Hi there: See attached inspection report. As the report states, Greg does not have a waste plan. This is a major concern as it is
the whole basis for animal waste management. Greg operated under John Hampton's waste plan until the farm was purchased.
from John. According to Greg he does not use any fields that were once in John's waste plan. Therefore, Greg is applying to land
NOT in his permit. He is aware of the consequences so the sooner he can be compliant the better it will be for him.
I understand the process of gathering.information for the. waste- plan -revision -is -taking-place.-If-this is -not. correct -let me
know. Also, if you have any questions or need assistance please contact me. Thank you all for your work in getting the
Alleghany Co. waste plans up to date.

Your facility is currently approved for operation under one of the Animal Waste Operation General Permits.
These permits expired on October 1, 2004. On June 11, 2004, the North Carolina Division of Water Quality
(Division) issued revised State General Permits for animal facilities. The General Permits were issued in
accordance with the directive of Senate Bill 733 (Session Law 2003-28). The Division staff is currently in the
process of issuing Certificates of Coverage for these revised general permits.
In order to assure your continued coverage under the e�permit, you must apply to the Division for renewal.
Enclosed you will find a Permit Coverage Renewal Application Form. The application form must be completed
and returned within 60 days from receipt of this letter.
Failure to request renewal of your coverage under a general permit within the time period specified may result in
a civil penalty. Operation of your facility without coverage under a valid general permit would constitute a
violation of NCGS 143-215.1 and could result in assessments of civil penalties of up to $25,000 per day.

Dear Mr. Wooten,
Thanks so much for helping us with the permitting of Facility Numbers 03-21 and 03-26. After reviewing the
latest information, we have a few questions to clarify for each of these farms:
1. Facility No. 03-21:
a. A recent site visitation made by the DWQ inspector had suggested including T-519 Field I in the waste plan.
Please verify if that field is to be included or should be left off in the latest plan.
b. Plant availbale nitrogen (PAN) appears to be calculated based on waste analysis results. Current guidance
recommends that an average PAN production rate be calculated using representative waste samples, at least
two samples per year, over a three year period. It is necessary to take these samples at different times of the
year to reflect seasonal variations in PAN. In addition, irrigation records must be supplied for the same three
year period. Please verify and submit information ( waste results and irrigation records) to support the PAN
production rate as listed in the current WUP. Otherwise, the WUP may be revised using "book" values for
PAN production at this facility.
2. Facility No. 03-21,
a. The field maps for the new acres (T-695, T-2553, and T-1470) are missing in the permit package. Please
submit proper aerial maps with site number and acreage clearly marked on them.
b. PAN appears to be based on waste analysis. In'that case we will require the proper documentation as
described above.

The Non -Discharge Permitting Unit has completed a preliminary review of the subject application. Additional
information is required before we can continue our review. Please address the following by April 27, 2003:
This office currently has a waste utilization plan (WUP) for this facility dated July 1997 and revised in
6/28/199 for a 262 head dairy operation. A number of pages in the above WUP were changed at a later date to
include all the fields that utilize animal waste. Those changes were not signed by the owner. Please verify that
the same WUP is being followed on this farm and, if so, have the corrected pages signed by both the owner
and technical specialist. If you have modified the WUP since then, please submit a copy of most recent WUP
that reflects correct number of animals, crops grown, field utilized and has field maps with acreage clearly
marked on the maps.
2. The Plant Available Nitrogen (PAN) rate in the WUP was generated using a waste analysis of the storage
pond. Current guidance recommends that an average PAN production rate be calculated using representative

information should be signed, sealed, and submitted in duplicate to my attention at the address below. The
information requested by this letter must be submitted on or before April 27, 2003 or the Division will
return your application as incomplete in accordance with 15A N.C.A.C. 2H .0200 and your facility will be
considered to be operating without a permit.

