Greg operated under John Hampton's waste plan until the farm was purchased. from John. According to Greg he does not use any fields that were once in John's waste plan. Therefore, Greg is applying to land NOT in his permit. He is aware of the consequences so the sooner he can be compliant the better it will be for him. I understand the process of gathering.information for the. waste- plan -revision -is -taking-place.-If-this is -not. correct -let me know. After reviewing the latest information, we have a few questions to clarify for each of these farms: 1. Facility No. 03-21: a. A recent site visitation made by the DWQ inspector had suggested including T-519 Field I in the waste plan. Please verify if that field is to be included or should be left off in the latest plan. b. Plant availbale nitrogen (PAN) appears to be calculated based on waste analysis results. Current guidance recommends that an average PAN production rate be calculated using representative waste samples, at least two samples per year, over a three year period. It is necessary to take these samples at different times of the year to reflect seasonal variations in PAN. In addition, irrigation records must be supplied for the same three year period. Please verify and submit information ( waste results and irrigation records) to support the PAN production rate as listed in the current WUP. Otherwise, the WUP may be revised using "book" values for PAN production at this facility. 2. Facility No. 03-21, a. The field maps for the new acres (T-695, T-2553, and T-1470) are missing in the permit package. Please submit proper aerial maps with site number and acreage clearly marked on them. b. This was in response to your telephone calls to our office on May 26, 2001 regarding a discharge of animal waste from an application field (Tract 671, Field 3CL) located off Highway 221 in Alleghany County into Rock Creek (Class C+ waters of the State). i Our investigation determined that between 9:00 AM and 12:00 PM on May 26, 2001, you applied 12 loads (3,000 gallons each) of animal waste from the milk parlor storage pond onto only two acres of the grass hay/pasture field cited above. Per evidence reviewed by Staff, the aforementioned field was already saturated due to several previous rain events on the days preceding the application of waste. Per conversations with Staff, you stated that the reason for application under these conditions was due to the high level of waste backing -up into the parlor pipe. While this office can certainly understand your situation, we cannot condone the improper method in which the waste was applied and the subsequent discharge that occurred. Please note that several factors, in fact, led to the discharge of unpermitted waste into surface waters of the State. Firstly, animal waste was applied to a field already saturated with precipitation. Although you stated to Ms. Rosebrock that you had "done this before and had no problems," your Certified Animal Waste Management Plan (CAWMP), signed by you, states that you will "apply waste according to your plan at the appropriate times and at rates that no run-off occurs." You are, therefore, in violation of your CAWMP and deemed permit. Secondly, your plan states that the field in question is approximately 35 acres in size. Since the field was saturated you stated that you could not land apply the waste to the entire field. Rather, the waste was allowed to just run out of the spreader tank at twelve different locations along the fence to the field. Since the area of application was only about two acres in size, an obvious hydraulic (and plant available nitrogen) overload occurred causing the run-off of unpermitted waste into waters of the State. Again, this is a violation of your CAWMP and deemed permit. In future situations such as this, the first option should be to transfer the waste from the "full" structure into one that can adequately receive and store the waste until such time as field conditions are suitable for application. The SLUR -I form should then be updated to reflect the date and amount of waste transferred from one holding structure to another. Lastly, during our investigation we noted the presence of what appeared to be subsurface drains located in the application field. We suggest that you contact the Alleghany SWCD/NRCS or your technical specialist for assistance in determining the presence and location of such drains. If determined that subsurface drains exist on this field, or on any others onto which - you maybe -applying -to waste: then the CAWMP-must-be revised to -include this information. This office acknowledges that you abided by the Emergency Action Plan contained in your CAWMP. It was also noted that, per your CAWMP, you notified our office of the discharge within one -and -a -half hours from first knowledge of the incident and at the direction of Alleghany County Emergency Management, successfully attempt to stop the flow of waste with the use of straw and hay bales. We have also received revised pages of the CAWMP that now include additional waste application fields. Additionally, our Staff has reviewed the requested waste application records for year 2001. While most. recordkeeping entries appear to be complete, we noted that May applications of waste from the milk parlor pond had not been included. We are specifically interested in the application