Met with the OIC/owner for this farm a couple weeks ago. Since they have had no cattle in the last few years, and
don't foresee the ability to purchase cattle in the near future, they would like to go to a zero animal permit.
Since this is cattle, I assume there would not an issue should they decide to apply for a general permit for approx. 240
in the future? Just complete the application, attach the CAWMP, and submit? They do not plan to make cheese even
if they re-establish the dairy cow herd.

I just spoke with the tech specialist this week and she has Mr. Shore as a priority. As we discussed, part of the hold-
up has been that the owner has had to get new lease agreements since his old ones expired and there is now some
questions as to how many acres Mr. Shore now has for waste application. It may be that the permitted number has
to be lowered even though there are currently no dairy cattle on site. Will keep you posted.

I have this long overdue file with me. This farm has had an individual permit which has now long expired. You and I discussed
about how they have depopulated and want to maintain their permit. In order to do that, we wanted them to fill out a renewal
application and send us a copy of their waste plan. I also sent them a certified letter to this effect on January 23, 2012.
I have not heard from them since.

Hey Melissa,
I've been on use or lose annual leave so today is my first day back. Thanks for sending this report. I've been wondering
what was going on with Tom. I'm still wondering after seeing the remark about 10 swine. Tom has been calling Yadkin
offices and trying to get Nancy or Pacer to update his waste plan. Pacer and I have discussed and Pacer knows the deal.
Tom Smith and I have told Tom Shore (he started calling last year about updating his plan) that we (1) will update his
waste plan but he needs to get new lease agreements before we can do anything. I am not going to a farm to do PLAT
unless I know the landowner is on board. If and when he gets the lease agreements signed, I will assist him. I think you
can understand why I am a little skeptical about him. I am so busy that I don't have time for any foolishness. I'm working
4 counties until February. Sorry to unload on you, but today has been a doozy. Keep me posted.

During the Fall or Winter of 2009-2010, a representative of your animal operation informed the
Division of Water Quality (DWQ) Winston-Salem Regional Office that there was inadequate freeboard in
the waste pond(s) or lagoon(s) serving the facility. The Animal Waste Management Permit (Section III. No.
13) states that the 'Permittee shall report by telephone to the appropriate Division Regional Office as soon
as possible, but in no case more than twenty-four (24) hours following first knowledge of the... failure to
maintain storage capacity in a lagoon/storage pond greater than or equal to that required in ... this General
Permit." We appreciate the fact that you reported the problem of high waste level as required by your
permit and have worked with our staff to manage the problem once it occurred.
While we recognize the extraordinary weather conditions existing at the time, the lack of adequate
freeboard reported to our office still represents non-compliance with the Certificate of Coverage issued to
your facility. As you are aware, this non-compliance is subject to appropriate enforcement action by DWQ.
The factors that lead to non-compliance, efforts to notify DWQ of the problem, efforts made to resolve the
problem once identified, and efforts proposed to prevent future problems have all been factors in our
decision regarding enforcement. Upon review and consideration of the information submitted and/or
discussed with DWQ staff, the Winston-Salem Regional Office has determined that a Notice of Deficiency
(NOD) is appropriate and that no further compliance/enforcement actions will be taken by the Division for
the high waste levels occurring between October 2009 and March 2010.
. —In the future,.please continue.to evaluate ways to maintain freeboard levels in the required range.
This may include, but is not limited to, water conservation practices, adding additional application sites,
updating your cropping systems, adding additional and / or more flexible application equipment, and main-

This letter is to follow-up on a compliance inspection conducted by staff of the Division of Water
Quality's Winston-Salem Regional Office (DWQ) on May 12, 2010 at Providence Farm. While
most animal waste management activities were in good order, a violation warrants your immediate
attention.
The Cattle Waste Management Permit issued to Providence Farm requires that an analysis of the
animal waste be conducted within sixty (60) days of application (Permit Section III. 7.). On -site
application records indicate that January 2010 applications did NOT have a corresponding waste
analysis performed within sixty (60) days. Failure to maintain required records is a violation of
NC General Statute 143-215.10C(e)(6) and the Cattle Waste Management Permit. While
DWQ staff noted that there were no cattle at the facility during time of inspection, a waste analysis
is still required within sixty (60) days of an application.
DWQ staff also observed that the waste level in the waste pond was approximately five (5) inches
below the maximum liquid level indicator mark. We strongly recommend that you apply waste
soon to lower the waste level in preparation for fall. DWQ staff also documented that a rain gauge
needs to be re -installed at the facility.

