In accordance with North Carolina General Statute 143-215.1OG, all animal operations who receive an animal
waste management system permit will be charged in each year of the tern an annual permit fee. Annual permit fees are
billed following the issuance of the permit and then annually thereafter on the anniversary of that date. Your animal waste
management system permit was issued on 9/12/2000.
Your annual permit fee for the .period of 9/12/2003 - 9/11/2004 is $150,00, Your payment was due 11/8/2003.
Because this fee was not fully paid within 30 days after being billed, this letter initiates action to revolve the subject permit,
pursuant to 15 NCAC 2H .0205 (c) (4). and G.S. 143-215.1 (b) (3).
Effective 60 days from receipt of this notice, the subject permit is hereby revoked unless the required Annual
Animal Waste Management System Permit fee for your animal operation is received within that time. Operation of an
animal waste management system without a valid permit is a violation of North Carolina General Statute 143-215.1 and is
subject to the assessment of a civil penalty of up to $10,000 per day. Your payment should be sent to:

On September 23, 2002 Melissa Rosebrock of the Division of Water Quality's Winston-Salem Regional
Office performed a compliance inspection at your dairy farm in Randolph County. Certified operator, Gary
Farlow, was also present during the inspection. While most animal waste recordkeeping was improved over last
year, there are continued animal waste management concerns that warrant your attention.
Specifically, a review of the animal waste records indicates that a soil analysis was not obtained for any
fields receiving animal waste in 2001. Failure to perform an annual soil analysis for those fields that
receive animal waste products is a violation of NCGS 143-215.10C and the Cattle Waste Operation
General Permit. Staff did note, however, that the required soil analysis for 2002 had already been obtained.
The Winston-Salem Regional office appreciates your cooperation in this matter. If you have any

Thanks again for your prompt reply to our situation. The farms that I
work with that are affected by the Randleman Dam are:
-Cashatt Dairy (Robert Cashatt) #76-28
-Green Valley Farm (Keith Hockett) #76-22
-Buttke Dairy Enterprises (Arlin Buttke) #76-12
-W.R. Farlow & Sons Dairy (William Farlow) #76-33
It is my understanding that the Buttke and Green Valley Farms are
towards the end of their negotiations with the PTRWA. An additional
facility, the Robbins Farm, is also affected but is not an 0200 farm
that I would or have visited.
The W.R. Farlow & Sons Dairy is a family operation owned (in whole or
part?) by the father, William Farlow and run by his sons Steve Farlow
and Gary Farlow (the certified operator). Steve still lives onsite on
the farm and has a son that could be the next generation to operate this
dairy. It is a grain/dairy operation meaning that the farm producers the
corn silage and grain that is used by the dairy operation. They are
certified for 175 confined dairy cows but additional heifers, calves,
etc. could be on pasture. The most recent DWQ inspection (12/11/01)
reports the current, confined, population to be 112.
Solid waste is scraped into an open wet/dry stack and liquid waste is
directed to the waste storage pond. Solids are hauled to the field and
applied while the liquid waste is irrigated. Per the most recent
Certified Animal Waste Management Plan (May 2000), all irrigated fields
are on "owned" land while the solids are broadcast onto "leased" land.
There is an unknown earning potential for the dairy business through
Steve's son, should he continue the business and an unknown development
potential should the owner choose to sell for development.

In regards to the silage waste leakage from the small
silage trench toward an unnamed tributary to Muddy Creek,
after having the Randolph County Soil and Water Conservation
specialist look at the problem, the only recommendation
they could come up with was to use all the silage up and not
use the small trench anymore. We plan to use all of this
silage by December 31, 2001.
The silage field that waste was being applied was planted
November 24, 2000.
The marker indicating the maximum liquid level and the top
of the dam (or spillway) was completed on November 27, 2000.
We will continue to work with the Randolph Soil and Water
Conservation District to update anything as needed. I hope
this will be sufficient.

