Proposed Impacts to 'Vaters of the United States/Waters of the State It is the applicant's (or agent's) responsibility to determine, delineate and map all impacts to wetlands, open water, and stream channels associated with the projcct. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. See attached. VIII. Mitigation 1. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. Please attach a separate sheet if more space is needed. See attached. 2. Mitigation may also be made by payment into the North Carolina Wetlands Restoration Program (NCWRP). Please note it is the applicant's responsibility to contact the NCWRP at (919) 733-5208 to determine availability and to request written approval of mitigation prior to submittal of a PCN. Existing Conditions Soils !nformation from the 2000 USDA Soil Survey of Burke County indicates that soils in the project area consist ofWoolwine-Fairview soils on the upland portions of the site, with Meadowfield-Rhodiss soils associated with the drainages on the site. The Woolwine- Fairview series soils on the upland areas with slopes ranging from 8-25 percent are typically eroded; Meadowfield-Rhodiss soils are very stony and are found on slopes ranging from 25-60%. A soils map is attached, showing the distribution of the soils on the property. Wetlands There are two wetlands on the proposed site. Wetland 1 is an isolated wetland located on the western boundary of the tract, adjacent to a large bend in the Lake Rhodiss Road and covers an area of approximately 0.13 acres. The soil boring in this wetland yielded a sample best described as a sandy clay, 10YR4/2 matrix with 15% 5YR4/6 mottle from 0- 5" depth, 1OYR4/3 matrix with 10% 5YR4/6 mottle from 5-13" depth, and 10YR4/2 matrix with 30% 5YR4/6 mottle from 13-18+" depth. Standing water in the pit was present at a depth of 18", drainage patterns were evident, and water-stained leaves were also abundant in the area. Vegetation within Wetland 1 was typically hydrophytic. Plants observed in the wetland were black willow, sweetgum, red maple, hazel alder, deciduous holly, buttonbush, sedges, tearthumb, Japanese honeysuckle, greenbriar, and wild grape. The eastern edge of this wetland will be near the bottom of a fill slope, but no adverse impacts to the wetland are anticipated. Wetland 2 is located in the southwestern corner of the tract, also near the Lake Rhodiss Road, and covers an area of approximately 0.17 acres. A soil boring in this wetland yielded a sample best described as a loamy clay, 10YR2/1 matrix with no mottle from 0- 5" depth, 10YR4/1 matrix with 1% 7.5YR4/6 mottle from 5-13" depth, 5Y311 matrix with no mottle from 13-16" depth and 2.5Y4/1 matrix with 5% 7.5YR4/4 mottle from 16- 18+" depth. Free water was present at a depth of3" in the pit, water-stained leaves were abundant in the area, and a sulfidic odor was detected. Wetland 2 is also associated with a spring, which gives rise to a small stream as it flows from the wetland. Vegetation within the wetland was typically hydrophytic. Plants observed in the wetland were red maple, American hornbeam, deciduous holly, Chinese privet, sedges, sensitive fern, yellow root, and Japanese honeysuckle. The proposed high school will have no impact to this wetland. Waters of the US The western boundary of the tract is formed by a perennial stream (S-I) approximately 4' wide and 3"-6" deep; this is a bedrock-controlled stream. This unnamed stream flows northward into Lake Rhodiss. A 50-foot buffer to the west of the stream (measured from Nationwide Permit Application Attachments, Page 2 Burke County Public Schools, East High School, Lovelady Road top-of-bank westward into the tract) will be placed in a permanent conservation easement; all construction activities will be kept outside this buffer. A small, intermittent stream (S-2) and seep are located on the northern end of the tract, near the proposed football field and track facilities. It will be necessary to culvert ~pproximately 149 feet of this stream in order to establish a stable slope with fill dirt there. The eastern boundary of the tract is adjacent to Hoyle Creek (S-3) and is separated from this stream by a paved, two-lane access road for most of the length of the eastern boundary of the tract. Hoyle Creek is a perennial stream, approximately 8' wide and 6"- 12" deep. A relatively short section (approximately 500 feet) of Hoyle Creek forms the tract boundary in the northwest corner of the tract. No development is scheduled for the area near Hoyle Creek in this section of the tract. A small, intermittent stream (S-4) is associated with Wetland 2 located in the southwestern corner of the tract. This stream originates at Wetland 2 and flows northwest into Hoyle Creek. No development is scheduled for this section of the tract. Four wet weather conveyances (WWC 1-4) were located during the survey; these conveyances are watercourses that flow only in response to storm events. Two of the wet weather conveyances drain eastward into S-I; the other two drain westward into Hoyle Creek. Each of the four wet weather conveyances have substrates consistent with soils (sandy loams) found on the site. Federally Protected Species A list of federal threatened, endangered, and species of concern for Burke County was obtained from the North Carolina Natural Heritage Program database (Table 1). This list included 4 federally endangered, 3 federally threatened, and 16 species of federal special concern recorded for Burke County. Habitat requirements for each of the 23 species were considered. Ofthe 23, 15 species had specific habitat requirements not satisfied by the site. The remaining 