Dear Mr. Hampton:
On May 30, 2001 Melissa Rosebrock of the Division of Water Quality's Winston-Salem Regional Office
performed an emergency notification inspection at the Hampton Dairy Farm. This was in response to your telephone
calls to our office on May 26, 2001 regarding a discharge of animal waste from an application field (Tract 671, Field
3CL) located off Highway 221 in Alleghany County into Rock Creek (Class C+ waters of the State).
i Our investigation determined that between 9:00 AM and 12:00 PM on May 26, 2001, you applied 12 loads
(3,000 gallons each) of animal waste from the milk parlor storage pond onto only two acres of the grass hay/pasture
field cited above. Per evidence reviewed by Staff, the aforementioned field was already saturated due to several
previous rain events on the days preceding the application of waste. Per conversations with Staff, you stated that
the reason for application under these conditions was due to the high level of waste backing -up into the parlor pipe.
While this office can certainly understand your situation, we cannot condone the improper method in which the
waste was applied and the subsequent discharge that occurred. Please note that several factors, in fact, led to the
discharge of unpermitted waste into surface waters of the State.
Firstly, animal waste was applied to a field already saturated with precipitation. Although you stated to Ms.
Rosebrock that you had "done this before and had no problems," your Certified Animal Waste Management Plan
(CAWMP), signed by you, states that you will "apply waste according to your plan at the appropriate times and at
rates that no run-off occurs." You are, therefore, in violation of your CAWMP and deemed permit.
Secondly, your plan states that the field in question is approximately 35 acres in size. Since the field was
saturated you stated that you could not land apply the waste to the entire field. Rather, the waste was allowed to
just run out of the spreader tank at twelve different locations along the fence to the field. Since the area of
application was only about two acres in size, an obvious hydraulic (and plant available nitrogen) overload occurred
causing the run-off of unpermitted waste into waters of the State. Again, this is a violation of your CAWMP and
deemed permit. Note that proper application of waste residuals includes an even application over the entire field.

Thirdly, a second waste storage pond, located at the same facility, had adequate freeboard to receive and
store the waste from the milk parlor waste pond. In future situations such as this, the first option should be to
transfer the waste from the "full" structure into one that can adequately receive and store the waste until such time
as field conditions are suitable for application. The SLUR -I form should then be updated to reflect the date and
amount of waste transferred from one holding structure to another.
Lastly, during our investigation we noted the presence of what appeared to be subsurface drains located in
the application field. We suggest that you contact the Alleghany SWCD/NRCS or your technical specialist for
assistance in determining the presence and location of such drains. If determined that subsurface drains exist on this
field, or on any others onto which - you maybe -applying -to waste: then the CAWMP-must-be revised to -include this
information.
This office acknowledges that you abided by the Emergency Action Plan contained in your CAWMP. It was
also noted that, per your CAWMP, you notified our office of the discharge within one -and -a -half hours from first
knowledge of the incident and at the direction of Alleghany County Emergency Management, successfully attempt
to stop the flow of waste with the use of straw and hay bales. We have also received revised pages of the CAWMP
that now include additional waste application fields.
Additionally, our Staff has reviewed the requested waste application records for year 2001. While most.
recordkeeping entries appear to be complete, we noted that May applications of waste from the milk parlor pond
had not been included. We are specifically interested in the application record for May 26, 2001. Once the waste
analysis results for this waste pond have been received, please update the SLUR-1 and 2 forms and submit those
to our office as well.
In order to avoid future Notices and probable enforcement action, it is recommended that you review your
waste management practices including storage procedures and timeliness of waste applications. The Winston-Salem
Regional Office appreciates your cooperation in these matters. If you have any questions concerning this Notice,

