I spoke with Daniel Horton today and we discussed the following (of which you may already be aware): -Waste level is 8-10 ft below the max/start pump. Only contains run-off water now. -No longer applying waste with dragline system and they have sold equipment. Have purchased a 6000 gal honey wagon/spreader and are using this for waste application. -No animals on the lot but are raising 200 heifers on pasture for Smitherman (Yadkin). The pastures were part of the easement project and have stream exclusion and drinkers. He reports pastures are in great shape. -He maystart raising heifers for Klaus Koopman (related to Ard Koopman but they do not get along). I think Klaus is in the WIRO? -If you don't have it, Daniel's number is 336-401-2490. *** I told Daniel that prior to any animals being on the lot, that the waste plan and permit needs to be amended/changed to heifers. This means the numbers will probably change since heifers are obviously smaller than milk cows. I've ask him to contact you to get the ball rolling when/if the time comes. It should be a quick approval by us as long as the waste plan is in order. That's it for now. Just spoke with Daniel and he said they were going to begin applying onto fields behind Bill's house in about an hour. This is a good spot I think... high and away from stream.. Fields are in corn stubble to be planted in wheat, or even oats since it's getting late and they need some sort of cattle feed. They have tested the dragline system and tractor and say the equipment won't get bogged down. I reminded them to have someone check field borders for run off and he said someone would drive the 4 wheeler around to check. He said it never runs more than 10' and that it has grass to run into. I requested that they not apply this Thursday since it is forecast to rain but he may if forecast changes. Daniel says he thinks they can have the WSP waste lowered five feet by Thursday. Daniel says they will remove sand/soil from spillway as soon as "rainy spell" ends and will have Tony re -shoot spillway elevation and re -seed vegetation. This was supposed to be done last year I think so I will be looking for completion of this task in particular during their inspection this year. Their phone call and discussion with me may serve as their Plan of Action (PDA). If anyone has questions or concerns or suggestionsplease let me know. Thanks again for your help. Skvada, ill Secretary This Notice is in response to the reported discharge of animal waste from a leak in the "small" waste storage pond located at Maple Ridge Dairy. Our records indicate that, at your request, Division of Water Quality (DWQ) staff was informed of the discharge by a Suny County Soil and Water employee on May 15, 2013. We have also documented your `official' notification to our office on May 16, 2013 at 9:30a.m. The Division would like to thank you for apprising us of the discharge as required by the Animal Waste Permit (Condition III. I3.a.) and for your actions to immediately lower the waste volume to a level below the leak. The leak, and subsequent discharge into waters of the State, appears to have been the result of a burrowing animal digging a hole through the upper portion of the waste pond embankment. An unknown amount of waste then entered a dry streambed of an unnamed tributary to Moores Fork Creek. This waterbody is classified as a Water Supply (WS-IV) stream within the Yadkin Pee - Dee River Basin. While the Division recognizes that the unpermitted discharge was caused by conditions presumably out of your control, it still violates NC General Statute NCGS 143-215.1 (a) which states in part that no person shall "Make any outlets into the waters of the State." To prevent future discharges, and probable enforcement action, the waste storage pond cited above must be closed out or repaired as soon as possible. Maple Ridge Dairy, Inc. was issued Certificate of Coverage AWC860010 by the Division of Water Quality, under General Permit AWG200000 for Maple Ridge Dairy on October 1, 2009, effective upon issuance, with an expiration date of September 30, 2014. D. Condition III.5 of the General Permit AWG200000 states in part that "An analysis of the animal waste shall be conducted in accordance with recommended laboratory sampling procedures as close to the time of application as practical and at least within sixty (60) days (before or after) of the date of application". E. On March 15, 2011, DWQ staff conducted a routine compliance inspection of Maple Ridge Dairy and found that there were no waste analyses records on site for review by the inspector. Irrigation had occurred in September and October, 2010 at the facility without a waste analysis being collected within the sixty day time frame. The most recent waste analysis on record was done in April, 2010. F. On April 15, 2011, the Division issued a Notice of Violation/Notice of Intent to Enforce (NOV/NOI) to Maple Ridge Dairy, Inc. identifying violations of N.C.G.S. 143-215.1 and General Permit No. AWG200000. The violations include failure to conduct waste analyses within sixty days of the date of wastewater application. G. The NOV/NOI Notice was sent Certified Mail, return receipt requested and received on April 26, 2011. H. The cost