Dear Mr. Farlow:
On November 20, 2000 Melissa Rosebrock of the Division of Water Quality's
Winston-Salem Regional Office performed a compliance inspection at the W.R.
Farlow and Sons Dairy. While most farm operations appeared in excellent condition,
one area of concern in particular warrants your immediate attention.
During the inspection, it was discovered that silage waste was leaking from a
small silage trench towards an unnamed tributary to Muddy Creek (Class WS N*
waters). While the unpermitted discharge of waste was not reaching waters of the
State on the date of the inspection, the potential certainly exists for a discharge to
waters in the future, particularly during rainfall events. You should also be aware that
the referenced discharge is a violation of North Carolina General Statute (NCGS)
143-215. 1 (a), and could subject you to civil penalties of up to $25,000 per day,
per violation. To eliminate the possibility of any type of waste getting into surface
waters of the State we recommend that you contact the Randolph County Soil and
Water Conservation District for suggestions regarding the containment or diversion of
the silage run-off.
A written response is to be submitted to this office within thirty (30) days of
receipt of this Notice indicating the actions taken to correct the silage run-off. This
written response should include a detailed explanation of "when and how" the
problem is to be corrected. Please address the information to the attention of Ms.
Rosebrock.
Staff also noted that waste applied to a corn silage field November 17, 2000
did not yet have a receiving crop planted to utilize the nutrients. Per your Animal
Waste Permit (Section 11, #3), "a vegetative cover is to be maintained on all land
application fields and buffers in accordance with the Certified Animal Waste 39V
Management Plan." This field should be planted within 30 days.J

Additional information is required before we can continue our review. Please address the following by July 26,
2000:
1. Please provide waste storage pond capacity documentation (design, as -built calculations, etc.) and
dry stack area documentation. Be sure to include any site evaluations, wetland determinations, or
hazard classifications that may be applicable.
2. Please include irrigation parameters in your Waste Utilization Plan (WUP). Irrigation events are to
be listed in the WUP as the maximum application allowable for that soil type from the time the
pumps are turned on until the time they are shut off. It is currently recommended that total
application amounts not exceed one inch in any application event for any soil type. If your
application rates need to be adjusted for the application of animal waste, please have your
Technical Specialist revise your WUP to reflect the appropriate application amount per event. If
the rates exceed the recommended one inch, please have your Technical Specialist justify the
increased application rate in the narrative of your WUP.
3. It appears that tract 2043, field 2 has a small grain overseed listed twice in the WUP for the same
amount of acreage. Please verify that this is correct. It is also noted that tract 2043, field I is only
listed as having a corn silage crop.
4. Please provide an Operation and Maintenance Plan.
5. The Plant Available Nitrogen (PAN) calculated for this facility appears to be lower than current
NRCS standards. Please provide an explanation of where the rates used in the calculations were
obtained. Also, please indicate which calculations if for irrigation versus broadcast and if there are
any assumptions made on the confinement time. Please refer to NRCS recommended PAN
calculations or submit waste analysis as justification for the reduction in PAN at this facility.

This letter is being sent to clarify the recordkeeping requirement for Plant Available Nitrogen (PAN)
application on fields that are part of your Certified Animal Waste Management Plan.
In order to show that the agronomic loading rates for the crops being grown are not being exceeded, you
must keep records of all sources of nitrogen that are being added to these sites. This would include nitrogen
from all types of animal waste as well as municipal and industrial sludges/residuals, and conunercial fertilizers.
Beginning January 1, 2000, all nitrogen sources applied to land receiving animal waste are required to
be kept on the appropriate recordkeeping forms (i.e. IRR1, IRR2, DRY1, DRY2, DRY3, SLUR1, SLUR2,
SLD1, and SLD2) and maintained in the facility records for review. The Division of Water Quality (DWQ)
compliance inspectors and Division of Soil and Water operation reviewers will review all recordkeeping during
routine inspections. Facilities not documenting all sources of nitrogen application will be subject to an
appropriate enforcement action.

liability for failure to comply with any State Rule, State Statute, Local County Ordinance, or permitting
requirement.

animal waste management plan by November 15, 1998.

