The information you provided us indicated that your operation's animal population does not exceed the number set forth by 15A NCAC 2H .0217, and therefore does not require registration for a certified animal waste management plan. Under 15A NCAC 2H .0217, your facility is deemed permitted if waste is properly managed and does not reach the surface waters of the state. Any system determined to have an adverse impact on water quality may be required to obtain a waste management plan or an individual permit, You are reminded that a discharge of wastes to the surface waters of the state will subject you to a civil penalty up to $10,000 per day. Should you decide to increase the number of animals housed at your facility beyond the threshold limits listed below, you will be required to obtain a certified animal waste management plan prior to stocking animals to that level. Sullins, Deputy Director Division of Water Quality As you know, Division of Water Quality (DWQ) staff from the Winston-Salem Regional Office visited your dairy farm located along Golf Course Road on May 6, 2008 in response to a complaint received May 5, 2008. The complaint alleged a discharge of cattle waste from the dairy farm, including the waste storage pond, into a freshwater ditch located uphill from the New River. This letter is to summarize the water quality concerns noted during our investigation. Upon arrival, DWQ staff observed cattle waste leaking from a solid spreader and loading area as the waste was being removed from an uncovered pit or "wet stack" located at the west end of the freestall barn. The waste was observed flowing into a roadside ditch-and-tfaveling- about 528 feet downhill towards, -but not yet reaching, a culvert that passes from the -east side -of -- Golf Course Road to the west. Staff also observed that the lot surrounding the east end of the culvert was void of vegetation due to excessive cattle traffic. The current situation, if not remedied, allows for the run off of sediment and cattle waste from the cattle lot into the culvert. Please note that the culvert is located approximately 3800 feet uphill from the New River, a Class C - Outstanding Resource Water (ORW) of the State. While there was no apparent discharge into the New River on the date of our complaint investigation, there is certainly the potential for a discharge during rain events and if conditions deteriorate. A reminder, that the unpermitted discharge of animal waste into waters of the State is a violation of North Carolina General Statute (NCGS) 143-215.1. The enforcement remedies available to the Division for an unpermitted discharge include a civil penalty of up to $25,000.00 per day, per violation. It is expected that all animal wastes have been and continue to be contained so as to eliminate the potential for an unpermitted discharge in the future. Vegetation should be established in the lot surrounding the east end of the culvert to prevent further run-off of sediment and waste. In addition, we strongly urge your cooperation with the Alleghany County SWCD/NRCS regarding any technical and/or financial assistance that may be available. APS-WSRO received complaint via fax from DOT on 5/5108 alleging that "cow manure from dairy farm was flowing into ditches along SR 1347" (Golf Course Road). He runs the dairy farm, along with his son, Greg Crouse. I met with both Edward and Greg during my investigation. Upon arrival at the farm, I observed E. Crouse dipping cattle waste from an uncovered "waste pit" with a front end loader and loading it into a solids spreader. Waste was leaking from the dippinglloading area and from the spreader and had entered a roadside ditch and traveled 1/10 of a mile downhill, through a grassed waterway, then into a denuded pasture. At the time of my visit waste had NOT yet entered a fresh water culvert located in the denuded pasture. E. Crouse stated that waste is dipped from the pit every week since the waste comes from an unguttered, concrete lot. The Crouse's were instructed to immediately build an earthen berm to contain the waste and/or exclude the waste from the culvert, This was completed while I was on site. They were also instructed to keep cattle out of the denuded pasture where the culvert was located and to re -seed this area so as to establish a vegetated buffer around the culvert. It was suggested that they also dig a retention "hole" to also help with containing and excluding the waste from the culvert. I also suggested that they contact the Alleghany SWCD/NRCS for technical assistance regarding waste management/handling techniques. The Crouse's stated that they have applied for financial assistance in the past and would like to make improvements but the owner will not sign a 10-year lease with them. A long-term lease is required for State/Federal financial assistance. I also checked the waste storage pond and did not observe evidence of a recent overflow. The embankment was vegetated appropriately and was in good condition. Waste is pumped using a honey wagon. It is my opinion, that waste should be pumped from the waste pit so as not to allow waste to accumulate near the loading area. However, according to the Croue's, the pit is not deep enough to accomodate an agitator pump. Digging the waste pit deeper would most likely require permission from the owner. Gary did not receive fax until May 5, 2008 and he forwarded it to me that day. I did some background research of the arealfarm and visited the farm the next day (May 6, 2008). Comments: Upon my arrival, I found Edward Crouse (leasee) loading slurry cattle waste from an uncovered wet stack into a solid spreader. Since the manure had a lot of liquid in it, the waste was leaking from the solid spreader and running into a ditch and flowing 1110 mile downhill towards, but not reaching, a culvert that passes under Golf Course Road. I spoke with Edward and his son Greg Crouse regarding the potential for waste to enter the culvert and continue Flowing towards the New River. I also explained that once the waste entered waters of the State it would be considered an illegalldirect discharge with a probable civil penalty assessment. Edward immediately began constructing an earthen berm to contain the waste and to exclude it from the culvert. The Edward's stated that waste is dipped out of the wet stack every week and the milk parlor waste storage pond is pumped every three to four months. The waste pond was checked and estimated to have at least 12 inches of storage remaining and no evidence of previous over -topping. The Edward's were instructed to dam up the flowing waste with soil (which they completed while I was there) and to dig a retention hole to further contain the waste during rain events. They were also to exclude cattle from the pasture containing the culvert so that vegetation might be established to control sediment and waste run-off, The area is to then be seeded. They were to contact the Alleghany SWCDINRCS for technical/financial assistance regarding measures to manage the waste properly. The farm is owned by the Walter Dickey Doughton Trust with Richard L. Doughton as Trustee. The Crouses have the money and would like to dig the wet stack deeper, install gutters, etc, but the owner reportedly does not want to put money into the operation and won't give the Crouse's the 10 year lease that they need to qualify for Cost Share assistance. The Crouse's met with SWCDINRCS previously and developed a plan for dealing with the waste but the owner reportedly would not go along with it. Conveyance: Estimated Number of fish?
