Melissa and I drove through the irrigation field and up to where you bury your dead animals after we had already said goodbye to Garrison. As a part of the inspection of the irrigation field, the hydrant that had the gun on -it that day had a damaged valve knob that needs to be replaced. In addition (and Melissa discussed this with Garrison but it didn't make it onto the form), the connecting pump flange on the pond pump was cracked and was leaking. It also will need to be replaced. These notes were added to the official inspection report that I have attached to this email. If you would like for us to send you a hard copy, let me know and I'll send it your way. While we were up near your burial location, I noticed the stockpiled poultry litter. We didn't include this as a part of the inspection since it is not a part of the permit, but did want to remind you of the requirements for it: "stockpiled litter shall not be uncovered for more than 15 days." This wasn't an issue with us because we can't say for sure how long it had been up there, but we do want to help prevent any complaints coming our way regarding that. It's always interesting to me how the sludge distribution is never uniform in a lagoon, even in a smaller one like Dennis'. Thanks for all your technical assistance. In reviewing the survey results (very complete I might add!), I think we're ok if Dennis requests an extension of the survey requirement until the next permit cycle. He will need to do this in writing... email or snail mail ... and sign and date. It only has to be a couple of sentences and should be sent to the attention of Mr. Miressa Garoma, whom I copied on this email. I've also attached the sludge survey results so Miressa will already have them. If you need his mailing address please let him or me know. Hope this is helpful. Worksheet for sludge volume and treatment volume Revised August 2008 The average thickness of the sludge layer and the thickness of the existing liquid (sludge -free) treatment zone (are determined from information on the Lagoon Sludge Survey Form (Items O and P, respectively). In this example, the average sludge layer thickness is 2.5 feet and the existing liquid treatment zone is 3.5 feet. If the lagoon has a designed sludge storage volume, see notes at end of the worksheet. The dimensions of the lagoon as measured and the side slope are needed for calculations of sludge volume and of total treatment volume. If the lagoon is a standard geometric shape, the sludge volume and treatment volume in the lagoon can be estimated by using standard equations. For approximate volumes of rectangular lagoons with constant side slope, calculate length and width at the midpoint of the layer, and multiply by layer thickness to calculate layer volume, as shown in the example. If you re -build and rotate the house so that the end of the house is NO CLOSER to the neighbor's property line (i.e. extend the house towards the farm road) there are no issues. If you re -build and rotate the house so that the house would be CLOSER to your neighbor's property line, then the setback is to be 500 feet to the property line*----OR---- If in rebuilding, the house is rotated and is then closer to the property line, then you might want to get a signed waiverfrom the neighbor.** *An argument could be made that since the lagoon is still the closest part of the waste management system to the neighbor's property, then as long as the house is uphill/behind the lagoon then the "system" has not moved any closer. "This depends if you are on good terms with your neighbor. If you don't anticipate problems, you probably don't need it. If he/she might object later, then you should get the waiver. A key point is that the SB1217 Committee and DENR have NOT been given authority to administer the provisions of the Swine Farm Siting Act (believe it or not!). We always tell folks that if there are questions regarding individual rights or responsibilities under the Act, then you should consult an attorney. In short ---you might not be in trouble with us ---but could be in trouble with your neighbor if you were sued. In general, if you follow the above policies, you should be ok. Understanding of Stocking Numbers: As long as you do not go over your 787 feeder to finish number (based on an annual average) you are still in compliance. This means that you could be at 900 hogs for awhile, then at zero.....as long as the annual average is at or below 787. In order to show that the agronomic loading rates for the crops being grown are not being exceeded, you must keep records of all sources of nitrogen that are being added to these sites. This would include nitrogen from all types of animal waste as well as municipal and industrial sludges/residuals, and commercial fertilizers. Beginning January 1, 2000, all nitrogen sources applied to land receiving animal waste are required to be kept on the appropriate recordkeeping forms (i.e. IRR1, IRR2, DRY1, DRY2, DRY3, SLUR1, SLUR2, SLD1, and SLD2) and maintained in the facility records for review. The Division of Water Quality (DWQ) compliance inspectors and Division of Soil and Water operation reviewers will review all recordkeeping during routine inspections. Facilities not documenting all sources of nitrogen application will be subject to an appropriate enforcement action.
