You are hereby notified that Locust Knob Farm, in accordance with G.S. 143-215.1 OC, must apply for coverage
under an Animal Waste Operation General Permit. Upon receipt of this letter, your farm has sixty (0) days to submit the
attached application and all supporting documentation. In accordance with Chapter 626 of 1995 Session Laws (Regular
Session 1996), Section 19(c)(2), any owner or operator who fails to submit an application by the date specified by the
Department SHALL NOT OPERATE the animal waste system after the specified date. Your application must be
returned within sixty (60) days of receipt of this letter. Failure to submit the application as required may also subject your
facility to a civil penalty and other enforcement actions for each day the facility is operated following the due date of the
application.
The attached application has been partially completed using information listed in your Animal Waste Management
Plan Certification Form. If any of the general or operation information listed is incorrect please make corrections as noted on
the application before returning the application package. The signed original application. one copy of the sinned application,
two copies of a general location map, and vivo copies of the Certified Animal Waste Management Plan must be returned to
complete the application package. The completed package should be sent to the following address:

Hi Melissa,
i think i'll send the application. maybe it will push him in these last
issues. you can let him know that it'll be coming.in the next week or
so and he'll have 60 days to send in application and you expect these
last few things done by then. that he will not "qualify" for a permit
until they're done and without a permit, he can't operate.

Hey Sue,
This operation still needs to mow vegetation on their dam and revise their CAWMP to include irrigation.
He had a couple of other minor repairs to make (fence cattle off dam; establish more vegetation on
pasture/spray field; repair fencing at creek; repair burrow holes; apply stockpiled poultry litter), but those
above were the biggies. I've called SWCD and the owner/operator to see where he's at in these issues. I'll
let you know if it's any different than I've described. As to whether to send a permit application? I don't
know. Maybe we should send one and make them conditions for approval?, You would know more about
how that would work than I would. Thanks for checking. Melissa

Senate Bill 1217, An Act to Implement Recommendations of the Blue Ribbon Study Commission on Agricultural
Waste, was enacted by the 1996 North Carolina General Assembly. This legislation requires owner of a certified
operator for each animal waste management system that serves 250 or more swine, 100 or more confined cattle,
75 or more horses, 1,000 or more sheep, or 30,000 or more confined poultry with a liquid waste management
system.
Our records indicate that the operator designated as the Operator In Charge (OIC) for your animal waste
management system is no longer certified. Therefore, you must designate a properly certified animal waste
management system operator as the OIC for your facility. The enclosed designation form must be returned to this
office by April 1, 2001. This office maintains a list of certified operators in your area if you need assistance in
locating a certified operator.
Failure to designate a properly certified Operator in Charge for your facility is a violation of N.C.G.S. 90A-47.2
and 15A NCAC 8F .0201(a) and may result in the initiation of enforcement action. Please be advised that nothing
in this letter should be taken as resolving you of the responsibility and liability for any past or future violations for
your failure to have a properly certified Operator in Charge designated for your animal waste management system.

The attached list of animal operations in the WSRO has been evaluated for proposed
coverage under the General Permits for Animal Operations. Our evaluation included a review
of all inspection and correspondence records contained in our files for each operation. Verbal
confirmation was also made with respective SWCD and NRCS personnel.
It is our recommendation that animal operations on the attached list, with the exception
of "Locust Knob Farm" #97-26 be sent an application for the General Permit. A compliance
inspection was performed August 3, 2000 on farm #97-26. We noted at that time that
maintenance needed to be performed on the waste storage pond dam and curbing near the
push -off ramp. Once these issues are -addressed, this office sees no reason why this facility
should not be permitted as well. Please note that the correct address for the Locust Knob
Farm, owned by Jason G. Payne is 2296 N. Lomax Rd., Traphill, NC, 28685. The phone
number is 336.9.57.8204.

Please review the enclosed list. The review of this list will be your only opportunity to comment
on these facilities. Please indicate which facilities should not receive a general permit
application, by checking the appropriate box. Please provide a brief description of why you
prefer not sending an application for a general permit to the facilities at this time. In addition,
please inform us of any special conditions or circumstances that we should be aware of during
our review of any of these facilities.
We intend to mail the applications during the week of September 11, 2000. Please return the
completed list with or without any comments, to my attention by September 1, 2000. Thank you

Each approved facility will be given written notice via certified mail. The notice will include a
copy of the aform and forand a deadline 'for response. The facility must respond within sixty

The Division of Water Quality (DWQ) has received your request for reactivation of your dairy
facility in Wilkes County; facility number 97-26. According to the previous Animal Waste
Management Plan Certification submitted for this facility, DWQ has reactivated this facility for a 200
dairy operation. If you choose to increase your herd size please recertify the facility for the number
you plan to have on -site. Your facility number will continue to be 97-26. Please reference this facility
number on all correspondence with DWQ regarding this operation. This letter serves as an
acknowledgement that facility 97-26 can restock.
As of January 1, 1997 all owners of animal operations with animal waste management
systems had to designate an Operator in Charge. A training and certification program for
operators of animal waste management systems is available. Please contact your local county
extension agent for training dates and times. As the owner of an animal operation with an animal
waste management system, you must designate an Operator in Charge and must submit the
enclosed designation form to the WPCSOCC. If you do not intend to operate your animal waste
management system yourself, you must designate an employee or engage a contract operator to
be the Operator in Charge. The person designated as the Operator in Charge, whether you or
another person, must sign the enclosed application form.

