WNW North Carolina Department of Environment and Natural Resources Division of Water Quality Beverly Eaves Perdue Coleen H..Sullins Governor Director June 19, 2009 Mr. Randy Wood RJW Farms 3723 South Center Church Road Thurmond, NC 28683 SUBJECT: Notice of Deficiency - Complaint Investigation NOV-2009-SS-0027, Permit numberfAWD97003436 r,Wilkes-_County, Dear Mr, Wood, Dee Freeman Secretary As you know, Division of Water Quality (DWQ) staff from the Winston-Salem Regional Office visited your livestock facility on June 9, 2009 in response to a complaint alleging violations of the State's permitted animal threshold level and water quality concerns due to cattle traffic in and around Elkin Creek. This letter is to summarize the water quality concerns noted during our investigation, Staff took photographs of the stream, including the two sample sites, and collected stream samples for the analysis of dissolved oxygen (DO), pH, specific conductance, and fecal coliform. Laboratory findings for the downstream sample conclude that the fecal coliform bacteria concentration was 3800 colonies1100mL while the upstream concentration was 130 coloniesl100mL. Please be aware that the downstream result exceeds the current North Carolina water quality standard of 200 coloniesl100mL (maximum) and increases the likelihood for future violations of the fecal coliform standard. There were no violations of the State's water quality standard for DO or pH. Note that there is currently no water quality standard for specific conductance. The section of Elkin Creek in question is classified as WS-II HQW (high quality) waters of the State. NC Administrative Codes require that this section of the stream be protected for secondary recreation, fishing, aquatic life including propagation and survival, and wildlife. The WS-Il classification also means that the stream is to be protected as a water supply and that control of non -point sources and stormwater pollution shall be required. Therefore, to avoid further action by this office, the Division strongly recommends that vegetated buffers be established along the stream and that cattle be excluded from these areas as soon as possible. We urge you to contact the Wilkes County Soil and Water Conservation District/Natural Resources Conservation Service office at (336) 838-3622 for any technical and/or financial assistance you may need in implementing these measures. The Division requests that you respond in writing to this office within thirty (30) days of receipt of this Notice to •tthe address contained in this letterhead. Any system determined to have an adverse impact on water quality may be required to obtain a waste management plan or an individual permit.