As you recall, staff of the Division of Water Quality performed an announced Compliance Inspection at
your dairy on January 18, 2007. As a result, staff observed that the liquid waste level was two inches above the
maximum elevation on the date of the inspection. While a failure to maintain the waste level below the
maximum is a violation of your Animal Waste Permit, the Division did receive prior notification on your behalf
from Mr. Bill Hurd, leasee of the property, regarding the high waste level stated above. Please respond, in
writing, stating how you propose to bring (or have brought) your operation into compliance with regard to the
volume of animal waste in the storage pond. Your response is to be sent to my attention at the address shown on
this letterhead.
Please be advised that North Carolina General Statutes provide for penalties of up to $25,000 per day
per violation as well as criminal penalties for violations of state environmental laws and regulations. If you have

Tom and I set the two markers today. If you're standing on the push off ramp, they are to
your left. The one closest to the pond is the max. liquid level or begin pump (it's 18"
below the low pt. on the spillway). Tom is suppose to spray paint the top. The other
marker is set at the elevation of the low point in the spillway. In between is a pipe that
sticks up about 4 ft..just to show where the markers are, in case weeds get high. Let me
know if we need to do anything else.
I hope you're doing okay. Call me sometime since you can't seem to email me. Am I the only
NRCS employee that you can't email? Dede .

Dear Mr. Shore:
On February 9, 2005 Melissa Rosebrock of the Division of Water Quality's Winston-Salem Regional
Office (DWQ-WSRO) performed a compliance inspection at your dairy/cheese operation in Stokes County.
While most of the animal waste activities and records appeared to be in acceptable order, there were continued
concerns that warrant your immediate attention and action.
While conducting the onsite inspection, staff observed that the waste storage structure lacked a
permanent waste -level marker as required by the animal waste management permit (Section III.4.a.). Failure to
maintain a "highly visible waste -level gauge" with "readily visible permanent markings" is a violation of
your Certified Animal Waste Management Plan (CAWMP) and Individual Cattle Waste Management
Permit. Our records indicate that you were previously made aware of this deficiency in May 2000 (DWQ
Notice of Violation) and again in January 2004 (Compliance Inspection). It is expected that this marker will
be correctly installed within 30 days of receipt of this Notice. As discussed during the inspection, you may
wish to contact the Stokes County NRCS/SWCD at 336.593.2846 for any technical assistance you may need.
Additionally, Ms. Rosebrock noted there were no records for weekly whey production and daily
precipitation. These are both requirements of your recently issued individual permit. As requested, a form with
which to record freeboard and precipitation is enclosed

Currently, the whey is collected and stored in a 1500 gallon refrigerated storage tank. Due to the

In the near future, the whey will be fed to 25 goats. The whey will be carried to the goats in a
bucket. Remaining whey will be mixed into the total mixed ration that is fed to the cows on the
farm. The goats will be housed in a barn approximately 120 feet from the cheese production
facility.