to the State of the enforcement procedures in this matter totaled $854.87. Based upon the above Findings of Fact, I make the following: IL CONCLUSIONS OF LAW: A. Maple Ridge Dairy, Inc., is a "person" within the meaning of N.C.G.S. 143-215.6A pursuant to N.C.G.S.143-212(4). B. A permit for an animal waste management system is required by N.C.G.S. 143-215.1. C. The above -cited failure to conduct waste analyses within sixty days of the date of application constitute violation of Condition III.5. of the General Permit AWG200000. D. N.C.G.S. 143-215.6A(a)(2) provides that a civil penalty of not more than $25,000.00 may be assessed against a person who fails to apply for or to secure a permit required by N.C.G.S. 143- 215.1, or who violates or fails to act in accordance with the terms, conditions, or requirements of a permit required by N.C.G.S. 143-215.1. E. N.C.G.S. 143-215.6A(b) provides that if any failure to act as required by the rules is continuous, a civil penalty of not more than $25,000.00 per violation may be assessed for each day the violation continues. F. N.C.G.S. 143-215.3(a)(9) and N.C.G.S. 143B-282.1(b)(8) provides that the reasonable costs of any investigation, inspection or monitoring survey may be assessed against a person who violates any regulations, standards, or limitations adopted by the Environmental Management Commission or violates any terms or conditions of any permit issued pursuant to N.C.G.S. 143- 215.1, or special order or other document issued pursuant to N.C.G.S. 143-215.2. G. The Chief of the Aquifer Protection Section, Division of Water Quality, pursuant to delegation provided by the Secretary of the Department of Environment and Natural Resources and the Director of the Division of Water Quality, has the authority to assess civil penalties in this matter. The leak is near the top of the dam on our small pond that holds only parlor water, there is a very minimal amount of water that has leaked out and went down a ditch that was constructed for fresh water till it reached a small spring that feeds to Moores Fork Creek, our best estimate is that less than 150 gallons was released and the water did pass through heavy vegetation before reaching the spring. The discharge was discovered around 10:00 a.m. and at that time we started pumping the waste into our large waste storage pond, the level had been lowered enough to get the leak stopped within thirty minutes. The cause of the discharge appears to be a burrowing animal digging a hole through the top portion of the dam (within the top three feet). All the recent rains probably made this easier for the animal to dig. The leaking has been stopped and we will keep the liquid level down in this pond until we can divert our parlor water to our big pond and close the small one permanently. We will work with Soil & Water and NRCS to get this done in a timely manner. We are attaching our sketch and latest sample, we will be working to get the required sample you ask for and you already have the pictures taken by Soil and Water. Moores Fork # 94709 Surry County Project Length: 19,915 LF Watershed: 1,527 ac River Basin: Yadkin Goals: ❑ Improve water quality in Moores Fork and the UTs through reductions in sediment and nutrient inputs from local stressorslsources; ❑ Create conditions for dynamic equilibrium of water and sediment movement between the supply reaches and project reaches; ❑ Promote floodwater attenuation and secondary functions associated with more frequent and extensive floodwater contact times; ❑ Improve in -stream habitat by increasing the diversity of bedform features; ❑ Enhance and protect native riparian vegetation communities; and ❑ Reduce fecal, nutrient, and sediment loads to project streams by promoting and implementing livestock best management practices. The Moores Fork Mitigation Project site is located in Surry County in western North Carolina, just north west of Mount Airy. The site is located in the Northern Central Piedmont region. Through this project, EEP proposes to restore, enhance and preserve approximately 19,915 linear feet (LF) of Moores Fork and fifteen previously unnamed tributaries (UTs), provide livestock fencing and alternative water sources to keep livestock out of the streams, remove invasive plant species across the project, and establish native riparian buffers. This project is located on a 461 ac. dairy farm called Maple Ridge Farm which currently has over 250 livestock that have access to Moores Fork and the tributaries surrounding the property. The EEP conservation easement will be over 140 ac that add more then a 50 foot buffer on all the streams on the property. Dairy operations are focused at a cluster of barns, silage pits and small buildings in a 4-acre area near the farm entrance along Horton Road. The 2009 Upper Yadkin RBRP (www.nceep.net/services/`restplans/Upper Yadkin RBRP 2009.pdf) identified the Stewarts Creek 14-digit HUC 03040101110010 as a TLW. We installed four hand-augered shallow (8-ft deep) wells this year. Groundwater and stream water quality data from the site show that there is reduction in nutrients and improvements in water quality because of the restoration work. We are working with the landowner in putting some additional wells