During the 1999 session, the North Carolina General Assembly passed a law directing the North
Carolina Department of Environment of Natural Resources (DENR) to develop an inventory and
ranking of all inactive lagoons and storage ponds in the State. In order to meet this directive, a
representative of DENR has recently evaluated the inactive lagoon(s) and/or storage pond(s) on your
property. Inactive lagoons and storage ponds were defined by the Statute as structures which were
previously used to store animal waste but have not received waste for at least one year.
The information collected on your property is contained in the attached field data sheets. Using
this field data, staff ranked your inactive waste structures as high, medium or low according to its
potential risk for polluting surface and/or groundwater. Your waste structure(s) was ranked as
follows:

these conditions or the collection and evaluation of additional data may modify the ranking of your

Information on your facility along with over 1000 others contained in the inventory has been
provided to the General Assembly. During this year's session, the General Assembly will consider
additional requirements for future management of these structures which may include requiring
proper closure of inactive lagoons and storage ponds according to current or alternative standards.

Regardless of their ranking, owners of all waste lagoons and storage ponds have certain
management responsibilities. These include taking appropriate actions to eliminate current
discharges, prevent future discharges and to insure the stability of their structures. Staff of the
Division of Water Quality will be in contact with owners of all inactive structures that have been
determined to pose a serious environmental risk, based on its ranking and/or additional field data
collected by the Department.
All liquids and waste removed from these structures must be land applied at a rate not to exceed
the agronomic needs of the receiving crops. Any major modifications made to the dike wails or
structure must be done in accordance with current standards and under the direction of a technical
specialist designated for structural design. Your local Soil and Water Conservation District is an
excellent source for information and guidance related to proper waste application practices, structure
operation and maintenance, .and other related animal waste management standards and/or
requirements.
Nothing in this letter should be taken as removing from you the responsibility and liability for
any past or future discharges from your lagoon(s) and/or storage pond(s) or for any violations of
surface water or groundwater quality standards.
Thank you for your cooperation and assistance in this process. If you have questions concerning
your inactive structures, please contact the staff of either in the Division of Water Quality or the
Division of Soil and Water Conservation in the Winston-Salem Regional Office at (336) 771-4600.

This is to acknowledge receipt of your request that your facility no longer be registered as an animal waste
management system per the terms of 15A NCAC 2H .0217. The information you provided us indicated that your
operation's animal population does not exceed the number set forth by 15A NCAC 2H .0217, and therefore does not
require registration for a certified animal waste management plan.
Under 15A NCAC 2H .0217, your facility is deemed permitted if waste is properly managed and does not
reach the surface waters of the state. Any system determined to have an adverse impact on water quality may be
required to obtain a waste management plan or an individual permit. You are reminded that a discharge of wastes to
the surface waters of the state will subject you to a civil penalty up to $10,000 per day.
Should you decide to increase the number of animals housed at your facility beyond the threshold limits
listed below, you will be required to receive approval from the Division of Water Quality prior to stocking animals
to that level. Threshold numbers of animals are as follows:

You were notified by letter dated December 5, 1996, that you were required to designate a certified animal waste
management system operator as Operator in Charge for the subject facility by January 1, 1997. Enclosed with that
letter was an Operator in Charge Designation Form specifically for your facility, Instructions for Completing
Application for Temporary Certification as an Animal Waste Management System Operator, and an Application for
Temporary Certification as an Animal Waste Management System Operator. Our records indicate that these
completed Forms have not yet been returned to our office.
As was explained in the previous letter, a training and certification program is not yet available for animal waste
management systems involving cattle, horses, sheep, or poultry (with a liquid waste system). Therefore owners of
these systems were allowed to request that they be issued temporary certifications until December 31, 1997. All that
was required to receive this temporary certification was the completion of the Application Form.
For you convenience, we are sending you additional copies of the Operator in Charge Designation Form specifically
for your facility, Instructions for Completing Application for Temporary Certification as an Animal Waste
Management System Operator, and an Application for Temporary Certification as an Animal Waste Management
System Operator. Please return this completed Form to this office as soon as possible but in no case later than April
25, 1997. This office maintains a list of certified operators in your area if you need assistance in locating a certified
operator.
Please note that failure to designate an Operator in Charge of your animal waste management system, is a violation
of N.C.G.S. 90A-47.2 and you will be assessed a civil penalty unless an appropriately certified operator is designated.
Please be advised that nothing in this letter should be taken as absolving you of the responsibility and liability for
any past or future violations for your failure to designate an appropriate Operator in Charge by January 1, 1997.
