Action Taken: WSRO DWR staff contacted Mr. Lawson on 5/20/2015 and he stated that he had been hauling waste which had been stockpiled for about 12 days. Told Mr. Lawson that we would be out to investigate and he stated that the waste would be spread by 5/23/2015 and that he stated that he only had 5 to 6 loads remaining. Right onto Eldora Road, right onto Bryant Mill which turns into Cox Ford Rd. Comments : Visited site on 512612015 at 10:50am. Mr. Lawson stated that he is receiving chicken litter from the farms of Jonny Simmons, Bruner Farms, etc. and that it is being hauled by "Dino", last name unknown. Litter was observed to have been spread onto fescue hay and corn land. Hay was in process of being cut while the corn has not yet been planted. Mr. Lawson's son-in-law helps spread the litter. When NCDENR contacted Mr. Lawson by telephone on 8/13/2014 to discuss the allegations, Mr. Lawson immediately became very angry, very irate, belligerent, and yelled "don't you EVER call this number again" and hung up. NCDENR attempted to contact Mr. Lawson three more times that day (cell and home) and left voice. mail messages. To date, no return calls have been received. The subject phone conversation took place as result of a complaint investigation conducted by our office regarding the stockpiling of poultry litter onto a field located on the corner of Bryant Mill Road and Cox Ford Road in Surry County. The anonymous complainant alleged that poultry litter had been stockpiled uncovered for greater than 15 days at this site. On May 2, 2012 staff from the Surry County Soil & Water office confirmed that there was uncovered poultry litter stockpile at the subject site. On May 17, 2012 staff from this office conducted a follow-up visit and observed uncovered poultry litter stockpiles were still present at the subject site. It should be noted that a portion of the litter stockpiles had been removed at the time of this visit. However, as Mr. Mitchell discussed with you on May 21, 2012, this is a violation of North Carolina Administrative Code 15A NCAC 02T .1303(a)(2). 15A NCAC 02T .1303(a)(2) requires that poultry litter shall not be stockpiled uncovered for greater than 15 days. On August 3, 2012 this office received a second complaint concerning stockpiling of poultry litter uncovered at the subject site for an extended period of time (i.e. greater than 15 days). This complaint has been confirmed by Surry County Soil & Water staff. To avoid further action, which may include possible enforcement actions for the above mentioned violation, please take the following corrective actions: Land apply the existing stockpiles of poultry litter as soon as conditions allow and in the future do not stockpile poultry litter uncovered for greater than 15 days. You want to consider the construction of a covered storage area for future stockpiling of poultry litter.
