operation's animal population does not exceed the number set forth by 15A NCAC 2H .0217, and therefore does not
require registration for a certified animal waste management plan.
Under 15A NCAC 2H .0217, your facility is deemed permitted if waste is properly managed and does not
reach the surface waters of the state. Any system determined to have an adverse impact on water quality may be
required to obtain a waste management plan or an individual permit. You are reminded that a discharge of wastes to

II. ELIGIBILITY FOR A SPECIAL AGREEMENT:
As per Senate Bill 1217 which was ratified on June 21, 1996, the Environmental Management
Commission (EMC) may enter into a special agreement with an operator who registered by
September 1, 1996 with their local Soil and Water Conservation District office and who makes
a good faith effort. to obtain an approved animal waste management plan by December 31,
1997. -This special agreement shall set forth a schedule for the operator to follow to obtain an
approved animal waste management plan by a date certain and shall provide that the EMC shall
not issue a notice of violation for failure to have an approved animal waste management plan so
long as the operator complies with the special agreement. Operators who did not register by
September 1, 1996 with their local Soil andWater Conservation District office or who can not.
document that they made a good faith effort to obtain an approved animal waste management
plan by December 31, 1997, will not receive a Special Agreement from the EMC. These
facilities will be subject to civil penalties, criminal penalties, injunctions and all other
enforcement tools available to DWQ.

Senate Bill 1217, An Act to Implement Recommendations of the Blue Ribbon Study
Commission on Agricultural Waste, enacted by the 1996 North Carolina General Assembly,
requires a certified operator for each animal waste management system that serves 250 or more
swine by January 1, 1997. The owner of each animal waste management system must submit a
designation form to the Technical Assistance and Certification Group which designates an
Operator in Charge and is countersigned by the certified operator. The enclosed form .must be
submitted by January 1, 1997 for all facilities in operation as of that date. Failure to designate a
certified operator for your animal waste management system is a violation of 15A NCAC 2H
.0224 and may result in the assessment of a civil penalty.
If you have questions concerning operator training or examinations for certification, please
contact .your local North Carolina Cooperative Extension Service agent or our office.
Examinations have been offered on an on -going basis in many counties throughout the state for
the past several months and will continue to be offered through December 31, 1996.

On May 15, an Operation Review was conducted of South Deep Creek Farm's Swine Operations, facility
no. 99-01 & 99-02, This Review, undertaken in accordance with G.S. 143-215.10D, is one of two visits
scheduled for all registered livestock operations during the 1997 calendar year. The Division of Water Quality
will conduct a second site inspection.
During the Review, it was determined that waste was not being discharged to the waters of the State.
However, the following management deficiencies were discovered and noted for corrective action: waste
seeping from houses at both facilities; facilities in poor condition for restocking; waste needing to be pumped
from under slat floor storage at both facilities. These management deficiencies need to be addressed and
corrected. It is also noted that you do not have a certified swine waste operator. You must have a certified
operator for waste handling activities if you restock these houses. You are encouraged to contact your certified
technical specialist if additional assistance is needed. During ensuing reviews, these same deficiencies will be
re-examined to determine if corrective actions were implemented.
In order for your facility to remain in compliance with environmental regulations, animal waste cannot be
discharged into the waters of the State, and the animal waste collection, treatment, storage and disposal
systems must be properly maintained and operated under the responsible charge of a certified operator.
Please remember that you are required to obtain and implement an approved animal waste
management plan by the end of this year. The plan must be certified by either a designated technical specialist
or a professional engineer. For additional assistance with the plan, please contact your local Soil and Water
Conservation District Office or local Cooperative Extension Service Office.

Question 10: Some seepage is coming from the house. Waste is still in the under floor pit and needs to be cleaned out. Al
Question 12: House has wind damage and missing tin. This is allowing rainwater to reach waste pit and should be correct. This
could potentially cause a discharge problem.
Comments: Operation has one house, about 2500 to 3000 pigs, and is a feeder to finish operation. There is no waste lagoon on site,
all waste is contained in pit under the slat floor of the house. Mr. Doub needs to get the waste pits under this house pumped down.

This operation is currently non operational. There have been no animals on site since late 1995. �*
Question 5: Waste is held in pits under slat floors. There are no lagoons on site. The waste pits under the floors should be pumped
s soon as possible.
Question 7: The operation also does not have a certified operator. Someone must complete the certified operators course before
restocking with animals.
Question 10: Waste is seeping from houses #1 and #2. It is not a great volume currently and does not leave site, however, this
could become a serious problem.

