Eddie and Ellen,
Just wanted to confirm that I received your voice mail message this morning stating that the lagoon was pumped down 8" below
the maximum liquid mark last week and that you had received 5" rain since last Friday (19`h). I understand that the waste level is
within 1" of the maximum level mark today and that you plan to pump onto fescue when soil conditions allow. If this is not
correct let me know.

Spoke with Eddie Johnson on 5/1/2017 stating that the waste level in the lagoon was one inch above maximum even though the
lagoon was pumped on 4/29/2017. Non -compliant.
Today's visit (5/3/2017) was to check waste level in the lagoon. There is 22 inches between lowest part of the dam and the waste
level and the spillway is 12 of those inches. This leaves 10 inches of freeboard below spillway. Non -compliant.
Follow-up Communication offer inspection:
Received message and photo from Eddie Johnson on 5/4/2017 which showed that the waste level was five inches below the top
of the marker. Compliant.
Call from Eddie Johnson on 5/10/2017 stating that the waste level was one inch below the maximum again Compliant.

Hi Eddie,
This email is to confirm our discussion today regarding the previously reported high waste level in your swine
lagoon. As I understand, the lagoon was pumped on Saturday April 29, 2017, but remains one inch above the
maximum liquid level. You also stated that your technical specialist, Tony Davis, was assisting you with completion
of a 10-day POA.
Per your phone call, you intend to apply waste on Tuesday or Wednesday this week (2"d or 3'd) in hopes of coming
back into compliance. I would caution you to be VERY careful during land application since some of the fields may
be saturated, especially Tuesday (tomorrow), since it is raining today.

The Division of Water Resources (Division) received your sludge survey information on July 25,
2016. Tony Davis on your behalf requested an extension of the sludge survey requirement for
the lagoon at Double E Farms 2 facility because lagoon was completely cleaned out in 2015.
Division of Soil and Water Conservation staff did witness that the lagoon was completely
cleaned out. The Division staff is also aware of the clean out. Based on the recommendation of
our staff, the Division agrees to an extension for the sludge survey requirement until-Decembe11

are requesting a five (5) year exemption because during the 2015 year the lagoon was
completely cleaned out. Soil 8c Water staff did witness that the lagoon was completely cleaned

Sludge Removal Plan for Double E Farms
Double E farms will be removing the solids from their lagoon; most of the liquids will be removed also
because they will be agitating and pumping, The sludge has been sampled and the report is attached to
this plan for use of the available nutrients, sludge will be applied at the agronomic rates that are
specified In the waste plan for the crop which the waste is being applied. The soil sample should be
used to make sure that the nutrients are not being over applied. All records must be kept with the
swine records. The following tracts and fields will be used for application of the sludge:

The Division of Water Resources (DWR) acknowledges receipt of your response to the subject
NOV. On September 16, 2015 staff from DWR performed an announced follow-up compliance
inspection at your permitted swine operation. While conducting the inspection, staff noted that all
the violations noted in the subject NOV were properly addressed as stated in your response. Based
upon the information provided in your response and observations by DWR staff, this office has
decided not to pursue punitive sanctions for NOV-2015-PC-0217. However, due to the repetitive
nature of this violation any future violations associated with NOV-2015-PC-0217 are subject
to enforcement actions, including civil penalty.

On August 28, 2015 a letter "Notice of Violation/Notice of Intent to
Enforce" was received following an announced compliance inspection
at my swine operation. Three violations were noted at this time:
#1 addressed "excess soil in spillway of the lagoon dam." On same
date, what was referred to as "excess soil' was removed, checked with
transit and same soil and all the soil which was removed was then
returned to same spillway and was verified by two NRCS Technical
Specialists. Same area was then seeded with fescue and mulched with
straw. I personally spoke with Michael Shepherd on Monday morning
explaining what had taken place after leaving message on August 20,
following inspection and upon completion of spillway work.

#2 addressed the recirculating pump for lagoon. The pump was
repeatedly worked on and has now been replaced with a new one. The
associated pipes have been cleaned and are working to full capacity.
#3 addressed land application event records for June 2015. Those
records were faxed to Michael Shepherd on same day (August 20,
2015) of inspection, and a follow up call was made to make sure that
they were received.
I assure you my immediate attention has been given to correcting the
violations issued. I will continue to make every effort to comply with
any and all regulations. I appreciate your assistance with this matter.

