A complaint investigation was first conducted by DWQ-WSRO on January 3, 2008 as a result of a complaint alleging that your cattle had caused severe stream bank erosion and the deposition of manure into East Double Creek (Class C waters of the State) due to their continued access to the creek. Fecal coliform samples obtained downstream from the cattle on January 3, 2008 resulted in 1100 colonies1100 ML, requiring DWQ personnel to conduct follow-up inspections on January 9, 15, 23, and 28, 2008 in order to document persisting water quality concerns. As Ms. Rosebrock explained to you during an on site visit, the North Carolina water quality standard for fecal coliform is a maximum of 200 colonies1100 ML. Stream samples were obtained during each aforementioned visits resulting in an upstream fecal coliform geometric mean of 8.69 coloniesl100 ML while the downstream fecal coliform geometric mean was 367.08 colonies1100 ML. Both upstream and downstream results were calculated using the geometric mean of at least five samples obtained within 30 days. The downstream geometric mean is based upon individual results of: 1100; >6000; 340; 90; and 33, respectively. Please be reminded that the above referenced downstream sampling result of 367.08 co11100 ML constitutes a North Carolina stream standard violation. In addition to fecal coliform, various other stream samples were obtained during the January 2008 sampling events and analyzed for dissolved oxygen (DO), pH, specific conductance, turbidity, biochemical oxygen demand (BOD), and nutrient levels. Lab results indicate that there were no violations of the State's water quality standards for BOD, pH, or turbidity (to date, there is no water quality standard for specific conductance, nutrients or BOD). Visual observations also indicate that a minimum of 1600 linear feet of denuded and eroded stream banks also exist on site. Please be aware that the stream impacts observed constitute a violation of North Carolina's water quality standard for Best Usage, specifically section 15A NCAC 28 .0211(2) that states: N' �I Carolina Xatura!!y N C. Sources of water pollution which preclude any of these uses on either a short-term or long-term basis shall be considered to be violating a water quality standard," While DWQ-WSRO did document fecal coliform violations and stream bank erosion caused by cattle initially having unlimited access to the stream, we also acknowledge your immediate response to our initial visit. You quickly began installing several hundred feet of electric as well as three and four -strand barbed wire fencing to exclude cattle from the stream. As noted earlier, the last two fecal coliform samples were below the water quality standard, indicating that cattle exclusion is an effective way of addressing the water quality concerns on your property. Ms. Rosebrock stated that you were most cooperative and planned to continue fencing and re -seeding of denuded areas. Therefore, to prevent further action by this office, the following corrective actions must be implemented: 1) Complete the fencing that you have planned on both sides of the creek. 2) Establish and maintain vegetation along the creek outside the large white bam (north of bridge). (We understand that seed has already been purchased for this project.) 3) Install a cattle waterer in the pasture north .(and uphill) of the current feeding area for summer grazing. 4) Stabilize the stream banks with vegetation to prevent further erosion of sediment into the State's surface waters. I The Division requests that you respond in writing to this office within twenty (20) days of receipt of this .Notice to the address contained in this letterhead. Your response should list specific dates at which the Division can reasonably expect each completion of each of the corrective actions listed above. Please be aware that these violations, and any future violations, could be subject to a civil penalty assessment of up to $25,000 per day, per each violation. He does not intend to ask SWCD for financial assistance. Mr. Scott and son Perry, had already installed several hundred feet of one -wire barbed wire fence with metal posts. Sediment was about 4 inches deep up trib near where he has been feeding approx. 78 beef cattle/calves. They are fenced out now and he is now feeding hay further back from the stream. Trib fecal= >6000, while the upstream (main stream) was=15. Fecal sample obtained downstream of all cattle on southern end of parcel (south side of River -Siloam Rd.) was 320. Mr. Scott was agreeable to continue fencing and to drill small grain and possibly rye on all the denuded areas near the bridge as soon as possible. Tried to call at 10:30 AM while on site. Left business card with note to call and why we had been there, No DO or pH violations measured. Took photos and nutrient, BOD, fecal, and turbidity samples. Are awaiting results on all but fecal coliform. Fecal in trib to right was 1100 and fecal upstream of confluence of trib (about 150' north of bridge) with main stream was 15 and 12 even further upstream (at property line). Fecal downstream, prior to River Siloam bridge was 240. Stream banks on each side of stream and the trib were denuded. Cattle had already been moved uphill to the east. No sludge worms or algae observed. Sullins, Director Division of Water Quality January 5, 2007 SUBJECT: NOTICE OF VIOLATION & RECOMMEDATION FOR ENFORCEMENT Best Usage and Settleable Solids Stream Standard Violations Scott Property, Parcel I.D. #5932-00-45-0252 Surry County Dear Mr. Scott: As the result of a complaint, Mike Mickey from the Winston-Salem Regional Office of the Division of Water Quality conducted a site inspection on January 3, 2007, of the above property located off River Siloam Road. Observations indicated that in excess - of 600 linear feet of an unnamed tributary to Cgndiff Creek, Class "C" waters, had been impacted by the (1) excavation of the streambed substrate (stream floor), (2) excavation of the stream bank and grading of the riparian area and (3) deposition of sediment in the State's surface waters from unstable streambanks. Photographs were taken to document the stream impacts. Accordingly, the following violations of North Carolina's Environmental Laws are confirmed: (1) Removal of Best Usage - The stream impacts noted above constitute a violation of 15A NCAC 2B .0211 (2) which states: "The waters will be suitable as a source of water supply for drinking as well as aquatic life propagation and maintenance of biological integrity, wildlife, and secondary recreation, and agriculture; sources of water pollution which preclude any of these uses on either a short-term or long-term basis will be considered to be violating a water quality standard. " (2) Settleable Solids Violation - The deposition of solids to surface waters is a violation of 15A NCAC 2B .021](3) which states: "Floating solids; settleable solids; sludge deposits: only such amounts attributable to sewage, industrial wastes\or other wastes as will not make the water unsafe or unsuitable for aquatic life and wildlife or impair the waters of any designated uses. This restoration plan must include the physical restoration of the stream to the original dimensions that existed before the disturbance.
