The Division of Water Resources (Division) received your sludge survey information on
February 2, 2016. With the survey results, you requested an extension of the sludge survey
requirement for lagoon #1 at the Edsel Bennett Feeder Pig Farn facility. Due to the amount of
treatment volume available, the Division agrees that a sludge survey is needed by the end of
2019 for this lagoon.
The next sludge survey for the lagoon at this facility should be performed before December 31,

Dear Mrs. Rosebrock,
The sludge survey of waste treatment lagoon (Edsel Bennett Feeder Pig Farm
Facility #85-01) completed late in 2015 showed sludge accumulation at a slow
rate. We concurred in our telephone conversation that Mr. Bennett would
complete the next sludge survey in 2019. Mr. Bennett also had similar results 3
years ago. The annual survey is not needed at this time based on current stocking
levels and past results. Let it be further noted; that Mr. Bennett is exempt of sludge
surveying their waste treatment lagoon until 2019.
Our office is here to assist Mr. Bennett as needed.

Attached is a copy of the sludge survey of my waste treatment lagoon( Edsel
Bennett Feeder Pig Farm Facility #85-01). The survey was completed with
assistance from Tom Smith technical specialist at the Stokes SWCD office. Based
on the measurements and calculation, the average thickness of the sludge layer is
3 feet. This leaves an average liquid treatment zone of 7.5 feet. The liquid
treatment zone is more than twice the required amount. Therefore, the sludge
has accumulated at very slow rate over the past fifteen years. It has only
increased 9 inches since 2007.
I request an exemption from the requirements to conduct a sludge survey
annually. I wish to take a sludge survey again in 3 years as we discussed during
your field visit. I am at this time requesting a concurrence letter from DWQ. If

In order to assure your continued coverage under the State Non -Discharge General Permits, you must submit an apnlication for permit
coverage to the Division. Enclosed you will find a `Request for Certificate of Coverage Facility Currently Covered by an Expiring
State Non -Discharge General Permit.' The application form must be completed and returned by September 3, 2009. Please note, you
must include two (2) copies of your most recent Waste Utilization Plan with the application form.
Failure to request renewal of your coverage under a general permit within the time period specified may result in a civil penalty.
Operation of your facility without coverage under a valid general permit would constitute a violation of NCGS 143-215.1 and could
result in assessments of civil penalties of up to $25,000 per day.

As Animal Waste Technical Specialists, Tom Smith and myself assisted the Edsel Bennett
Feeder Pig Farm (Facility # 85-01) with a sludge survey of his waste treatment lagoon. Based on
our measurements and calculations, the average thickness of the sludge layer 2.75 feet, leaving
an average liquid treatment zone of 8.5 feet. The liquid treatment zone is more than twice the
required amount. Therefore, the sludge is accumulating at a very slow rate over the past ten
years.
Melissa Rosebrock, DWQ Water Quality Specialist has suggested that we request an exemption
from the requirement to conduct a sludge survey annually. Based on the sludge survey findings,
Mr. Bennett is requesting a concurrence letter from the appropriate personnel to conduct sludge
surveys every three to four years. Please advise me or Mr. Bennett of your decision. If you have
questions, please don't hesitate to call me.

On February 6, 2004 Melissa Rosebrock of the Division of Water Quality's Winston-
Salem Regional Office (DWQ-WSRO) performed a compliance, inspection at your swine farm in
Stokes County. While most animal waste operations appeared to be in order, there is a
recordkeeping concern that requires your attention.
Specifically, Ms. Rosebrock noted that a soil analysis had not been obtained for those
fields receiving animal waste in 2003. As discussed during the inspection, failure to have
complete records is a violation of North Carolina General Statute 143-215.10C and your
Animal Waste Management Permit. Please be advised that North Carolina General
Statutes provide for penalties of up to $25,000 per day per violation as well as criminal
penalties for violations of state environmental laws and regulations.
A reminder that a representative Standard Soil and Fertility Analysis, including pH,
copper, and zinc, still needs to be obtained for those fields receiving animal waste during 2004.
-Per the swine waste permit, the results of the soil tests are to be maintained for three years.

your facility on May 3, 2000. Although the waste handling system and other farm
operations appeared in good condition, the record keeping system needs
improvement.
Staff noted that the inf a iF`ott m your waste application re co not

June 24 or October 16, 199 tion dates. In addition, it was noted that oil
sample was not taken to 999. Note that waste and soil analysis records once
obtained, must be kept for a minimum of five years.
Failure to have the above components available and complete is a violation of
your Certified Animal Waste Management Plan (CAWMP). Remember that
waste applications should be applied during the time the crop can utilize the
nutrients in the waste. In general, waste should be applied no earlier than 30 days
prior to planting.

This letter is being sent to clarify the recordkeeping requirement for Plant Available Nitrogen (PAN)
application on fields that are part of your Certified Animal Waste Management Plan.
In order to show that the agronomic loading rates for the crops being grown are not being exceeded, you
must keep records of all sources of nitrogen that are being added to these sites. This would include nitrogen
from all types of animal waste as well as municipal and industrial sludges/residuals, and commercial fertilizers.
Beginning January 1, 2000, all nitrogen sources applied to land receiving animal waste are required to
be kept on the appropriate recordkeeping forms (i.e. IRRI, IRR2, DRYI, DRY2, DRY3, SLURI, SLUR2,
SLDI, and SLD2) and maintained in the facility records for review. The Division of Water Quality (DWQ)
compliance inspectors and Division of Soil and Water operation reviewers will review all recordkeeping during
routine inspections. Facilities not documenting all sources of nitrogen application will be subject to an
appropriate enforcement action.
Please be advised that nothing in this letter should be taken as removing from you the responsibility or
liability for failure to comply with any State Rule, State Statute, Local County Ordinance, or permitting
requirement.