The WSRO has received and reviewed the individual permit application submitted by
Providence Farm in Stokes County. While most of our concerns regarding the farm's waste
management procedures were addressed in the submitted application, this office has additional
questions that need to be answered by Mr. Shore prior to the issuance of the requested permit:
1) Specifically, Mr. Shore proposes that the whey waste be consumed by an "optimum number of
goats." This office would request that Mr. Shore submit, in writing, Mr. Bruce Shankle's
recommendations for the "necessary number of goats to meet the whey consumption needs." This
office suggests that the number of goats be incorporated as a permit requirement.
Should this new endeavor prove to require a greater number of animals to consume the whey that is
produced, the permit should also allow the State to require that additional animals be maintained.
2) This office suggests that Mr. Shore be required to document that the "necessary number of goats"
be on site prior to the issuance of the requested permit. Further, it is our recommendation that the
permit require Mr. Shore to maintain these goats on the same site as the cheese -making operation.
3) The WSRO recommends that the weekly amount of whey produced be recorded and maintained as
part of the animal waste management records. This should be stated as a permit condition.
4) Since Mr. Shore is proposing a new type of operation and a unique whey disposal method, he may
find that his method for managing the whey waste needs to be revised or changed (number/type of
animals, storage, type of tank, etc.). The WSRO suggests that a permit condition be included that
requires Mr. Shore to submit a written request and receive approval, prior to deviating from the
disposal method proposed in the permit application dated August 17, 2004.

Thank you again for your time during the compliance inspection performed at your dairy
farm on January 29, 2004. During the compliance inspection, you described your plans for
making "Casa Blanco" on -site at the existing dairy. You had several questions regarding
approval and/or permitting by our Division for this type of operation.. The purpose of this letter is'
to address those questions.
As I understand, the cheese will be made in batches using a 50-gallon pasteurizer. The
milk from the dairy cattle is to be piped from the milk parlor to the cheese manufacturing
building. Once pasteurized, the cheese will be removed for packaging and the remaining liquid
whey is to be collected and fed on -site to an undetermined number of swine animals. As of the
date of the inspection, the proposed swine were not yet on -site. The wash water used to clean the
pasteurizer is to be piped to the existing waste storage pond and eventually land -applied at
agronomic rates. In order for the wash water to be discharged into the waste storage pond, you
will need to apply for and obtain an Individual Animal Waste Permit (currently $150 annually).
The specifics described above must also be incorporated into a Waste Utilization Plan (WUP),
including the number of proposed swine, where they are to be located, and the amount of wash
water to be discharged into the waste storage pond.
The whey CANNOT be put in the waste pond, a septic system, or land -applied under an
Individual Animal Waste Permit. By definition, the whey is considered an "industrial waste" If
the whey were to be discharged into the waste storage pond, then all of the liquid in the waste
storage pond would be considered industrial waste. Additionally, if the whey were to be taken
from the farm to a treatment facility you would need to obtain a pump -and -haul "approval letter"
from the DWQ-Winston Salem Regional Office. There is no charge by the Division for this
letter. Alternately, if you chose to land -apply the whey to any owned or leased land you would
need to apply for and obtain a WQ permit with an annual fee of $675.
A copy of the Individual Animal Waste Permit application is attached. Once the
Individual permit is issued, the General permit that you currently have can be rescinded. Should

Dear Mr. Shore;
I have discussed your proposed cheese facility and your waste management situation with
Tommy Burchette, NRCS-Civil Engineering Technician. Since Mr. Burchette did not review or
sign off on the volume calculations of the existing waste storage pond and since he did not
complete the existing waste utilization plan,,he will not be able to provide much assistance. He
did provide the following guidance:
1. As soon as possible, it is imperative that you apply waste from your storage pond in
compliance with your current waste management plan developed by Tom Smith on
December 29, 1997. If you need another copy of this plan, please call our office at 593-
2846. It is recommended that you agitate and apply as soon as land conditions permit.
2. Per Melissa Rosebrock's recent inspection, a gauged marker with maximum liquid level
elevation needs to be installed. We can provide assistance but the storage pond needs to
ba olose'to empty before installation.
3. There should riot be a problem with the outlet pipe from the cheese facility being one foot
higher than the existing parlor pipe outlet as long as the topography will allow.
4. If hogs -are kept`in a part of the cattle barn, we will need to know the number of hogs and
their average weight in order to develop a new waste management plan.
5. Please have your electrical lines marked before installing the new pipe to storage pond.
As stated during site visit, Tom and I will be glad to survey the pipe layout for you. Call
us a couple of days before your backhoe operator will be on site.
Our office is familiar with your operation and developed your. existing waste management plan.
We will assist you with getting your individual permit and will stay in contact with Ms.
Rosebrock throughout this process.

