWQ regional office in Winston- Salem. George Smith visited the Weston site on August 13, 1997 and agreed to support the overall plan. However, he did not feel that he should be the DWQ representative to support the project in writing. Therefore, I contacted Steve Mauney seeking DWQ written support. He, too, felt that written support should come from a higher level, that probably being Dennis Ramsey. He agreed to contact Mr. Ramsey. Based on their being no other practical alternative, the approaching December 31, 1997 deadline, all the complications and delays already incurred, etc., I am requesting the S.B. 1217 Guidance Committee support the Glen Weston project in writing as soon as possible. I am working with the Wilkes Soil & Water Conservation District in the development of a plan for both of my feedlots. The S.B. 1217 Guidance Committee visited my farm on January 14, 1997. They recommended relocation/confinement of my operations. We are presently asking to be allowed time on the March 19, 1997 meeting of the NC Soil & Water Conservation Commission in an attempt to find out what extent NC Ag. Cost -Share funds can be used in this relocation. Once we are able to work out the necessary arrangements we will proceed on with the plans. It does appear now that we will be relocating and/or confining the entire 600 head. Please accept this as being a concerted effort to take corrective actions. In consultation with the District office, they feel we should have a plan on both feedlots in sixty (60) days. This is a violation of Title 15A of the North Carolina Administrative Code, Chapter 2, Subchapter 2H, Section .0217(d). Failure to comply with these rules can result in civil penalty of $10,000 per day, per violation, and the facility may be required to apply for an individual nondischarge permit. For your information, one copy of the State regulations is enclosed. An inspection was performed on April 3, 1996 and it appeared the facility on the corner of Hwy 18 & High Rock Road was adversely impacting the waters of the State. A letter dated April 29, 1996 instructed you to contact NRCS and develop a best management plan. The letter indicated that a follow-up inspection would be conducted. On January 7, 1997 Mr. George Smith and Ms. Jenny Rankin of this office investigated the facility on the corner of Hwy 18 & High Rock Road. The investigation revealed the facility adversely impacts the waters of the State.