8 species could potentially occur at the site; 1 (Hexasty/is nalliflora) of the 8 species was found during the field survey. Dwarf-flowered heart leaf (Hexastylis Ilaniflora) is a low-growing, perennial herb; it is endemic to the upper Piedmont of North Carolina and South Carolina. This plant typically grows along bluffs and north-facing slopes, boggy areas near streams, and adjacent slopes in deciduous forests. It is usually associated with acidic, sandy loam soils, Dwarf-flowered heartleafwas found in three areas of the proposed high school site. The first area includes approximately 91 plants, is roughly crescent-shaped and located near the northern boundary of the tract. This area overlaps a portion of the fill adjacent to the Nationwide Permit Application Attachments, Page 3 Burke County Public Schools, East High School, Lovelady Road proposed football field and track facility; 24 of the 91 plants will be impacted and will require relocation. The second area is located around a small seep and intermittent stream (S-3) and contains approximately 105 plants; all of these plants will be impacted and will require relocation. This area will be located under the fill immediately to the north of the proposed track/football field. The third area containing dwarf-flowered heartleaf is located along the banks in the northern portion of the perennial stream (S-I) on the eastern boundary of the tract. This area contains approximately 117 plants; none will be impacted by the proposed school. VD. Impact Justification (Avoidance and Minimization) The search for potential sites for the new East Burke County High School began in September 2004. Three sites were considered; the first two were eliminated largely due to the necessity of multiple stream crossings and proximity to floodplains. After elimination of the first two sites, a total of 9 schemes were devised for the current Lovelady Road site. These were subsequently evaluated for minimization of environmental impact, efficiency of traffic flow, public safety, and the necessity to keep all buildings and athletic fields in reasonable proximity to one another. For more information, see attached schemes and narrative from Cort Architectural Group, P A. The Lovelady Road site is bordered by a perennial stream to the east; small wetlands are also located along the Lake Rhodiss Road on the western side of the tract. Some of the eliminated schemes required one or more perennial stream crossings, Another site on Lovelady Road was also considered but was eliminated as it required crossing a perennial stream (S-I) and placed the footprint of the campus across a ravine. This placement would have also mixed car and school bus traffic, which is not desirable according to the North Carolina Division of Public Instruction. The current scheme places the campus on the west side of the perennial stream (S-I), requires no crossings of this stream, encroaches least on the floodplain when compared to the other schemes, and does not impact the wetlands at all. All of the schemes for this site required culverting the intermittent stream on the northern portion of the site; no scheme was able to avoid this feature. The School Site Planner published by the North Carolina Division of School Planning states that a minimum of 48 useable acres is required for an 800-student high school with a stadium and spectator area. Of the 77.3 acres on the Lovelady Road site, 58 will be denuded during construction; in addition to the 800-student high school with a stadium and spectator area these 58 acres will contain additional recreational facilities for community use. Length of the intermittent stream to be culverted was minimized as much as possible; the filled area north of the football field and track facility is necessary to allow access to this area, behind bleachers and an outbuilding. The width of this area is usually 30 feet from the back of the bleachers; to reduce the length of culverted stream, the width of this area was reduced to 10 feet, which is a minimum required for pedestrian egress in this type of facility. Mitigation Plan The proposed mitigation plan entails protection of approximately 2500 feet of perennial stream, 400 feet of intermittent stream, and 1.5 additional acres of forested upland on the northern portion of the tract. This protection will be achieved by placing a 50-foot buffer along the western side (the eastern side is not part of the tract) of the perennial stream (S- 1), placing a 50-foot buffer along both sides of the intermittent stream (S-2), just downstream of the culverted section and extending to the property line, and placing an area north and west of the proposed football field and track facility into a conservation easement. This would result in an estimated total of 5.33 acres of the site via conservation easement. Hexastylis naniflora plants are located in areas where they will be impacted by construction of the new schoo\. These areas include the culverted intermittent stream section and the northwestern corner of the football field / track facility. Of the 313 individual plants identified during the field survey, 129 will be impacted and will require relocation. Plants within the impacted areas will be relocated to nearby areas of suitable habitat, which are also protected by conservation easement. All of the proposed conservation easement areas contain habitat for Hexastylis naniflora. Each relocated plant will be placed in an area that has hydrology and aspect similar to its original location. Whether impacted or unimpacted, each individual Hexastylis naniflora plant will be marked with a pin