to see the effects of groundwater quality with reference to certain land uses on his property. A major limitation of this project is that we started this project after the restoration work at the site, but nonetheless we are learning much. We are interested in pursuing one or more projects where we can monitor groundwater and stream water quality before the start of any construction work to establish a baseline for the site and continue on for a few years after construction. Gravel under the asphalt will be approximately 1736 cu yds of stone. They can use crusher run or another gravel under the asphalt. He stated that he had spoken with HydroEngineering and that the emergency pump kill switch was going to be about $1100, using a wireless system with a relay wire/pole on top of a barn. He said that the company suggested that he might want to use a "Murphy Gauge" instead. This type of gauge is oil filled and is installed on the pump at the waste pond. Pressure parameters can be set for individual application events. Daniel said that they usually run from 70-90 psi at the "gun" end so the pump pressure is about 10 psi higher. The low/hig ssure parameters are set then if the gets kinked, clogged, broken, etc. and goes outside of the pre-set psi We, the pump is shut off. The gauge halme sort of feature (can't remembers' + the name) by which the waste water does not come in contact or is cleaned from the gauge (I wasn't clear on this) so that the gauge lasts longer. This type of set-up costs $300. He ask if this would be ok with us? I told him that we had actually discussed this type of gauge on the ride home and told him we would make a decision and get back to him. i Regardless, I told him we would still require someone else to be within a couple minutes from the pump in case something happened. DWQ files indicate that leachate has been a water quality concern off and on since 2002. Obviously, the impacts have been greatest just after the silos are filled with silage each Fall and Spring and of the least impact when the silos are almost empty. Rainfall has an effect on the amount of leachate that flows into the freshwater stream as well. DWQ has afforded the Horton's numerous opportunities over the years to address the issue themselves. The Horton's have tried various "methods' to contain the leachate, exclude freshwater from the silos, and to exclude leachate from the stream. None have worked satisfactorily. As the farm has increased its herd size, the amount of stored silage has also increased. There is often foam in the stream directly below the silos, as well as a strong odor, fungal growth, and discolored water. DWQ and the Surry County NRCS/SWCD staff have been debating what it will take to permanently address this water quality problem for a long time. Our conclusion is that the problem can't realistically be fixed in situ due to the terrain, proximity of silos to the stream, flow of water from the DOT road and farm lot, and physical hindrance from the farm road. In my opinion, the only way to permanently deal with the nutrient rich leachate is to re -locate the silos. Tony, Greg, Patrick and I have also discussed potential areas for relocation, and we concur that the silo needs to be on the other side of the farm road and below the newest waste pond. Tony or Greg could probably describe more precisely the preferred location, along with our ideas for allowing the leachate to disperse out over several hundred feet of vegetated buffer/crop land before it would even come close to surface waters. DWQ and the Surry SWCD/NRCS offeave always enjoyed and appreciatedospectful and considerate working relationship. We have always tried to keep each other apprised of the "goings on" and DWQ has felt comfortable in allowing Slurry (and many other counties and farmers!) the time and flexibility to address the water quality issues in the way in which their field staff suggests. All agencies AND the surface waters have benefitted from this type of cooperation. I would expect this situation be no different. With the long arm trackhoe we will not have to get into the pond and risk damage to the liner. The bucket on the trackhoe is fitted with a smooth cutting edge that will not damage the liner. I am told that this narrative should include a few sentences describing the new dragline system and proper operating pressures. The following items should be referenced in the narrative and included as an appendix: the dragline design by Jason Graham, the design worksheet from Mid -Atlantic, the flow design table by Daniel Horton or other design flow table, as fit. The dragline design, including any flow charts for operating psi should be referenced in the narrative and included as an appendix. Please note that installation and demonstration may be necessary prior to a Technical Specialist adding this narrative. 2. The waste application equipment must be tested and an initial calibration completed following installation during first use. This equipment must then be calibrated once every two years thereafter. DWQ recommends that you contact Mr. Joe Hudyncia with the Division of Soil & Water Conservation for technical assistance with calibration and record keeping. 