Today's visit was a result of a phone call received by the DWQ-WSRO at 1350 hours on 5/26/01 from Mr. John Hampton (operator)
regarding the discharge of animal waste from an application field into Rock Creek on 5/26/01. Operator stated that he had spread waste
from the milk parlor waste storage pond onto a meadow located at "the old place" (T-671, F-30). He further stated that he had been

doing this before without any problems. His message indicated that some waste had seaped into the ground and had gotten into an old
ditch then had gotten into the creek. He called back the same day at 1818 hours to say that emergency management had taken care of the
situation. Per records obtained from the Town Manager's office, this area had received at least a trace of precipitation almost everyday
for 10 days prior to the application of waste by Mr. Hampton on 5/26/01. Per emergency management report written by Mr. Gerald

Leftwich, the field was unable to absorb the waste causing runoff to go into Rock Creek. According to his report, although the
stream became discolored, "no stream wildlife seemed to be affected." When questioned, Mr. Leftwich said that no fish kills were
observed or reported in the county either. Per instruction from Mr. Leftwich, the operator successfully stopped the flow of waste into
the creek through the use of hay and straw at approximately 1600 hours.
Investigation:
Between 0900 and 1200 hours on 5/26/01, the waste operator unloaded 12 loads (3,000 gal. each) along the fence line (Hampton
Lane) onto a two acre area of the field since the field was too wet for him to drive upon and spread waste. A good stand of 6-9 inch
tall grass had been established on the application field. Discharge site was approximately 458 feet from the fenceline where the waste
was unloaded from the spreader tank. Discharge occured at Long 36 31 34 Lat 81 11 03. It appeared as if the waste had gotten into
a subsurface drain and was conveyed to the creek. Per operator, there may be three subsurface drains on this field. Jay Collins
(neighbor) notified operator of discoloration in creek at 1330 hours. Per Mr. Leftwich and Mr. Hampton, the discoloration in the
creek was clearing up by 1600 to 1615 hours.
On the date of the investigation no visual evidence of waste was in the stream. Additionally, no waste odors were noted. Dissolved
oxygen measurements were taken in the creek at various locations to rule out any background discharges:
9.1 mg/l - 25' downstream of discharge
9.0 mg/l - Discharge site
8.8 mg/I - 228' upstream of discharge site
9.0 mg/I - 417' upstream of discharge site of fork in creek
7.8 mg/I - at "Bobby Joe's fork" 417' upstream of discharge
8.5 mg/I - 900' upstream of discharge at property line

#19. Need to obtain waste sample analysis for waste from parlor waste storage pond. Need to update records once waste sample
results have been received. Sample was sent off 5/31/01.
#22. Received call from operator at 1350 hours and again at 1818 hours on 5/26101.
#25. Certified Animal Waste Management Plan states that no subsurface drains are present on the farm. Per operator and our
investigation, there may be one to three such drains on the field in question. Recommend that operator contact NRCS and/or
Technical Specialist to take a look at this particular field and make determination.

Melissa Rosebrock and Matt Czahor of this Office conducted a site inspection at your
facility on June 1, 2000. Although the waste handling system and other farm operations
appeared in excellent condition, the record keeping system needs improvement.
Staff noted that the information in your waste application records was not complete.
Specifically, waste applications for each field had not been recorded on the appropriate forms
(SLUR-1 and SLUR-2). A nitrogen balance had not been calculated and recorded for each
field either. Staff did note however, that you had kept very detailed and complete records in a
personal notebook regarding the number of loads, fields, and dates to which waste was
applied. Should you need assistance regarding the transference of this information onto SLUR
forms #1 and #2, we would suggest you contact the Sparta Field Office at [phone].
Please note that waste and soil records, once obtained, should be kept for a minimum of five
years.
Failure to have the above components available and complete is a violation of your
Certified Animal Waste Management Plan. As you know, waste applications should be
applied during the time the crop can utilize the nutrients in the waste. In general, waste should
be applied no earlier than 30 days prior to planting. If you have any questions concerning this

