The site will be an easy fix as far as removing the cattle from the stream and we are planning to exclude them from the entire gully and dig a well and install water tanks. We are going to have him seed the entire area down with winter wheat or rye immediately. We are having to wait on some funding to do the work but we are signing him up for Ag Cost Share and EQIP. We will keep you posted of progress on this issue. He said he was working with you to implement your suggestions. I just wanted to confirm that he is working with you? If you think about it, and have time, could you keep me posted on his progress? At some point in the near future, we'll do a re -check of the oxygen and fecal to confirm that he's back in compliance, but I want to give him time to correct the problem. Thanks for all your help. Quality's Winston-Salem Regional Office (DWQ-WSRO) conducted a site investigation on your property on August 15, 2008 as a result of a'complaint received'by our office alleging the accumulation of animal waste in an unnamed tributary to Mill Creek, Class C Trout waters of the State. Our investigation included the collection .of stream samples that were analyzed for fecal coliform bacteria, dissolved oxygen (DO), pH, turbidity, biochemical oxygen'demand (BOD), and nutrient'levels. Additionally, visual observations. and photographs were obtained to further document the surface water conditions on that date. The followingiaboratory -resoits,,verify. violations of 'the:,State's wator.g4olityatandards fog; dissatve oxygen: Given that the fecal colifom� concentration was highly elevated downstream from the cattle, there is ttie expectation for future fecal collform violations if current conditions persist. Please be aware that denuding stream banks and causing sedimentation to enter the State's surface waters also violates North Carolina water quality standards for Best Usage and Settleable Solids: (1) Removal of Best Usage - The stream impacts noted above constitute a violation of 15A NCAC 2B .0211 (2) which states: "The waters will be suitable as a source of water supply for drinking as well as aquatic life propagation and maintenance of biological integrity, wildlife, and secondary recreation, and agriculture; sources of water pollution which preclude any of these uses on either a short-term or long-term basis will be considered to be violating a water quality standard ' (2) Settleable Solids Violation -The deposition of solids to surface waters is a violation of 15A NCAC 2B .0211(3) which states: 'Floating solids settleable solids; sludge deposits. only such amounts attributable to sewage, industrial wastes or other wastes as will not make the water unsafe or unsuitable for aquatic life and wildlife or impair the waters of any designated uses.' The Division of Water Quality requires that the violations detailed in this letter be abated immediately. These violations, and any future violations, are subject to a civil penalty assessment of up to $25,000 per day, per each violation. The Division of Water Quality requests that you respond in writing to this office within- ten (10) days following receipt of' this Notice. Your response should include a plan detailing the restoration of the impacted stream and adjoining riparian areas, including cattle exclusion and a schedule indicating proposed completion dates.