On June 9, 2015 staff from the Division of Water Resources (Division) performed a compliance
inspection at your permitted swine operation. While conducting the inspection, staff noted the
following violations which warrant your immediate attention and action:
1. The waste lagoon appeared to be above the maximum liquid storage level. Prior to the
Division site visit, representatives of your facility had notified this office of the waste lagoon
reaching or exceeding the max freeboard level. on June 5, 2015 as required in Permit
Condition III. 13.
While the Division recognizes that persistent wet weather conditions likely have contributed
to the high waste levels, exceeding the maximum liquid level is a violation of General
Permit condition V. 2. It should be noted that in addition to the date listed above,
representatives from your facility have also made prior notifications of reaching or
exceeding the max liquid level on the following dates: February 24, 2014 and July 2, 2013.
Furthermore, a Notice of Deficiency was issued to you on May 19, 2010 and June 19, 2014
for inadequate freeboard in the waste lagoon.
Required Actions:.
1. Please continue to update this office until the waste level is returned below the max mark.
Failure to make notifications to the Regional Office as required in Permit Condition III. 13.

2. Please evaluate ways to maintain freeboard levels in the required range. This may include,
but is not limited to, water conservation practices, adding additional application sites,
maintaining the waste level at the lowest allowable and appropriate levels throughout the
year, and/or excluding unwanted stormwater from entering the waste collection and storage
system. The Division recommends that you see a Technical Specialist for a review of the
waste collection system.
3. The Division staff observed excess dirt in the spillway of the lagoon dam while on site. The
Division requests that you see a Technical Specialist to have the elevation of the spillway
checked and excess dirt removed to correct as needed.
Please provide this office a written explanation for the violations cited, or if you believe there are
other factors which should be considered. This response should also provide details on how you
intend to address the violations listed above and prevent them from occurring again in the future.
Please provide such information to me in writing within thirty (30) days from receipt of this
letter to my attention at the address shown on the letterhead. Be advised that should these
violations continue, further enforcement actions including civil penalty may result.

On August 20, 2015 staff from the Division of Water Resources (Division) performed an announced
compliance inspection at your permitted swine operation. While conducting the inspection, staff
noted the following violations which warrant your immediate attention and action:
1. Division staff observed excess soil stockpiled in the designed spillway of the lagoon dam
while on site. This is a violation of your certified animal waste management plan
(CAWMP) and Permit Condition I. 3. Division staff have documented excess soil in the
spillway and asked your facility to return the spillway to the original design during your
2013, 2014, and 2015 compliance inspections and in a 2014 NOD and 2015 NOV. The
Division requests you receive written documentation from a Technical Specialist certifying
the elevation of the spillway and excess soil removed to correct as needed as specified in
Permit Condition II. 25. The Division request that you establish a vegetative cover on the
spillway after it has been certified as required by Permit Condition II.2.
2. Division staff observed that the recirculating pump for the lagoon continues to be broken.
Freshwater is being used to wash down houses and then is added to the lagoon. In
accordance to your facilities general swine Permit this is a violation of Condition II. 1, you
shall maintain properly operating equipment, and no unnecessary additional liquid volume
shall be added in the structure unless accounted for in the original structure design. The
Division request that you have the pumps and associated pipes fixed or replaced to correct as
needed.

3. While reviewing records for land application events, the Division concluded there were no
records for land application events that occurred during June 2015. This is a violation of
Permit Condition I11. 6. Please send copies of all records for land application events at your
facility for the months of June, July and August 2015 to my attention.
Our office is considering the pursuit of punitive sanctions for these violations. Pursuant to G.S.
143-215.6A, a civil penalty of not more than twenty-five thousand dollars ($25,000.00) may be
assessed against any person who violates or fails to act in accordance with the terms, conditions, or
requirements of any permit issued pursuant to G.S. 143-215.1. If you wish to provide additional
information regarding the noted violation, request technical assistance, or discuss overall
compliance, please respond in writing within thirty (30) days after receipt of this Notice. A review
of this information will be conducted and you will then be notified of any civil penalties that may be
assessed regarding the violations. If no response is received in this Office within the 30 day
period, a civil penalty assessment may be prepared.
Your written response should be sent to my attention at the address shown on the letterhead. Be
advised that should these violations continue, further enforcement actions including civil penalties
may result.