I spoke with Kim Colson and we have decided that Mr. Shore can apply for an
Individual Animal Waste permit, provided that NRCS will "sign -off" on the extra wash
down water going to the existing lagoon and all of the whey is fed (not land
applied). We will require that the amount of washdown water from the cheese facility
be recorded to insure that the waste management system is not overloaded. The
application for the Individual permit is on our website and I have attached it. The
annual fee will not change (same as for the dairy). Let me know if you have any

Hi Melissa,
Basically, the wastewater from cheese (or icecream) processing is considered industrial waste and any
type of system other than trucking it away or getting it into municipal sewer is going to require a permit
from us.
Both options you list below will require the same permit, a WQ wastewater irrigation permit. However,
if he mixes the industrial waste with the animal waste, it all becomes industrial so he may choose to
leave it separate and apply it to separate dedicated fields. I'm attaching a template wastewater irrigation
permit. now this is just a template, and each permit we write is individual so more may be added or
removed. you may see if any staff in WSRO knows of an industrial facility with a WQ permit that you
can look at as a true example. however if its older it may not acurately reflect what we'd require now.

I answered both of these questions for Melissa before her and I both went on
vacation last week. I also played phone tag with the engineer designing the
sand trap and told him what to do in a message.
1. What I told melissa, after conferring with Kim, was that the animal waste
system is deemed permitted now. s soon:, as,n.,,theyputrcheese..itDT,;
2. Actually, this isn't going to look good for us. Now we've told the WSRO
and the engineer/applicant two different things. We have been telling people
that to construct any type of wastewater collection, treatment, storage or
land app. system they should design it, then submit for permit modification
and wait for a new permit before constructing. That is what the statute says,
you can not construct or operate without a permit. And this would protect
everyone, as we would be able to review before construction and catch any
flaws. I told both Melissa and the engineer that we understood the need to
get this done asap and we would review it as soon as it got here. I don't see
that it'll take that long, Michelle has a pretty flexible project schedule and
can bump it up when it gets here.

gone to the County Zoning office for approval and they are calling us.
He is apparently wanting to do this as the rest of the farm is in
financial trouble. As Melissa is out this week I got the inquiry. I
would suggest that if his Waste Management plan is evaluated by a
Technical Specialist and found to have adequate lagoon capacity and land
application capacity then it is possible after they amend his plan. My
only question is whether this stuff needs to be pretreated?
2. Randolph co site owned by Buttke dairy and they want to put in a sand

Melissa,
I visited Mr. Shore this week and I gave him notice of the sewage
violation. He has thirty days to correct it and we talked about how to
come into compliance.
He was very polite and seemed to want to do the "right thing".
I will follow up with him towards the end of June to be certain that he
has made the proper repairs. -
By the way, he mentioned to me that he wants to build a cheese
production facility. I was wondering, can he discharge whey to his
lagoon? The volume will be tremendous relative.to subsurface disposal
standards. The septic I'd design for that flow would be more expensive
than the rest of his operation.

Heather, f Thanks or the update on Mr. Shore's situation. 'He has been. talking
about a cheese making operation for a few years now. Please see the
email below from Sue Homewood in our Non -discharge permitting unit
(which includes animal operations)..
Mr. Shore's best bet if he plans to stay under 100 confined -cattle is to
keep the cheese processing waste separate from his animal waste:..i.e.
not put the cheese waste in the animal waste pond .... and to just permit
the cheese waste.

hi melissa,
i confirmed my thoughts on this one. i was correct. if he starts'a cheese making proms any waste from
that process is industrial wastewater and needs to be permitted.- whether its a subsurface permitted system,
a discharge system, or a non -discharge system. however, he may:want to think very seriously about
keeping the animal waste and cheese making waste very separate: if he wanted to mix the two then we
would regulate/permit it all and if he keeps it separate, and his animal numbers stay below 100 then we
don't have to address the animal waste.

