Culpepper Carolina Income Management Group, LLC 1400 Harding Place, Suite 100 Charlotte, North Carolina 28204 RE: Proposed Project, Morrison Plantation Marina Facility, Iredell County Dear Mr. Culpepper: This correspondence is in response to your letter of March 25, 2002 concerning the above referenced marina facility. The North Carolina Wildlife Resources Commission (NCWRC) is authorized to comment and make recommendations which relate to the impacts of this project on fish and wildlife through the Federal License of Water Resource Project Act (Federal Power Act-16 U.S.C. 791a et seq.), and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d). The project will include 40 boat slips, a boat launch platform and a boat ramp. Shoreline stabilization is indicated as part of the project. It is our understanding that these activities are proposed in an area where they are permissible under Duke Power's Shoreline Management Plan. We have previously commented on various phases of this project, including the provision of 50' naturalized buffers. Hopefully, these recommendations have been useful in site planning. The NCWRC will not object to the marina provided the following issues are addressed and/or satisfactorily implemented: 1) Boat slips should not be placed so as to impede or block navigation or create a navigational hazard for recreational vessels or swimmers. We are concerned about the distances between piers and dock structures in this cove. Accordingly, these facilities should be reviewed further by Duke Power Company to ensure compliance with boating safety issues and Federal Energy Regulatory Commission requirements. 2) If dredging is necessary, it should be done by suction dredge or in the dry when lake waters are down. This will minimize sedimentation impacts to the lake. 3) Please note that the NCWRC discourages dredging shallow water areas with productive bottom, wetlands, or submerged aquatic vegetation. We are less concerned with dredging shallow areas having a mud or sand substrate. The contact is Mr. Steve Chapin at 828- 271-7980. Additionally, you should contact Mr. Mike Parker with the NC Division of Water Quality (Mooresville Regional Office) at 704-663-1699 to determine if a 401 Certification may be necessary. 5) Parking lot and driveway stormwater runoff should be conveyed through vegetated buffers instead of piped and discharged into the lake. The use of curb and guttering to convey stormwater is not recommended. The NCWRC encourages the utilization of Duke Power's Fish-Friendly Pier construction practices. We also recommend the establishment of shoreline vegetation for enhanced habitat and shoreline erosion control. We prefer the use of a more "natural" approach to shoreline stabilization. A combination of riprap used to two feet above normal pool elevation (760 contour) with banks sloped back and vegetated with grass, willows or other acceptable vegetation create a more "natural" bank. A filter fabric may be necessary to prevent soil from eroding from behind riprap during high water and/or wave action. Riprap or larger stone should be imbedded 18 inches into the lake bottom to prevent undercutting. All activities must follow Duke Power Excavation Guidelines and any other special conditions specified by the NC Department of Environment and Natural Resources, including buffer requirements. As discussed with you on April 1, 2002, the associated 30" intake pipe will be relocated to the corner of the bulkhead. The pipe and intake screen will be extended as far away from the shoreline as practicable. The pipe should be extended a minimum of five (5) feet; however, more distance from the shoreline is desirable. This should diminish potential aquatic mortality, as this relocation will separate the intake from shoreline habitats and nearby aquatic habitat structures. Signage may be prudent and reasonable if the pipe might interfere with safety and/or navigation. Thank you for the opportunity to comment early during your project planning. The purpose of the project is for an irrigation intake structure. The North Carolina Wildlife Resources Commission (NCWRC) is authorized to comment and make recommendations which relate to the impacts of this project on fish and wildlife through the Federal License of Water Resource Project Act (Federal Power Act-16 U.S.C. 791a et seq.), and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d). This activity will occur on Federal Energy Regulatory Commission Project Number 2232. We have previously commented on this intake facility. We recommend that the intake structure meet conditions previously provided by this office. In addition, the intake pipe should be extended beyond the shoreline by a minimum of five feet (more if possible) to reduce potential impacts to shoreline aquatic species. A copy of our previous letter is enclosed for your review and consideration. Based on our review of the documents submitted, we will not object to the project since the dredging site is shown to be located in an area identified as acceptable for this type of activity on Duke Power Company's "Critical Habitat Inventory" maps. The purpose of the project is to provide irrigation water for Morrison Plantation. The North Carolina Wildlife Resources Commission (NCWRC) is authorized