In reply to your notification, at this time we are 8 inches below our
maximum liquid storage level. We will continue to pump as necessary.
It never exceeded top of marker. The irrigation pump was repaired,
although initial repairs were slowed due to parts not being available. An
alternate PTO pump was located and used as well. Active repairs are
taking place on return pump. I am presently working with Soil and
Water to get dirt out of spillway. Hope this answers any questions you
might have concerning the subject of this correspondence. I appreciate

Guys, I was look in the RYE data tables today, and found that there actually IS an agronomic rate on the for Burley
Tobacco in Surry County... albeit the soil I used was Braddock FSL, 2-8% slopes (was just looking for one on a common
soil)
Here's the number on the site for Burley on Braddock:
RYE: 2744 Ibs
N factor: 0.072
Realistic N rate: 198 Ibs/ac/year
Est P removal: 12 Ibs/ac/year
Is there a different soil type needed?

The application windows established in the 1217 Guidance Documents for Burley is May 15"—August 15t'. I hope this

During the Fall or Winter of 2009-2010, a representative of your animal operation informed the
Division of Water Quality (DWQ) Winston-Salem Regional Office that there was inadequate freeboard in
the waste pond(s) or lagoon(s) serving the facility. The Animal Waste Management Permit (Section III. No.
13) states that the "Permittee shall report by telephone to the appropriate Division Regional Office as soon
as possible, but in no case more than twenty-four (24) hours following first knowledge of the... failure to
maintain storage capacity in a lagoon/storage pond greater than or equal to that required in ... this General
Permit." We appreciate the fact that you reported the problem of high waste level as required by your
permit and have worked with our staff to manage the problem once it occurred.
While we recognize the extraordinary weather conditions existing at the time, the lack of adequate
freeboard reported to our office still represents non-compliance with the Certificate of Coverage issued to
your facility. As you are aware, this non-compliance is subject to appropriate enforcement action by DWQ.
The factors that lead to non-compliance, efforts to notify DWQ of the problem, efforts made to resolve the
problem once identified, and efforts proposed to prevent future problems have all been factors in our
decision regarding enforcement. Upon review and consideration of the information submitted and/or
discussed with DWQ staff, the Winston-Salem Regional Office has determined that a Notice of Deficiency
(NOD) is appropriate and that no further compliance/enforcement actions will be taken by the Division for
the high waste levels occurring between October 2009 and March 2010.
In the future, please continue to evaluate ways to maintain freeboard levels in the required range.
This may include, but is not limited to, water conservation practices, adding additional application sites,
updating your cropping systems, adding additional and / or more flexible application equipment, and main-

This letter is a follow-up to the October 25, 2006, meeting that Mike Mickey, Daryl Lamb and I
had on -site with you, Trevor and Mark Taylor of Ecologic Engineering/Construction, concerning
the stream restoration measures necessary at the above property off Zephyr Road. As we discussed,
it is our understanding that Ecologic Engineering/Construction will prepare and submit a restoration
plan within 60 days for stabilization of the illegally constructed channel. Copies of this plan should
be sent to Danny Smith, Wetlands/401 Unit Central Office, Division of Water Quality, 2321
Crabtree Boulevard, Parkview Building, Raleigh, NC 27604-2260 and to Daryl Lamb, DWQ,
Winston-Salem Regional Office, 585 Waughtown Street, Winston-Salem, NC 27107.
Additionally, please note that our office has yet to receive a monitoring plan for your previous
restoration project on Hodges Mill Road (Parcel I.D. #4978-00-00-0421). This plan was a
requirement of our February 3, 2006 letter that approved the restoration plan submitted by Buck
Engineering. The monitoring plan, due back in March 2006, should be submitted to this office on
or before November 30, 2006. Per Item 6(d) of the above February 3 approval letter, your first
written annual report for the Hodges Mill Road site is due in March 2007.
At this time, the assessment of any civil penalties for both violation sites will be held in abeyance
until all of the required restoration and monitoring activities are satisfactorily completed. If you

