CERTIFY THE CLOSURE.
GENERAL INFORMATION
The main waste storage pond was constructed in 1979 with design assistance from the
Natural Resource Conservation Service and the Davidson Soil & Water Conservation
District to contain and store animal waste from a 52,000 bird layer operation. The
previous owner constructed the secondary (smaller) waste storage pond with no design
assistance from NRCS or the Davidson SWCD, This facility was in operation until 1999,
at which time the integrator; Cal -Maine removed the layers from the property. The
landowner has no plans to restock this operation.

The facility has received a Notice of Violation from the Division of Water Quality
(failure to remove trees & woody vegetation from dam). Mr. Pope intends to have the
dams of both structures breached upon completion of liquid and sludge being removed.
The anticipated time of closure is summer to early fall of 2004. The waste applicator will
be responsible for keeping records for volumes of liquid removed and for field
application records on forms provided by the Davidson SWCD. The landowner is to
notify Davidson SWCD or NRCS personnel at least 48 hours prior to commencement of
closure.
CLOSEOUT SPECIFICATIONS
The closure of the pond waste storage ponds will be completed in accordance with the
standards and specifications outlined in the Closure of Waste Impoundments, (360)
Section IV of the NRCS Field Office Technical Guide (FOTG). The waste storage ponds
will be agitated with a PTO driven chopper pump for sufficient time to create slurry from
the sludge. At least two agitation locations will be required. Both structures have
bottoms that are located above the water table. The bottoms should be capable of
supporting earth -moving equipment such as a track loader. Liquid from upper storage
pond is to be agitated well, before any pumping is to begin. Once material is agitated
properly, pumping into Iiquid transfer tanks (honey wagons) will begin. Waste is to be
land applied to designated fields in such a manner not to exceed the hydraulic loading
capacity of the soil and the crop nitrogen requirements. As liquid level decreases in the
upper storage pond, liquid from lower storage pond will be agitated and pumped into the
upper pond. After all liquids have been pumped out and side slopes washed down, pool
bottoms are to be scraped to remove any existing sludge and calcium deposits. This
material is to be hauled to application fields in dump trucks and land applied with track
loader or tractor and blade. It is not anticipated that the lower pond will contain sludge
since it has served as an overflow from the upper pond and the waste analysis for
nitrogen is 0.00. If sludge is found to exist in lower pond, bottom is to be scraped and
sludge applied in the same manner as mentioned above. Waste application must be made
uniformly and the application rates and amounts described in the closure plan must not be
exceeded.
After sludge is removed embankment is to be breached a minimum of 10 feet wide at the
bottom and side slopes graded to a 3:1 slope or flatter. No additional soil from off site
areas is to be placed into pool areas. Grading will be done in such a manner that no
surface waters are impounded. After grading is completed, all disturbed areas are to be
seeded with tall fescue, fertilized, limed and mulched with the following materials and
amounts:
Tall fescue seed 60 lbs./acre
2 tons lime/acre
1,000 lb s . 10- 10- 1 0/acre
60 — 80 bales of straw/acre
After grading is complete, certifying technical specialist will determine the acreage to be
seeded and total amount of materials required.
REMOVAL OF INFLOW DEVICES
An overflow pipe conveying liquid from any overflow of waste from the upper waste
pond irito the lower pond is to be removed after all liquids have been removed. The
lower waste pond has no overflow devices. In the event that the landowner elects to
convert either waste storage ponds to fresh water farm ponds, NRCS standards and
specifications for practice code 378 (pond) are to be adhered to.
DESCRIPTION OF BUFFERS AND SETBACKS
The custom waste applicator will be informed of all applicable setback distances and
buffers to insure that water quality and closure procedures are properly followed.
Technical specialist on site will review the closure plan with applicator and discuss
locations.of fields to receive animal waste. Waste applicator will be given a complete
copy of the closure plan with field maps. Application maps will have perennial streams
and fresh water impoundment's noted on the maps. Approximate property boundaries
will also be shown on map to prevent waste from being applied too close to property
lines. Setbacks and buffers distances are as follows: no closer than 25 feet from perennial
waters or streams, 100 feet from wells, 200 feet from dwellings not associated with the
farm. Waste is to be applied in such a manner not to reach property and public right-of-
ways.
VOLUMES TO BE REMOVED
Refer to attached calculations on volumes on the respective waste storage ponds. The
volumes are based on site conditions at the time of closure plan development. The Iiquid
level of the structures is subject to change based on climatic conditions.
LAND APPLICATION OF ANIMAL WASTE
The effluent will be land applied to nearby grassland fields that will be maintained as tall
fescue. Waste must be applied in such a manner that no runoff of effluent occurs.