On May 15, an Operation Review was conducted of the dairy operation at South Deep Creek Farm,
facility no. 99-17. This Review, undertaken in accordance with G.S. 143-215.10D, is one of two visits scheduled
for all registered livestock operations during the 1997 calendar year. The Division of Water Quality will conduct
a second site inspection.
During the Review, it was determined that waste was 1141 being discharged to the waters of the State,
and the animal waste collection, treatment, storage and disposal systems were properly maintained and
operated under the responsible charge of a designated operator. However, the following management
deficiencies were discovered and noted for corrective action: failure to install start pumping markers within the
pond; erosion gully forming on far side of pond wall; and failure to maintain pond banks (need to cut brush and
blackberry briars. These management deficiencies need to be addressed and corrected. You are encouraged
to contact your certified technical specialist if additional assistance is needed. During ensuing reviews, these
same deficiencies will be re-examined to determine if corrective actions were implemented.

SUBJECT: Animal Waste Operation Inspection

Dear Mr. Doub:
As you are aware, an inspection of the animal waste handling
facilities at your swine and cattle operations were conducted by
Bill Justice and David Russell of this Office on July 28, .1995.
Specifically, the inspection was conducted to determine the status
of your compliance with Title 15 A, North Carolina Administrative
Code 2H .0200 regulations, which govern wastewater disposal systems
which do not discharge to surface waters of the State.
Animal waste management systems which comply with the .0200
regulations are "deemed permitted" by the Division, and thus, are
not required to apply for individual permits for operation. The
primary factor in assessing compliance with the regulations is
whether or not a discharge of pollutants occurs from the facilities
(in your case a lagoon and pits under hog houses) during any rain
event less severe than a 25 year storm. A 25 year storm is a storm
of such severity, that it can statistically be expected to recur
once every 25 years. A 25 year storm in Yadkin County would amount
to any rainfall 6 inches or greater within a 24 hour period. You
should be aware, however, that because the weather data used to
compile what is a 25 year storm covers many years, it is possible
to experience 25 year storms on two consecutive days. Likewise,
you could receive 5 inches of rain one day, and 5 inches the next,
and neither would constitute a 25 year storm, so you would need at
least 10 inches of freeboard to prevent a discharge.
The freeboard level of your lagoon at the dairy operation was
noted to be adequate at the time of the inspection. The
appropriate freeboard level is at least 16 inches (1 foot plus the
6 inches from the 25 year storm). But, during the inspection a
problem was noted at one of the hog house pits at the South Deep
Creek Farm. The end of one pit was damaged structurally, and as a

result there is potential for a discharge from this pit. Please be
aware that the construction of manmade pipes, ditches, or other
conveyances for the purpose of willfully discharging pollutants to
the waters of the State may result in the immediate imposition of
civil penalties of up to $5, 000. 00 for the first offense. This pit
needs to be repaired, if it has not already been fixed, and you
should Cake all precautionary measures to prevent any discharge
from your operations. Should a discharge from your lagoon or pits
occur, you could lose your "deemed permitted" status, requiring
submittal of an individual nohdischarge permit application to DEM,
or requiring you to get an approved animal waste management plan
prior to the mandatory December 31, 1997 deadline for animal waste
management plans.

The dairy waste pond for this farm (#99-17) has been closed out.
Just an FYI ---the same owner has at least one (maybe two) other farms under the same name (South
Deep Creek). Our files show farm #99-1 as a swine farm having five houses with a waste pit
underneath each house. No lagoons. I visited this farm many years ago.
We also have 99-2 listed but no other info. Could 99-2 actually be the 499-17? Soil and water could
not confirm this.