Dear Mr. & Mrs. Johnson:
On September 21, 2006, Melissa Rosebrock of the Division of Water Quality's Winston-Salem
Regional office inspected the above property located off Joe Layne Mill Road. Observations
revealed that an unnamed tributary to the Mitchell River (Class "C" Waters of the State) had been
severely impacted by the deposition of sediment up to ten inches deep below the recently cleared
areas. Accordingly, the following violations of North Carolina's Environmental Laws are
confirmed:
(1) Removal of Best Usage - The stream impacts constitute a violation of 15A NCAC 2B .0211
(2) which states: "The waters will be suitable as a source of water supply for drinking as well as
aquatic life propagation and maintenance of biological integrity, wildlife, and secondary
recreation, and agriculture; sources of water pollution which preclude any of these uses on
either a short-term or long-term basis will be considered to be violating a water quality
.standard. "
(2) Settleable Solids Violation - The deposition of solids to surface waters is a violation of 15A
NCAC 2B .0211(3) which states: "Floating solids; settleable solids; sludge deposits: only such
amounts attributable to sewage, industrial wastes or other wastes as will not make the water
unsafe or unsuitable for aquatic life and wildlife or impair the waters of any designated uses. "
Please be aware that these violations, and any future violations, could subject you to a civil penalty
assessment of up to $25,000 per day, per each violation. In order to bring the site into compliance,
the accumulated sediment in the stream channel below the denuded areas needs to be removed.
You are requested to respond in writing to this office within twenty (20) days of receipt of this
Notice. Your response should detail your plan for sediment removal and restoring the stream to its'
original condition.

On September 21, 2006, Melissa Rosebrock from the Winston-Salem Regional Office of the
Division of Water Quality inspected the above property located off Zephyr Road. Observations
indicated that f d been placed in 725 linear feet of an unnamed tributary to the Fisher River,
Class "WS-II JWQ A Waters", and the original stream channel was relocated. Photographs and
measurements taken during the site visit to document the stream impacts. Accordingly, the
following violations of North Carolina's Environmental Laws are confirmed:
(1) Failure to Obtain a Section 401 Water Quality Certification - A file review indicates that
the U.S. Army Corps of Engineers (COE) has not authorized the use of a Nation Wide Permit
for these activities. Additionally, the review confirmed that no Pre -construction Notification
had been received by the Division of Water Quality for this project, and no Section 401 Water
Quality Certification has been issued. A Section 401 Water Quality Certification is required for
the above -mentioned impacts pursuant to 15A NCAC 2H .0500.
(2) Wetland Water Quality Standard Violation - The placement of fill in a stream or wetland
constitutes a violation of 15 A NCAC 2B .0231(b) which states: "Hydrological conditions
necessary to support the biological and physical characteristics naturally present in wetlands
shall be protected to prevent adverse impacts... and the populations of wetland flora and fauna
shall be maintained to protect biological integrity. "

(3) Removal of Best Usage - The stream impacts noted above constitute a violation of 15A
NCAC 2B .0214 (2) which states: "The waters will be suitable as a source of water supply for
drinking as well as aquatic life propagation and maintenance of biological integrity, wildlife,
and secondary recreation, and agriculture; sources of water pollution which preclude any of
these uses on either a short-term or long-term basis will be considered to be violating a water
quality standard. "
(4) Settleable Solid Violation - The deposition of solids to surface waters is a violation of 15A
NCAC 2B .0211(3) which states: "Floating solids; settleable solids; sludge deposits: only such
amounts attributable to sewage, industrial wastes or other wastes as will not make the water
unsafe or unsuitable for aquatic life and wildlife or impair the waters of any designated uses. "
Corrective Action
The Division of Water Quality requires that the violations detailed above be abated immediately.
The following corrective actions are needed to bring the site into compliance:
1. Submit a stream restoration plan to the State for restoring the impacted stream, wetlands and
adjoining riparian areas. This restoration plan must include the physical restoration of the
stream and wetland to their original dimensions, pattern and profile that existed before the
disturbance, as well as the measures that will be used to establish a stable stream channel,
stream banks, and adjacent riparian zone. At a minimum, it should include the following:
❖ a reference stream with a description of its profile, pattern and dimensions and a
detailed description of the methods, materials, and structures necessary to install such
a stream. You are encouraged to secure an environmental consultant to assist you with
the plan's development, and the securing of required permits, certifications and
authorizations necessary to implement the plan.
❖ a riparian zone restoration plan. The stream banks and the riparian zone must be
stabilized and planted with woody vegetation. Specifically, address the location of the
riparian area to be restored and how to insure that future stream and riparian zone
impacts do not occur. A planting outline must be developed and implemented in order
to ensure that at least two native tree species are planted at a density sufficient to
provide 320 trees per acre at maturity. This density is usually achieved by planting
approximately 436 trees/acre on a 10 x 10 ft. grid or 681 trees/acre on an 8 x 8 ft. grid.
This plan must include the types of native woody vegetation selected, methodology of
planting, and a site map indicating the location of the replanting efforts. Note that the
riparian buffer zone on both sides of the stream must be restored.