(b) "OWNER" shall comply with all terms and conditions of the North Carolina
General Statutes 143-215.1 and the relevant rules promulgated thereunder
except 15A NCAC 2H .0217(a)(1)(E).
(c) No later than fourteen (14) calendar days after the date identified in 2(a) above,
submit to the Director of DWQ written notice of compliance or noncompliance
therewith. In the case of noncompliance, the notice shall include a statement of
the reason(s) for noncompliance, remedial action(s) taken, and a statement
identifying the extent to which subsequent dates or times for accomplishment of
listed activities may be affected.
3. "OWNER" agrees that unless excused under paragraph four (4), "OWNER" will pay
the Director of DWQ, by check payable to the North Carolina Department of
Environment and Natural Resources, stipulated penalties according to the following
schedule for failure to meet the deadline set out in paragraph 2(a) above.
Failure to obtain and fully implement a Certified $100.00 for the first seven days
Animal Waste Management Plan by the date past the date identified in 2(a)
identified in 2(a) above: $500.00 for each additional
day
4. "OWNER" and the Commission agree that stipulated penalties are not due if
"OWNER" satisfies the Division of Water Quality that noncompliance was caused
solely by:
a. An act of God;
b. An act of war;
c. An intentional act or omission of a third party, but this defense shall not be
available if the act or omission is that of an employee or agent of the defendant
or if the act or omission occurs in connection with a contractual relationship
with the "OWNER";
d. An extraordinary event beyond the "OWNER'S" control. Contractor delays or
failure to obtain funding will not be considered as events beyond the
"OWNER's" control; or
e. Any combination of the above causes.
Failure within thirty (30) days of receipt of written demand to pay the penalties, or
challenge them by a contested case petition pursuant to G.S. 150B-23, will be grounds
for a collection action, which the Attorney General is hereby authorized to initiate.
The only issue in such an action will be whether the thirty (30) days has elapsed.
5. This Special Agreement and any terms and conditions contained herein, hereby
supersedes 15A NCAC 2H .0217(a)(1)(E).
6. Noncompliance with the terms of this Special Agreement are subject to enforcement
action in addition to the above stipulated penalties, including injunctive relief pursuant
to G.S. 143-215.6(C).

7. The "OWNER", upon signature of this Special Agreement, will be expected to
comply with all schedule dates, terms, and conditions of this document.

(a) "OWNER" has previously been deemed permitted in accordance with 15A
NCAC 2H .0217 for the operation of an animal waste treatment works, but was
unable to comply with 15A NCAC2H .0217 (a)(1)(E) requiring an approved
animal waste management plan to be submitted by December 31, 1997.
(b) Failure to obtain and implement a Certified Animal Waste Management Plan in
accordance with 15A NCAC 2H .0217(a)(1)(E) is a violation of State Water
Quality Regulations -and "OWNER" is within the jurisdiction of the Commission
as set forth in G.S. Chapter 143, Article 21.
(c) "OWNER" desires to continue to operate the animal waste treatment works as a
Non -Discharge system.
(d) "OWNER" has secured assistance from a certified technical to develop animal
waste management system which, once certified, will meet or exceed all
applicable guidelines and standards and will be able to comply with all aspects of
the Commissions animal waste general permit.
(e) During the term of this Agreement there will be no increase in Steady State Live
Weight (SSLW) at the facility. Any new construction will be.designed to
accommodate only the SSLW for which the facility was registered in accordance
with 15A NCAC 2H .0217(a)(1)(D).
(e) Since this Special Agreement is by Consent, neither party will file a petition for a
contested case or for judicial review concerning its terms.
(f). Nothing in this Special Agreement .shall be taken as absolving or relieving
"OWNER" from any responsibility or liability for discharges of animal waste to
surface waters of the State of North Carolina.
2. "OWNER" desiring to comply with the Permit identified in paragraph I (a) above,
hereby agrees to do the following:

d. An extraordinary event beyond the "OWNER'S" control. Contractor delays or
failure to obtain funding will not be considered as events beyond the
"OWNER's" control; or
e. Any combination of the above causes.
Failure within thirty (30) days of receipt of written demand to pay the penalties, or
challenge them by a contested case petition pursuant to G.S. 150B-23, will be grounds
for a collection action, which the Attorney General is hereby authorized to initiate.
The only issue in such an action will be whether the thirty (30) days has elapsed.
5. This Special Agreement and any terms and conditions contained herein, hereby
supersedes 15A NCAC 2H .0217(a)(1)(E).
6. Noncompliance with the terms of this Special Agreement are subject to enforcement
action in addition to the above stipulated penalties, including injunctive relief pursuant
to G.S. 143-215.6(C).

7. The "OWNER", upon signature of this Special Agreement, will be expected to
comply with all schedule dates, terms, and conditions of this document.
8. This Special Agreement shall expire upon owners submittal of a certified animal
waste management plan.

Dear Mr. Farlow:
In .the next few days, you will be receiving a certified
letter from our Raleigh Office informing you that your
facility was not certified by the December 31, 1997
deadline. In the letter, you will be asked to respond in
writing back to the Raleigh Office informing them of the
reasons why your facility was not certified by the deadline.
Attached to the letter will be an application for a
"Special Agreement". This agreement will allow you to set a
schedule for you to follow to complete the necessary
improvements or construction activities required in your
waste management plan prepared by NRCS or Soil and Water
Conservation. The Environmental Management Commission in
Raleigh will review and approve the schedule you propose.
Please complete the application when you receive it and
return it.to the address found on the last page of the
Raleigh letter.

all the necessary paperwork is completed.
