The information you provided us indicated that your operation's animal population does not exceed the number set forth by 15A NCAC 2H .0217, and therefore does not require registration for a certified animal waste management plan. Under 15A NCAC 2H .0217, your facility is deemed permitted if waste is properly managed and does not reach the surface waters of the state. Any system determined to have an adverse impact on water quality may be required to obtain a waste management plan or an individual permit. You are reminded that a discharge of wastes to the surface waters of the state will subject you to a civil penalty up to $10,000 per day. Should you decide to increase the number of animals housed at your facility beyond the threshold limits listed below, you will be required to obtain a certified animal waste management plan and contact the Division of Water Quality prior to stocking animals. Operators who did not register by September 1, 1996 with their local Soil andWater Conservation District office or who can not. document that they made a good faith effort to obtain an approved animal waste management plan by December 31, 1997, will not receive a Special Agreement from the EMC. This is allowing rainwater to reach waste pit and should be correct. This could potentially cause a discharge problem. Comments: Operation has one house, about 2500 to 3000 pigs, and is a feeder to finish operation. There is no waste lagoon on site, all waste is contained in pit under the slat floor of the house. Specifically, the inspection was conducted to determine the status of your compliance with Title 15 A, North Carolina Administrative Code 2H .0200 regulations, which govern wastewater disposal systems which do not discharge to surface waters of the State. Animal waste management systems which comply with the .0200 regulations are "deemed permitted" by the Division, and thus, are not required to apply for individual permits for operation. The primary factor in assessing compliance with the regulations is whether or not a discharge of pollutants occurs from the facilities (in your case a lagoon and pits under hog houses) during any rain event less severe than a 25 year storm. A 25 year storm is a storm of such severity, that it can statistically be expected to recur once every 25 years. A 25 year storm in Yadkin County would amount to any rainfall 6 inches or greater within a 24 hour period. You should be aware, however, that because the weather data used to compile what is a 25 year storm covers many years, it is possible to experience 25 year storms on two consecutive days. Likewise, you could receive 5 inches of rain one day, and 5 inches the next, and neither would constitute a 25 year storm, so you would need at least 10 inches of freeboard to prevent a discharge. The freeboard level of your lagoon at the dairy operation was noted to be adequate at the time of the inspection. The appropriate freeboard level is at least 16 inches (1 foot plus the 6 inches from the 25 year storm). But, during the inspection a problem was noted at one of the hog house pits at the South Deep Creek Farm. Please be aware that the construction of manmade pipes, ditches, or other conveyances for the purpose of willfully discharging pollutants to the waters of the State may result in the immediate imposition of civil penalties of up to $5, 000. 00 for the first offense. This pit needs to be repaired, if it has not already been fixed, and you should Cake all precautionary measures to prevent any discharge from your operations. Should a discharge from your lagoon or pits occur, you could lose your "deemed permitted" status, requiring submittal of an individual nohdischarge permit application to DEM, or requiring you to get an approved animal waste management plan prior to the mandatory December 31, 1997 deadline for animal waste management plans. Just an FYI ---the same owner has at least one (maybe two) other farms under the same name (South Deep Creek). Our files show farm #99-1 as a swine farm having five houses with a waste pit underneath each house. No lagoons. I visited this farm many years ago. We also have 99-2 listed but no other info. Could 99-2 actually be the 499-17? Soil and water could not confirm this. Regardless of their ranking, owners of all waste lagoons and storage ponds have certain management responsibilities. These include taking appropriate actions to eliminate current discharges, prevent future discharges and to insure the stability of their structures. Staff of the Division of Water Quality will be in contact with owners of all inactive structures that have been determined to pose a serious environmental risk, based on its ranking and/or additional field data collected by the Department. All liquids and waste removed from these structures must be land applied at a rate not to exceed the agronomic needs of the receiving crops. Any major modifications made to the dike walls or structure must be done in accordance with current standards and under the direction of a technical specialist designated for structural design. The inspection was prompted by a recent complaint concerning the possibility of animal wastes reaching South Deep Creek. An inspection of the site revealed that hog wastes from your operation are being dumped down a steep eroded slope above a corn, field. Our observations of the ditches in the fields leading to South Deep Creek found solids and a greenish discoloration typical of animal wastes. Samples were taken to document the discharge. Please be advised that the non -permitted discharge of any type of wastewater to the waters of the State is a violation of North Carolina General Statute 143-215.1. This illegal discharge from your hog operation must be ceased immediately. You should contact the Yadkin Soil and Water Conservation District for technical advice on how to handle animal wastes in a legal and beneficial manner. As you are aware, current regulations require you to provide a certification form to our Division by December 31, 1997, verifying that -you have an animal waste management plan approved by the Soil and Water Conservation Commission. Doub Rt. 2 Eastbend, NC 27018 SUBJECT: Animal Waste Operation Inspection South Deep Creek Farm Yadkin County Dear Mr. Doub: As you are aware, an inspection of the animal waste handling facilities at your swine and cattle operations were conducted by Bill Justice and David Russell of this Office on July 28, 1995. Specifically, the inspection was conducted to determine the status of your compliance with Title 15 A, North Carolina Administrative Code 2H .0200 regulations, which govern wastewater disposal systems which do not discharge to surface waters of the State. Animal waste management systems which comply with the .0200 regulations are "deemed permitted" by the Division, and thus, are not required to apply for individual permits for operation. The primary factor in assessing compliance with the 'regulations is whether or not a discharge of pollutants occurs from the facilities (in your case a lagoon and pits under hog houses) during any rain event less severe than a 25 year storm. A 25 year storm is a storm of such severity, that it can statistically be expected to recur once every 25 years. A 25 year storm in Yadkin County would amount to any rainfall 6 inches or greater within a 24 hour period. You should be aware, however, that because the weather data used to compile what is a 25 year storm covers many years, it is possible to experience 25 year storms on two consecutive days. Likewise, you could receive 5 inches of rain one day, and 5 inches the next, and neither would constitute a 25 year storm, so you would need at least 10 inches of freeboard to prevent a discharge. The freeboard level of your lagoon at the dairy operation was noted to be adequate at the time of the inspection. The appropriate freeboard level is at least 18 inches (1 foot plus the 6 inches from the 25 year storm). But, during the inspection a problem was noted at one of the hog house pits at the South Deep Creek Farm. The end of one pit was damaged structurally, and as a 585 Waughtown Street. Please be aware that the construction of manmade pipes, ditches, or other conveyances for the purpose of willfully discharging pollutants to the waters of the State may result in the immediate imposition of civil penalties of up to $5, 000. 00 for the first offense. This pit needs to be repaired, if it has not already been fixed, and you should take all precautionary measures to prevent any discharge from your operations. Should a discharge from your lagoon or pits occur, you could lose your "deemed permitted" status, requiring submittal of an individual nondischarge permit application to DEM, or requiring you to get an approved animal waste management plan prior to the mandatory December 31, 1997 deadline for animal waste management plans.