3. Rainfall during the month of August totaled 2.9" but occurred on 9 different days severely impacting silage harvest and pushing into the month of September. Then in September rainfall of .3" occurred on 9/2 and a 2.1" rainfall on 9/3 followed by a .9" rain the next day the 4th. Silage was harvested between the 14th and 17th when the land was finally dry enough to handle equipment. Following silage harvest rain occurred on the 17th of .5" and then the next day a heavy rainfall event of 2.5". Freeboard on 9/6 was observed at 4" but by the time the heavy rain had occurred on the 17th and 18th freeboard exceeded the marker on the 20th. I left Mr. Mitchell a message that morning to inform him of the exceed freeboard. We did spread 9/20-9/24 and had about 2 inches of freeboard showing on the 24th. During the early morning of 9/25 and prior to Mr. Mitchell's inspection a pump in WSP #1 became plugged with solids so that morning my brother started hauling from WSP #1 so he could address the plugged pump. This pump is used to run our sand separator which keeps sand out of WSP#2. Without the use of the separator WSP42 would fill up even faster so that is the reason we were hauling from WSP#1 and not from WSP#2. Since the pump in WSP#1 was plugged additional sand was pushed in WSP#2 during the night of the 24th and the early morning of the 25th causing the waste to exceed the freeboard by the 2" that Mr. Mitchell observed during his inspection. In regard to violation #2, WSP#1 was sprayed and mowed during the late spring of 2012 however during the heatwave in June and July the young grass died and was overtaken by a bunch of broadleaf weeds. It is my understanding the Hortons have/are entering an easement agreement with EEP. One of the concerns on the site is the silage leachate from the existing silage trenches. When Tom and I were talking, I didn't understand that the recommendation from Melissa, Greg and Tony included relocating the silage storage ... so that eliminates any possible piping under the road. What they have recommended is to move the silage storage to the same side of the road as the waste storage pond but further down the road. The area would be graded such that the any silage leachate and other runoff be contained in a curbed area. The curbing would be a speed bump type formation approximately 6-ft wide and 4-6-inches high depending on what depth of leachate/runoff needed to be contained before a flushing flow started to over flow the curbing. This would allow traffic and equipment to go into the silage storage without damage to equipment or curbing. Melissa has seen this type of arrangement work on other farms. My initial concerns/questions about a design: 1-The Hortons want to use asphalt for some portion of the design. I haven't designed anything using asphalt and would have to do some research to figure out where to start. They want to go to asphalt because it is supposed to hold up to the silage leachate better than concrete. 2- It is my understanding that the landowner wants to expand the available silage storage capacity during this process. Is EEP willing to give them as much as they want as long as there is adequate room or maintain what they have? 3- Who would decide at what point the silage leachate is diluted/broken down enough to be flushed? The same question would have to be answered if we tried to collect the runoff and leachate and pipe it the waste storage pond. Would we have to meet the 25 year- 24 hour storm event waste pond was originally designed for is storage capacity for the number of animals planned for expansion and thelWd runoff and waste water. Adding theqWfrom the existing size silage storage would be extremely taxing on the WSP as well as additional concerns for applying the effluent and field capacity for that much more liquid. 4- Time frame of need. It would be a few months before I could get to a design stage. I have 3 dam projects and 3 other projects on my list at this time that would be ahead of anything new. What they have recommended is to move the silage storage to the same side of the road as the waste storage pond but further down the road. The area would be graded such that the any silage leachate and other runoff be contained in a curbed area. The curbing would be a speed bump type formation approximately 6-ft wide and 4-6-inches high depending on what.depth of leachate/runoff needed to be contained before a flushing flow started to over flow the curbing. This would allow traffic and equipment to go into the silage storage without damage to equipment or curbing. Melissa has seen this type of arrangement work on other farms. My initial concerns/questions about a design: 1-The Hortons want to use asphalt for some portion of the design. I haven't designed anything using asphalt and would have to do some research to figure out where to start. They want to go to asphalt because it is supposed to hold up to the silage leachate better than concrete. 