Gilmer Allen 281 Double A Trail Advance NC 27006 LOCATION: From I-40 exit NC hwy 801 north two tenths of a mile to Yadkin Valley road on the right. Continue approximately 3 miles to Double A Trail on the left. Farm is at end of drive. Farm is located along Sheek Creek which flows to the Yadkin River. GENERAL The closed dairy is located in the Yadkin Valley community of Davie County. The dairy was closed in 1997. The waste storage pond was constructed in August, 1982 for 100 dairy cows. The farm has not received a notice of violation from DWQ. VOLUME TO BE REMOVED The WSP measures 106' x 48' inside bottom dimensions with depth average of 8' and top dimension 138' x 80' (25 ac.) Approximately 6' (200,000 gallons) of liquid and solids remain in wsp that will be removed by agitating and pumping into honey wagon. Gilmer has received two estimates from contractors for land application of the waste. • NOTE: NRCS or SWCD personnel must be onsits while waste storage pond is being closed for them to certify the proper closure of the structure. SPECIFICATIONS: The waste storage pond will be agitated, waste pumped into honey wagon and broadcast onto hayland/pastureland/cropland. An accumulation of sludge in bottom will be agitated thoroughly by adding water if needed and pumped. All sludge left in bottom will be removed with a tracked equipment. The sludge will be removed to a depth as determined at the site by technical specialist (approximately 0.5' — 2.0') and 3" to 4" inches of clay soil will be removed. The sludge will be applied with box type spreader. Once waste storage pond is declared "clean", there are three options for closing the pond. A pipe can be installed, using no steeper than 1.5:1 side slopes, backfilled with compacted clay, all disturbed areas vegetated to meet all requirements of NRCS Standard 378 for Ponds. Or the dam can be taken down, the pool area filled in and area seeded to permanent vegetation. A third option would be to breach the dam using 3:1 sideslopes and all disturbed area vegetated. Waste storage pond dam will be breeched.. Closure of this operation must be done without any runoff of waste water. Do not land apply while raining or when ground is saturated. Avoid applying prior to predicted rain. It is against the law to allow a discharge into the surface waters of the state. All disturbed areas will be vegetated according to NRCS Standards. Seeding rates: 2 tons lime/acre 1000 Ibs 10-10-10/acre or equivalent 60 Ibs fescue/acre 1 bushel/acre small grain 75% ground cover with small grain mulch All pipes feeding into waste storage pond will be removed prior to certification. LAND APPLICATION OF WASTE The waste storage pond will be emptied and closed between February and April 2001. The waste will be applied to cropland/pasturland/hayland. The application rate will not exceed 24 pounds of nitrogen per acre. A 25 ft. buffer will be left around fields. Waste analysis = 2 lbs. In order to meet this directive, a representative of DENR has recently evaluated the inactive lagoon(s) and/or storage pond(s) on your property. Inactive lagoons and storage ponds were defined by the Statute as structures which were previously used to store animal waste but have not received waste for at least one year. The information collected on your property is contained in the attached field data sheets. Using this field data, staff ranked your inactive waste structures as high, medium or low according to its potential risk for polluting surface and/or groundwater. Your waste structure(s) was ranked as follows: Structure Number Surface Area Acres Rankin 1 0.27 Medium This ranking is based in part on the conditions existing on the day of the site visit. Changes in these conditions or the collection and evaluation of additional data may modify the ranking of your waste structure(s) in the future. Information on your facility along with over 1000 others contained in the inventory has been provided to the General Assembly. During this year's session, the General Assembly will consider additional requirements for future management of these structures which may include requiring proper closure of inactive lagoons and storage ponds according to current or alternative standards. 585 Waughtown Street, Winston-Salem, North Carolina 27107 Telephone (336) 7714600 Fax (336) 7714631 An Equal Opportunity Affirmative Action Employer 50% recyeled/10% post -consumer paper Rating of Potential Riso • Inactive Waste Lagoons and Storage Ponds Animal Waste Management System Page 2 Regardless of their ranking, owners of all waste lagoons and storage ponds have certain management responsibilities. These include taking appropriate actions to eliminate current discharges, prevent future discharges and to insure the stability of their structures. Staff of the Division of Water Quality will be in contact with owners of all inactive structures that have been determined to pose a serious environmental risk, based on its ranking and/or additional field data collected by the Department. All liquids and waste removed from these structures must be land applied at a rate not to exceed the agronomic needs of the receiving crops. Any major modifications made to the dike walls or structure must be done in accordance with current standards and under the direction of a technical specialist designated for structural design. Your local Soil and Water Conservation District is an excellent source for information and guidance related to proper waste application practices, structure operation and maintenance, and other related animal waste management standards and/or requirements. Nothing in this letter should be taken as removing from you the responsibility and liability for any past or future discharges from your lagoon(s) and/or storage pond(s) or for any violations of surface water or groundwater quality standards. Thank you for your cooperation and assistance in this process. If you have questions concerning your inactive structures, please contact the staff of either in the Division of Water Quality or the Division of Soil and Water Conservation in the Winston-Salem Regional Office at (336) 771-4600. The information you provided us indicated that your operation's animal population does not exceed the number set forth by 15A NCAC 2H .0217, and therefore does not require registration for a certified animal waste management plan. Under 15A NCAC 2H .0217, your facility is deemed permitted if waste is properly managed and does not reach the surface waters of the state. Any system determined to have an adverse impact on water quality may be required to obtain a waste management plan or an