In order to meet this directive, a representative of DENR has recently evaluated the inactive lagoon(s) and/or storage pond(s) on your property. Inactive lagoons and storage ponds were defined by the Statute as structures which were previously used to store animal waste but have not received waste for at least one year. The information collected on your property is contained in the attached field data sheets. Using this field data, staff ranked your inactive waste structures as high, medium or low according to its potential risk for polluting surface and/or groundwater. These include taking appropriate actions to eliminate current discharges, prevent future discharges and to insure the stability of their structures. Staff of the Division of Water Quality will be in contact with owners of all inactive structures that have been determined to pose a serious environmental risk, based on its ranking and/or additional field data collected by the Department. All liquids and waste removed from these structures must be land applied at a rate not to exceed the agronomic needs of the receiving crops. Any major modifications made to the dike walls or structure must be done in accordance with current standards and under the direction of a technical specialist designated for structural design. Your local Soil and Water Conservation District is an excellent source for information and guidance related to proper waste application practices, structure operation and maintenance, and other related animal waste management standards and/or requirements. Nothing in this letter should be taken as removing from you the responsibility and liability for any past or future discharges from your lagoon(s) and/or storage pond(s) or for any violations of surface water or groundwater quality standards. S. 143-215.1 D and is one of two visits scheduled for all registered livestock operations during the 1998 calendar year. The Division of Water Quality should have already conducted an inspection on your farm. This review will be done by Margaret O'Keefe from the Division of Soil & Water. I will accompany her on these reviews. I would like to take this opportunity to recommend that you make a decision to officially close and clean out the lagoons on your farm. This would greatly reduce your liability for these lagoons as far as potentially running over, someone getting hurt, and other problems associated with lagoons. The district can assist you in developing a closure plan for the lagoons. You may be eligible for cost share funds as well. "An unclosed lagoon is both a danger to the environment and a liability to the farmer. Until it is properly closed there is a constant threat of a discharge to the surface waters and possible groundwater contamination. Preston Howard, Jr., P.E., Director July 23, 1998 MEMORANDUM TO: Water Quality Regional Supervisors FROM: Coleen Sullins 6�_ - SUBJECT: Animal Operations who failed to respond to request for status updates III" W S P-0 4 • NCDENR NORTm CAROLINA DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES In February of this year, the Division of Water Quality mailed certified letters requesting a status update to 396 facilities who were listed as an "active" farm on our tracking database but had failed to submit a Certified Animal Waste Management Plan by December 31, 1997. Since that time, the Division has worked with 363 of these facilities who have either applied for a Special Agreement, obtained a Certified Animal Waste Management Plan (CAWMP) or requested removal from the database as an "active" farm. Attached is a list of the facilities in your region that have failed to respond to the Division's "Request for Status Update" letters. The Director has requested that we visit each of these facilities and determine if they are currently in operation above the threshold numbers. A flow diagram is attached to help show the process for dealing with these facilities. For facilities that are out of operation or below the threshold, staff should have the facility owner fill out a Removal Request form (Form RR-1 revised 2/98). It is imperative to have the owner sign this form because in doing so the owner certifies that he will obtain a CAWMP before coming back into business or above the threshold number for his type of operation. He also certifies that he understands if he is operating below the threshold, the Division of Water Quality may still require him to obtain a CAWMP and/or permit based on the facility's actual or potential impacts on surface waters of the State. If a facility is found to be in operation and above the threshold, please conduct a normal inspection noting any potential for environmental impacts. Staff should inform the owner or his onsite representative that because the facility has failed to obtain and implement a CAWMP and failed to respond to our request for status updates, the Division is preparing to seek an injunction to stop the =permitted treatment of wastewater at the facility. Since that time, the Division has worked