Waste is not to be applied while it is raining or when soil conditions are saturated.
Applying waste prior to predicted rainfall events is also to be avoided.
Refer to waste analysis data sheets attached for nutrient concentrations and analysis.
Land application data, fields, soil types, RYE and acres are contained in the attached data
sheets. The Phosphorus Loss Assessment Tool (PLAT) has been applied to all fields to
insure that phosphorus is not being over applied. Since application fields are maintained
as established tall fescue, soil erosion is not expected to be a concern.

Dear Permittee:
Your facility is currently approved for operation under one of the Animal Waste Operation General Permits. These permits expire on
April 30, 2003. The Division of Water Quality (Division) staff is currently in the process of renewing these permits and is scheduled
to have the permit reissued by early April 2003. Once the permit is reissued, your facility would be eligible for continued coverage
under the reissued permit.
Although you have informed the Division previously that you are not currently operating your facility, the current permit issued to you
requires that the permit remain active until the animal waste management system (lagoons and/or waste ponds) are properly
permanently closed. Therefore, it will be necessary for you to submit the enclosed form.

SUBJECT: Notice of Violation - Compliance Inspection
Larry Pope Farm, 429-01, Davidson County
Dear Mr. Pope:
On March 11,.2002 Melissa Rosebrock of the Division of Water Quality's Winston-Salem Regional
Office performed a compliance inspection at your poultry facility. Although the final lagoon level was adequate
and you are reportedly out of business, there are other concerns that warrant your immediate attention.
Specifically, there were at least three trees greater than 6 inches in diameter that need to be removed
from the embankment between the upper and lower lagoons. The vegetation was so overgrown on the
embankment structure that we have been unable to conduct a thorough inspection except during the time when
most vegetation is dormant. Excessive vegetation is a concern since it can provide sheltered areas for insects
and burrowing animals; interfere with establishment and maintenance of desirable vegetative cover; hinder
visual inspection of the darn; and impair its structural integrity. A review of our files indicates that you have
previously been alerted to this problem (2001 and 2000 DWQ Compliance Inspections and 2000 DSWC
Operational Review). Failure to remove trees, shrubs, and other woody vegetation from the lagoon
embankment is, therefore, a violation of your Poultry Waste Permit (Part 11, #10).
While there was not an immediate threat of an unpermitted discharge reaching waters of the State on the
date of the inspection, the potential certainly exists for a dam failure in the future, particularly if conditions
deteriorate. Be advised that North Carolina General Statutes provide for penalties of up to $25,000 per day
per violation as well as criminal penalties for violations of state environmental laws and regulations.
Note also that the Poultry Waste Permit states that if animal production ceases, the lagoon must be
closed according to NRCS standards (Section V, #7). Should you wish to close your lagoon, we urge you to
contact the Davidson Soil and Water Conservation District office at (336) 242-2075 for assistance.
The Winston-Salem Regional Office appreciates your cooperation in this matter. If you have any

This letter is being sent to clarify the recordkeeping requirement for Plant Available Nitrogen (PAN)
application on fields that are part of your Certified Animal Waste Management Plan.
In order to show that the agronomic loading rates for the crops being grown are not being exceeded, you
must keep records of all sources of nitrogen that are being added to these sites. This would include nitrogen
from all types of animal waste as well as municipal and industrial sludges/residuals, and commercial fertilizers.
Beginning January 1, 2000, all nitrogen sources applied to land receiving animal waste are required to
be kept on the appropriate recordkeeping forms (i.e. IRR1, 1RR2, DRY1, DRY2, DRY3, SLURi, SLUR2,
SLD1, and SLD2) and maintained in the facility records for review. The Division of Water Quality (DWQ)
compliance inspectors and Division of Soil and Water operation reviewers will review all recordkeeping during
routine inspections. Facilities not documenting all sources of nitrogen application will be subject to an
appropriate enforcement action.

liability for failure to comply with any State Rule, State Statute, Local County Ordinance, or permitting
requirement.