individual permit. You are reminded that a discharge of wastes to the surface waters of the state will subject you to a civil penalty up to $10,000 per day. Should you decide to increase the number of animals housed at your facility beyond the threshold limits listed below, you will be required to obtain a certified animal waste management plan prior to stocking animals to that level. Threshold numbers of animals which require certified animal waste management plans are as follows: Swine 250 Confined Cattle 100 Horses 75 Sheep 1,000 Poultry with a liquid waste s tem 30,000 If you have questions regarding this letter or the status of your operation please call Sue Homewood of our staff at (919) 733-5083 ext 502. , - _. This Review, undertaken in accordance with G.S. 143-215.1OD, is one of two visits scheduled for all registered livestock operations during the 1997 calendar year. The Division of Water Quality will conduct a second site inspection. It was determined that no corrective actions are necessary as the result of this Review, since waste was = being discharged to the waters of the State, and the animal waste collection, treatment, storage and disposal systems were maintained and operated under the responsible charge of a designated operator. Please remember that you are required to obtain and implement an approved animal waste management plan by the end of this year, and have a certified operator. The plan must be certified by either a designated technical specialist or a professional engineer. For additional assistance with the plan or the operator certification course, please contact your local Soil and Water Conservation District Office or local Cooperative Extension Service Office. The Division of Soil and Water Conservation appreciates your cooperation with this Operation Review. Darr ,'f;. 01 z.;.'iilil APR 0 7 W7 Winston-Salem Regional Offle i SUBJECT: Notice of Violation Designation of Operator in Charge Gilmer Allen Facility Number 30--13 Davie County You were notified by letter dated December 5, 1996, that you were required to designate a certified animal waste management system operator as Operator in Charge for the subject facility by January 1, 1997. Enclosed with that letter was an Operator in Charge Designation Form specifically for your facility, Instructions far Completing Application for Temporary Certification as an Animal Waste Management System Operator, and an Application for Temporary Certification as an Animal Waste Management System Operator. Our records indicate that these completed Forms have not yet been returned to our office. As was explained in the previous letter, a training and certification program is not yet available for animal waste management systems involving cattle, horses, sheep, or poultry (with a liquid waste system). Therefore owners of. these systems were allowed to request that they be issued temporary certifications until December 31, 1997. All that was required to receive this temporary certification was the cornpletion of the Application Form. For you convenience, we are sending you additional copies of the Operator in Charge Designation Form specifically for your facility, Instructions for Completing Application for Temporary Certification as an Animal Waste Management System Operator, and an Application for Temporary Certification as an Animal Waste Management System Operator. Please return this completed Form to this office as soon as possible but in no case later than April 25, 1997. This office maintains a list of certified operators in your area if you need assistance in locating a certified operator. Please note that failure to designate an Operator in Charge of your animal waste management system, is a violation of N.C.G.S. 90A-47.2 and you will be assessed. a civil penalty unless an appropriately certified operator is designated. Please be advised that nothing in this letter should be taken as absolving you of the responsibility and liability for any past or future violations for your failure to designate an appropriate Operator in Charge by January 1, 1997. DEC 12 IBUID Subject: Operator In Charge Designation W i 'i Facility: Gilmer Allen Rl}UisuE Facility ID #: 30-13 Davie County Senate Bill 1217, An Act to Implement Recommendations of the Blue Ribbon Study Commission on Agricultural Waste, was enacted by the North Carolina General Assembly on June 21, 1996. This bill requires that a certified operator be designated as the Operator in Charge by January 1, 1997, for each animal waste management system that serves 250 or more swine, 100 or more confined cattle, 75 or more horses, 1,000 or more sheep, or 30,000 or more confined poultry with a liquid animal waste management system. Our records indicate that your facility is registered with the Division of Water Quality and meets the requirements for designating an 01C. A training and certification program is not yet available for animal waste management systems involving cattle, horses, sheep, or poultry. Owners and operators of these systems will be issued temporary animal waste management certificates by the Water Pollution Control System Operators Certification Commission (WPCSOCC). The temporary certificates will expire December 31, 1997, and will not be renewed. To obtain a permanent certification, you will be required to complete ten hours of training and pass an examination by December 31, 1997. A training and certification program for operators of animal waste management systems involving cattle, sheep, horses, and poultry is now being developed and should be available by the spring of 1997. The type of training and certification required for the operator of each system will be based on the nature of the wastes to be treated and the treatment process(es) primarily used to treat the animal waste. As the owner of an animal operation with an animal waste management system, you must designate an Operator in Charge and must submit the enclosed designation form to the WPCSOCC. If you do not intend to operate your animal waste management system yourself, you must designate an employee or engage a contract operator to be the Operator in Charge. The person designated as the Operator in Charge, whether yourself or another person, must complete the enclosed application form for temporary certification as an animal waste management system operator. Both the designation form and the application form must be completed and returned by December 31, 1996. If you have questions about the new requirements for animal waste management system operators, please call Beth Buffington or Barry Huneycutt at 919n33-0026. Sincerely, z(f FORSteve W.
