As you may recall, on September 10, 2012 you contacted staff with the North Carolina Division of Water
Quality, Winston-Salem Regional Office (DWQ) to make a notification of a liquid manure discharge to
surface waters for Bowman Dairy, Inc. in Guilford County.
It is DWQ's understanding that the shutoff and safety valves for the animal waste irrigation system were left
open following an irrigation event on a previous date. Subsequently the piping associated with the animal
waste irrigation system eventually ruptured below the waste storage pond embankment resulting in the
uncontrolled release of animal waste into an unnamed a tributary of North Prong Stinking Quarter Creek,
which is classified as a "Water Supply V— Upstream" (WS V) and "Nutrient Sensitive Waters" (NSW) in
the Cape Fear River basin.
DWQ visited the site on September 10, 2012, and made the following observations: 1) the shutofTvalves had been closed, 2) an earthen berm was constructed, within a few hours of the spill, in an attempt - o
prevent any additional discharge of animal waste into the stream, 3) and lime was in the process of being
applied over the spiv area to stabilize the waste. The estimated amount of waste that was released and
discharged from the waste storage pond before the valves were closed was approximately 80,000 gallons.
Stream samples were obtained and anal} -zed to monitor any potential surface water impacts. Follow-up
sampling and investigation will be conducted.

The unpermitted discharge cited above violates NC General Statute NCGS 143-215.1 (a) -
which reads "Activities for Which Permits Required. -- No person shall do any of the following things or
carry out any of the following activities unless that person has received a permit from the Commission and
has complied with all conditions set forth in the permit: (1) Make any outlets into the waters of the
State." and Permit Condition I. 1. - which discusses failure to operate the facility as a non4scharge
system and prevent a discharge of waste that reaches surface waters.
Corrective Actions:
If you have not already done so, please take the following corrective actions:
1. Issue a Press Release within forty-eight (48) hours after first knowledge of discharge to
surface waters as outlined in Permit Condition III. 16. It should be noted that DWQ received a copy
of this Press Release on September 11, 2012.
2. Awaste sample must be obtained within seventy-two (72) hours following first knowledge of
discharge to surface waters, from the source storage pond, and shall be analyzed for the minimum
parameters which are stated in Permit Condition III.9.f The results must be submitted to our office
within thirty (30) days of the discharge event.
3. File a written report to the WSRO within five (5) calendar days following first knowledge of
occurrences (i.e. discharge) outlined in Permit Condition I11.13.
4. Place a Public Notice within ten (10) days following the discharge as outlined in Permit
Condition ID. 17.
DWQ would like to thank you for notifying the WSRO as required in your Pemlit under Condition III. 13. a.,
and for the quick response in constructing the earthen berm for containment purposes. It -is recommended
that you begin the practice of closing the shutoff and safety valves for the irrigation system following each
irrigation event in the future.

Just a clarification: The concentration of fecal coliform bacteria is reported in colonies per mL ---not per liter, as was
stated in the previous email below. The term colonies is used because the bacteria tend to clump together. As
requested, I am forwarding the latest sample results (see attached). This sample was obtained from the waste
storage pond ---not from the stream. MPN stands for "most probable number."
For those interested, the following excerpts come from the EPA website:
Members of two bacteria groups, coliforms and fecal streptococci, are used as indicators of possible sewage
contamination because they are commonly found in human and animal feces. Although they are generally not
harmful themselves, they indicate the possible presence of pathogenic (disease -causing) bacteria, viruses, and
protozoans that also live in human and animal digestive systems. Therefore, their presence in streams suggests that
pathogenic microorganisms might also be present and that swimming and eating shellfish might be a health risk.
Since it is difficult, time-consuming, and expensive to test directly for the presence of a large variety of pathogens,
water is usually tested for coliforms and fecal streptococci instead.
The most commonly tested fecal bacteria indicators are total coliforms, fecal coliforms, Escherichio coli, fecal
streptococci, and enterococci. All but E. coli are composed of a number of species of bacteria that share common
characteristics such as shape, habitat, or behavior; E. coli is a single species in the fecal coliform group. Fecal
coliforms, a subset of total coliform bacteria, are more fecal -specific in origin. That is why NC requires discharges from
animal waste facilities to test
The membrane filtration method (MF) involves filtering several different -sized portions of the sample using filters
with a standard diameter and pore size, placing each filter on a selective nutrient medium in a petri plate, incubating
the plates at a specified temperature for a specified time period, and then counting the colonies that have grown on