The Non -Discharge Permitting Unit has completed a review of the additional information sent. However. more information is
required before we can continue our review. Please address the following by March 22, 2000:
1. Please provide capacity documentation for the waste storage ponds onsite. We received the information on
the number of days of storage in the ponds — please provide a volume for each (cubic feet, gallons). This
can be a design volume or an as -built volume.
2. The Plant Available Nitrogen (PAN) rate in the Waste Utilization Plan (WUP) was generated using a waste
analysis of the waste storage pond liquid. Guidance from the Interagency Committee lists
recommendations for establishing PAN rates with waste analyses. A copy of this guidance is enclosed_ An
average PAN production rate should be calculated using representative waste samples, at least two per year,
over a three year period. It is necessary to take these samples at different times of the year to reflect
seasonal variations in PAN. In addition, irrigation records must be supplied for the same three year period.
Please submit additional information to support the PAN production rate as listed in the current WUP or
revise the Al- P to show average "book" values for PAN production at this facility.
3. Along with the maps submitted for the new fields added to the W4 UP, there were some maps for tracts that
do not appear in your WUP. These maps are enclosed. If these should be included in your WUP. please
contact your technical specialist and have them added.
4. Please clariy the number of each type of animal at your facility. You are currently certified for 262 animals.
Is this 237 milking cows and 25 dry cows? Are some of these replacement heifers? What is the
confinement percentage for each?
Please note that all NVUP revisions must be signed and dated by both the owner and the technical specialist. Please
reference the subject permit application number when providing the requested information. All information should be signed,
sealed, and submitted in duplicate to my attention at the address below. The information requested by this letter must be
submitted on or before March 22. 2000 or the Division will return your application as incomplete in accordance with 15A

This letter is being sent to clarify the recordkeeping requirement for Plant Available Nitrogen (PAN)
application on fields that are part of your Certified Animal Waste Management Plan.
In order to show that the agronomic loading rates for the crops being grown are not being exceeded, you
must keep records of all sources of nitrogen that are being added to these sites. This would include nitrogen
from all types of animal waste as well as municipal and industrial sludges/residuals, and commercial fertilizers.
Beginning January 1, 2000, all nitrogen sources applied to land receiving animal waste are required to
be kept on the appropriate recordkeeping forms (i.e. IRR1, IRR2, DRY1, DRY2, DRY3, SLUR], SLUR2,
SLD1, and SLD2) and maintained in the facility records for review. The Division of Water Quality (DWQ)
compliance inspectors and Division of Soil and Water operation reviewers will review all recordkeeping during
routine inspections. Facilities not documenting all sources of nitrogen application will be subject to an
appropriate enforcement action.
Please be advised that nothing in this letter should be taken as removing from you the responsibility or
liability for failure to comply with any State Rule, State Statute, Local County Ordinance, or permitting

information is required before we can continue our review. Please address the following by October 23, 1999:
1. Please provide waste storage pond capacity documentation (design, as -built calculations, etc.). Be sure to
include any site evaluations, wetland determinations, or hazard classifications that may be applicable.
2. Please provide the Operation and Maintenance Plan for this facility.
3. Your Waste Utilization Plan (WUP) lists the nitrogen application amount for the grass -legume mix on page
seven as 20 lbs./ton. In table 1 of your WUP (page nine), it appears as though 40 lbs./ton have been used.
Please contact your technical specialist to revise the Waste Utilization Plan or provide information that
supports the increased application amount as shown in the current WUP. Please note that all WUP revisions
must be signed and dated by both the owner and the technical specialist.
4. Best Management Practices (BMPs) that are to be implemented at this facility should be identified (check
the appropriate BMPs) on the Insect Control Checklist (enclosed).

6. In your WUP on page 4, the amount of gallons of waste produced per year appears to be reduced by 75%.
This indicates that the animals at your facility are not confined 100% of the time. This was not mentioned
elsewhere in your application. Please verify that the animals at your facility are only confined 75% of the
time. Also, please contact your technical specialist to review the amount of excess water calculated. 225
cows were used for this but 262 animals were used for the gallons of waste produced. Please have this
explained.

