He did not breech the dam. He went in from the side. He stockpiled all the sand/soil/manure from the bottom, in an area adjacent to the holding pond. This area used to be part of his stock trail to the pasture. So it is high and dry. I told him to cover it, which will keep rain from washing it off. (He plans on selling this stuff.) What can I do, to help them out? Mr. Keck doesn't need any more problems. Should I write a closure plan and begin the -Closure Report form? There may a little more they can get out. But is looked pretty good to me. It was down to clay with just a little left on the north and west side slopes. I will be in meetings on Monday, Wednesday and Thursday. The next week I have something on Mon. morning, Tues. morning and all day Thursday. Other than that I am free. While most of the farm's operations appeared to be in excellent condition and record keeping was improved over last year, there continues to be a concern regarding the waste analysis records. Specifically, Ms. Rosebrock noted that a waste analysis was not performed within 60 days of the June 2001 waste applications. As you are aware, waste samples are to be submitted for analysis within 60 days of all animal waste applications. A review of the waste records also indicates that 2001 soil test analyses have not yet been performed for those fields that received animal waste. These soil samples need to be taken by the end of the calendar year. Please note that waste and soil analysis, once obtained, should be kept for a minimum of three years. Failure to have complete records is a violation of North Carolina General Statute 143-215.10C and your Animal Waste Management Permit. In order to show that the agronomic loading rates for the crops being grown are not being exceeded, you must keep records of all sources of nitrogen that are being added to these sites. This would include nitrogen from all types of animal waste as well as municipal and industrial sludges/residuals, and commercial fertilizers. Beginning January 1, 2000, all nitrogen sources applied to land receiving animal waste are required to be kept on the appropriate recordkeeping forms (i.e. IRR1, IRR2, DRY1, DRY2, DRY3, SLUR1, SLUR2, SLD1, and SLD2) and maintained in the facility records for review. The Division of Water Quality (DWQ) compliance inspectors and Division of Soil and Water operation reviewers will review all recordkeeping during routine inspections. Facilities not documenting all sources of nitrogen application will be subject to an appropriate enforcement action.
