David Tucker (NRCS), Dale Sollenberger (tank contractor), JBK Grading (grading contractor), and Alan and Steve Joines were on site. My last visit was a week ago on October 4, 2017. During the last visit, we pulled a tape and estimated the center of the tank and the tank's footprint. Upon arrival today, it was noted that the grading contractor had moved a lot of earth. Based on the footprint, the grader had begun digging done. The grader had reworked the dam, creating access to the pond bottom from the backside of the dam. My original flagging of the tank center was in place, as the grader had excavated around it creating a pier. From the original center point, Dale began pulling 45' with the tape and marking the sides where excavation needed to occur. Next to the barn, the excavation was about 3' shy of 45'. The grader had graded within 8' of the barn and did not feel comfortable getting much closer. David and I measured 100' from the creek and found that we could shift the tank torwards the creek a couple of feet. The tank center was moved and Dale was able to measure 45' next to the barn without any more excavation occurring in this area. The high wall was discussed with Dale. He felt comfortable working next to the high wall once the grader sloped the top back some. To help control runoff from the barn roof during rains (to prevent eroding of the sides), the LO put plastic down at the top of the excavation, hoping to gutter the water away from the excavation. Dale discussed ingress/egress and pad needs with the contractor. A tractor trailer will need to back into the hole with the crane, so the access point will need to be widened and armored. The pad where the concrete will be pumped will need to be compacted as well. A pipe will be connected to the existing pipe exiting the milk parlor. This pipe will pass through the top of the tank per the tank drawings. The ramps were briefly discussed with Dale. They are not part of his contract, but offered a couple of ideas. Since the tank was shifted closer to the ramps, the ramps will have a steeper slope going down to the tank. This will need to be studied more. There was discussion of possibly using a chute. This will be further investigated. In the coming days, the grading contractor will continue digging around the area to achieve the appropriate width and depth needed for the tank. The grader will also work on preparing the foundation, ensuring there is proper ingress/egress and pad, and digging a ditch for the foundation drain. As you know, often we hear about the new structures only after they have already constructed or begun construction 1 They need to obtain a COC first (see below). They will only need to fill out the first part of the Certificate form (see attached). If they are not changing the animal numbers, they do not need to modify their waste plan. Just send their latest copy. Otherwise, they will have to modify plan as well. § 143-215.10C. Applications and permits. (a) No person shall construct or operate an animal waste management system for an animal operation or operate an animal waste management system for a dry litter poultry facility that is required to be permitted under 40 Code of Federal Regulations § 122, as amended at 73 Federal Register 70418 (November 20, 2008), without first obtaining an individual permit or a general permit under this Article. The Commission shall develop a system of individual and general permits for animal operations and dry litter poultry facilities based on species, number of animals, and other relevant factors. It is the intent of the General Assembly that most animal waste management systems be permitted under a general permit. The Commission, in its discretion, may require that an animal waste management system be permitted under an individual permit if the Commission determines that an individual permit is necessary to protect water quality, public health, or the environment. It is also our aim to provide our workers with the safest and best prepared site conditions possible toward achieving this goal. Therefore, it is requested that the following guidelines and practices be followed during the excavation, stone base preparation and backfilling operations of your current project: 1) The area where the storage structure is to be placed must have a minimum soil -bearing capacity of 3,000 pounds per square foot. The subgrade shall be uniform, well -compacted and free of organic material. If the tank is to be placed on a site with expensive soils or other subgrade problems, the subgrade preparation must be supervised by an experienced soils engineer. 2) Site access during inclement weather may slow down or stop construction of the project. If construction of the project is to continue during these conditions, it is the customer's responsibility to provide access into and around the construction site. The customer is also obligated to supply and place stone, fill or other suitable material necessary to provide access. NOTE: Provisions for the drainage of surface water, along with standard E & S plans, must be incorporated during initial land clearing and excavation. 3) Proper excavation to provide safety, access and exact grade for the project must be completed using the following guidelines: a) It is recommended that a fifteen (15) foot wide entrance ramp be excavated into the structure site. This ramp must be sloped in a manner that provides reasonable access for excavation equipment, stone trucks, concrete trucks, et cetera. It is the customer's obligation to place stone as required. b) To provide maximum safety during construction, ground banks must be sloped away from the lowest point of the excavation using OSHA standards. (See attachment for recommended slopes for different soil types.) c) To provide construction access around the outside of the finished tank wall, the finished hole must be a minimum of eight (9) feet wider at the footer elevation than the inside dimension of the tank. Example: A one -hundred (100) foot diameter x twelve (12) foot deep tank requires a one -hundred and nine (I09) foot diameter excavation. d)jThe customer needs to be aware that it is the excavator's responsibility to provide easy access down the access ramp for our semi and straight trucks to unload our forms, Upon tank completion, access for our trucks to within 10' of tank perimeter should also _ 2 be provided so the forms can be loaded: if this access is not possible, the customer,' will be charged a crane rental fee which may range from $500 to $20001 e) In order to achieve the correct finished height for the top of the tank wall, the depth of the footer must be taken into consideration during excavation. The total depth of the excavation is calculated by adding the height of the wall plus the total depth of the footer. f) To provide a subbase for the concrete floor, a level -crushed stone base must be placed and brought to exact grade prior to pouring the concrete floor. NOTE: This is a critical part of the project and it is m recomended that this work be done by an experienced excavation contractor. Upon completion of the rough excavation, the form/batter boards will be placed by the SSLLC construction crew who will determine the depth of the footer and the depth of the crushed -stone subbase. g) If the amount of concrete used in the floor and footer installation exceeds what the contract calls for due to improper base preparation, the buyer will be billed as follows: Material:$1:50-0jj per cubic yard for material Labor: _(men) x _(hours) x $50.00 per hour = (Total) 4) Concrete pumping equipment is typically used in placing concrete for the structure floor and wall. Access, along with a level pad area must be provided for this operation. For smaller tanks, a minimum thirty (30) foot x thirty (30) foot area is required. For tanks over ninety (90) foot in diameter, two (2) level, thirty (30) foot x thirty (30) foot sites will be required. 