In order to meet this directive, a representative of DENR has recently evaluated the inactive lagoon(s) and/or storage pond(s) on your property. Inactive lagoons and storage ponds were defined by the Statute as structures which were previously used to store animal waste but have not received waste for at least one year. The information collected on your property is contained in the attached field data sheets. Using this field data, staff ranked your inactive waste structures as high, medium or low according to its potential risk for polluting surface and/or groundwater. Your waste structure(s) was ranked as follows: Structure Number Surface Area (Acres) Ranking 1 1.32 High This ranking is based in part on the conditions existing on the day of the site visit. Changes in these conditions or the collection and evaluation of additional data may modify the ranking of your waste structure(s) in the future. Information on your facility along with over 1000 others contained in the inventory has been provided to the General Assembly. These include taking appropriate actions to eliminate current discharges, prevent future discharges and to insure the stability of their structures. Staff of the Division of Water Quality will be in contact with owners of all inactive structures that have been determined to pose a serious environmental risk, based on its ranking and/or additional field data collected by the Department. All liquids and waste removed from these structures must be land applied at a rate not to exceed the agronomic needs of the receiving crops. Any major modifications made to the dike walls or structure must be done in accordance with current standards and under the direction of a technical specialist designated for structural design. Your local Soil and Water Conservation District is an excellent source for information and guidance related to proper waste application practices, structure operation and maintenance, and other related animal waste management standards and/or requirements. Nothing in this letter should be taken as removing from you the responsibility and liability for any past or future discharges from your lagoon(s) and/or storage pond(s) or for any violations of surface water or groundwater quality standards. Soil Conservation Service. Following is a list of procedures that I have followed thus far. 1. Pumped all liquids out of lagoon. (July 1999) 2. Applied pumped liquids to adjacent fields. 3. Breeched the dam. (Sept. 1999) 4. Due to hurricane, wet weather has delayed further work until spring 2000. Concerns: 1. The lower pond is fed by a small spring that keeps it full year round. 2. Beaver have built dams and continue to live there. 3. No water from hog houses goes into the lagoon (pipes out). Schedule: April -May 2000, will build ramp into lagoon. June 2000, spread solids on fields after wheat crop has been harvested, July -Aug 2000, close in dam and sow for erosion control. Z 333 044 963 RETURN RECEIPT REQUESTED Mr. Burch Lynch 9123 Harmony rmony Church Road Mebane, N.C. 27302 SUBJECT: Notice of Violation Inactive Animal Waste Storage Evaluation Butch Lynch Farm #01-9001 Alamance County Dear Mr. Lynch The purpose of this letter is to summarize the findings of an inactive swine lagoon evaluation performed by Larry Coble and Melissa Rosebrock on February 16, 2000. Our comments will focus only on the concerns noted as a result of the evaluation. On the date of the evaluation it was found that the lagoon had been breached and that all ol'the liquid waste had flowed through a breached area of the dam into a farm pond directly adjacent and downhill from the drained lagoon. On the date of our evaluation, the farm pond containing the lagoon waste, was overflowing into a small creek. h was also noted that the remaining waste solids had not been removed from the lagoon. An area between the swine houses and lagoon had also been ditched under the drainage pipes, allowing rain and/or wastewater run-off into the lagoon. A roof was missing on one of the swine houses allowing, again, the potential for rain and/or wastewatcr to enter the drained lagoon. Please be advised that the non -permitted discharge of any type of wastewater to the watcrs of the State is illegal as per North Carolina General Statue 143-215.1(a) and could subject you to civil penalties of up to $25,000 per day per violation. This means that you could be subject to this penalty even if the waste storage structure is inactive and/or the farm is below certifiable threshold numbers. In order to correct this situation you should immediately eliminate all sources of additional discharge into the lagoon by filling in the ditched area outside the swine houses and removing the potential for discharge from the pipes. Additionally, our office is aware that you rein the process of closing out the lagoon described above.