7. An inspection from earlier this year indicated that some waste from this facility was applied on some
neighboring land. All land that is used for waste application must appear in the WUP with all necessary
supporting information_ Also, a land use agreement must accompany that information. If you intend to
apply waste to land other than that in your WUP, please contact your technical specialist for a WUP
revision.
Please contact your technical specialist and have the application windows (months) added to your WUP for
the crop grown.

You are hereby notified that John Hampton Dairy Farm, in accordance with G.S. 143-215.1 OC,
must apply for coverage under an Animal Waste Operation General Permit. Upon receipt of this letter,
your farm has sixty (60) days to submit the attached application and all supporting documentation. In
accordance with Chapter 626 of 1995 Session Laws (Regular Session 1996), Section 19(c)(2), any
owner or operator who fails to submit an application by the date specified by the Department
SHALL NOT OPERATE the animal waste system after the specified date. Your application must
be returned within sixty (60) days of receipt of this letter. Failure to submit the application as required
may also subject your facility to a civil penalty and other enforcement actions for each day the facility is
operated following the due date of the application.
The attached application has been partially completed using information listed in your Animal
Waste Management Plan Certification Form. If any of the general or operation information listed is
incorrect please make corrections as noted on the application before returning the application package.
The signed original application, one copy of the signed application, two copies of a general location
map, and two copies of the Certified Animal Waste Management Plan must be returned to complete the
application package. The completed package should be sent to the following address:

Dear Mr. Hampton
Senate Bill 1217, An Act to Implement Recommendations of the Blue Ribbon Study Commission
on Agricultural Waste, was ratified by the North Carolina General Assembly on June 21, 1996.
This bill required that a properly certified operator be designated as the Operator in Charge for each
animal waste management system that serves 250 or more swine, 100 or more confined cattle, 75 or
more horses, 1,000 or more sheep, or 30,000 or more confined poultry with a liquid animal waste
management system.
The deadline for designating an Operator in Charge for animal waste management systems
involving cattle, horses, sheep, or poultry was January 1, 1997. Because a training and
certification program was not yet available for these systems, you were allowed to apply for and
were issued a temporary animal waste management certificate from the Water Pollution Control
System Operators Certification Commission (WPCSOCC). Because you applied for and were
issued a temporary certificate, you were allowed to be designated as the Operator in Charge of an
animal waste management system.
Your temporary certificate expires December 31, 1997, and is not renewable. Our records indicate
that you have not obtained a permanent animal waste management system operator certification. If
you intend to remain the Operator in Charge of the facility for which you were designated, you must
obtain a permanent animal waste management system operator certification of the appropriate type
before your temporary certification expires on December 31, 1997. To obtain a permanent
certification, you must be 18 years of age, complete ten hours of approved training, and pass an
examination. If you do not intend to remain the Operator in Charge, a properly certified animal
waste management system operator must be designated as Operator in Charge of the facility prior to
the expiration of your temporary certification.
This year's final training program for both Type A and Type B animal waste management systems
is scheduled for December 10 and 11, 1997, at the Hunt Horse Complex in Raleigh. If you would
like information about this training program, please contact your local cooperative extension agent
or call Dee Ann Cooper at 919/515-6968. For those enrolled in this training and registering with
Ms. Cooper prior to December 1, an exam will be offered at the Hunt Horse Complex on December
11, beginning at 1:00 pm.

In addition to the training and testing at the Hunt Horse Complex, examinations for permanent
certification will be offered on December 11, 1997, in Williamston, Kenansville, Raleigh
(Wake Tech), Wentworth, Salisbury and Morganton. This examination date will be the last
opportunity to obtain permanent certification before your temporary certification expires. If you
need additional information or have questions concerning the examinations for certification, please

An Animal Feedlot Operation Inspection was performed on the John Hampton Dairy
Farm by Jenny Rankin of this office on October 24, 1997.
The inspection found your waste management system to be extremely well
maintained. No water quality concerns were noted. Enclosed is the inspection sheet which
was completed during the visit.
