Melissa,
Myself and Andrew Cox SWCD both talked with Mr Critcher and he said he
was willing to do what it took to solve the problem. The site will be
an easy fix as far as removing the cattle from the stream and we are
planning to exclude them from the entire gully and dig a well and
install water tanks. We are going to have him seed the entire area down
with winter wheat or rye immediately. We are having to wait on some
funding to do the work but we are signing him up for Ag Cost Share and
EQIP. We will keep you posted of progress on this issue.

I received a letter from Mr. Critcher today in response to an NOV we had
to send regarding WQ violations for oxygen (and probably fecal if we
take 5 samples w/in 30 days). He said he was working with you to
implement your suggestions. I just wanted to confirm that he is working
with you?
If you think about it, and have time, could you keep me posted on his
progress? At some point in the near future, we'll do a re -check of the
oxygen and fecal to confirm that he's back in compliance, but I want to
give him time to correct the problem.
Thanks for all your help. Call or email if we need to discuss it
further.

Staff from the Division of, Water.. Quality's Winston-Salem Regional Office (DWQ-WSRO) conducted a site
investigation on your property on August 15, 2008 as a result of a'complaint received'by our office alleging the accumulation
of animal waste in an unnamed tributary to Mill Creek, Class C Trout waters of the State. Our investigation included the
collection .of stream samples that were analyzed for fecal coliform bacteria, dissolved oxygen (DO), pH, turbidity,
biochemical oxygen'demand (BOD), and nutrient'levels. Additionally, visual observations. and photographs were obtained to
further document the surface water conditions on that date.
The followingiaboratory -resoits,,verify. violations of 'the:,State's wator.g4olityatandards fog; dissatve oxygen:
Given that the fecal colifom� concentration was highly elevated downstream from the cattle, there is ttie expectation for
future fecal collform violations if current conditions persist. At this time there is no water quality standard for nutrients or
BOD, however, sample results suggest that the stream was also impacted as a; result,of excess nutrients:
Upstream of Pasture

Our observations also indicate that approximately 500 linear feet of the unnamed tributary to Mill Creek is impacted
due to severe stream bank erosion caused by excessive cattle traffic and the deposition of sediment and waste, up to ten
inches in depth, into the State's surface waters caused by the unstable stream banks. Please be aware that denuding
stream banks and causing sedimentation to enter the State's surface waters also violates North Carolina water
quality standards for Best Usage and Settleable Solids:
(1) Removal of Best Usage - The stream impacts noted above constitute a violation of 15A NCAC 2B .0211 (2) which states:
"The waters will be suitable as a source of water supply for drinking as well as aquatic life propagation and maintenance of
biological integrity, wildlife, and secondary recreation, and agriculture; sources of water pollution which preclude any of
these uses on either a short-term or long-term basis will be considered to be violating a water quality standard '
(2) Settleable Solids Violation -The deposition of solids to surface waters is a violation of 15A NCAC 2B .0211(3) which states:
'Floating solids settleable solids; sludge deposits. only such amounts attributable to sewage, industrial wastes or other
wastes as will not make the water unsafe or unsuitable for aquatic life and wildlife or impair the waters of any designated
uses.'
The Division of Water Quality requires that the violations detailed in this letter be abated immediately. These
violations, and any future violations, are subject to a civil penalty assessment of up to $25,000 per day, per each violation.
The Division of Water Quality requests that you respond in writing to this office within- ten (10) days following receipt of'
this Notice. Your response should include a plan detailing the restoration of the impacted stream and adjoining riparian
areas, including cattle exclusion and a schedule indicating proposed completion dates.
We ask that you give your immediate attention to these matters. We also urge you to contact the Ashe County.Soil
and Water Conservation District/Natural Resource Conservation Service at [phone] for any technical or financial

The samples were collected and submitted. I had a problem with the conductivity measurement. Also,
the % saturation is not correct. I would suggest using the water temp and DO to+get your saturation
from a table, I have a file down here. The pictures are on G: under Critcher animals. I did not talk with
the farmer yet. I never went on the property.

3. Today's inspection resulted from a complaint received by George Smith (WSRO-DWQ-SWP) alleging an accumulation of animal
waste in Mill Creek (Class C trout`). Mr. Smith followed -up on the complaint himself by visiting the site and collecting stream samples
for analysis of various parameters. Results indicate that there was a downstream DO violation (0.29 mg1L) and probable fecal coliform
violations (160,000 co11100 mL).
Visual stream observations were documented as well. At least 500 linear feet of stream was impacted due to severe stream bank
erosion caused by excessive cattle traffic and and the deposition of up to 10 inches of sediment and waste. This resulted it a water
CJity_standard violation for removal of best usage and settleable solids.

I know Mrs. Joan Hall. She is the daughter of one of our District
Superivsors.
Andrew (Coat Share Tech.) and I went out today to look at this site, I
am attaching pictures we took. After looking at this site we both felt
like this is a very high environmental issue as there is a direct
discharge of chicken litter going dire by into a small stream which
then feeds into Mill Creek; which 1 think is designated HOw.