Required Response
The Division of Water Quality requests that you respond in writing to this office within tw ty (20)
days of receipt of this Notice. Your response should outline the actions that have been taken
be taken to correct the stream impacts. These violations, and any future violations, are subject to a
civil penalty assessment of up to $25,000 per day, per each violation.
Please be advised that this Office is considering a recommendation for enforcement action to the

On January 17, 2006, the Winston-Salem Regional Office (WSRO) of the North Carolina Division of Water
Quality (DWQ) received a stream and wetland restoration plan for the above It
property, which is
owned by you. This plan was prepared by Buck Engineering of Cary, North Carolina and was submitted to
DWQ in response to the requirement for corrective action stipulated in the Notice of Violation issued to you on
December 9, 2005 for violations of North Carolina Water Quality Regulations which occurred on your property
located between Hodges Road and Crossroads Church Road in Surry County (Parcel I.D. 44978-00-00-0421).
WSRO DWQ staff have reviewed this plan with regard to meeting the requirements of corrective action as
specified in the NOV - specifically the repair of damage to 1,035 feet of an unnamed tributary to the Fisher
River and to approximately three acres of wetlands located along the left bank'of this tributary. We have
determined that the restoration activities proposed by this plan will satisfactorily meet the corrective action
requirements. By way of this letter, DWQ authorizes you to construct the stream and wetland restoration as
detailed in this plan. In addition to the activities described in the plan, you must also meet the following
additional requirements:
1. Appropriate sediment and erosion control measures which equal or exceed those outlined in the most
recent version of the North Carolina Sediment and Erosion Control Planning and Design Manual or the
North Carolina Surface Mining Manual (available from the Division of Land Resources at NCDENR
regional offices or the central office), whichever is more appropriate, shall be designed, installed and
maintained properly to assure compliance at all times with the North Carolina water quality standards
that are applicable to Class WS-II, HQW waters as described in 15A NCAC 02B .0214 Fresh Surface
Water Quality Standards For Class WS-II Waters and 15A NCAC 02B .0224 High Quality Waters.
Such measures must equal or exceed the requirements specified in the most recent version of the North
Carolina Sediment and Erosion Control Manual. These measures must be maintained on all
construction sites, borrow sites, and waste pile (spoil) sites, including contractor owned and leased
borrow pits, which are associated with this project.

measure is failing or showing evidence of pending failure, the condition of riparian restoration efforts
(including plantings) and whether any are failing or are not surviving, and measurements of the
amounts of sediment that are being deposited on the stream floor.
d) a written annual report due within 30 days of the end of each monitoring year. This annual report
shall be sent to DWQ's Winston-Salem Regional Office. The report must list the date of each
inspection, describe the inspection results, include digital photographs of each station, and describe
any repairs or corrections made and their dates of completion. For the first monitoring year, the
annual report shall also include copies of the quarterly field inspection reports.
e) procedures for undertaking repairs and corrections. If monitoring efforts show the need for repairs or
corrections to any restoration measure or riparian zone restoration effort, then such repairs or
corrections must be initiated within 20 days of the observation of such need. Any such repairs and/or
corrections shall be fully documented in the annual report.
Deviations from this protocol maybe acceptable when they can be justified. Proposed exceptions will be
evaluated on a case -by -case basis by DWQ.

