Hi Mellissa.
We met with Mr. Villapando, on Rumley Rd. and gave him several suggestions. He seems most willing to address the problems.
That you had met with him about.
He has been in the process of moving the manure piles that were near the creek and applying the manure to his pasture.
We suggested sowing the area down with some spring oats, millet and fescue to utilize the nutrients. Also extending the pond drain out of
the pasture.
This should take care of the immediate problem.
We also talked to him and Angela Dobbins is putting together some ideas for a EQIP contract to fence the cattle from the streams and
Provide alternative water sources. Hopefully this will address the concerns for this farm.

Staff from the Winston-Salem, Regional. Office of the Division of Water Quality (WSRO-DWQ) conducted site
investigations on April 18 and 25, 2013 at the farm location referenced above. These investigations were prompted by a
complaint alleging the illegal discharge of animal waste from your property into an unnamed tributary (UT) to Haw River
which Flows through the property. Since the entrance gate was locked on April 18; observations such as denuded stream
banks and stockpiled litter were observed and photographed from outside the property fence.
DWQ staff visited the referenced farm.site again on April 25, 2013 and met with the farm's manager, Mr. Ricardo Uribe.
While most of the pasture areas contain adequate vegetation and exclusion fencing, the area nearest Rumley Road does
not. Mr. Uribe stated that there are waterers in two bams from which the 60 cattle (approximately) can obtain drinking
water. Additionally, we noted that several inches of soil and sand has been deposited beside the tributary during flood
events.
The following water quality concerns were also documented and must be addressed immediately:
1. Sludge worms were seen in the tributary indicating that excess nutrients are present. The unpermitted
discharge of animal waste into waters of the State is a violation of NC General Statute (GS) 143-215.1(a)(6).
The WSRO strongly suggests that cattle be excluded from surface waters and the buffer areas along the UT.
2. Due to excessive cattle traffic, the buffer areas along the UT were completely denuded, increasing the run-off
of sediment and waste into the UT during precipitation events. Permanent vegetation should be established,
and maintained, on all areas along the UT.
3. Stockpiled bedding waste was stored, uncovered, only 75 feet from surface waters. It is strongly
recommended that the bedding waste be land applied as soon as possible and that future bedding waste be
covered; and stored at least 100 feet from surface waters.

Dear Commissioners,
I 'm writing about the recent news (N&O 3/27) that Jordan lake may be about to be
approved as a backup source of drinking water for Chapel Hill, and is already in use as part of
the supply to Cary and Durham.
I wonder whether your office has taken into account what seems to be a heavy discharge of
animal waste into the Haw River several miles upstream of Jordan lake and just above the
Saxapahaw dam.
From the Google Earth web Images there Is visible a huge plume of dark brown/black
material being discharged Into the Haw that seems unmistakably to originate near several
buildings further inshore from the West bank. While this discoloration cannot be seen from
ground level on the accessible East bank, it is starkly visible on the Google Imagery. Whether
It is animal waste cannot be discerned from the image
As a frequenter of both Jordan lake and the Saxapahaw village, I would like to know if this
possible animal waste contamination has been taken into account in the Commission's move
to approve Jordan lake, not only for recreational swimming and limited drinking water
supply (as at present) but for future expanded drinking water use.

Attached are a few photos taken during a site investigation that resulted from the
letter the EMC received from Mr. Paul Green regarding alleged animal waste entering the
Haw River/Jordan Lake. This was initially sent to Danny Smith in RRO, but after
further review it was determined to be in Alamance County in WSRO. As you can see from
Jenny Graznak's summary email below, there is a pile of hay/manure stockpiled on the
property. According to Melissa Rosebrock (APS-WSRO Animal Inspector), this pile may be
too close to the stream and could have the potential to cause runoff during rain
events. Further investigation with this aspect will be conducted. Jenny did not
observe any further issues of concern. WSRO will follow up with the farm owner and
work with them to resolve the stockpile issue. We will also contact Mr. Green and fill
him in on our ongoing investigation.

In response to the complaint received in our office this week regarding a potential
plume of animal waste entering the Haw River via a tributary just above the Saxapahaw
dam -- I visited the area today, April 18, 2013. The property that the complainant was
concerned about appears to be 5551 Rumley Road, Saxapahaw, NC 27253. Owner of the
property is Abel Villapando, according to Alamance County tax records. I was unable to
find a phone number for Mr. Villapando and the gate to the property (as you can see in
the photo) was locked. Therefore, I was unable to enter the property. However, I did
take photos from the entrance/road and you can see those attached. It appears to be a
hobby type of farm. I saw a horse and two cows in pasture. Appeared to be several horse
barns on the property. There was a pile of hay/manure stockpiled that I photographed.
According to Melissa, this pile might be too close to the stream and could be causing
some runoff during rain events. However, I did not see any other issues from the road.
(Note: Melissa said she could send a letter to the owner explaining that the pile
should be moved further away from the stream.)
The stream passes under Rumley Road at the entrance of this property, and did not show
any signs of contamination at the time of my inspection. Photos are attached. No solids
were visible and no odor was detected. However, a dark tint of the water was observed
and looked similar to surface waters with naturally high concentrations of tannins.
Frogs and fish were observed in this trib.
I drove down Shoreline Trail to see the outlet of the trib into Haw River. The water in
the trib is very shallow and rocky. It doesn't transfer well in the attached photos but
you can see a few large rocks poking out from the surface. Also observed a bit of the
dark tint mentioned earlier. No odor detected and in general looked like a beautiful
day on the river.
Also to note: the Alamance County GIS has another aerial photo of this outlet of
concern. Dark color can still be seen but does not look like a "plume."
Let me know if you would like for me to address this issue further.
