Reference is made to your request for rescission of the subject animal waste permit with the
submission of a completed Animal Waste Storage Pond and Lagoon Closure Report Form on
June 18, 2014. Staff from our Regional Office has confirmed that this Coverage is no longer
required. Therefore, in accordance with your request, Certificate of Coverage No. AWC990022
is rescinded, effective immediately.
If, in the future, you wish again to operate an animal waste management system you must first
apply for and receive a new animal waste permit Certificate of Coverage. Operating an animal
waste management system without a valid animal waste permit Certificate of Coverage will
subject the responsible party to a civil penalty of up to $25,000 per day.

This letter is in response to the Notice of Violation received on my farm (Douglas Farms,
#99-22) following Melissa Rosebrock's routine inspection on November 20, 2002. In
reference to the issues which Melissa noted to be violations and causing water quality
problems I plan to work with Yadkin NRCSISWCD and the NC Cooperative Extension
Service and take the following actions:
1) It was indicated that the source of waste causing accumulation of sludge into the
unnamed tributary was coming from a heifer watering area located on the east side of
farm driveway. -
Action: I plan to fence the heifers out of this area and let the area rejuvenate naturally.
2) Silage leachate entering creek
Action: I plan to install a gravel pit (5 ft. -long x 5 ft. deep x 2 ft. wide) and fill with
#57 gravel stone or larger to capture leachate. This pit should allow leachate to settle
and detoxify before entering into a grass filter strip. This plan was derived through
conservation with Melissa Rosebrock approving based on her experience in solving this
type of water quality problem.
3) Cattle having uncontrolled access to surface waters of the state and lack of vegetation
along streambank.
Action: Animals.will be fenced out of areas a minimum of 15 feet to allow
streambank to revegetate naturally. If natural restoration of streambank vegetation
does not occur, a shade tolerant grass mixture will be sown over area.

This letter is to summarize the observations made during a November 20, 2002 compliance inspection
performed by Division of Water Quality (DWQ) staff from the Winston-Salem Regional Office. Mr. Randy
Douglas, certified operator for the farm, was also present during the inspection. While the animal' waste
application records were in excellent order, there are continuing water quality concerns and violations which
warrant your immediate attention and action.
As discussed during the inspection, DWQ staff observed evidence of accumulated sludge in the section
of an unnamed tributary (UT) to Long Branch (class WS-EJ) located on your property. The source of the waste
appears to be from the cattle watering area located on the east side of the farm's driveway. Manure and
sediment from this area appears to be entering the drainage ditch and flowing into the tributary on a frequent
basis. The unpermitted discharge of animal waste into waters of the State is a violation of North Carolina
General Statute (NCGS) 143-215.1 and your Animal Waste Permit.
Additionally, a large amount of silage leachate is entering the creek from ditches located along both
sides of the farm's drive. Leachate is an environmental concern due to the high instream oxygen demand caused
by the decomposition of the nutrient rich liquid in the creek. We encourage your continued cooperation with the
Yadkinville Field Office in determining the best method for keeping the silage waste from entering tributary. Be
advised that the non -permitted discharge of any type of wastewater to the waters of the State is illegal as
per NCGS 143-215.1 and could subject you to civil penalties of up to $25,000 per day, per violation.
A visual inspection of the downstream section of the tributary also revealed that cattle have uncontrolled
access to waters of the State. Staff also observed that the buffer area along the waterway is void of vegetation
due to cattle traffic. Several inches of sediment were observed to have washed into the UT, impacting several
feet of water. Vegetation needs to be established in the buffer area along the UT to help prevent further
sediment run-off.

Individually, or together, the issues described above are affecting the water quality in the UT located on
your farm. These situations allow for a future, probable, water quality violation (fecal, BOD, turbidity,
nutrients, etc.), particularly if conditions deteriorate further. This is of special concern to the State since the
section of stream in question is classified as a "water -supply" by the Environmental Management Commission
(EMC). Note again that, North Carolina law allows for the assessment of up to $25,000 per day, per
violation, for violations of environmental regulations and water quality standards.
A written response is expected within thirty (30) days of receipt of this Notice, indicating the actions
you are taking to correct the noted problems. Your response is to include statements and specific descriptions of
how and when the water quality concerns are to behave been addressed. Please direct your response to my
attention at the address listed on this letterhead.

I am writing this letter in reference to Wettable Acre Determination at Douglas Farms (99-22)
in Yadkin County. Their plan was one of the first that I did in the county and since that time
(Dec. 1997) several changes have been made in rules and regulations. I plan to re -write the
plan using a different format. The farm has more than adequate land to apply the waste
without having to do a wettable acre determination.
If in fact a wettable acre determination still needs to be completed, I will have to wait until
the contract person is back at the farm with all of his equipment. This can be done within
the next five months.
If you could let me know something as soon as possible on this issue, I would greatly
appreciate it.

This letter is being sent to clarify the recordkeeping requirement for Plant Available Nitrogen (PAN)
application on fields that are part of your Certified Animal Waste Management Plan.
In order to show that the agronomic loading rates for the crops being grown are not being exceeded, you
must keep records of all sources of nitrogen that are being added to these sites. This would include nitrogen
from all types of animal waste as well as municipal and industrial sludges/residuals, and commercial fertilizers.
Beginning January 1, 2000, all nitrogen sources applied to land receiving animal waste are required to
be kept on the appropriate recordkeeping forms (i.e. IRR1, 1RR2, DRY1, DRY2, DRY3, SLURI, SLUR2,
SLD1, and SLD2) and maintained in the facility records for review. The Division of Water Quality (DWQ)
compliance inspectors and Division of Soil and Water operation reviewers will review all recordkeeping during
routine inspections. Facilities not documenting all sources of nitrogen application will be subject to an
appropriate enforcement action.