flag, numbered, and mapped (via GPS or measurement from a known station). Impacted and unimpacted plants will be monitored bimonthly for 1 year to determine survival rates of impacted and unimpacted plants. This approach will allow investigators to separate natural population fluctuation with effects of relocation on survival of relocated plants. This monitoring plan will also provide valuable information to determine potential effectiveness of Hexastylis naniflora relocation efforts elsewhere. Upon completion of the monitoring plan, a report will be prepared and sent to the US Fish and Wildlife Service, The North Carolina Natural Heritage Program, and the US Army Corps of Engineers. . . To get you some background information on these sketches, we started looking for a site September of last year. The first site we looked at was on the corner of US 70 and Peeler Street. This site was 60+ acres but presented a few major hurdles to get over. One such item was the amount of water on site, Please note the stream crossings. As you can see from the sketch, this site contained a steady moving stream along with a 2+ acre lake. Also, another issue we faced with this site was the separation of the ball fields. With these issues in the way, we proceeded to the next site. The next track of land was located on Lovelady Road, just SW of site chosen. This site contained 88+ acres and contained one large stream and almost 8-1/2 acres of Flood Plain. This scheme required stream crossings. In trying to keep all ball fields and buildings out of the flood plain, we proceeded to look at the site across the road. This site has been chosen due to the utilities and roads in place and the potential of this site for the future of the school and the future of the community. After the decision was made to proceed with the site, we started getting schemes together to present to the School Board. We started out with all of the ball fields on the south side of the property and the stadium and practice field on the North side of the property. This arrangement of fields stays consistent throughout all the schemes. However, the big difference in the schemes is the Entry Road. Scheme "A", Option 1, has the Main Entry Road and student drop-off driving up facing the school with a two-lane 24' wide road, The students must cross the stream at the south end of the property, going 1200 linear feet on the East side of the stream and then cross it again. This is not a good option due to the two stream crossings, see enclosures. Pam Boaze Burke High Schools Page 2 of 3 Scheme "A", Option 2, uses the same Entry Road and student drop-off as Option 1, but has all the students entering/leaving Campus on the West side onto Lake Rhodhiss Road. However, one of the contingencies of Burke County Public Schools for purchasing and using this site was no student traffic on this road, school buses and deliveries only. Scheme "A", Option 3, is identical to Option 2, only eliminates the practice field on the North side. This was not a good option for Burke County Public Schools, since their need for this practice field is high and the plan to have this open for public use allows the community and school system to work together to create a school that is a true asset to the community. Scheme "A", Option 4, takes the Entry Road and has it come around the baseball field and the student drive face the school and stay on the west side of the stream. This scheme is the best option, since both roads stay within the stream banks and do not use Lake Rhodhiss Road for a student entry, Scheme "B" takes the entire Campus and moves it on the East side of the stream. This scheme was not looked at in depth as much as Scheme "A" for a couple of reason: One reason is the main Entry Road for all vehicles crosses the stream and instead of splitting the cars and buses, vehicles are placed coming and going on one 24' wide road. According to the North Carolina Division of Public Instruction, it is desirable to avoid mixing parent drop-off driveways with bus driveways. Secondly, looking at the topo you can see an existing water ravine going through the middle of the school. This of course would not be a good idea. After this presentation on February 19 to the School Board, we took their comments and suggestions and proceeded with additional sketches. Using Scheme "A", Option 4, we started moving fields and roads. Option 4.A just places the ball fields on the west side of the Entry Road and gets them close together to allow use of only one Field House/Concessions Stand. Option 4.A.1 is identical to 4.A however, it eliminates the practice field on the North side of the property. As stated earlier this is not a good option for Burke County Public Schools, since their need for this practice field is high and the plan to have this open for public use enabling the school to become a true asset to the community. Pam Boaze Burke High Schools Page 3 of 3 Option 4.B takes Scheme "A" Option 4 and moves some ball fields around to allow maximum community use. Option 4.C mirrors the Campus. As you can see, this option lengthens all of the roads and places the football stadium in the 68' RW for the power line which of course is not an option. After meeting with the School Board and presenting these schemes, they decided to proceed with Option 4,A. We took their comments and suggestions and developed the plan to its current condition. As you can tell, these plans have been through the strainer several times to achieve the end result. We have made every effort to eliminate stream crossings which is nearly impossible when planning for an 80-acre complex.
