Caudle 664 Sink Farm Road Lexington, NC 27292 Colon Sullins, Director Division of Water Quality September 12, 2008 SUBJECT: NOTICE OF VIOLATION Removal of Best Usage, Settleable Solids, and Water Quality Stream Standard Violations Farm #29-37, Parcel I.D. # 6705-03-10-3978 Davidson County Dear Mr. Caudle: As you are aware, staff from the Division of Water Quality's Winston-Salem Regional Office (DWQ-WSRO) conducted a site investigation on August 6, 2008 as a result of a complaint received by our office alleging the accumulation of animal waste in a stream bordering the eastern edge of -the pasture behind your dairy's milk parlor. Our investigation included the collection of stream samples that were analyzed for fecal coliform, dissolved oxygen (DO), pH, specific conductance, turbidity, biochemical oxygen demand (130D), and nutrient levels. Additionally, visual observations and photographs were obtained to further document the surface water conditions on that date. The following laboratory results verify violations of the State's water quality standards for dissolved oxygen and turbidity. Given that the fecal coliform concentration was highly elevated downstream from the cattle pasture, please note that there is the potential for future fecal coliform violations if current conditions persist. Please be aware that denuding stream banks and causing sedimentation to enter the State's surface waters also violates North Carolina water quality standards for Best Usage and Settleable Solids: (1) Removal of Best Usage - The stream impacts noted above constitute a violation of 15A NCAC 2B .0211 (2) which states: "The waters will be suitable as a source of water supply for drinking as well as aquatic life propagation and maintenance of biological integrity, wildlife, and secondary recreation, and agriculture; sources of water pollution which preclude any of these uses on either a short-term or long-term basis will be considered to be violating a water quality standard." (2) Settleable Solids Violation -The deposition of solids to surface waters is a violation of 15A NCAC 2B .0211(3) which states: "Floating solids, settleable solids, sludge deposits: only such amounts attributable to sewage, industrial wastes or other wastes as will not make the water unsafe or unsuitable for aquatic life and wildlife or impair the waters of any designated uses.' The Division of Water Quality requires that the violations detailed in this letter be abated immediately. These violations, and any future violations, are subject to a civil penalty assessment of up to $25,000 per day, per each violation. The Division of Water Quality requests that you respond in writing to this office within ten (10) days following receipt of this Notice. Your response should include a plan detailing the restoration of the impacted stream and adjoining riparian areas, including cattle exclusion and a schedule indicating proposed completion dates. Today's inspection is a result of a complaint alleging the accumulation of waste in UT to North Potts Creek (Class C). Samples were obtained and analyzed for various parameters. Visual observations of the stream were also documented. NOV to be sent for downstream DO (1.44 mg/L) and turbidity (570 NTU) violations as well as removal of best usage and settleable solids. 2400 linear feet of stream is impacted due to severe stream bank erosion caused by excessive cattle traffic. Up to four inches of sediment and waste was measured in the stream. Potential for future fecal coliform violations since upstream was 220 co11100 mL and downstream result was 180,000 col/1 00 mL. Upstream BOD=4.6 mg/L and downstream=88.0 mg/L. Jenifer Carter (DWQ-SWP) was also present. We spoke to Mr. Caudle's son prior to obtaining samples. We informed him of the probability for violations based on the sampling performed downstream of the farm.
