Per your request for more information dated August 20, 2009, responses to your
requests follow,
1. Please verify that the USACE will be permitting this project under solely
a Nationwide Permit 12, and not a Nationwide Permit 12 and a
Nationwide Permit 39 and/or Nationwide Permit 29.
This project will not create any new residential, commercial, or institutional
development, therefore, only a Nationwide Permit 12 is required for this
project. The project is intended to solve problems with existing septic tanks in
the project area and not provide services for any new development.

2. Please provide a qualitative indirect and cumulative impact analysis for
the project. Please see DWQ's policy for guidance on our web site at:

No indirect or cumulative impacts to water quality are expected by the
proposed project. The project is proposed to improve water quality standards
by redirecting flow from failing septic systems to a central wastewater
collection system,

Undeveloped parcels in Leggett will have access to the proposed project, but
no new development is planned due to this new construction.
3. Please note that your buffer impacts are considered permanent, and not
temporary, by the DWQ.
