This letter is to follow-up on a compliance inspection conducted by the Division of
Water Quality's Winston-Salem Regional Office staff (DWQ) on July 15, 2010 at
Long Meadow Farm. While the majority of the animal waste management
activities were in good order, a violation warrants your immediate attention.
The Cattle Waste Management Permit issued to Long Meadow Farm requires that
an analysis of the animal waste be conducted within sixty (60) days of waste
application (Permit Section lit. 5.). Onsite records indicate that March 2010
applications did NOT have a corresponding waste analysis performed within sixty
(60) days. Failure to obtain a waste analysis within the required sixty (60)
days of waste application is a violation of NC General Statute 143-
215.10C(e)(6) and the Cattle Waste Management Permit issued to Long
Meadow Farm. DWQ staff noted that the December 2009 waste analysis results
indicated a Nitrogen content of 1.8 pounds of Nitrogen per 1000 gallons. While
this level of Nitrogen content is less likely to cause environmental impact, a waste
analysis is still required within sixty (60) days of an application.
DWQ staff also observed that the soil pH level in a number of application fields
was below 5.5 and two fields had a pH of less than 5.0. We strongly recommend
that you apply lime to these fields as recommend in the soil analysis report. DWQ

available at the time of inspection. As a reminder, please have a copy of the

Andy,
I have received your letter and plans for revising the waste storage pond at the
referenced facility. From our discussions with you and the landowner it sounds as if
the "pump station" will simply be an area near the waste pond (15'X30') that will be
used by the operator to park the honey wagon, agitate and then to pump the manure
into the honey wagon for application. My understanding is that this area was
initially approved for the waste pond but was not installed at the time of
construction. The owner wishes to construct this area now to keep the dam on the
slope side from damage due to machinery traffic. The submitted documentation
describes the area to be constructed in natural soil, not in or on the dam, and will
not increase/decrease the size of the waste pond. Per MRCS, the waste pond will
continue to meet their standards. For these reasons, I do not see that any approval
is required from our office. I appreciate your efforts to keep me updated regarding
this facility. Please contact me if you have any further questions or require
assistance from DWQ.

This pumping station is necessary to facilitate removal of effluent from the
pond. The pumping station will not change the storage volume of the pond
and will not serve as an emergency spillway. The dam will not be affected
by the installation. I have discussed this with Tommy Burchette, CET,
USDA-NRCS and he confirms that the structure will continue to meet NRCS
Standards and Specification if the pumping station is installed as proposed.

This letter is to follow up on our telephone conversation from earlier today. Enclosed is a sketch
of the proposed revision to the Clyde Snider Waste Storage.Pond in Davidson County. This
revision is requested to facilitate removing effluent from the storage pond. This pump station
was included in the original design from 1990 but Mr. Snider chose not to construct the pump
station at that time. Installing the pump station will allow more complete removal of effluent
from the pond. The diversion above the pump station will be reconstructed to prevent any
additional runoff from entering the pond.
Construction of this pump station will be done in natural ground and will not alter the storage
capacity of the structure. The dam will be unaffected by the construction. This pump station
will not serve as an emergency spillway.
Tommy Burchette, CET, with the USDA Natural Resources Conservation Service has reviewed
this proposal and confirms that the structure will continue to meet NRCS Standards and
Specifications if the pump station is constructed as proposed.
If this revision requires your attention or approval prior to construction please advise me as soon
as possible.

Dear Mr. Snider:
Ms. Melissa Rosebrock of this Office conducted a site inspection at your
facility on August 29, 2000. Although most farm operations appeared in good
condition, the record keeping system needs improvement.
Staff noted that your waste records were not complete. Specifically, waste
analysis records for solids applied February through June of this year were not
available. Please note that waste and soil analysis, once obtained, should be kept
for a minimum of five years.
Failure to have the above components available and complete is a violation of
your Animal Waste Permit. Remember that waste applications should be applied
during the time the crop can utilize the nutrients in the waste. In general, waste
should be applied no earlier than 30 days prior to planting.

This letter is being sent to clarify the recordkeeping requirement for Plant Available Nitrogen (PAN)
application on fields that are part of your Certified Animal Waste Management Plan.
In order to show that the agronomic loading rates for the crops being grown are not being exceeded, you
must keep records of all sources of nitrogen that are being added to these sites. This would include nitrogen
from all types of animal waste as well as municipal and industrial sludges/residuals, and commercial fertilizers.
Beginning January 1, 2000, all nitrogen sources applied to land receiving animal waste are required to
be kept on the appropriate recordkeeping forms (i.e. IRRI, IRR2, DRY I, DRY2, DRY3, SLUR), SLUR2,
SLDI, and SLD2) and maintained in the facility records for review. The Division of Water Quality (DWQ)
compliance inspectors and Division of Soil and Water operation reviewers will review all recordkeeping during
routine inspections. Facilities not documenting all sources of nitrogen application will be subject to an
appropriate enforcement action.
Please be advised that nothing in this letter should be taken as removing from you the responsibility or
liability for failure to comply with any State Rule, State Statute, Local County Ordinance, or permitting
requirement. _

