Wright Farm #79-6 Rockingham County Dear Mr. Wright: ALI 00A NCDENR Division of Water Quality February 19, 2001 On February 16, 2001 Melissa Rosebrock of the Division of Water Quality's Winston-Salem Regional Office performed a compliance inspection at the J.M. Wright Farm. While most farm operations appeared in excellent condition, there are some areas of concern that warrant your Specifically, Ms. Rosebrock noted that slurry and liquid waste applications during 2000 and 2001 were made to receiving crops outside of the application months stated in your Certified Animal Waste Management Plan (CAWMP). Per discussions with the Rockingham County SWCD/NRCS during the inspection, it is our understanding that the CAWMP is to be revised as soon as possible to allow a "range" of appropriate application dates rather than just one to two specific months per cropping cycle. Per your Animal Waste Permit (Section III, #2), a gauged marker indicating the maximum liquid level and the top of the clam (or spillway) is to be installed within 60 days of issuance of the Certificate of Coverage under the general permit. Our records indicate that Certificate of -- Coverage (Animal Waste Permit) was issued February 25, 2000. Per discussion with Staff during the inspection today, you stated that the adjusted marker is to be installed within 30 days. You may also want to contact the Rockingham County SWCD/NRCS for assistance regarding correct placement of the marker. In addition, staff also noted that you were keeping records for waste levels after rain events. Dept. of EHNR JAN 0 5 2000 Winston-Salem Regional Office Subject: Fertilizer Application Recordkeeping Animal Waste Management System Facility Number 79-6 Rockingham County This letter is being sent to clarify the recordkeeping requirement for Plant Available Nitrogen (PAN) application on fields that are part of your Certified Animal Waste Management Plan. In order to show that the agronomic loading rates for the crops being grown are not being exceeded, you must keep records of all sources of nitrogen that are being added to these sites. This would include nitrogen from all types of animal waste as well as municipal and industrial sludges/residuals, and commercial fertilizers. Beginning January 1, 2000, all nitrogen sources applied to land receiving animal waste are required to be kept on the appropriate recordkeeping forms (i.e. IRR1, IRR2, DRY1, DRY2, DRY3, SLURI, SLUR2, SLDI, and SLD2) and maintained in the facility records for review. The Division of Water Quality`(DWQ) compliance inspectors and Division of Soil and Water operation reviewers will review all recordkeeping during routine inspections. Facilities not documenting all sources of nitrogen application will be subject to an appropriate enforcement action. Please be advised that nothing in this letter should be taken as removing from you the responsibility or liability for failure to comply with any State Rule, State Statute, Local County Ordinance, or permitting requirement. Please address the following by December 12, 1999: Please provide a third party applicator agreement for the broadcast portion of the waste stream. 2. Your facility is certified for 150 dairy cows. Information submitted with the application package indicates that there may also be 40 heifers at the facility. The certification number should be the total number of animals contributing to the waste stream at the facility. Please see the enclosed page for amending certifications. Please contact your technical specialist to discuss what may need to be done. I was unable to find the Waste Utilization Agreement (lease agreement) for T1339 Elsie Brown. Please note that all WUP revisions must be signed and dated by both the owner and the technical specialist. Please reference the subject permit application number when providing the requested information. All information should be signed, sealed, and submitted in duplicate to my attention at the address below. The information requested by this letter must be submitted on or before December 12, 1999 or the Division will return your application as incomplete in accordance with 15A N.C.A.C. 2H .0200 and your facility will be considered to be operating without a permit. Please be advised that operation of the subject animal waste management system without a valid permit is a violation of North Carolina General Statute 143-215.1 and will subject you to the enforcement authority of the Environmental Management Commission.
