Gillispie 639 Gillespie Street Dobson, NC 27017-8454 Subject: NOTICE OF VIOLATION Stream Standard Violations: NOV-2011-SS-0027 Parcel ID #4986-08-99-6178 Facility No. 86-36, Permit No. AWD860036 Surry County Dear Mr. Gillispie: On July 7, 2011 Melissa Rosebrock, of the State's Division of Water Quality (Division) Winston-Salem Regional Office, conducted a site visit at the above referenced property on Lakeview Drive. This visit was the result of a complaint received by our office alleging that cattle activity in and around the stream flowing through the above parcel was causing a water pollution problem. Staffs of the Surry County NRCSISWCD Field Office were also present to offer technical assistance. At the time of our investigation, the Division observed that at least 35 beef cattle had access to an unnamed tributary (UT) to the Fisher River, This particular section of surface water is a Class WS-II/HQW stream located within the Yadkin River Basin. WS-II waters are used as sources of drinking water, culinary, or food processing purposes. WS-II waters are also generally in predominantly undeveloped watersheds. All WS-11 waters are HQW (High Quality Water) by supplemental classification. Supplemental classifications are intended to protect waters which are rated excellent based on biological and physicallchemical characteristics through Division monitoring or special studies. The section of water where the cattle are located is approximately 2.3 miles upstream of the water supply intake for the Town of Dobson. Although the pastures are well vegetated, excessive cattle activity in and around the tributary has resulted in approximately 1,040 linear feet of impact due to severe stream bank erosion and the accumulation of several inches of sediment and animal waste. Photographs and surface water samples were obtained, the results of which are attached for your review. Turbidity Stream Standard Violation The attached laboratory results document a violation of the State's water quality standard for turbidity, Specifically, the upstream turbidity was 8.7 NTU while the downstream turbidity was 500 NTU. NC water quality standards specify that the turbidity in this stream be no greater than 50 NTU. Turbidity is a measure of water clarity and how much the material suspended in water decreases the passage of light through the water. Suspended materials include soil particles (clay, silt, and sand), algae, plankton, microbes, and other substances. Turbidity can affect the color of the water. Higher turbidity increases water temperatures because suspended particles absorb more heat. This, in turn, reduces the concentration of dissolved oxygen (DO) because warm water holds less DO than cold. Higher turbidity also reduces the amount of light penetrating the water, which reduces photosynthesis and the production of DO. Suspended materials can clog fish gills, reducing resistance to disease in fish, lowering growth rates, and affecting egg and larval development. As the particles settle, they can blanket the stream bottom, especially in slower waters, and smother fish eggs and benthic macroinvertebrates. Sources of turbidity include: soil erosion; waste discharge; eroding stream banks; and excessive algal growth. Item II. Potential Fecal Coliform and Dissolved Oxnen (DO) Violations Although the upstream fecal coliform result of 380 colonies/100 mL was greater than the State's water quality standard of 200 colonies/100 mL, a downstream finding of 19,000 colonies/100 mL clearly indicates that excessive cattle activity in and around the stream is impacting surface water. Given that the fecal coliform level is already highly elevated downstream of the cattle, there is the possibility of future civil penalty assessments should the Division obtain a required total of five samples within 30 days that result in a geometric mean greater than 200 colonies/100 MI. Stream samples were also obtained and analyzed for DO, pH, specific conductance, nutrient levels, and biochemical oxygen demand (BOD). There is currently no State water quality standard for specific conductance, nutrients, or BOD. As the attached results indicate, there were no violations of the State's water quality standard for DO or pH. Please note, however, that the upstream DO was 7.29 mg/L while the downstream DO was only 5.37 mg/L. The NC water quality standard specifies that the DO in this stream be no less than 4.0 mg/L (as an instantaneous value) or a daily average of 5.0 mg/L. There is the possibility for future violations of the DO standard if current conditions are allowed to continue. Reuuested Response Our office requests that you respond in writing within thirty (30) days of receipt of this Notice. At minimum, adequate vegetation should be established in the buffer area along the stream to prevent further run-off of sediment and animal waste. The Division requires that the violations, as described above, be abated immediately.