As you are aware, Mike Mickey and Melissa Rosebrock from the Winston-Salem Regional Office
of the Division of Water Quality conducted a site inspection on December 7, 2005, at the subject
property located between Hodges Mill Road and Crossroads Church Road. Observations indicated
that 1,035 linear feet of an unnamed tributary to the Fisher River, Class "WS-11 HWQ Waters", had
been severely impacted by the (1) excavation of the streambed substrate (stream floor), excavation
of the stream bank, widening of the stream bed, and grading of the riparian area, (2) placement of
approximately 50 linear feet of 7-foot diameter metal pipe into the stream channel, (3) ditching and
draining of one acre of wetlands and placement of the fill into the wetland and (4) deposition of
sediment up to eight inches in depth in the State's surface waters at numerous locations on the
property. During the site investigation photographs and various measurements were also obtained
to document the stream impacts. Accordingly, the following violations of North Carolina's
Environmental Laws are confirmed:
(1) Failure to Obtain a Section 401 Water Quality Certification - The Winston-Salem
Regional Office confirmed that approximately 1,035 linear feet of stream channel and banks
had been impacted by excavation and approximately 50 linear feet of stream had been
impacted by culverting and earthen backfill prior to securing a Section 404 Nationwide Permit
from the U. S. Army Corps of Engineers. A file review also indicates that the U.S. Army
Corps of Engineers (COE) has not authorized the use of a Nation Wide Permit for these
activities. Additionally, the review confirmed that no Pre -construction Notification had been
received by the Division of Water Quality for this project, and no Section 401 Water Quality
Certification has been issued. A Section 401 Water Quality Certification is required for the
above -mentioned impacts pursuant to 15A NCAC 2H .0500.

wetland impacts. This map should clearly indicate the position of the impacted areas relative
to adjacent property lines, roadways, stream channels and any other significant structures
immediately above and below the impacted areas.
2. Explain why authorization from the U. S. Army Corps of Engineers (404 Permit) and the
Division of Water Quality (401 Water Quality Certification) was not secured for this activity.
3. Submit a stream restoration plan to the State detailing your plans for restoring the impacted
streams, wetlands and adjoining riparian areas. This restoration plan must include the
physical restoration of the stream and wetland to their original dimensions, pattern and profile
that existed before the disturbance. This plan must also include the measures that will be used
to establish a stable stream channel, stream banks, and adjacent riparian zone. At a minimum,

Please see the attached Guidelines for Riparian Buffer Restoration (January 2001) for
assistance in developing your plan. This plan must include the types of native woody
vegetation selected, methodology of planting, and a site map indicating the location of
the replanting efforts. Note that the riparian buffer zone on both sides of the stream
must be restored.
Copies of this plan should be sent to Danny Smith, Wetlands/401 Unit Central Office, Division of
Water Quality, 2321 Crabtree Boulevard, Parkview Building, Raleigh, NC 27604-2260 and to
Daryl Lamb, Division of Water Quality, Winston-Salem Regional Office, 585 Waughtown Street,
Winston-Salem, NC 27107. In addition, you should contact the U. S. Army Corps of Engineers
at (919) 876-8441 and the Division of Land Resources, N. C. Department of Environment and
Natural Resources, Winston-Salem Regional Office, at (336) 771-4600 to ensure that your
restoration plans are in compliance with the requirements of Section 404 of the Clean Water Act
and the requirements of the Division of Land Resources.
4. Additionally, either remove the culvert pipe and restore the impacted stream section and
adjoining riparian area, or secure an "after the fact" 404 Permit from the US Army Corps of
Engineers and a 401 Water Quality Certification from the Division of Water Quality. Should
the US Army Corps of Engineers decline to issue an "after the fact" permit for this impact,
proceed with removal of the pipe and include the affected area in the restoration plan above.
5. In order to stabilize the stream in the interim, temporary ground cover should be installed
immediately. This ground cover should be suitable for current soil and climate conditions.
6. In addition to the required restoration, remove the accumulated sediment from the stream. It
is recommended that hand labor (buckets, shovels and wheelbarrows) be used to remove

I have received your letter dated January 7, 2000. I apologize for the amount of time it is taking the Division of Water Quality
to permit your facility. I am working as quickly as possible to issue a permit, however our Division currently has many staff
positions that are vacant and the workload does not allow me to process applications as quickly as we would all like. Please
be patient with us, and know that we are doing our best to review your submittals as quickly as possible.
Unfortunately, there is one item that will need to be addressed in your current Waste Utilization Plan. Please address the
following by February 19, 2000 and I will do my best to process your reply as quickly as I can.
1. The irrigation parameters listed on page 4 of your current Waste Utilization Plan (WUP) exceed current
recommendations. Irrigation events are to be listed in the WUP as the maximum application allowable for
that soil type from the time the pumps are turned on until the time they are shut off. The application events
listed in your WUP appear to be out of the Sprinkler Irrigation Guide. The Application Amounts listed in
this guide have not been adjusted for the application of animal waste. It is currently recommended that total
application amounts not exceed one inch in any application event for any soil type. Please have your
Technical Specialist revise your WUP to reflect the appropriate application amount per event. If the rates
exceed the recommended one inch, please have your Technical Specialist justify the increased application
rate in the narrative of your WUP.

