Bowman: Dee Freeman Secretary As you may recall, on September 10, 2012 you contacted staff with the North Carolina Division of Water Quality, Winston-Salem Regional Office (DWQ) to make a notification of a liquid manure discharge to surface waters for Bowman Dairy, Inc. in Guilford County. It is DWQ's understanding that the shutoff and safety valves for the animal waste irrigation system were left open following an irrigation event on a previous date. Subsequently the piping associated with the animal waste irrigation system eventually ruptured below the waste storage pond embankment resulting in the uncontrolled release of animal waste into an unnamed a tributary of North Prong Stinking Quarter Creek, which is classified as a "Water Supply V— Upstream" (WS V) and "Nutrient Sensitive Waters" (NSW) in the Cape Fear River basin. DWQ visited the site on September 10, 2012, and made the following observations: 1) the shutofTvalves had been closed, 2) an earthen berm was constructed, within a few hours of the spill, in an attempt - o prevent any additional discharge of animal waste into the stream, 3) and lime was in the process of being applied over the spiv area to stabilize the waste. The estimated amount of waste that was released and discharged from the waste storage pond before the valves were closed was approximately 80,000 gallons. Stream samples were obtained and anal} -zed to monitor any potential surface water impacts. Follow-up sampling and investigation will be conducted. Bowman Dairy, Inc. — NOV-201*-0315 September 17, 2012 Page 2 of 2 The unpermitted discharge cited above violates NC General Statute NCGS 143-215.1 (a) - which reads "Activities for Which Permits Required. -- No person shall do any of the following things or carry out any of the following activities unless that person has received a permit from the Commission and has complied with all conditions set forth in the permit: (1) Make any outlets into the waters of the State." and Permit Condition I. 1. - which discusses failure to operate the facility as a non4scharge system and prevent a discharge of waste that reaches surface waters. Corrective Actions: If you have not already done so, please take the following corrective actions: 1. Issue a Press Release within forty-eight (48) hours after first knowledge of discharge to surface waters as outlined in Permit Condition III. 16. It should be noted that DWQ received a copy of this Press Release on September 11, 2012. 2. Awaste sample must be obtained within seventy-two (72) hours following first knowledge of discharge to surface waters, from the source storage pond, and shall be analyzed for the minimum parameters which are stated in Permit Condition III.9.f The results must be submitted to our office within thirty (30) days of the discharge event. 3. File a written report to the WSRO within five (5) calendar days following first knowledge of occurrences (i.e. discharge) outlined in Permit Condition I11.13. 4. Place a Public Notice within ten (10) days following the discharge as outlined in Permit Condition ID. 17. DWQ would like to thank you for notifying the WSRO as required in your Pemlit under Condition III. 13. a., and for the quick response in constructing the earthen berm for containment purposes. It -is recommended that you begin the practice of closing the shutoff and safety valves for the irrigation system following each irrigation event in the future. The term colonies is used because the bacteria tend to clump together. As requested, I am forwarding the latest sample results (see attached). This sample was obtained from the waste storage pond ---not from the stream. MPN stands for "most probable number." For those interested, the following excerpts come from the EPA website: Members of two bacteria groups, coliforms and fecal streptococci, are used as indicators of possible sewage contamination because they are commonly found in human and animal feces. Although they are generally not harmful themselves, they indicate the possible presence of pathogenic (disease -causing) bacteria, viruses, and protozoans that also live in human and animal digestive systems. Therefore, their presence in streams suggests that pathogenic microorganisms might also be present and that swimming and eating shellfish might be a health risk. Since it is difficult, time-consuming, and expensive to test directly for the presence of a large variety of pathogens, water is usually tested for coliforms and fecal streptococci instead. The most commonly tested fecal bacteria indicators are total coliforms, fecal coliforms, Escherichio coli, fecal streptococci, and enterococci. All but E. coli are composed of a number of species of bacteria that share common characteristics such as shape, habitat, or behavior; E. coli is a single species in the fecal coliform group. Fecal coliforms, a subset of total coliform bacteria, are more fecal -specific in origin. Water Quality) about the lagoon breach at Bowman Dairy. The breach was caused by equipment failure (ruptured pipe). The lagoon was repaired and is now in working condition. Several water samples were collected in the North Prong Stinking Quarter Creek downstream from the spill. Elevated fecal coliform levels (8200 colonies per liter) were observed in one location. Acceptable fecal coliform levels are < 200 colonies per liter. Samples collected downstream returned to < 200 (144 at Phillippi; 180 at Alamance Church Rd). The Dairy's operator has submitted all forms and paperwork to DWQ; signs were posted in the area and notices were sent to local newspapers. To date, there have been no complaints received by neighbors or people downstream. Immediately after the detection the safety valve was shut off. There was a considerable amount of waste water noticed so Melissa Rosebrock from the Winston Salem regional offices was notified. In the meantime, a berm was constructed that included a pit behind it. Next dolomitic lime stone and hydrated lime was applied to the area where the runoff had occurred. There were seven waste samples collected and sent to Research and Analytical Lab in Kernersville. Lastly, public notices were sent to the Greensboro News and Record, and the Burlington Times News on September 12, 2012. Solution: First, a new hose was purchased and installed to be in place prior to the next waste application. As a new factor in our standard operation of guidelines the safety valve will be closed when pump is not in use as well as make routine observations of the pump to insure it is working properly. Lastly, the intake suction tube will be sheltered when not in use to prevent UV damage. A training and certification program is not yet available for animal waste management systems involving cattle, horses, sheep, or poultry. Owners and operators of these systems will be issued temporary animal waste management certificates by the Water Pollution Control System Operators Certification Commission (WPCSOCC). The temporary certificates will expire December 31, 1997, and will not be renewed. Mr. Ron Linville of this office in conjunction with Mr_ John Andrews, District NRCS Conservationist visited your animal operation on October 19, 1995. observations at your facility have been categorized as follows: Category I. NOTICE OF VIOLATION A wastewater lagoon at your facility has overflowed. Adequate freeboard (minimum of 1911) is not being maintained in the lagoon. A pipe, ditch, pad or other conveyance can contribute to waste being discharged from the animal operation (ie. parlor wash ditch). operational and Maintenance concerns exist which are likely.to cause animal waste runoff in a manner that is detrimental to water quality. Category II. NOTICE OF CONCERN Parlor wash, calf feeding or other activities could contribute negative impacts to water quality. Loafing areas have the potential to release waste intermixed with rainfall to the extent that water quality could be negatively impacted. Existing apparatus for controlling waste need repair or replacement. X Other: Corner of loafing area needs curbing and Pining. Category III. Please be advised that any non -permitted discharge of any type of wastewater to the waters of the State is illegal per North Carolina General Statute 143-215.1. Discharges from the lagoons and feedlots must cease immediately. Until compliance is achieved with the regulations, your Farm will be considered in violation of GS: 143-215.1 and could be subject to enforcement action with the possible assessment of civil penalties of up to $10,000 per day per violation. If your facility has any Category II NOTICE OF CONCERNS, you should notify the Winston-Salem Regional Office by phone at (910) 771-4600 to discuss your progress in resolving water quality concerns by December S, 1995. For both Category I and II above, this office recommends that you seek the advice of the Guilford Soil and Water Conservation District at 910/333-5460 prior to providing a written or verbal response to this office. Your cooperation in this matter is greatly appreciated. If you have abandoned waste lagoons or storage ponds, you should consider proper closure of the structures. Operations below threshold limits may be removed from the registry providing a written request is submitted to the Division.