2- It is my understanding that the landowner wants to expand the available silage storage capacity during this process. Is EEP willing to give them as much as they want as long as there is adequate room or maintain what they have? 3- Who would decide at what point the silage leachate is diluted/broken down enough to be flushed? The same question would have to be answered if we tried to collect the runoff and leachate and pipe it the waste storage pond. Would we have to meet the 25 year- 24 hour storm event? The waste pond was originally designed for a year's storage capacity for the number of animals planned for expansion and the related runoff and waste water. Adding the runoff from the existing size silage storage would be extremely taxing on the WSP as well as additional concerns for applying the effluent and field capacity for that much more liquid. 4-Time frame of need. It would be a few months before I could get to a design stage. I have 3 dam projects and 3 other projects on my list at this time that would be ahead of anything new. While most animal waste management activities were in good order, there are continued issues that warrant your immediate attention and action. As previously discussed, the Cattle Waste Management Permit issued to Maple Ridge Dairy, Inc. requires that an analysis of the animal waste be conducted within sixty (60) days of application (Section I11.5.). On -site application records indicate that February, March, April, and June 2007 applications did NOT have a corresponding waste analysis. Failure to maintain required records is a violation of NC General Statute 143-215.10C and the Cattle Waste Management Permit. Please note that you were previously advised of this deficiency during a March 2007 Operation Review and issued a Notice of Violation (NOV) by DWQ in 2001 for the same infraction. DWQ staff also documented that weekly waste level readings had not been recorded for the newest waste storage structure (installed Spring 2007). Since this structure now contains animal waste, it is expected that waste level records be recorded and maintained per the Cattle Waste Management Permit (Section III.2a.). Staff also observed that animal waste was inadequately contained to the wet stack and "Group 4" barn areas. Corrective measures, including gutter repair, rail and concrete installation, and clean- up are to be completed by October 18, 2007. Tony Davis, with the Surry SWCD was also present during the inspection. While record keeping was improved over last year, there are still some concerns that warrant your attention. Specifically, Ms. Rosebrock noted that waste samples were not taken within 60 days of the October and December 2000 waste applications. As you are aware, waste samples are to be taken within 60 days of all waste applications. As mentioned during the inspection, a Standard Fertility Analysis is to include an analysis for copper and zinc. This was not included for the 2000 Standard Fertility Analysis. Please note that waste and soil analysis, once obtained, should be kept for a minimum of five years. Failure to have complete records is a violation of North Carolina General Statute 143-215.10C and your Animal Waste Permit. During the inspection, Staff also observed that some waste had previously seeped from the wooden dry -stack structures into a drainage area that leads directly to a fresh water drain. It was also noted that the dry stacks were almost empty on the date of the inspection. Ms. Rosebrock also observed some stream bank erosion on the heifer pasture. You may wish to contact the Surry SWCD or your Technical Specialist for assistance regarding seeding, fencing, pasture rotation, etc. While the above concerns do not pose an immediate threat of unpermitted discharges reaching waters of the State, the potential certainly exists for a discharge to waters in the future, particularly if conditions deteriorate. You should also be aware that the referenced discharge from the dry -stack is a violation of your Animal Waste Permit and North Carolina General Statute (NCGS) 143-215.1(a), and could subject you to civil penalties of up to $25,000 per day, per violation. Since the added/expanded dry stack area, this counts. It is up to regional staff and their supervisors whether they issue a notice of violation, and recommend enforcement. In order to show that the agronomic loading rates for the crops being grown are not being exceeded, you must keep records of all sources of nitrogen that are being added to these sites. This would include nitrogen from all types of animal waste as well as municipal and industrial sludges/residuals, and commercial fertilizers. Beginning January 1, 2000, all nitrogen sources applied to land receiving animal waste are required to be kept on the appropriate recordkeeping forms (i.e. IRRI, IRR2, DRY1, DRY2, DRY3, SLURl, SLUR2, SLD1, and SLD2) and maintained in the facility records for review. The Division of Water Quality (DWQ) compliance inspectors and Division of Soil and Water operation reviewers will review all recordkeeping during routine inspections. Therefore, some or all of your fields may be exceeding the allowable loading rates set in your Certified Animal Waste Management Plan. In order to resolve this issue, please contact a designated Technical Specialist to have him or her conduct a Wettable Acre Determination for your facility. The Technical Specialist must be one that has been approved by the Soil and Water Conservation Commission to conduct Wettable Acre Determinations. Many Technical Specialist with the N.C. Cooperative Extension Service, the Soil and Water Conservation Districts, the Natural Resources Conservation Service, and the Division of Soil and Water Conservation have received this special designation. You may also contact a private Technical Specialist who has received this designation, or a Professional Engineer. All needed modifications to your Animal Waste Management System must be made and the Wettable Acres Determination Certification must be returned to DWQ within the next 180 days. A representative from Southern States is scheduled to come to the farm 6-30-99 and take soil samples from fields where waste is applied. 