with 363 of these facilities who have either applied for a Special Agreement, obtained a Certified Animal Waste Management Plan (CAWMP) or requested removal from the database as an "active" farm. Attached is a list of the facilities in your region that have failed to respond to the Division's "Request for Status Update" letters. The Director has requested that we visit each of these facilities and determine if they are currently in operation above the threshold numbers. A flow diagram is attached to help show the process for dealing with these facilities. For facilities that are out of operation or below the threshold, staff should have the facility owner fill out a Removal Re uest.form (Form RR-1 revised 2198) 1t-is imperative to have the owner sign th� i� s o because in doing so the owner certifies that he will obtain a CAWMP before coming back into business or above the threshold number for his type of operation. He also certifies that he understands if he is operating below the threshold, the Division of Water Quality may still require him to obtain a CAWMP and/or permit based on the facility's actual or potential impacts on surface waters of the State. If a facility is found to be in operation and above the threshold, please conduct a normal inspection noting any potential for environmental impacts. C)ept f tjoV 21 Senate Bill 1217, An Act to Implement Recommendations of the Blue Ribbon Study Commission on Agricultural Waste, enacted by the 1996 North Carolina General Assembly, requires a certified operator for each animal waste management system that serves 250 or more swine by January 1, 1997. The owner of each animal waste management system must submit a designation form to the Technical Assistance and Certification Group which designates an Operator in Charge and is countersigned by the certified operator. The enclosed form must be submitted by January 1, 1997 for all facilities in operation as of that date. Failure to designate a certified operator for your animal waste management system is a violation of 15A NCAC 2H .0224 and may result in the assessment of a civil penalty. Dear Mr Sizemore: About a year ago, Ron Linville with the NC Division of Water Quality (formerly Environmental Management) and I visited your hog operation on Sizemore Road that had not been in operation for several. years. The site appears to have 3 lagoons that were used in the operation. The visit was in connection of inspections being conducted on al.1 livestock operations across the state. On November 22, 1995, Mr Linville sent you a letter indicating that no wastewater deficiencies were observed and recommended that proper abandonment procedures be considered for the three lagoons. About a week ago, Mr Linville called with information on abandoned sites and suggested that I contact you. It seems that a new rule or regulation will soon be coming out that requires that all abandoned lagoons should be closed out prior to 12/31/97. Any overflow or discharge after that date would be subject to fines and open the operator to third party lawsuits. We have technical standards for proper closure of abandoned lagoons and possible financial assistance through the NC Agricultural Cost Share Program. If you wish to request technical assistance and be considered for cost -sharing, please complete the attached form and mail back to this office. Julian, NC 27283 SUBJECT: Farm Inspection Sizemore Swine Farm Guilford County Dear Mr. Sizemore: Due to recent concerns about agricultural -impacts to waters of the State, the Division of Environmental Management conducted inspections of all registered farming operations involving livestock. Mr. Ron Linville of this office in conjunction with Mr. John Andrews, District NRCS Conservationist visited your animal operation on July 25, 1995. observations at your facility have been categorized as follows: Category I.I. NOTICE OF VIOLATION A wastewater lagoon at your facility has overflowed. Adequate freeboard (minimum of 1911) is not being maintained in the lagoon. A pipe, ditch, pad or other conveyance can contribute to waste being discharged from the animal operation. operational and Maintenance concerns exist which are likely to cause animal waste runoff in a manner that is detrimental to water quality. Category II. NOTICE OF CONCERN Parlor wash, calf feeding or other activities could contribute negative impacts to water quality. Loafing areas have the potential to release waste intermixed with rainfall to the extent that water quality could be negatively impacted. Existing apparatus for controlling waste need repair or replacement. Other: Category III. NO OBSERVED PROBLEMS X No observed wastewater deficiencies at the time of the site visit. Discharges from the lagoons and feedlots must cease immediately. until compliance is achieved with the regulations, your Farm will be considered in violation of GS: 143-215.1 and could be subject to enforcement action with the possible assessment of civil penalties of up to $10,000 per day per violation.
