Seats Dairy, #30-30 Forsyth County Dear Mr. Allen: Our office has received and reviewed the results of an inactive waste storage pond evaluation performed by the Davie County NRCS/SWCD on the structure once owned by the late William F. Seats. This evaluation was performed at your request to determine if any animal waste remained in the bottom of the waste storage pond after closure. As discussed during our site visit of March 28, 2002, the proper procedure for closure of an animal waste storage structure should include the following steps: 1.) Obtaining a "Closure Plan" written by a technical specialist, which outlines in detail, how the closure is to be completed according to the NRCS standard (4360); 2.) Removal of the liquid and solid waste from the structure; 3.) Land application of the nutrient containing waste to a receiving crop at an agronomic rate; 4.) Verification of the application rate through a waste analysis and application records: 5.) Inspection of the site for adequate removal of waste from the bottom of the structure; 6.) Filling the pit, grading, and seeding the disturbed areas of land; and 7.) Submittal of a completed closure form to the Division of Water Quality. One of the purposes for closing a structure according to NRCS standards is to protect the quality of surface water and groundwater resources. The objective is "to remove waste materials, to the maximum extent practical, from a structure prior to closure." While the evaluation data shows that not all the waste material was removed (hole #3), it is our determination that most of the material was removed prior to closure. Per discussion with Non -Discharge Compliance and Enforcement staff in Raleigh, and in light of your unique ownership situation, it is the Division's decision not to pursue enforcement action regarding closure of the waste storage structure in question. The Winston-Salem Regional office also appreciates your willingness to cooperate with us on our investigation and your timeliness in requesting the waste storage pond evaluation from the Davie County NRCS/SWCD. Seats, Facility # 30-30 Wnston:!Salem Regional OffiCe Mr. Allen, On April 10, 2002 you received a letter from Division of Water Quality, Winston Salem Regional Office and contacted. our office for assistance with the inactive waste storage pond of the late William F. Seats. On May 9, 2002 Don Redmond, NRCS Soil Conservation Technician, and I visited the farm to field investigate if any animal waste remained on the bottom of the storage pond. After reviewing Mr. Seat's design of the waste storage pond (wsp) we determined location and depth of wsp. The wsp was constructed and completed September 1984, with a constructed bottom elevation of 88.0 and did not meet plans and specifications. During our field investigation using the wsp drawing we relocated the bottom. We bored three (3) holes with a soils auger to determine if any waste remained on the bottom.,. See attached drawing for location of wsp and auger boring. Our findings are as follows: Hole #1--Depth 90.0 boring was difficult because of rock, broken concrete and small pieces of wood. We did not get to bottom because material in auger hole. Hole #2--Depth 88.3 we'were able to get to constructed elevation (88.0) with no evidence of animal waste. Hole #3--Depth 87.4 we were able to get 0.3 below constructed bottom (88.0). There was approximately 6 inches of dried animal waste near the bottom. We appreciate the opportunity to assist you. Thorpe, Ph.D. Acting Director Division of Water Quality April 9, 2002 The purpose of this letter is to summarize the findings of a compliance inspection performed March 28, 2002 at the dairy farm once owned by Mr. William Seats. Staff of the Division of Water Quality -Winston- Salem Regional Office (DWQ-WSRO), along with the Davie Soil and Water Conservation District (SWCD) performed an inspection at your farm as a follow-up to an "Inactive Lagoon Evaluation" inspection conducted in 1997. A copy of the 2002 inspection report is enclosed for your review. On the date of the inspection, DWQ Staff observed that the waste storage pond had been filled in, graded level, and seeded with fescue. While there were no obvious water quality impacts on the date of the inspection, our office is concerned that the waste storage pond may not have been properly closed out per Article 21 of the North Carolina General Statutes. Our files indicate that a "Closure Plan" was not followed nor was the removal and land application of the waste liquids and sludge at agronomic rates verified by a Technical Specialist. Inforination gathered during the March 2002 inspection, however, suggests that waste from the waste storage pond was indeed agitated and land applied on fescue pasture grass. The solids were reportedly scraped - out later and also land applied onto the fescue crop. Closure of the structure was completed in 2001 (see attached inspection form). While no written or photographic verification appears to exist regarding the proper closure of this structure, you may wish to contact the Davie SWCD regarding possible field techniques to test and/or document the removal of waste solids from the area. The purpose of today's follow-up inspection is to check on reports of the waste storage pond being closed without a closure plan. Staff from the Davie SWCD was also resent. 