Annual permit fees are billed following the issuance of the permit and then annually thereafter on the anniversary of that date. Your animal waste management system permit was issued on 9/12/2000. Your annual permit fee for the .period of 9/12/2003 - 9/11/2004 is $150,00, Your payment was due 11/8/2003. Because this fee was not fully paid within 30 days after being billed, this letter initiates action to revolve the subject permit, pursuant to 15 NCAC 2H .0205 (c) (4). and G.S. 143-215.1 (b) (3). While most animal waste recordkeeping was improved over last year, there are continued animal waste management concerns that warrant your attention. Specifically, a review of the animal waste records indicates that a soil analysis was not obtained for any fields receiving animal waste in 2001. The farms that I work with that are affected by the Randleman Dam are: -Cashatt Dairy (Robert Cashatt) #76-28 -Green Valley Farm (Keith Hockett) #76-22 -Buttke Dairy Enterprises (Arlin Buttke) #76-12 -W.R. Farlow & Sons Dairy (William Farlow) #76-33 It is my understanding that the Buttke and Green Valley Farms are towards the end of their negotiations with the PTRWA. An additional facility, the Robbins Farm, is also affected but is not an 0200 farm that I would or have visited. The W.R. Farlow & Sons Dairy is a family operation owned (in whole or part?) by the father, William Farlow and run by his sons Steve Farlow and Gary Farlow (the certified operator). Steve still lives onsite on the farm and has a son that could be the next generation to operate this dairy. It is a grain/dairy operation meaning that the farm producers the corn silage and grain that is used by the dairy operation. They are certified for 175 confined dairy cows but additional heifers, calves, etc. could be on pasture. The most recent DWQ inspection (12/11/01) reports the current, confined, population to be 112. Solid waste is scraped into an open wet/dry stack and liquid waste is directed to the waste storage pond. Solids are hauled to the field and applied while the liquid waste is irrigated. Per the most recent Certified Animal Waste Management Plan (May 2000), all irrigated fields are on "owned" land while the solids are broadcast onto "leased" land. There is an unknown earning potential for the dairy business through Steve's son, should he continue the business and an unknown development potential should the owner choose to sell for development. DEC 19 2POO am Randolph County In regards to the silage waste leakage from the small silage trench toward an unnamed tributary to Muddy Creek, after having the Randolph County Soil and Water Conservation specialist look at the problem, the only recommendation they could come up with was to use all the silage up and not use the small trench anymore. We plan to use all of this silage by December 31, 2001. The silage field that waste was being applied was planted November 24, 2000. The marker indicating the maximum liquid level and the top of the dam (or spillway) was completed on November 27, 2000. We will continue to work with the Randolph Soil and Water Conservation District to update anything as needed. I hope this will be sufficient. Very truly yours, William R. Farlow and Sons Dairy #76-33 Randolph County Dear Mr. Farlow: On November 20, 2000 Melissa Rosebrock of the Division of Water Quality's Winston-Salem Regional Office performed a compliance inspection at the W.R. Farlow and Sons Dairy. While most farm operations appeared in excellent condition, one area of concern in particular warrants your immediate attention. During the inspection, it was discovered that silage waste was leaking from a small silage trench towards an unnamed tributary to Muddy Creek (Class WS N* waters). While the unpermitted discharge of waste was not reaching waters of the State on the date of the inspection, the potential certainly exists for a discharge to waters in the future, particularly during rainfall events. You should also be aware that the referenced discharge is a violation of North Carolina General Statute (NCGS) 143-215. 1 (a), and could subject you to civil penalties of up to $25,000 per day, per violation. To eliminate the possibility of any type of waste getting into surface waters of the State we recommend that you contact the Randolph County Soil and Water Conservation District for suggestions regarding the containment or diversion of the silage run-off. A written response is to be submitted to this office within thirty (30) days of receipt of this Notice indicating the actions taken to correct the silage run-off. This written response should include a detailed explanation of "when and how" the problem is to be corrected. Please address the information to the attention of Ms. Rosebrock. Staff also noted that waste applied to a corn silage field November 17, 2000 did not yet have a receiving crop planted to utilize the nutrients. Per your Animal Waste Permit (Section 11, #3), "a vegetative cover is to be maintained on all land application fields and buffers in accordance with the Certified Animal Waste 39V Management Plan." In the letter, you will be asked to respond in writing back to the Raleigh Office informing them of the reasons why your facility was not certified by the deadline. Attached to the letter will be an application for a "Special Agreement". This agreement will allow you to set a schedule for you to follow to complete the necessary improvements or construction activities required in your waste management plan prepared by NRCS or Soil and Water Conservation. The Environmental Management Commission in Raleigh will review and approve the schedule you propose. Please complete the application when you receive it and return it.to the address found on the last page of the Raleigh letter.