I spoke with Melissa Rosebrock (Div. Water Quality) about the lagoon breach at Bowman Dairy. The breach was caused by
equipment failure (ruptured pipe). The lagoon was repaired and is now in working condition. Several water samples were
collected in the North Prong Stinking Quarter Creek downstream from the spill. Elevated fecal coliform levels (8200 colonies per
liter) were observed in one location. Acceptable fecal coliform levels are < 200 colonies per liter. Samples collected
downstream returned to < 200 (144 at Phillippi; 180 at Alamance Church Rd).
The Dairy's operator has submitted all forms and paperwork to DWQ; signs were posted in the area and notices were sent to
local newspapers. To date, there have been no complaints received by neighbors or people downstream. DWQ is planning to
collect additional water samples soon.

Waste Pond Spill

Occurrence:
At approximately 2:20pm on September 10, 2012 it was discovered that a pump suction hose had burst.
Immediately after the detection the safety valve was shut off. There was a considerable amount of
waste water noticed so Melissa Rosebrock from the Winston Salem regional offices was notified.
In the meantime, a berm was constructed that included a pit behind it. Next dolomitic lime stone and
hydrated lime was applied to the area where the runoff had occurred. There were seven waste samples
collected and sent to Research and Analytical Lab in Kernersville. Lastly, public notices were sent to the
Greensboro News and Record, and the Burlington Times News on September 12, 2012.
Solution:
First, a new hose was purchased and installed to be in place prior to the next waste application.
As a new factor in our standard operation of guidelines the safety valve will be closed when
pump is not in use as well as make routine observations of the pump to insure it is working
properly. Lastly, the intake suction tube will be sheltered when not in use to prevent UV
damage.
With these new actions in place it will minimize chance of reoccurrence in the future.

The Non -Discharge Permitting Unit has completed a preliminary engineering review of the subject application. Additional
information is required before we can continue our review. Please address the following by December 7, 2000:
According to the Waste Utilization Plan (WUP) submitted, the total amount of waste produced per year
(Feces and Urine + Parlor Water + Runoff from Feedlot + Excess Rainfall) is 1,342.568 gallons of
wastewater or 179,475 cubic feet of wastewater per year. The Dairy Waste Storage Worksheet that was
submitted indicates that the total liquid volume required is only 98,414 cubic feet for 225 days of storage.
Please provide an explanation and/or calculations showing how the waste totals in the worksheet were
determined.
Please note that all WUP re-6sions must be signed and dated by both the owner and the technical specialist. Please
reference the subject permit application number when providing the requested information. All information should be signed,
sealed, and submitted in duplicate to my attention at the address below. The information requested by this letter must be
submitted on or before December 7, 2000 or the Division will return your application as incomplete in accordance with 15A
N.C.A.C. 2H .0200 and your facility will be considered to be operating without a permit.
Please be advised that operation of the subject animal waste management system without a valid permit is a violation of North
Carolina General Statute 143-215.1 and will subject you to the enforcement authority of the Environmental Management
Commission.

This letter is being sent to clarify the recordkeeping requirement for Plant Available Nitrogen (PAN)
application on fields that are part of your Certified Animal Waste Management Plan.
In order to show that the agronomic loading rates for the crops being grown are not being exceeded, you
must keep records of all sources of nitrogen that are being added to these sites. This would include nitrogen
from all types of animal waste as well as municipal and industrial sludges/residuals, and commercial fertilizers.
Beginning January 1, 2000, all nitrogen sources applied to land receiving animal waste are required to
be kept on the appropriate recordkeeping forms (i.e. IRR1, IRR2, DRY1, DRY2, DRY3, SLUR1, SLUR2,
SLD1, and SLD2) and maintained in the facility records for review. The Division of Water Quality (DWQ)
compliance inspectors and Division of Soil and Water operation reviewers will review all recordkeeping during
routine inspections. Facilities not documenting all sources of nitrogen application will be subject to an
appropriate enforcement action.

