Box 650 Blowing Rock, NC 28605 SUBJECT: Site Visit — Blowing Rock Equestrian Preserve Facility No. 95-0008 Watauga County To whom this may concern: This letter is a follow-up to a site visit made to the Blowing Rock Equestrian Preserve located at 1500 Laurel Lane, Blowing Rock on May 22, 2013 by Division of Water Quality (DWQ) staff members Mr. Patrick Mitchell and Ms. Melissa Rosebrock from the Winston-Salem Regional Office. This site visit occurred as a result of two separate . complaint investigations conducted within the last 12 months concerning horse manure and bedding material mix, reportedly received from the Blowing Rock Equestrian Preserve, being stock piled improperly. Present for the site visit was Mr, J.C. Shore and Ms. Ladonna Shore (Blowing Rock Equestrian Preserve representatives). The purpose of this site visit was to determine the following: 1. If the facility meets the criteria found within NC General Statute 143-215. 10B, and 1OC., which requires'facilities with 75 or greater horses confined on a lot (i.e. a lot or building, or combination of lots and buildings intended for holding horses in which animal waste may accumulate or where established vegetative cover cannot be maintained), that are confined for 45 individual days or more (which may or may not be consecutive) within a 12-month period to obtain an individual permit or general permit from the State of North Carolina. Through discussions with the onsite representatives it was determined that at this time the facility does not meet the above listed criteria requiring a permit. Should you decide to modify future facility activities to include additional events or increased number of resident/weekend horses held at the facility, please contact DWQ to obtain the required permit. 2. If animal waste (horse manure and _bedding mix) is disposed of properly. Through discussions with the onsite representatives it appears that the facility is giving away or distributing animal waste gcnerated at the facility, and is not land applying or storing the waste onsite. Please also be aware of the following requirements related to distribution and land application of animal waste contained within NC Administrative Code 02T .1403(a): Persons accepting or purchasing animal waste at a rate of 100 tons or less per year must apply the waste at no greater than agronomic rates; and maintain a setback of at least 25 feet from a perennial stream or waterbody. In addition to the previously listed requirements, persons accepting or purchasing over 100 tons of animal waste per year must also do the following: register with DWQ prior to accepting or purchasing the manure; animal waste shall not be stockpiled within 100 feet of a perennial stream or waterbody; animal waste shall not be stockpiled uncovered for greater than 15 days; along with the other requirements contained within section .1403(a)(2). This office recommends that you inform future persons accepting or purchasing animal waste generated from your facility of these requirements to minimize future complaints and any potential violations. The site visit occurred as result of two separate anonymous complaints (October 2012 and May 2013) received by DWQ concerning improper placement of horse manure stockpiles and potential impact to surface waters on two seperate properties. The horse manure and bedding mix for each of these investigation sites was reportedly received from Blowing Rock Equestrian Preserve. The site visit revealed the following details: No horse manure stockpiles were observed onsite during visit. DWQ discussed concerns of proper use, storage, and distribution of animal waste with the onsite facility representatives. The confined (e.g. horses held in stalls or on non -vegetated lots) threshold number of horses in a given year was also discussed with representatives. It was indicated by representatives that the facility does not have 75 or greater confined horses for 45 individual days in any given year. Director October 31, 2012 SUBJECT: Animal Waste Stockpile Complaint Dear Mr. Rich: Nov D 2 2012 Dee FreeW,n.5a1em SecrrW15i r'al Office This letter is a follow up to -my complaint investigation conducted October 18, 2012. 1 would like to clarify some points regarding our Rules (North Carolina Administrative Code Title 15A Subchapter 2T) that address the storage and hauling of animal manure. Specifically, rule Section .1400 - Manure Hauler Operations. Manure haulers must register with the Division of Water Quality if they accept and land apply over 100 tons of manure. If they deliver the manure to a land owner for'land application, then the land owner becomes a hauler since he is actually accepting and land applying the waste. In this case, your family would be the manure hauler. If you land apply over 100 tons of manure (any animal source including chicken litter/horse manure, etc.) in a year, you must cover any stockpiles within 15 days. The size of each individual stockpile does not matter as the 100 ton limit is for the total amount received and applied by the 'person' in a calendar year, not the amount in any given pile. In general, any type of material, like horse stall bedding etc. that is mixed with animal waste, becomes animal waste. Any leachate/run-off to surface waters from an animal waste stockpile regardless of the size of the stockpile is prohibited. You indicated in our conversation that you did not know the volume of the waste stockpiled on your property and that this was a one-time event. You also indicated that the waste would be spread over your gardens. At the time of the investigation, I did not observe or see any evidence of runoff from the stockpile of bedding/manure.