to comment and make recommendations which relate to the impacts of this project on fish and wildlife through the Federal License of Water Resource Project Act (Federal Power Act-16 U.S.C. 791a et seq.), and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d). Your letter indicated that Morrison Plantation intends to install a temporary intake during the first phase of the project, then install a permanent intake during the second phase. The temporary intake will not exceed velocities of 0.48 feet per second. The permanent intake will not exceed velocities of 0.22 fps. Maximum withdrawal is indicated to be 720,000 gallons per day. We previously commented on intake requirements for this project on September 21, 2001. It appears that both the temporary and permanent intakes should be within established aquatic protection limits (based on your letter). Attachments to your recent letter indicate future boat slips, boat ramp facilities, and a seawall. It is important that Morrison Plantation be advised that we do not support seawall structures in the water edge, as they do not provide sufficient habitat. In addition, it is our policy to recommend that private boat docks/ramps mitigate these activities through the establishment of naturalized tree buffers and provision of fish enhancement structures. Based on our review of your February 27, 2002 letter, we will not object to the temporary or permanent intake structures providing the recommendations previously provided by us are followed. Compliance should avoid fish impingement and/or entrainment. Except for the ramp, large rocks should be used from the seawall down to low water lake level elevations to provide continuous habitat. The 50-foot buffer zone should be reforested and naturalized. It should be kept undisturbed for soil stability, edge habitat, and buffer benefits. Duke Power Company Fish-Friendly Pier construction practices should be used for docks and boat slips. Mr. Buz Cobb with Duke Power may be able to advise you about any alternative methods. Please be advised that all lake shoreline activities must follow Catawba buffer rules and any other special conditions specified by the NC Department of Environment and Natural Resources. The purpose of the project will be to provide irrigation water for Morrison Plantation. The North Carolina Wildlife Resources Commission (NCWRC) is authorized to comment and make recommendations which relate to the impacts of this project on fish and wildlife through the Federal License of Water Resource Project Act (Federal Power Act-16 U.S.C. 791a et seq.), the Clean Water Act of 1977, and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d). You are proposing to remove approximately 1850 cubic yards of material from Lake Norman in order to install an 8-inch intake pipe with a 24 inch fish screen (1/4 inch wire mesh) and foot valve. Riprap "interplanted" with emergent grasses will be placed on the affected shoreline area for stabilization and habitat purposes. The maximum withdrawal capacity will be 720,000 gallons per day with a sustained average rate of withdrawal of 288, 000 gallons from April 30 to October 1. The NCWRC has no objection to this project, provided the conditions indicated in your letter and the following recommendations are followed or implemented: 1) Facilities should not be placed so as to impede or block navigation or create a navigational or safety hazard. A pier or floating structure should be considered prior to applying for 404 Permits and 401 Certifications. Submerged devices such as intakes can be dangerous to the boating and swimming public. Appropriate signage should be provided to warn the public of potential hazards. 2) If dredging is necessary, it should be done in the dry when the lake level is low or by suction dredging. This should minimize lake turbidity and sedimentation issues. 3) The NCWRC discourages dredging shallow water areas with productive bottom, wetlands, or submerged aquatic vegetation. The following North Carolina Wildlife Resources Commission guidelines for the construction and operation of water intake structures should be followed: a. Intake structures should utilize passive screens with openings not to exceed 1 centimeter (1 millimeter in waters having anadromous fish) and with a maximum intake velocity of 0.5 fps (feet per second). b. Dredging and lake drawdown in preparation for dredging generally should not take place from March 15 to June 1 to prevent impacts to spawning fish. Dates may vary regionally or be previously established for specific waters. C. Excavated materials should not be stockpiled where sediment will erode to surface waters. d. Intake structures should be marked in a manner that will reduce hazards to navigation during and after construction. e. Wet concrete is toxic to aquatic organisms. Construction procedures that prevent wet concrete from contacting surface waters should be used. We recommend the establishment of native woody shoreline vegetation for enhanced habitat and shoreline erosion control. Excavation activities must follow Duke Power Excavation Guidelines and any other special conditions specified by the NC Department of Environment and Natural Resources. Edmond Kale, III 1400 Harding Place Charlotte, NC, 28204 APPROVAL of 