Sidden 9528 Longbottom Road Traphill, NC 28685 Subject: NOTICE OF DEFICIENCY Potential Stream Standard Violations: NOD-2012-SS-0002 Facility No. 97-37, Permit No. AWD970037 Parcel ID #3975-99-4281, Wilkes County Dear Mr. and Mrs. Sidden: Dee Freeman Secretary As you recall, on June 11, 2012 Melissa Rosebrock and Patrick Mitchell, of the State's Division of Water Quality (Division) Winston-Salem Regional Office, conducted a site visit at the above referenced parcel located on Longbottom Road. This visit was the result of a complaint received by our office alleging that cattle activity in and around the stream flowing through your property was causing a water quality problem. At the time of our investigation, the Division observed that at least 60-80 beef cattle had access to Harris Creek. This particular section of water is a Class C; Tr (Trout); HQW (High Quality Water) stream located within the Yadkin -Pee Dee River Basin. Surface Water Classifications are designations applied to surface water bodies, such as streams, rivers and lakes, which define the best uses to be protected within these waters (for example swimming, fishing, drinking water supply, etc.) and carry with them an associated set of water quality standards to protect those uses. "Tr" is a supplemental classification intended to protect freshwaters which have conditions which shall sustain and allow for trout propagation and survival of stocked trout on a year-round basis. "HQW" is an additional supplemental classification intended to protect waters which are rated excellent based on biological and physical/chemical characteristics through Division monitoring or special studies, primary nursery areas designated by the Marine Fisheries Commission, and other functional nursery areas designated by the Marine Fisheries Commission. As a result of the complaint investigation the following stream standard deficiencies are documented: Potential Fecal Coliform and PH Violations The upstream fecal coliform result of 200 colonies1100 mL was equal to the State's water quality standard of 200 colonies/100 mL while downstream results of 1,120 and 1,200 colonies/100 mL indicate that excessive cattle activity in and around the stream is impacting Harris Creek. Given that the fecal coliform level is already elevated downstream of the cattle, there is the possibility of future civil penalty assessments should the Division obtain a required total of five samples within 30 days that result in a geometric mean greater than 200 colonies/100 ml. Stream samples were also obtained during the investigation and analyzed for dissolved oxygen (DO), pH, specific conductance, nutrient levels, and biochemical oxygen demand (BOD). There are currently no State water quality standards for specific conductance, nutrients, or BOD. Our findings indicate no violations of the State's water quality standard for DO. Please note however, that the downstream pH was only 5.95 (above the bridge) and 5.38 below the cattle. The NC water quality standards specify that the pH in this stream be between 6.0 and 9.0. There is the possibility for future violations of the pH standard as well if conditions are allowed to continue. Requested Resl2onse Per your request, the Division has afforded you time to make some cattle management changes (i.e. how the cattle are to be excluded from the surface water). Our office, therefore, requests that you respond in writing within thirty (30) days of receipt of this Notice describing how the water quality concerns have been addressed. We anticipate that adequate permanent vegetation has been established in the buffer area along the stream to help prevent run-off of sediment and animal waste. It is also our expectation that all cattle have been excluded from the stream and that an alternate water source has been provided for their use. Please note that these and any future violations are subject to a civil penalty assessment of up to $25,000 per day for each violation. We counted 60-80 beef cattle that had access to Harris Creek (C;Tr;HQW). Mr. Sidden stated 51 were in the pastures located on both sides of Longbottom Road. His son, Roger Sidden, owns the cattle. Cattle are located on parcel #2101393 (PIN 3975-99-4281 ) located at 9528 Longbottom Rd. and owned by Claude R. and Billie A. Sidden. His wife's email is billiejack@wilkes.not. We observed algae, organic matter, and a slight odor in the stream. Photos and samples were obtained. Fecal Coliform: Upstream=200 Above bridge=1,120 pH=5.95 Downstream=1,200 pH=5.38 No violations of DO standard. Spoke to Mr. and Mrs. Sidden prior to sampling and agreed to afford them time to construct additional fencing to exclude cattle and to re -vegetate stream embankments. A couple of wires had been strung but were not adequate. Sidden's are working with Wilkes County NRCSISWCD.