3. On June 28 Tony Davis and Greg Goins from NRCS visited our farm and are assisting us with plans to enlarge the dry stack storage to accommodate volume for 200 head. Nancy Keith of NCCES has agreed to redo our WUP as needed for 200 head. Our waste water pond meets the storage capacity needed for 200 head for 90 days according to NRCS. There are 233 acres available for land application which NRCS says is sufficient for 200 head. We ask that we be granted an extension until the end of 1999 to complete all the necessary tasks involved in item #4. Since we will be involved with working closely with NRCS and NCCES as well as doing construction ourselves to enlarge the dry stack storage, we feel that we will need that much time to complete everything necessary. (d) "OWNER" has secured assistance from a certified technical to develop animal waste management system which, once certified, will meet or exceed all applicable guidelines and standards and will be able to comply with all aspects of the Commissions animal waste general permit. (e) During the term of this Agreement there will be no increase in Steady State Live Weight (SSLW) at the facility. Any new construction will be designed to accommodate only the SSLW for which the facility was registered in accordance with 15A NCAC 2H .0217(a)(1)(D). (e) Since this Special Agreement is by Consent, neither party will file a petition for a contested case or for judicial review concerning its terms. (f). Nothing in this Special Agreement shall be taken as absolving or relieving "OWNER" from any responsibility or liability for discharges of animal waste to surface waters of the State of North Carolina. 2. "OWNER" desiring to comply with the Permit identified in paragraph 1(a) above, hereby agrees to do the following: (a) Undertake all necessary activities in order to obtain and implement a certified animal waste management plan by September 30, 1998. In the case of noncompliance, the notice shall include a statement of the reason(s) for noncompliance, remedial action(s) taken, and a statement identifying the extent to which subsequent dates or times for accomplishment of listed activities may be affected. 3. "OWNER" agrees that unless excused under paragraph four (4), "OWNER" will pay the Director of DWQ, by check payable to the North Carolina Department of Environment and Natural Resources, stipulated penalties according to the following schedule for failure to meet the deadline set out in paragraph 2(a) above. , Failure to obtain and fully implement a Certified $100.00 for the first seven days Animal Waste Management Plan by the date past the date identified in 2(a) identified in 2(a) above: $500.00 for each additional day 4. An extraordinary event beyond the "OWNER'S" control. Contractor delays or failure to obtain funding will not be considered as events beyond the "OWNER's" control; or e. Any combination of the above causes. Failure within thirty (30) days of receipt of written demand to pay the penalties, or challenge them by a contested case petition pursuant to G.S. 150B-23, will be grounds for a collection action, which the Attorney General is hereby authorized to initiate. The only issue in such an action will be whether the thirty (30) days has elapsed. 5. Facility No. 86-10 Surry County Dear Mr. Horton: The purpose of this letter is to summarize the inspection of your dairy on September 18, 1997. Tony Davis with the Surry County Soil and Water Conservation District as well as Mike Mickey, Wes Bell, and Jenny Rankin with the Winston-Salem Regional Office of the Division of Water Quality were present for the inspection. The inspection found that you have two illegal discharges on your farm. The first discharge is from the barn where manure is pushed off the concrete pad and some enters a drainage pipe for stormwater. This pipe runs underground into a ditch. A curb needs to be placed around the edge of the barn to prevent manure from running off the concrete pad. The second discharge is from parlor water which sheet flows down a hill and into a creek. There is no storage pond for this parlor water. On the day of the inspection, Tony Davis told DWQ that you are planning to either build a storage pond yourself or have NRCS help you. At any rate, a storage pond needs to be built so you will not be in violation. Please be advised that the non -permitted discharge of any type of wastewater to the waters of the State is illegal as per North Carolina General Statute 143-215. L Steps should be taken immediately to remedy the problems associated with the animal waste and parlor water runoff.