401 Water Quality Certification and Catawba River Buffer Rules with Additional Conditions Dear Mr. Kale: You have our approval, in accordance with the attached conditions, to construct an irrigation intake structure on Lake Norman (Catawba River) in Iredell County, as you described in your application received by the Division of Water Quality on March 20, 2002, and in additional information received April 2, 2002. The project is to include temporary installation of an 8" intake line and pier with minor excavation within the shoreline buffer to install the line. The permanent intake facility will involve placement of a 30" diameter pipe installed at an invert elevation of 750' (10 feet below full pond level). Minor dredging will be necessary to install the permanent intake line. After reviewing your application, we have decided that this work is covered by General Water Quality Certification Number 3373, which can be viewed on our web site at http:Hh2o.enr.state.nc.us/ncwetiands . This Certification allows you to use Regional Permit Number 198200030 when the Corps of Engineers issues it. This approval is also valid for the Catawba River Mainstem and Lake Buffer Protection Rule (15A NCAC 2B .0243). In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 permit expires unless otherwise specified in the General Certification. If you change your project, you must notify us in writing and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and the additional conditions listed below: 1. This survey must clearly indicate the FERC project boundary (i.e. contour elevation), the points of intersection of side lot lines with the project boundary, the designated lot number for each lot having project frontage, and the location, labels and necessary descriptive information for all existing or planned facilities that now or will penetrate the FERC project boundary including, but not limited to, shoreline stabilization for the amenity areas, boatslips, stormwater outfalls, including any associated rip rap, utility line crossings, excavation areas, etc., but not including individual private piers and shoreline stabilization associated therewith. The survey should also include the shoreline classifications according to Duke Power's Shoreline Management Plan (SMP), especially any areas classified as Environmental or Natural Areas. The aquatic habitat including depths and bottom types and areas of emergent vegetation or woody debris. The condition of the existing shoreline including areas of erosion, stabilization and vegetative cover. The survey should also indicate that the applicant is the current owner or lease holder of the property adjoining the project boundary from which the facility will be located. The facility will be developed in two stages. The first phase is a temporary facility which we will develop for use beginning immediately upon approval this year. The facility consists of a single pier for the purpose of extending an irrigation intake line. The intake line will be 8" PVC pipe secured to the underside of the pier. A screen mesh with a maximum opening size not to exceed 1 centimeter will be placed at the end of the line similar to the sketch attached herewith. The actual draw will be monitored and will not exceed 108,000 gallons per day. The maximum velocity of the flow will not exceed 0.48 fps. This facility will be in use until the permanent facility we describe herein is approved and placed in service. The permanent facility will consist of 4' diameter wet well placed above the 760 elevation near the irrigation pump location. A 30" diameter HDPE pipe will be installed at invert elevation 750'. This pipe will run horizontally between the wet well and the new bulkhead as depicted in the attached sketch. The installation of the bulkhead will require dredging approximately 1,900 cubic yards of material. Dredging will not take place between March and June. All work will comply with Duke Power Shoreline Management Guidelines. The maximum capacity of the intake facility is 720,000 gallons 0 per day. The maximum velocity of the permanent facility will be 0.22 fps. Design of the proposed facility has followed the Duke Power Shoreline Management Plan requirements and will be constructed with strict adherence to the Shoreline Management Guidelines. All designated Environmental Areas have been 0 kept from disturbance and no Natural Areas as identified by Duke Power will be disturbed by this activity. No habitat for rare or endangered or important species will be disturbed by this activity. 2. Historic values have been taken into account in the design by researching the b possible existence of archeological and historic sites within the subject property. Although a number of sites were found within the overall property, none in the vicinity of the proposed irrigation intake were considered to be of significance. These findings were recorded in a report titled: "An Archeological Survey of the Proposed Morrison Plantation Development Tract, Mooresville Vicinity, Iredell County, North Carolina" by Thomas Hargrove, January 1999 of Archeological Research Consultants, Inc. Raleigh, North Carolina. 