liability for failure to comply with any State Rule, State Statute, Local County Ordinance, or permitting
requirement.

information is required before we can continue our review. Please address the following by October 30, 1999:
Please provide lagoon capacity documentation (design, as -built calculations, etc.). Be sure to include any
site evaluations, wetland determinations, or hazard classifications that may be applicable.
Applications windows should be included in the Waste Utilization Plan (WUP). Please contact your
technical specialist to revise the WUP.
Please note that all IWP revisions must be signed and dated by both the owner and the technical specialist. Please
reference the subject permit application number when providing the requested information. All information should be signed,
sealed, and submitted in duplicate to my attention at the address below. The information requested by this letter must be
submitted on or before October 30, 1999 or the Division will return your application as incomplete in accordance with 15A
N.C.A.C. 2H .0200 and your facility will be considered to be operating without a permit.
Please be advised that operation of the subject animal waste management system without a valid permit is a violation of North
Carolina General Statute 143-215.1 and will subject you to the enforcement authority of the Environmental Management
Commission.

A letter dated January 15, 1999 was sent to advise you about concerns associated with Certified Animal
Waste Management Plans and the method by which the irrigated acres within the plans were calculated. Only
the acres that are wetted can be credited in the waste management plan as receiving waste application. Any
acreage within the plan that can not be reached by waste application equipment can not be used as part of your
plan.
An evaluation by Rocky Durham on 5/24/99 was made to review the actual number of acres at your
facility that receive animal waste during land application. The evaluation of your facility has yielded one of
the following two results as indicated by the box marked with an "X".
Category 1:
The evaluation of your facility could not be completed due to a lack of information. Please
contact your Technical Specialist to assist in providing Rocky Durham the necessary
information to potentially exempt your facility from undergoing a complete wettable acre
determination. Please submit this information to Rocky Durham, at 585 Waughtown Street,
Winston-Salem, NC 27107, within in 90 days of the receipt of this letter. If you have any
questions please contact Rocky Durham at [phone]. If within 90 days you are
unable to provide Rocky Durham with the information you are automatically required

❑ Your facility has been identified by the Department of Environment and Natural Resources
as a facility that may have overestimated the number of acres actually receiving animal
waste. Therefore, some or all of your fields may be exceeding the allowable loading rates
set in your Certified Animal Waste Management Plan.
In order to resolve this issue, please contact a designated Technical Specialist to have him
or her conduct a Wettable Acre Determination for your facility. The Technical Specialist must
be one that has been approved by the Soil and Water Conservation Commission to conduct
Wettable Acre Determinations. Many Technical Specialist with the N.C. Cooperative Extension
Service, the Soil and Water Conservation Districts, the Natural Resources Conservation
Service, and the Division of Soil and Water Conservation have received this special
designation. You may also contact a private Technical Specialist who has received this
designation, or a Professional Engineer.
All needed modifications to your Animal Waste Management System must be made and
the Wettable Acres Determination Certification must be returned to DWQ within the next
180 days. If the needed modifications are not made and if the form is not returned within the
required time, DWQ will be forced to take appropriate enforcement actions to bring this facility
into compliance. These actions may include civil penalty assessments, permit revocation,
and/or injunctive relief.
Once a Wettable Acre Determination has been completed, a copy of the attached Wettable
Acre Determination Certification must be submitted to the address listed on the form. Please
note that both the owner and the Technical Specialist must sign the certification. A copy of ail
the Wettable Acre Determination documentation that applies to your Waste Utilization Plan
must be kept at your facility. DWQ and the Division of Soil & Water Conservation Staff will
review all documentation during their annual visit of your facility. An additional copy must by
kept on file at the local Soil & Water Conservation District Office. Please note that if you install
or modify your irrigation system, a designated Irrigation Specialist or a Professional Engineer
must also sign the Wettable Acre Determination Certification.

farm has six 60 days to submit the attached application and all supporting documentation. In
accordance with Chapter 626 of 1995 Session Laws (Regular Session 1996), Section 19(c)(2), any
owner or operator who fails to submit an application by the date specified by the Department
SHALL NOT OPERATE the animal waste system after the specified date. Your application must
be returned within sixty (60) days of receipt of this letter. Failure to submit the application as required
may also subject your facility to a civil penalty and other enforcement actions for each day the facility is
operated following the due date of the application.

