Barry Greer and Bryan Colvard were present from the Wilkes County Field Office. Mr. Harris' son, Jeff Harris, was also present. Cattle numbers have been reduced and all cattle appear to be excluded from surface waters. Those pastures/paddocks where fencing is not yet installed will not contain cattle until the fencing has been installed. Fecal coliform samples taken and sent for analysis. Upstream result= 1200 col/1 00 mL. and Downstream result=280 col/1 00 mL. No pH, DO or turbidity samples taken ---could still be violations of these parameters. 3. Buffers and vegetation need to be established in all paddocks/pastures to help control run-off of sediment and manure from surface waters. In particular: "Alley -way" - Keep cattle out. Owner plans to cut trees and establish vegetation. May need silt fencing at bottom of slope. Graze grass down no shorter than 4". On the wooded side of drive (on left as you are coming in) owner has agreed to install fence to keep cattle out of surface water branch. To be completed prior to allowing cattle in this area. "Cut -through" - Need to establish AND maintain grass on hill. Seed with combination of fescue and small grain (rye). Need to also move existing single strand wire back about 50-60 feet from the stream and about 25 feet from the draw. Mr. Harris stated that this could be completed by October 31, 2011. "Sewer line areas" - Areas below Damascus Ch. Rd., new dirt road, etc. Will need to have vegetation established AND maintained. This is to be completed within 30 days of the sewer line completion and contractors out. DWO staff has been in contact with city and county officials regarding deficiencies with sewer project. These are the stub -outs for the existing homes that will be tied to the new sewer line. There are 71 possible hookups to this system and of that total 34 homes had failing systems, 10 had no systems and about an additional 15 with gray water discharges. There are brass caps on top of the PVC pipes to allow them to be located by metal detector when they were covered up. He also noted that the intent is to move the cleanouts for those taps to the edge of the R-O-W. Kelly indicated that he planned to meet you guys there tomorrow along with other staff. They have a 5% hold back of funds to encourage the contractor to finish the site stabilization. Excessive cattle activity in and uphill of the unnamed tributary to Little Cub Creek (Class C waters) has resulted in impact to over 2,100 feet of stream. Sludge worms, clumps of sludgelorganic matter and waste odor were observed in the surface water. The land where the cattle are being maintained is completely denuded. Due to the slope and lack of vegetation, the stream contains up to 10 inches of eroded sediment. Stream banks are severely eroded. Extensive construction was occuring around the stream as N. Wilkesboro is installing sewer lines. Sediment basins and silt fencing was observed and appeared to be installed correctly in the areas where we sampled. DWQ has been in contact by phone with the Wilkes Co. SWCDINRCS office and the violator regarding our observations and the need to reduce the cattle population and establish vegetation. NOD (deficiency) for more than 100 confined cattle (due to lack of pasture cover) without a permit. Stream samples were taken and analyzed. Partial results received July 5, 2011. Upstream fecal coliform was 1,500 CFU1100 mL while the downstream samples were >60,000 and 58,000. Limit is 200 CFU1100rnL--NOV Upstream tubidity was 7.6 NTU and the downstream was up to 390 NTU. This visit was the result of a complaint received by our office alleging the run-off of cattle manure and sediment from your property into waters of the State. The surface water in question is an unnamed tributary (UT) to Little Cub Creek, which is a Class C water located within the Yadkin River Basin. Our site investigation confirmed that approximately 185 beef cattle are/were being maintained on the property resulting in severely denuded pastures and the run-off of sediment and animal waste into the stream. Additionally, at least 2,100 linear feet of stream is impacted due to excessive animal activity in and around the tributary. As a consequence of the complaint investigation the following violations are documented: Item I. Permit Violation On June 16, 2011, staff observed at least 185 beef cattle being maintained on a feedlot located at the above address. July 27, 2011 Page 2 of 3 Per NCGS 143-215.1 OB and 143-215.10C, any agricultural farming activity involving 100 or more confined cattle is considered an "animal operation" requiring application for coverage under an Animal Waste Operation General Permit. Our records indicate that you have not yet applied for the required permit. Item 11. Stream Standard Violations Stream samples were also obtained and analyzed for dissolved oxygen (DO), pH, specific conductance, nutrient levels, biochemical oxygen demand (BOD), fecal coliform and turbidity. While there is currently no state water quality standard for specific conductance, nutrients, or BOD the attached results also indicate that there were no violations of the State's water quality standard for DO or pH, While there were no DO and pH violations on the date of our complaint investigation, there is certainly the potential for a violation if conditions further deteriorate. Although the upstream fecal coliform result of 1500 colonies1100 ml is greater than the State's water quality standard, the downstream findings of 58,000 and >60,000 clearly indicate that excessive cattle activity in and around the stream is impacting surface waters. Given that the fecal coliform levels are elevated at two locations downstream of the cattle, there is the possibilty for future civil penalty assessments should staff obtain a required total of five samples within the next 30 days that result in a geometric mean greater than 200 colonies/100 ml. Requested Response and Corrective Actions Upon receipt of this letter, you have sixty (60) days to submit the attached "State Application for New or Expanding Animal Waste Operations" and all supporting documentation. Please note that the application is to be completed using information from a Certified Animal Waste Management Plan (CAWMP). Once the application has been completed and signed, the original and two copies of the application must be returned (along with three copies of the entire CAWMP) to the Division. The Wilkes County NRCSISWCD Field Office staff can assist you in developing a CAWMP. Their office number is (336) 838-3622. Be aware that operation of your facility (in its current condition) without coverage under a valid general permit could result in assessments of civil penalties of up to $25,000 per day. Since "true" pastures are not considered feedlots according to the statutes, you may, as an alternative, install and maintain conservation practices that will re-establish the vegetation in the current feedlot(s). if you wish to pursue this option, we urge your continued cooperation with Mr. Barry Greer in the Wilkes County NRCSISWCD Field Office to implement the required practices. At minimum, cattle should be excluded from the stream and vegetation established in the buffer area along the stream to prevent further run-off of sediment and animal waste. The Winston-Salem Regional Office requests that you respond in writing, within thirty (30) days, regarding the permit violation described above, including whether you intend to apply for a permit. Your response should also contain a plan and specific descriptions detailing how and when the stream standard violations are to be addressed.