A letter dated January 15, 1999 was sent to advise you about concerns associated with Certified Animal
Waste Management Plans and the method by which the irrigated acres within the plans were calculated. Only
the acres that are wetted can be. credited in the waste management plan as receiving waste application. Any
acreage within the plan that can not be reached by waste application equipment can not be used as part of your
plan.
An evaluation by Rocky Durham on 3/29/99 was made to review the actual number of acres at your
facility that receive animal waste during land application. The evaluation of your facility has yielded one of
the following two results as indicated by the box marked with an "X".
Category 1:
❑ The evaluation of your facility could not be completed due to a lack of information. Please
contact your Technical Specialist to assist in providing Rocky Durham the necessary
information to potentially exempt your facility from undergoing a complete wettable acre
determination. Please submit this information to Rocky Durham, at 585 Waughtown Street,
Winston-Salem, NC.27107, within in 90 days of the receipt of this letter. If you have any

Category 2:
Your facility has been identified by the Department of Environment and Natural Resources
as a facility that may have overestimated the number of acres actually receiving animal
waste. Therefore, some or all of your fields may be exceeding the allowable loading rates
.set in your Certified Animal Waste Management Plan.
In order to resolve this issue, please contact a designated Technical Specialist to have him
or her conduct a Wettable Acre Determination for your facility. The Technical Specialist must
be one that has been approved by the Soil and Water Conservation Commission to conduct
Wettable Acre Determinations. Many Technical Specialist with the N.C. Cooperative Extension
Service, the Soil and Water Conservation Districts, the Natural Resources Conservation
Service, and the Division of Soil and Water Conservation have received this special
designation. You may also contact a private Technical Specialist who has received this
designation, or a Professional Engineer.
All needed modifications to your Animal Waste Management System must be made and
the Wettable Acres Determination Certification must be returned to DWQ within the next
180 days. If the needed modifications are not made and if the form is not returned within the
required time, DWQ will be forced to take appropriate enforcement actions to bring this facility
into compliance. These actions may include civil penalty assessments, permit revocation,
and/or injunctive relief.
Once a Wettable Acre Determination has been completed, a copy of the attached Wettable
Acre Determination Certification must be submitted to the address listed on the form. Please
note that both the owner and the Technical Specialist must sign the certification. A copy of all
the Wettable Acre Determination documentation that applies to your Waste Utilization Plan
must be kept at your facility. DWQ and the Division of Soil & Water Conservation Staff will
review all documentation during their annual visit of your facility. An additional copy must by
kept on file at the local Soil & Water Conservation District Office. Please note that if you install
or modify your irrigation system, a designated Irrigation Specialist or a Professional Engineer
must also sign the Wettable Acre Determination Certification.

North Carolina General Statute 90 A-47.2 requires the owner of each animal waste
management system that serves 250 or more swine, 100 or more confined cattle, 75 or
more horses, 1,000 or more sheep, or 30,000 or more confined poultry with a liquid
animal waste management system, to designate a properly certified operator as the
Operator in Charge (OIC). Our records indicate that the OIC you previously
designated is no longer a certified animal waste management system operator.
As the owner of a registered animal operation with an animal waste management
system, you must designate a certified animal waste management system operator as
the Operator in Charge. Enclosed is an Operator in Charge Designation Form
specifically for your facility. Please return this completed form to this office by
June 12, 1998. Please be advised that nothing in this letter should be taken as
absolving you of the responsibility and liability for any past or future violations for
your failure to designate an appropriate Operator in Charge.

Senate Bill 1217, An Act to Implement Recommendations of the Blue Ribbon Study Commission
on Agricultural Waste, was ratified by the North Carolina General Assembly on June 21, 1996.
This bill required that a properly certified operator be designated as the Operator in Charge for each
animal waste management system that serves 250 or more swine, 100 or more confined cattle, 75 or
more horses, 1,000 or more sheep, or 30,000 or more confined poultry with a liquid animal waste
management system.
The deadline for designating an Operator in Charge for animal waste management systems
involving cattle, horses, sheep, or poultry was January 1, 1997. Because a training and
certification program was not yet available for these systems, you were allowed to apply for and
were issued a temporary animal waste management certificate from the Water Pollution Control
System Operators Certification Commission (WPCSOCC). Because you applied for and were
issued a temporary certificate, you were allowed to be designated as the Operator in Charge of an
animal waste management system.
Your temporary certificate expires December 31, 1997, and is not renewable. Our records indicate
that you have not obtained a permanent animal waste management system operator certification. If
you intend to remain the Operator in Charge of the facility for which you were designated, you must
obtain a permanent animal waste management system operator certification of the appropriate type
before your temporary certification expires on December 31, 1997. To obtain a permanent
certification, you must be 18 years of age, complete ten hours of approved training, and pass an
examination. If you do not intend to remain the Operator in Charge, a properly certified animal
waste management system operator must be designated as Operator in Charge of the facility prior to
the expiration of your temporary certification.
This year's final training program for both Type A and Type B animal waste management systems
is scheduled for December 10 and 11, 1997, at the Hunt Horse Complex in Raleigh. If you would
like information about this training program, please contact your local cooperative extension agent
or call Dee Ann Cooper at 919/515-6968. For those enrolled in this training and registering with
Ms. Cooper prior to December 1, an exam will be offered at the Hunt Horse Complex on December
11, beginning at 1:00 pm.

In addition to the training and testing at the Hunt Horse Complex, examinations for permanent
certification will be offered on December 11, '1997, in Williamston, Kenansville, Raleigh
(Wake Tech), Wentworth, Salisbury and Morganton. This examination date will be the last
opportunity to obtain permanent certification before your temporary certification expires. If you