3. Scenic and public recreational values have been protected and/or enhanced in the design of the proposed facility by preservation of the shoreline buffer of existing vegetation to the greatest extent possible. Where clearing for pipe placement occurs, the removed vegetation will be replaced by suitable materials to re- establish the buffer area. Where rip rap is employed for shoreline stabilization, it will be interplanted with emergent vegetation to visually soften its effect and to provide shade/aquatic habitat. The irrigation pump will be within an enclosed structure to screen the mechanical equipment and to abate any noise of operation. The structure will be positioned landward of the shoreline buffer to screen it from views- from the lake. Due to the passive nature of the proposed facility - it's sole 0 purpose will be to withdraw lake water for irrigation- no recreational values currently enjoyed by the public will be compromised. L 0 0 J. Describe what measures will be used to ensure boating safety in the vicinity of the proposal during and after construction activity. (Include any required Navigational 0 Safety Plans with a plan and schedule for installation, maintenance and inspection of the wanting/safety devices, with responsibilities listed and verified by confirmation letters from the responsible entity(s). The following suggestions concerning the promotion of boating safety were provided 0 by Duke Power Lake Management and the Lake Norman Marine Commission. It is the intent of the applicant to implement these measures at the proposed irrigation facility. During Construction: 1. All contractors will be notified of the necessity to exercise extreme caution in their on-water operations, particularly during the boating season. 2. The area of construction limits will be clearly demarcated with buoys, reflectors, and prominent signs advising boaters to keep clear. 3. Any pilings will be prominently marked with buoys or reflectors. After Construction: 1. "No Wake" signs will be prominently displayed prior to the approach to the proposed facility. These signs will be placed on the outside of the proposed pump enclosure structure or at other strategic places where they can be easily seen from the water. 10 2. "No Wake" signs will also be placed on poles in several locations at the entrance to the cove area where the facility is proposed. Amber lights will be placed on the poles for clear identification of the "No Wake" areas and to alert boaters to the need to reduce speed and turbulence- 3. Reflectors will be placed at the ends and sides of any part of the proposed facility b that extends waterward of the 760 foot contour. 4. "No Swimming" and "No Diving" signs will be prominently displayed on any part of the proposed facility that is near enough to the water to attract that type of activity. C I 0 0 K. The magnitude and pattern of the existing boat traffic is minimal as the shoreline is 0 largely undeveloped. Some existing single-family residences with individual piers are encountered on the way to the proposed facility along McCrary Creek. Existing boat traffic associated with these residences is presumably for personal recreation or fishing. There are no areas of attraction such as marine gas facilities, restaurants, and mooring areas currently in existence near the proposed facility. The effect of the proposed irrigation intake line and pump enclosure on existing boat traffic is negligible since no boats are added by the creation of this facility except during construction and at times of periodic examination for maintenance. 0 P ? Where clearing occurs, appropriate vegetation will be planted to re-create the shoreline buffer once construction is completed and the disturbed areas are stabilized. Any dredging below the 760 contour will be conducted after the end of the June fish spawning season. No bottom disturbance in the lake will occur during the months of March, April, May and June. Erosion control fencing will be employed to contain any materials from clearing, grading or construction activities on this site which could impact the reservoir. Any operations below the 760 contour will be isolated by turbidity curtains. The appropriate procedures and inspections required by NCDENR will be strictly adhered to, as will the requirements of the Department of the Army Corps of Engineers under the permit procedures. Uwe agree that reasonable water conservation measures will be implemented during drought conditions. Uwe understand that interbasin transfers do impact the project and that such transfers should be kept to the lowest practical levels. Uwe agree that excavation will not occur during the months of March, April, May and June because of potential impact to fish spawning areas. Uwe understand that trees and vegetation growing below the project boundary play an important role in the overall environmental condition of the lake. The ecological impact the vegetation has on the fish and wildlife habitat is necessary to ensure a sound and healthy lake environment. I/we also understand that unauthorized removal of shoreline vegetation (Le. button bushes, willows, cattails, etc.) and/or disturbance of the shoreline buffer may result in suspension or denial of lake use permitting requests and re- establishment of vegetation, if the disturbance is found to be in violation of the state or county watershed buffer regulations.