You were notified by letter dated December 5, 1996, that you were required to designate a certified animal waste
management system operator as Operator in Charge for the subject facility by January 1, 1997. Enclosed with that
letter was an Operator in Charge Designation Form specifically for your facility, Instructions for Completing
Application for Temporary Certification as an Animal Waste Management System Operator, and an Application for
Temporary Certification as an Animal Waste Management System Operator. Our records indicate that these
completed Forms have not yet been returned to our office.
As was explained in the previous letter, a training and certification program is not yet available for animal waste
management systems involving cattle, horses, sheep, or poultry (with a liquid waste system). Therefore owners of
these systems were allowed to request that they be issued temporary certifications until December 31, 1997. All that
was required to receive this temporary certification was the completion of the Application Form.
For you convenience, we are sending you additional copies of the Operator in Charge Designation Form specifically
far your facility, Instructions for Completing Application for Temporary Certification as an Animal Waste
Management System Operator, and an Application for Temporary Certification as an Animal Waste Management
System Operator. Please return this completed Form to this office as soon as possible but in no case later than April
25, 1997. This office maintains a list of certified operators in your area if you need assistance in locating a certified
operator.
Please note that failure to designate an Operator in Charge of your animal waste management system, is a violation
of N.C.G.S. 90A-47.2 and you will be assessed a civil penalty_ unless an appropriately certified operator is designated.
Please be advised that nothing in this letter should be taken as absolving you of the responsibility and liability for
any past or future violations for your failure to designate an appropriate Operator in Charge by January 1, 1997.

Senate Bill 1217, An Act to Implement Recommendations of the Blue Ribbon Study Commission on
Agricultural Waste, was enacted by the North Carolina General Assembly on June 21, 1996. This bill
requires that a certified operator be designated as the Operator in Charge by January 1, 1997, for each animal
waste management system that serves 250 or more swine, 100 or more confined cattle, 75 or more horses,
1,000 or more sheep, or 30,000 or more confined poultry with a liquid animal waste management system. Our
records indicate that your facility is registered with the Division of Water Quality and meets the requirements
for designating an OIC.
A training and certification program is not yet available for animal waste management systems involving
cattle, horses, sheep, or poultry. Owners and operators of these systems will be issued temporary animal waste
management certificates by the Water Pollution Control System Operators Certification Commission
(WPCSOCC). The temporary certificates will expire December 31, 1997, and will not be renewed. To obtain
a permanent certification, you will be required to complete ten hours of training and pass an examination by
December 31, 1997, A training and certification program for operators of animal waste management systems
involving cattle, sheep, horses, and poultry is now being developed and should be available by the spring of
1997. The type of training and certification required for the operator of each system will be based on the nature
of the wastes to be treated and the treatment process(es) primarily used to treat the animal waste.
As the owner of an animal operation with an animal waste management system, you must designate an
Operator in Charge and must submit the enclosed designation form to the WPCSOCC. If you do not intend to
operate your animal waste management system yourself, you must designate an employee or engage a contract
operator to be the Operator in Charge. The person designated as the Operator in Charge, whether yourself or
another person, must complete the enclosed application form for temporary certification as an animal waste
management system operator. Both the designation form and the application forth must be completed and
returned by December 31, 1996.

To follow up on the letter your office sent me, A letter was mailed mid -December 1995
to Mr. Ron Linville stating our runoff potential would be corrected. How ever we have
not had a plan completed by the Guilford SCS. I personally had contacted the Guilford
SCS the second week of December in 1996 to request a plan.
As of this date the plan is not complete. Contract 41-96-25-02 to complete our plan
should be funded by June 15, 1996. The plan should be completed by September 30,
1996.

