REQUEST FOR MORE INFORMATION
To Mr. Lewis:
On July 7,2009, the Division of Water Quality (DWQ) received your application to remove
sediment and debris from an un-named tributary to Dicks Branch and to perform maintenance on
two culverts located under 1 st and 2nd Street in Calypso, NC. The DWQ has determined that
your application was incomplete and/or provided inaccurate information as discussed below.
The DWQ will require additional information in order to process your application to impact
protected wetlands and/or streams on the subject property. Therefore, unless we receive the
additional information requested below, we will have to move toward denial of your application
as required by 15A NCAC 2H .0506 and will place this project on hold as incomplete until we
receive this additional information. Please provide the following information so that we may
continue to review your project.
Additional Information Requested:
1. In your application, you propose to impact 700 linear feet of perennial stream for this
project. Part B 3 of the application states that the project will remove sediment and
debris for a distance of 175 linear feet up and downstream of 1 st and 2nd Street and
will perform maintenance of the culverts under 1 st and 2nd Street. You also list the
total linear feet of existing stream on the property as 700 linear feet. However, the
drawings submitted with the application do not show impacts to the entire 700 linear
feet. Revise the plan project and drawings as needed.
2. The U. S. Army Corps of Engineers (USACE) contacted the DWQ on August 10,
2009, stating that this project would require authorization under Nationwide Permit
18 as well as Nationwide Permit 3. In addition, the US ACE informed the DWQ that
they would only authorize impacts for replacement of eroded banks and the
stabilization and maintenance of the culverts for this project and not for excavation of
the stream. The DWQ contacted your consultant Jim Blanchard & Associates on
August 10, 2009, by phone to ask for revised plans and a revised application for this
project. This office has not received a reply to that request as ofthe date of this letter.

Please revise project plans and the application as needed to reflect the new permit
requirements and remove the impacts associated with excavation.
Please respond within three weeks of the date of this letter by sending this information to me in
writing and Ian McMillan c/o 401 Wetlands Unit, 2321 Crabtree Blvd, Raleigh, NC 27604-2260.
Ifwe do not hear from you within three weeks, we will assume that you no longer want to pursue
this project and we will consider the project as withdrawn.
This letter only addresses the application review and does not authorize any impacts to wetlands,
waters or protected buffers. Please be aware that any impacts requested within your
application are not authorized (at this time) by the DWQ. Please call me at 910- 796-7215 or