I hate it when I make a mistake .... and I definately made one that has caused some confusion. The date of
COC issuance, as mentioned in the letter, should have been August 13, 1999 not 2001. Mr. Shore then
requested removal in September of 2000. I hope this clears it up for you. I appologize for your

This letter is in response to a request by the Stokes County SWCD to address your recent questions
regarding possible reactivation of your animal waste management system. While general guidelines, procedures,
and requirements are outlined below, we suggest that you contact Division of Water Quality staff for further,
specific guidance.
For facilities such as yours, who have been out of operation for less than four years, whether below
threshold numbers (100 cattle) or who have had no animals on -site the following must first be submitted to the
Division of Water Quality for review:
- A copy of a complete Animal Waste Management Plan Certification.
- A completed Reactivation Request Form (attached).
- Proof of a significant number of animals on -site within the past four years for a period of 45 or
more days within any 12-month period (ex. vet records, market sales for this facility, etc.).
- A completed Operator in Charge Designation Form (attached).

Additionally, you must be able to implement and abide by all conditions of your Certified Animal Waste
Manageme and the Certificate of Coverage for the Animal Waste Management Permit issued to you on
August 13 2001. lease note that, at the time of your last Division of Water Quality routine inspection, several
recordkeep nd maintenance violations needed to be addressed. Additionally, per your Animal Waste Permit,
a maximum liquid marker would also need to be installed. A copy of this inspection report is attached for your
review. In order to avoid possible enforcement action, the violations described above must be corrected
prior to reactivation of the animal waste management system.

Dear Mr. Shore:
Melissa Rosebrock and Jenny Rankin of this Office conducted a site inspection
at your facility on May 11, 2000. Although the liquid waste freeboard level
appeared adequate, there are other areas of the waste collection system that need
immediate attention.
A visual inspection of the waste storage structure revealed that cattle had been
allowed to graze on and around the structure to a point that ruts, gullies, and non -
vegetated areas were becoming apparent on the dam. This practice should cease
immediately. Cattle are to be kept off the dam at all times. Additionally, the use of
machinery/equipment on the dam during wet weather is discouraged since the dam
and waste storage structure is more susceptible to damage during this time. The
damaged sections of the dam need to be graded and re -seeded as soon as possible.
We could not locate a liquid waste marker as well. A marker may exist,
however the vegetation was so overgrown around the waste storage structure that
we were unable to conduct a thorough inspection. Excessive vegetation is a concern
since it can: provide sheltered areas for insects and burrowing animals; interfere
with establishment and maintenance of desirable vegetative cover; hinder visual
inspection of the dam; and impair its structural integrity. We urge you to contact the
Stokes County Field office at (336) 593-2846 for suggestions regarding repair, type
of seed, setting a marker, etc.
Staff also noted that the information in your waste application records was not
complete. Specifically, only form "SLUR- I" was available for 1999. A form
"SLUR-2" should also be completed as well. This form is used to record the total

annual waste application to one field per crop cycle with a slurry or pump and haul system. It
provides for calculating the total nitrogen application to the field and comparing it to the
recommended nitrogen loading rate. Again, please contact the Stokes County Field office for
assistance regarding calculations and record keeping.
In addition, it was noted that a soil sample was not taken for 1999. Waste and soil analysis
records once obtained, must be kept for a minimum of five years. Weekly rain and freeboard
readings should be measured and recorded as well. Failure to have the above components
available and complete is a violation of your Certified Animal Waste Management Plan
(CAWMP). Remember that waste applications should be applied during the time the crop can
utilize the nutrients in the waste. In general, waste should be applied no earlier than 30 days prior
to planting.