Carolina Department of Environment of Natural Resources (DENR) to develop an inventory and
ranking of all inactive lagoons and storage ponds in the State. In order to meet this directive, a
representative of DENR has recently evaluated the inactive lagoon(s) and/or storage pond(s) on your
property. Inactive lagoons and storage ponds were defined by the Statute as structures which were
previously used to store animal waste but have not received waste for at least one year.
The information collected on your property is contained in the attached field data sheets. Using
this field data, staff ranked your inactive waste structures as high, medium or low according to its
potential risk for polluting surface and/or groundwater. Your waste structure(s) was ranked as

proper closure of inactive lagoons and storage ponds according to current or alternative standards.
Regardless of their ranking, owners of all waste lagoons and storage ponds have certain
management responsibilities. These include taking appropriate actions to eliminate current
discharges, prevent future discharges and to insure the stability of their structures. Staff of the
Division of Water Quality will be in contact with owners of all inactive structures that have been
determined to pose a serious environmental risk, based on its ranking and/or additional field data
collected by the Department.
All liquids and waste removed from these structures must be land applied at a rate not to exceed
the agronomic needs of the receiving crops. Any major modifications made to the dike walls or
structure must be done in accordance with current standards and under the direction of a technical
specialist designated for structural design. Your local Soil and Water Conservation District is an
excellent source for information and guidance related to proper waste application practices, structure
operation and maintenance, and other related animal waste management standards and/or
requirements.
Nothing in this letter should be taken as removing from you the responsibility and liability for
any past or future discharges from your lagoon(s) and/or storage pond(s) or for any violations of
surface water or groundwater quality standards.

On February 25, 1994, Mr. Mike Mickey and Mr. Corey Basinger of this office visited
your hog operation at the end of Todd Road. The inspection was prompted by a recent complaint
concerning the possibility of animal wastes reaching South Deep Creek. An inspection of the
site revealed that hog wastes from your operation are being dumped down a steep eroded slope
above a corn, field. Our observations of the ditches in the fields leading to South Deep Creek
found solids and a greenish discoloration typical of animal wastes. Samples were taken to
document the discharge.
Please be advised that the non -permitted discharge of any type of wastewater to the waters
of the State is a violation of North Carolina General Statute 143-215.1. This illegal discharge
from your hog operation must be ceased immediately.
You should contact the Yadkin Soil and Water Conservation District for technical advice
on how to handle animal wastes in a legal and beneficial manner. As you are aware, current
regulations require you to provide a certification form to our Division by December 31, 1997,
verifying that -you have an animal waste management plan approved by the Soil and Water
Conservation Commission. It is our off ce's recommendation that you consider installing a
lagoon for additional storage capacity during wet weather conditions as well as a pump and
irrigation system for reliable waste application at agronomic rates.

As you are aware, an inspection of the animal waste handling
facilities at your swine and cattle operations were conducted by
Bill Justice and David Russell of this Office on July 28, 1995.
Specifically, the inspection was conducted to determine the status
of your compliance with Title 15 A, North Carolina Administrative
Code 2H .0200 regulations, which govern wastewater disposal systems
which do not discharge to surface waters of the State.
Animal waste management systems which comply with the .0200
regulations are "deemed permitted" by the Division, and thus, are
not required to apply for individual permits for operation. The
primary factor in assessing compliance with the 'regulations is
whether or not a discharge of pollutants occurs from the facilities
(in your case a lagoon and pits under hog houses) during any rain
event less severe than a 25 year storm. A 25 year storm is a storm
of such severity, that it can statistically be expected to recur
once every 25 years. A 25 year storm in Yadkin County would amount
to any rainfall 6 inches or greater within a 24 hour period. You
should be aware, however, that because the weather data used to
compile what is a 25 year storm covers many years, it is possible
to experience 25 year storms on two consecutive days. Likewise,
you could receive 5 inches of rain one day, and 5 inches the next,
and neither would constitute a 25 year storm, so you would need at
least 10 inches of freeboard to prevent a discharge.
The freeboard level of your lagoon at the dairy operation was
noted to be adequate at the time of the inspection. The
appropriate freeboard level is at least 18 inches (1 foot plus the
6 inches from the 25 year storm). But, during the inspection a
problem was noted at one of the hog house pits at the South Deep
Creek Farm. The end of one pit was damaged structurally, and as a

result there is potential for a discharge from this pit. Please be
aware that the construction of manmade pipes, ditches, or other
conveyances for the purpose of willfully discharging pollutants to
the waters of the State may result in the immediate imposition of
civil penalties of up to $5, 000. 00 for the first offense. This pit
needs to be repaired, if it has not already been fixed, and you
should take all precautionary measures to prevent any discharge
from your operations. Should a discharge from your lagoon or pits
occur, you could lose your "deemed permitted" status, requiring
submittal of an individual nondischarge permit application to DEM,
or requiring you to get an approved animal waste management plan
prior to the mandatory December 31, 1997 deadline for animal waste
management plans.
