To Whom It May Concern:
You have our approval, in accordance with the attached conditions, to impact 0,14 acres of wetlands and
0.14 acres of Neuse River Buffers for the purpose of providing lot fill and grading for a residential
subdivision as you described in your application dated December 18, 2003, After reviewing your
application we have decided, this fill is covered by General Water Quality Certification Number 3402,
This Certification allows you to use Nationwide Permit Number 39 when the Corps of Engineers issues
it. This approval is also valid for the Neuse River buffer rules (15A NCAC 2B ,0233). In addition, you
should get any other federal, state or local permits before you go ahead with your project including (but
not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply
Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA
permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application, If you
change your project, you must notify us and send us a new application. If the property is sold, the new
owner must be given a copy of this Certification and approval letter and is thereby responsible for
complying with all conditions, This approval shall expire when the corresponding Nationwide Permit
expires or as otherwise provided in the General Certification, If total wetland fills for this project (now
or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC
2H ,0506 (h). For this approval to be valid, you must follow the conditions listed in the attached
certification and those listed below.
Conditions of Certification:
1. Upon completion of all work approved within the 401 Water Quality Certification or applicable
Buffer Rules, and any subsequent modifications, the applicant is required to return the attached
certificate of completion to the 401/Wetlands Unit, North Carolina Division of Water Quality,

WATER QUALiTY SECTiON
On behalf of Diehl & Philips, PA (project engineer), we hereby request authorization from the US
Army Corps of Engineers (US ACE) to use Nationwide Permit 39 for proposed permanent
impacts to jurisdictional wetlands resulting from lot fill and grading. In addition, we request
written concurrence from the North Carolina Division of Water Quality that the project complies
with the Neuse Buffer Rules and the 401 Water Quality Certifications associated with NWP 39.
A Pre-construction Notification Application (PCN) is attached, which includes an Agent
Authorization form.
The site is :t 56 acres in size and is located south of Honeycutt Road (SR 2765) approximately
0.58 miles west of its intersection with Highway 55 near Fuquary-Varina. Please refer to the
attached map (Figure 1) for the project's location on a USGS topographic quadrangle.
The purpose ofthis project is to construct a residential subdivision that will meet the demand for
housing in this area. Proposed impacts resulting from lot fill and grading will total 0.14 acre of
jurisdictional wetlands and 6,061 square feet (0.14 acres) to Zone 2 ofthe Neuse Buffers. Ifany
building is proposed in Zone 2 it will require a minor variance.
Residential roads (previously permitted) and houses in Phases 1 and 2 have been and are being
constructed. The Town of Fuquary-Varina has developed a community park along the east and
north property boundary. Mr. Steve Mitchell with the NC-DWQ visited the site to determine the
starting point of the riparian buffers. A copy of Mr. Mitchell's letter is attacheds (NBRRO 00-
306). A jurisdictional determination was approved for this site on February 25, 1998, by Eric
Alsmeyer of USACE Raleigh Regulatory office. Previous permitted impacts related to Phases 1
and 2 road crossings and utilities include 232 linear feet of channel and 0.34 acres of
jurisdictional wetlands (NWP 39 - AID 200120188) and 0.76 acres of wetlands (NWP 12 - AID
2001201887). In addition, the previously mentioned Town of Fuquay-Varina Municipal Park had
previously been considered part of this project and impacts from the park (0.16 acres of wetlands)
were included iIi the cumulative impacts for the above referenced permits, Mr. Todd Tugwell of
the US ACE Raleigh Regulatory office has since ruled that the park is now considered a separate
project because the park has independent utility and is not related to the subdivision.

Impacts A & B - Buffer Co pliance
The applicant proposes graditg and construction of homes on four lots impacting 6,061 square
feet (0,14 acres) ofNeuse Ri er Buffers in Zone 2, Ifbuildings are proposed in Zone 2 a minor
variance will be required. T?i se impacts are labeled Impacts A, B, C, and D on the attached
maps. Buffer impacts have ijeen limited to Zone 2 of the buffers and will consist of grading and
lot fill. Erosion and siltatio ,I control devices will be used during construction activities in and
around all buffered areas,
Nationwide Permit 39
In order to develop individ allots (Lot #'s 361, 363, 364,366,368,367,378),0.14 acres of
jurisdictional wetlands will/be impacted during grading activities. These impacts, consisting of
fill, are unavoidable in order to prepare individual lots for structural foundation footings and
utilize lot space. The apPb~ant will employ appropriate erosion and siltation controls during
construction, This project 'll comply with the general and regional conditions ofNWP 39. No
stream channels will be im acted by the grading and filling activities.
The USACE's current p~r y requires applicants to avoid and minimize wetland and stream
channel impacts to the . mum extent practicable and may require compensatory mitigation to
offset unavoidable losses fwaters of the US when impacts exceed the thresholds for notification
(0.10 acre) or if a diSCha*e causes the loss of any open waters. Impacts on-site have been limited
to seven wetland areas, in ividually totaling 0.03 acres or less of lot fill. Typically, impacts to
jurisdictional wetlands Ie s than Y2 acre per project do not require mitigation; therefore, S&EC
does not believe mitigati n should be required by the US ACE for this project. Iffor some reason
mitigation is required, the client proposes payment to the NC-WRP,
NC-DWQ's current POli~y requires mitigation for perennial stream impacts of greater then 150
linear feet and loss of wetlands greater than Y2 an acre per project. There are only 0.14 acres of
wetland impacts, therefo e, mitigation is not proposed, DWQ typically does not require riparian
buffer mitigation for re onable impacts within Zone 2. Also, buffer mitigation is typically not
required for impacts les than 1/3 of an acre. Because the proposed impacts are less than 1/3 of
an acre and are limited t Zone 2, no buffer mitigation is proposed.

VII. Impact Justification (Avoidance and Minimization)

Mitigation I
DWQ - In accordance with 15A NCAC 2H ,0500, mitigation may be required by the NC
Division of Water QuJity for projects involving greater than or equal to one acre of impacts to
freshwater wetlands oJ greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accord8f.ce with the Final Notice of Issuance and Modification of Nationwide
Permits, published in 1he Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure ~at adverse effects to the aquatic environment are minimal, Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will ~e considered in determining acceptability of appropriate and practicable
mitigation as proposed., Examples of mitigation that may be appropriate and practicable include,
but are not limited td: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetatfd buffers to protect open waters such as streams; and replacing losses of
aquatic resource fun9tions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed,

On October 17, 2000 I met with you onsite to perform an evaluation of the stream features on the
subject property, The plat map and other information was provided to allow a determination to be
made as to whether or not the site would require compliance with the Neuse Buffer Rule, This
project is referenced by the Raleigh Regional Office as NBRRO 00-306,
The features represented on the Wake County Soils and the USGS Fuquay Varina Quad maps were
evaluated to determine their subjectivity to the Neuse Buffer Rule, There are four features depicted
on the maps, The two continuous features that are depicted on the maps are subject to protection
under the Neuse River Basin: Nutrient Sensitive Waters Management Strategy; Protection and
Maintenance of Existing Riparian Areas, Administrative Code T15A:02B.0233 (NCAC 0233). The