6. The waste storage pond has been pushed -in, graded, and seeded with fescue for grazing. Per Mr. Allen, the previous owner (William F. Seats, father-in-law), milked cattle from 1994-2000, then retired in 2000. Mr. Seats passed away in March 2001 and the cattle were then sold in May of2001. Mr. Allen further stated that closure of the waste storage pond began towards the end of 2000 and was [completed in 2001. He said that the storage pond was thoroughly agitated and pumpcd out. At the time, there were beef cows on the lot so I left it on the active list. I was checking with the FO today about the new list and some of the repeats and was told that Mr. Seats died in the last and someone has closed that WSP. It was recommended that someone check into it as there was no assistance requested of the FO. Harold Seats is Mr. Seats son and could probably tell you who owns that land now. The information you provided us indicated that your operation's animal population does not exceed the number set forth by 15A NCAC 2H .0217, and therefore does not require registration for a certified animal waste management plan. Under 15A NCAC 2H .0217, your facility is deemed permitted if waste is properly managed and does not reach the surface waters of the state. Any system determined to have an adverse impact on water quality may be required to obtain a waste management plan or an individual permit. You are reminded that a discharge of wastes to the surface waters of the state will subject you to a civil penalty up to $10,000 per day. Should you decide to increase the number of animals housed at your facility beyond the threshold limits listed below, you will be required to obtain a certified animal waste management plan prior to stocking animals to that level. While doing the operations reviews in Davie county on June 16 - 18, 1997, I appraised the status of these operations. Facility No. 30-01 Ketchie Creek Hog: 1 have include Mr. Thomas Williams signed request for removal from the register. This operation is out of business and there are no swine present on the site. Mr. Williams does not plan on going back into the swine business. I can confirm that this operation can be removed from the TeRister. Facility No. 30-05 Charlie Barnes Farm: This is a small swine operation that is out of the commercial swine business. Mr. Barnes currently has I sow, 7 piglets, 1 boar, and 3 Vietnamese Potbelly pigs in his facility. He says he plans to keep these few hogs for family use, but does not plan to commercially raise again. LSrs1fl confirm that this operation can be, removed from the LCgister. Facility No. 30-09 Reavis & Hendrics Dairy: Mr. Reavis is out of business, he sold out on 3/26/97. He has some replacement heifers on pasture, but is well below the threshold. Facility No. 30-11 Hobar Dairy, Inc.: This dairy is below the threshold, however their pond is currently in violation due to lack of adequate freeboard and discharge over the dike. Facility No. 30-24 Williams Dairy: This operation is currently below the threshold and has no immediate plans to increase number. I have included Mr. Williams' signed request for removal. Enclosed with that letter was an Operator in Charge Designation Form specifically for your facility, Instructions for Completing Application for Temporary Certification as an Animal Waste Management System Operator, and an Application for Temporary Certification as an Animal Waste Management System Operator. Our records indicate that these completed Forms have not yet been returned to our office. As was explained in the previous letter, a training and certification program is not yet available for animal waste management systems involving cattle, horses, sheep, or poultry (with a liquid waste system). Therefore owners of these systems were allowed to request that they be issued temporary certifications until December 31, 1997. All that was required to receive this temporary certification was the completion of the Application Form. For you convenience, we are sending you additional copies of the Operator in Charge Designation Form specifically for your facility, Instructions for Completing Application for Temporary Certification as an Animal Waste Management System Operator, and an Application for Temporary Certification as an Animal Waste Management System Operator. Please return this completed Form to this office as soon as possible but in no case later than April 25, 1997. This office maintains a list of certified operators in your area if you need assistance in locating a certified operator. Please note that failure to designate an Operator in Charge of your animal waste management system, is a violation of N.C.G.S. 90A-47.2 and you will be assessed a civil penalty unless an appropriately certified operator is designated. Please be advised that nothing in this letter should be taken as absolving you of the responsibility and liability for any past or future violations for your failure to designate an appropriate Operator in Charge by January 1, 1997. This bill requires that a certified operator be designated as the Operator in Charge by January 1, 1997, for each animal waste management system that serves 250 or more swine, 100 or more confined cattle, 75 or more horses, 1,000 or more sheep, or 30,000 or more confined poultry with a liquid animal waste management system. Our records indicate that your facility is registered with the Division of Water Quality and meets the requirements for designating an OIC. A training and certification program is not yet available for animal waste management systems involving cattle, horses, sheep, or poultry, Owners and operators of these systems will be issued temporary animal waste management certificates by the Water Pollution Control System Operators Certification Commission (WPCSOCC). The temporary certificates will expire December 31, 1997, and will not be renewed. To obtain a permanent certification, you will be required to complete ten hours of training and pass an examination by December 31, 1997. A training and certification program for operators of animal waste management systems involving cattle, sheep, horses, and poultry is now being developed and should be available by the spring of 1997. The type of training and certification required for the operator of each system will be based on the nature of the wastes to be treated and the treatment process(es) primarily used to treat the animal waste. As the owner of an animal operation with an animal waste management system, you must designate an Operator in Charge and must submit the enclosed designation form to the WPCSOCC. If you do not intend to operate your animal waste management system yourself, you must designate an employee or engage a contract operator to be the Operator in Charge. The person designated as the Operator in Charge, whether yourself or another person, must complete the enclosed application form for temporary certification as an animal waste management system operator. Both the designation form and the application form must be completed and returned by December 31, 1996.