The Non -Discharge Permitting Unit has completed a preliminary engineering review of the subject application. Additional
information is required before we can continue our review. Please address the following by September 22, 1999:
1. Currently, your facility is certified for 175 animals. According to the information submitted, this facility
has 305 total head (275 cows, 30 calves). The certification was to be the total number of animals that the
facility could handle. Please contact your technical specialist and have him recertify (re-evaluate if
necessary) the facility for the additional 30 animals. r

2. Tract 150, Field 14 — the Waste Utilization Plan (WUP) lists the acreage as 9.0 acres while the maps
provided show only 4.6 acres_ Tract 158, Field 4 — the WUP shows 3.9 acres while the maps submitted
show 3.2 acres. Please explain these discrepancies or contact your technical specialist to revise your WUP.
3. Tract 151, Field 1 is listed in both WUPs. One WUP has this field as fesc6e hay while the other WUP has
this field in a corn silage, wheat and summer annual rotation. Please contact your technical specialist and
have the V, UPs revised to rcflcct the correct cropping scheme for this field and to correct the duplication.
4. Please indicate whether or not the waste from the calves is collected in the waste storage pond and how it is
handled.
Please note that all WUP redsions must be signed and dated by both the owner and the technical specialist. Please
reference the subject permit application number when providing the requested information. All information should be signed,
sealed, and submitted in duplicate to my attention at the address below. The information requested by this letter must be
submitted on or before September 22, 1999 or the Division will return your application as incomplete in accordance with 15A
N.C.A.C. 2H .0200 and your facility will be considered to be operating without a permit.
Please be advised that operation of the subject animal waste management system without a valid permit is a violation of North

Carolina General Statute 143-215.1 and will subject you to the enforcement authority of the Environmental Management
Commission.

You are hereby notified that Long Meadow Farm, in accordance with G.S. 143-215.10C, must
apply for coverage under an Animal Waste Operation General Permit. Upon receipt of this letter, your
farm has sixty (60) days to submit the attached application and all supporting documentation. In
accordance with Chapter 626 of 1995 Session Laws (Regular Session 1996), Section 19(c)(2), any
owner or operator who fails to submit an application by the date specified by the Department
SHALL NOT OPERATE the animal waste system after the specified date. Your application must
be returned within sixty (60) days of receipt of this letter. Failure to submit the application as required
may also subject your facility to a civil penalty and other enforcement actions for each day the facility is
operated following the due date of the application.
The attached application has been partially completed using information listed in your Animal
Waste Management Plan Certification Form. If any of the general or operation information listed is
incorrect please make corrections as noted on the application before returning the application package.
The signed original application, one copy of the signed application, two copies of a general location
map, and two copies of the Certified Animal Waste Management Plan must be returned to complete the

Senate Bill 1217, An Act to Implement Recommendations of the Blue Ribbon Study Commission
on Agricultural Waste, was ratified by the North Carolina General Assembly on June 21, 1996.
This bill required that a properly certified operator be designated as the Operator in Charge for each
animal waste management system that serves 250 or more swine, 100 or more confined cattle, 75 or
more horses, 1,000 or more sheep, or 30,000 or more confined poultry with a liquid animal waste
management system.
The deadline for designating an Operator in Charge for animal waste management systems
involving cattle, horses, sheep, or poultry was January 1, 1997. Because a training and
certification program was not yet available for these systems, you were allowed to apply for and
were issued a temporary animal waste management certificate from the Water Pollution Control
System Operators Certification Commission (WPCSOCC). Because you applied for and were
issued a temporary. certificate, you were allowed to be designated as the Operator in Charge of an
animal waste management system.
Your temporary certificate expires December 31, 1997, and is not renewable. Our records indicate
that you have not obtained a permanent animal waste management system operator certification. If
you intend to remain the Operator in Charge of the facility for which you were designated, you must
obtain a permanent animal waste management system operator certification of the appropriate type
before your temporary certification expires on December 31, 1997. To obtain a permanent
certification, you must be 18 years of age, complete ten hours of approved training, and pass an
examination. If you do not intend to remain the Operator in Charge, a properly certified animal
waste management system operator must be designated as Operator in Charge of the facility prior to
the expiration of your temporary certification.
This year's final training program for both Type A and Type B animal waste management systems
is scheduled for December 10 and 11, 1997, at the Hunt Horse Complex in Raleigh. If you would
like information about this training program, please contact your local cooperative extension agent
or call Dee Ann Cooper at 919/515-6968. For those enrolled in this training and registering with
Ms. Cooper prior to December 1, an exam will be offered at the Hunt Horse Complex on December
11, beginning at 1:00 pm.

certification will be offered on December 11, 1997, in Williamston, Kenansville, Raleigh
(Wake Tech), Wentworth, Salisbury and Morganton. This examination date will be the last
opportunity to obtain permanent certification before your temporary certification expires. If you