This letter is being sent to clarify the recordkeeping requirement for Plant Available Nitrogen (PAN)
application on fields that are part of your Certified Animal Waste Management Plan.
In order to show that the agronomic loading rates for the crops being grown are not being exceeded, you
must keep records of all sources of nitrogen that are being added to these sites. This would include nitrogen
from all types of animal waste as well as municipal and industrial sludges/residuals, and commercial fertilizers.
Beginning January 1, 2000, all nitrogen sources applied to land receiving animal waste are required to
be kept on the appropriate recordkeeping forms (i.e. IRR1, IRR2, DRY1, DRY2, DRY3, SLURI, SLUR2,
SLDI, and SLD2) and maintained in the facility records for review. The Division of Water Quality (DWQ)
compliance inspectors and Division of Soil and Water operation reviewers will review all recordkeeping during
routine inspections. Facilities not documenting all sources of nitrogen application will be subject to an
appropriate enforcement action.
Please be advised that nothing in this letter should be taken as removing from you the responsibility or
liability for failure to comply with any State Rule, State Statute, Local County Ordinance, or permitting
requirement.

The Non -Discharge Permitting Unit has completed a preliminary engineering review of the subject
application. Additional information is required before we can continue our review. Please address the
following by May 6, 1999:
1. The lagoon volume calculations that you submitted show the lagoon was constructed for
120 days of temporary storage, however sheet 36 in your Waste Utilization Plan (WUP)
states that the lagoon has 180 days of temporary storage. Please have a technical
specialist review this discrepancy and determine which number is correct.

corrected to reflect the correct number of acres in this field, and the total nitrogen utilized
by the crop in this field.

7. Liquid waste shall be applied at rates not to exceed the
soil infiltration rate such that runoff does not occur
offsite or to surface waters and in a method which does
riot cause drift from the site during application. No
panding should occur in order to control conditions
conducive to odor or flies and provide uniformity of
application..
8. Animal waste shall not be applied to saturated soils,
during rainfall events, or when the surface is frozen.
9. Animal waste shall be applied on actively growing crops in
such a manner that no more than 20 to 25 percent-. of the
leaf area is covered.
10. Waste nutrients shall riot be appl..i.ed in fall or winter for
spring planted crops ou soi..ls wish a high porenr.:i.aL for
leaching. Waste nutrient load111g rates on these sol.l.s
should be held to a minimum and a suitable winter cover

surface water. This distance may be reduced for waters
that are not perennial provided adequate vegetative filter

12. Animal waste shall not be applied closer than 100 feet to
wells.
13. Animal waste shall not be applied closer than 200 feet of
dwellings other than those owned by the landoWiter.
14. !Waste shall be applied in a manner not to reach artier
property and public right-of-ways.
15. Animal waste shall not be discharged into surface waters,
drainageways or wetlands by a discharge or by over -
spraying. Animal waste may be applied to prior converted
wetlands provided they have been approved as a Land
application site by a "technical specialist-". Animal
waste should not be applied on grassed waterways that
discharge directly into water courses, and only then at
agronomic rates provided the application causes no runoff
or drift from the site.

The Non -Discharge Permitting Unit has completed a preliminary engineering review of the subject
application. Additional information is required before we can continue our review. Please address the
following by October 17, 1999:
1. The lagoon volume calculations that you submitted show the lagoon was constructed for
120 days of temporary storage, however page 4 in your Waste Utilization Plan (WUP)
states that the lagoon has 180 days of temporary storage. Please have a technical
specialist review this discrepancy and determine which number is correct.
2. Please submit a Mortality Management Checklist.
3. Your Waste Utilization Plan (WUP) list the yield for no -till corn on as 160 bushels per
acre. This is higher than suggested in documents available to the Division of Water
Quality. Please contact your technical specialist to review the Waste Utilization Plan and
provide documentation that supports the yield as shown in the current WUP or revise the
WUP to current guidance. Please note that all WUP revisions must be signed and dated
by both the owner and the technical specialist.
4. The application window shown in Table 1 of your WUP for com is March through May
and September through November. Please have a technical specialist verify that com is
an actively growing crop in September through November and will be able to adequately
utilize any nutrients applied during that window.