Dear Mr. Bowman:
Recent follow up inspections of farms in Guilford County were conducted by
Mr. Ron Linville of this office in conjunction with Mr. John Andrews and Ms.
Millie Langley. It was determined on May 1, 1996 that you still need to complete
construction of additional waste management facilities. It is our understanding
that you have applied for assistance from the Guilford County S&W Conservation
District and that a plan is being developed.
Please advise this office in writing by May 24, 1996 as to your specific
schedule for implementing these improvements so as to reduce the potential for
a discharge to occur from your dairy operation. Failure to provide adequate
actions could result in this Division revocating your deemed permitted status and
or pursuing an enforcement case for any discharges. Again, please be advised
that any non -permitted discharge of any type of wastewater to the waters of the
State is illegal per North Carolina General Statute 143-215.1. Discharges from

This is to acknoledge our telephone conversation December 5, 1995 concerning the letter
of concern that was sent to our farm in late November. We have been in contact with the
Guilford SCS and with Millie Langley to devise a plan to correct the problem with the
loafing area on our holding lot to divert lot runoff water into the lagoon. A plan is in the
works to correct the problem and will be completed soon. If there is any questions or
other concerns please do not hesitate to contact us. Good water quality is a concern of
ours as is the environment and our farm strives to make both better.

Dear Mr. Bowman:
Due to recent concerns about agricultural impacts to waters of the State,
the Division of Environmental Management conducted inspections of all registered
farming operations involving livestock. Mr. Ron Linville of this office in
conjunction with Mr_ John Andrews, District NRCS Conservationist visited your
animal operation on October 19, 1995.
observations at your facility have been categorized as follows:
Category I. NOTICE OF VIOLATION
A wastewater lagoon at your facility has overflowed.
Adequate freeboard (minimum of 1911) is not being maintained in the
lagoon.
A pipe, ditch, pad or other conveyance can contribute to waste being
discharged from the animal operation (ie. parlor wash ditch).
operational and Maintenance concerns exist which are likely.to cause
animal waste runoff in a manner that is detrimental to water
quality.
Category II. NOTICE OF CONCERN
Parlor wash, calf feeding or other activities could contribute
negative impacts to water quality.
Loafing areas have the potential to release waste intermixed with
rainfall to the extent that water quality could be negatively
impacted.
Existing apparatus for controlling waste need repair or replacement.
X Other: Corner of loafing area needs curbing and Pining.
Category III. NO OBSERVED PROBLEMS
No observed wastewater deficiencies at the time of the site visit.

If your facility has any Category I NOTICE OF VIOLATION item indicated, it
is necessary that you notify this office in writing by December 6, 1995 as to the
steps you have initiated or will be taking to rectify the condition(s). Please
be advised that any non -permitted discharge of any type of wastewater to the
waters of the State is illegal per North Carolina General Statute 143-215.1.
Discharges from the lagoons and feedlots must cease immediately. Until
compliance is achieved with the regulations, your Farm will be considered in
violation of GS: 143-215.1 and could be subject to enforcement action with the
possible assessment of civil penalties of up to $10,000 per day per violation.
If your facility has any Category II NOTICE OF CONCERNS, you should notify
the Winston-Salem Regional Office by phone at [phone] to discuss your
progress in resolving water quality concerns by December S, 1995.
For both Category I and II above, this office recommends that you seek the
advice of the Guilford Soil and Water Conservation District at 910/333-5460 prior
to providing a written or verbal response to this office. Your cooperation in
this matter is greatly appreciated. If you have abandoned waste lagoons or
storage ponds, you should consider proper closure of the structures. Operations
below threshold limits may be removed from the registry providing a written
request is submitted to the Division. If you believe that this notification is
in error or if you have any questions about this letter, please do not hesitate
to contact Mr. Ron Linville or Steve Mauney, Water Quality Supervisor at (910)