record for May 26, 2001. Once the waste analysis results for this waste pond have been received, please update the SLUR-1 and 2 forms and submit those to our office as well. In order to avoid future Notices and probable enforcement action, it is recommended that you review your waste management practices including storage procedures and timeliness of waste applications. Operator stated that he had spread waste from the milk parlor waste storage pond onto a meadow located at "the old place" (T-671, F-30). He further stated that he had been t tr doing this before without any problems. His message indicated that some waste had seaped into the ground and had gotten into an old ditch then had gotten into the creek. He called back the same day at 1818 hours to say that emergency management had taken care of the situation. Per records obtained from the Town Manager's office, this area had received at least a trace of precipitation almost everyday for 10 days prior to the application of waste by Mr. Hampton on 5/26/01. According to his report, although the stream became discolored, "no stream wildlife seemed to be affected." When questioned, Mr. Leftwich said that no fish kills were observed or reported in the county either. Per instruction from Mr. Leftwich, the operator successfully stopped the flow of waste into the creek through the use of hay and straw at approximately 1600 hours. Investigation: Between 0900 and 1200 hours on 5/26/01, the waste operator unloaded 12 loads (3,000 gal. each) along the fence line (Hampton Lane) onto a two acre area of the field since the field was too wet for him to drive upon and spread waste. A good stand of 6-9 inch tall grass had been established on the application field. Discharge site was approximately 458 feet from the fenceline where the waste was unloaded from the spreader tank. Discharge occured at Long 36 31 34 Lat 81 11 03. It appeared as if the waste had gotten into a subsurface drain and was conveyed to the creek. Per operator, there may be three subsurface drains on this field. Jay Collins (neighbor) notified operator of discoloration in creek at 1330 hours. Per Mr. Leftwich and Mr. Hampton, the discoloration in the creek was clearing up by 1600 to 1615 hours. On the date of the investigation no visual evidence of waste was in the stream. Additionally, no waste odors were noted. Dissolved oxygen measurements were taken in the creek at various locations to rule out any background discharges: 9.1 mg/l - 25' downstream of discharge 9.0 mg/l - Discharge site 8.8 mg/I - 228' upstream of discharge site 9.0 mg/I - 417' upstream of discharge site of fork in creek 7.8 mg/I - at "Bobby Joe's fork" 417' upstream of discharge 8.5 mg/I - 900' upstream of discharge at property line #f9. Will need gauged marker once permitted. #19. Need to obtain waste sample analysis for waste from parlor waste storage pond. Need to update records once waste sample results have been received. Staff noted that the information in your waste application records was not complete. Specifically, waste applications for each field had not been recorded on the appropriate forms (SLUR-1 and SLUR-2). A nitrogen balance had not been calculated and recorded for each field either. Staff did note however, that you had kept very detailed and complete records in a personal notebook regarding the number of loads, fields, and dates to which waste was applied. Please note that waste and soil records, once obtained, should be kept for a minimum of five years. This bill required that a properly certified operator be designated as the Operator in Charge for each animal waste management system that serves 250 or more swine, 100 or more confined cattle, 75 or more horses, 1,000 or more sheep, or 30,000 or more confined poultry with a liquid animal waste management system. The deadline for designating an Operator in Charge for animal waste management systems involving cattle, horses, sheep, or poultry was January 1, 1997. Because a training and certification program was not yet available for these systems, you were allowed to apply for and were issued a temporary animal waste management certificate from the Water Pollution Control System Operators Certification Commission (WPCSOCC). Because you applied for and were issued a temporary certificate, you were allowed to be designated as the Operator in Charge of an animal waste management system. Your temporary certificate expires December 31, 1997, and is not renewable. Our records indicate that you have not obtained a permanent animal waste management system operator certification. If you intend to remain the Operator in Charge of the facility for which you were designated, you must obtain a permanent animal waste management system operator certification of the appropriate type before your temporary certification expires on December 31, 1997. To obtain a permanent certification, you must be 18 years of age, complete ten hours of approved training, and pass an examination. If you do not intend to remain the Operator in Charge, a properly certified animal waste management system operator must be designated as Operator in Charge of the facility prior to the expiration of your temporary certification. This year's final training program for both Type A and Type B animal waste management systems is scheduled for December 10 and 11, 1997, at the Hunt Horse Complex in Raleigh.
