Facility No. 99-10 Yadkin County On May 14, an Operation. Review was conducted of Brawley Bros., facility no. 99-10. This Review, undertaken in accordance with G.S. 143-215.100, is one of two visits scheduled for all registered livestock operations during the 1997 calendar year. The Division of Water Quality will conduct a second site inspection. During the Review, it was determined that waste was not being discharged to the waters of the State, and the animal waste collection, treatment, storage and disposal systems were properly maintained and operated under the responsible charge of a designated operator. However, the following management deficiency was discovered and noted for corrective action: failure to install start pumping markers within the pond. This management deficiency needs to be addressed and corrected. You are encouraged to contact your certified technical specialist if additional assistance is needed. During ensuing reviews, this same deficiency will be re-examined to determine if corrective actions were implemented. In order for your facility to remain in compliance with environmental regulations, animal waste can be discharged into the waters of the State, and the animal waste collection, treatment, storage and disposal systems must be properly maintained and gRerated under the responsible charge of a certified operator. Please remember that you are required to obtain and implement an approved animal waste management plan by the end of this year and have a certified operator. The plan must be certified by either a designated technical specialist or a professional engineer. There were 10 heifers and two beef cows (all on pasture) at this farm when I performed their compliance inspection on October 11, 2007. The farm's animal waste operator, Van Brawley, told me during the inspection that they no longer wish or plan to raise confined dairy cattle due to the lack of available farm -help. Van also stated that the Brawley family members have no interest in milking either. He also mentioned that they would need to do some renovations in the milk parlor and they do not want to pursue this. If you'll recall, DWQ has had some previous concerns regarding animal waste management at this facility. A Notice of Violation (NOV) was issued in January 2005 for the run-off of waste from the lot into an unnamed tributary to Harmon Creek. This particular surface water is classified as WS-IV waters of the State. The WS means it's a water supply. In February 2006, DWQ documented that animal waste was applied during the Fall of 2005 onto fields that the operator never planted in small grain, as intended. Our office has listed several other minor record -keeping concerns over the years. While Mr. Brawley has been very pleasant to work with, our concern is that since there is no one regularly on site, that a waste storage or containment problem could occur without someone realizing it for several days. This is especially troubling since the waste storage pond is only feet uphill from the UT to Harmon Creek. Based on the previous waste management concerns and proximity to (water supply) surface waters, this office would heartily support your proposal for closure of the waste storage structure. Director Division of Water Quality On February 14, 2006 staff of the Division of Water Quality's Winston-Salem Regional Office (DWQ- WSRO) performed a compliance inspection at your dairy operation. Most animal waste management activities and record keeping were in good order, however, there is another issue that warrants your attention. Specifically, animal waste was applied during Fall 2005 to several fields that were to be planted in small grain. During the compliance inspection it was documented that, while these fields had an excellent cover of corn residue, they did not have a vegetative cover. On -site animal waste management records indicate that most fields in question received approximately 20 pounds of plant available nitrogen (PAN) per acre. The amount of PAN applied to each field in question must, therefore, be deducted from the allowable PAN for the next crop (i.e. corn). Failure to maintain a vegetative cover on all land application fields and buffers in accordance with the Certified Animal Waste Management Plan (CAWMP) is a violation of the Cattle Waste Operation General Permit (Section H. #2). Future cropping systems should be managed so that adequate land application sites are available at all times. Please be advised that North Carolina General Statutes provide for penalties of up to $25,000 per day per violation as well as criminal penalties for violations of state environmental laws and regulations. We built a basin to catch the runoff from the lot. The basin is built from silo staves with a concrete bottom. The basin is three feet deep and about six feet in diameter. From this point an agricultural sump pump forces the runoff of water to another sectia, of the lot. This releases it to run to the waste storage pond. Brawley: On November 23, 2004 Melissa Rosebrock of the Division of Water Quality's Winston- Salem Regional Office (DWQ-WSRO) performed a compliance inspection at your dairy farm on Brawley Road. Certified operator, Mr. Van Brawley, was also present during the inspection. While most all animal waste activities and records appeared to be in excellent order, there were other concerns that warrant your immediate attention and action. A copy of the inspection is attached for your review. While conducting the onsite inspection, staff observed several gallons per minute of waste -containing -surface -water washing from the low end of the concrete lot near the silo. Since it was raining on the date of the inspection, the waste continued washing down the hill and into an unnamed tributary (UT) to Harmon Creek (Class WS IV waters of the State). It was also noted that a berm to contain the waste was not in place in this particular section of the lot. Failure to acquire a permit prior to making an outlet to waters of the State or to cause or permit any waste to be discharged to waters of the State is a violation of NCGS 143-215.1 and your animal waste permit. As discussed during the inspection, the animal waste was to be contained immediately with temporary measures. You may wish to contact the Yadkin County NRCS/SWCD or the Cooperative Extension Service for technical assistance regarding this matter. Please respond, in writing, within 10 (ten) days stating how you propose to eliminate the potential for this type of unpermitted discharge in the future. In order to show that the agronomic loading rates for the crops being grown are not being exceeded, you must keep records of all sources of nitrogen that are being added to these sites. This would include nitrogen from all types of animal waste as well as municipal and industrial sludges/residuals, and commercial fertilizers. Beginning January 1, 2000, all nitrogen sources applied to Iand receiving animal waste are required to be kept on the appropriate recordkeeping'forms (i.e. IRRI, 1RR2, DRY1, DRY2, DRY3, SLUR1, SLUR2, SLDI, and SLD2) and maintained in the facility records for review.