5) Upon placement of the form/batter boards for the concrete floor or the completion of pouring the floor, it is recommended that the four (4) inch diameter "perimeter drain line" be placed, covered with crushed stone and exited to daylight. TLhe perimeter drain installation is the responsibility of the excavator! b) Upon completion of the tank construction, but prior to placement of any safety fences, scrape alleys, tractor pads or other needed amenities, it is required that the finished structure be backfilled with suitable material and be compacted in areas where additional construction is to take place. 7) If SSLLC is required to drill into rock in order to place batterboards, the additional expenses (both labor and materials) involved in performing this task will be the responsibility of the customer. 8) It is the customer's responsibility to provide a porta-potty for our workmen. 9) Special provisions: Overhead electric line will be de-encrgized while pumping concrete, and Sollenberger Silos and/or the concrete pumping company will not be held responsible for damage to the line ,poles, and transformer incurre while placing concrete. We thought we had everything good to go on building a 80 foot diameter 16 foot high concrete tank. The design was going to be completed by an Engineer who was working for Sollenburger Silos in Pennsylvania. This Engineer than said that somebody had to certify the foundation of the building and that typically Sollenburger Silos had this done or the landowner. The Joines were not told about this when they signed a contract with Sollenburger Silos. Sollenburger Silos told us that theyjust wanted it graded flat and geotextile cloth put down and 4 inches of gravel. (This is what is in their contract from what I remember) To even get anyone to certify a base the old Waste Pond will have to be removed and the site graded down to the appropriate level to see what is even there. This involves the risk of it not being suitable for someone to approve possibly. Anyway the Joines don't like the idea of having to extend their push off ramps 100 feet and into this new Tank. We looked at another option of 2 smaller tanks which they do not like as well. Sollenburger Silos recommended a Pre -Fab Square type tank but this type of tank has not been approved through the NRCS Engineering process. Next Alan Joines wanted us to just retrofit the Waste Pond he has by digging it deeper and then making the sidewalls vertical and then pouring the bottom and sidewalls with concrete. This is what we have been trying to get an idea on next to see if anyone has any experience (NRCS or SWCD Engineers) in doing this kind of retrofit. Since this is highly specialized we have been trying to locate someone in house with some expertise. Any way the Joines cannot understand why we just cannot come out there and draw it out and start construction today. The foundations for anything out there will have to be certified as well as any back fill around the tanks to get ground level back up to where you can build push off ramps. The Joines are also still going to try and keep milking with all of their animals there while this is being completed. This will be hard to do. Anyway the Joines have already signed Contracts with NCACSP and these are pended waiting on design. I would also like to get the animals back out on the pasture behind the Free Stall Barn by fencing the stream out and putting in some water tanks there and fixing the Animal Trail and Walkway to where it is usable. By doing this it will take a lot of pressure off of waste going in the Pond. I cannot build a NRCS contract until we know exactly what we are going to do out there or something close. Anyway we are still trying to get something in place out there that will work. In all reality it is a very difficult site to start with as you well know. Call me if you need to. I'd like to get some information from the guy who does the concrete tanks. David said that the guy from Pennsylvania had mentioned a 75-ft diameter tank 16-ft deep and that the depth concerned him (David). That depth concerns me too and as you can see the diameter won't fit in the 100-ft buffer off the stream. Do we know how far he needs to be away from the existing buildings to be safe to dig the footers for the tank and not endanger the buildings? Does he ever do rectangular or irregular shaped structures? I can call him or one of you can and get back to me but I don't have any contact information for him. We may have to look at a small tank adjacent to the barns and then transfer to a larger tank. We had also talked about getting William Miller up there when the silage trench was empty to look at soils and those seeps/springs. Do you know that status of his silage storage? Will it be spring before that trench is emptied? The standard says that if it has not expanded since 4/15/1987, we can go with a 300-ft buffer to the house. if it was after that we have to get a waiver for the 750- ft. With 750-ft we are in the middle of the existing pond. You can see the buffers to the house and wells and what kind of limitations we are working with. He will need in the neighborhood of 508,000 gallons of storage for 130 head for six months storage, or about 775,000 gallons for 120 davgminr 130 head at 100% confinement, Those bers give some storage for rainfall and 25 years storm on the structure. He said he has a 2 inch "safety" built in so when he told you he had 5 inches of FB last week he actually had 7 inches. I ask him to keep you updated on any progress or info from David Tucker. Allen said that David is considering getting a permit to "move" the stream so as to give him 150 feet of buffer room. He said David said that it was not safe to reconstruct his existing WSP and that there needed to be another new one built. So they may be doing both: new WSP and moving stream. I told him to call if you if he needed someone to talk to Sue Homewood about the stream. Skvarla, III Secretary Mr, Allen Joines of Joines Dairy Farm contacted Ms. Melissa Rosebrock of the WSRO on Thursday January 31, 2013 at approximately 2:00 pm via telephone to notify the WSRO that the waste pond was over the max level mark. On Friday February 1, 2013 at approximately 9:00 am Mr. Patrick Mitchell of the WSRO contacted Mr. Allen Joines to discuss the freeboard level in the waste pond. Mr. Joines stated that the freeboard level in the waste pond was at the max level mark on Monday January 28, 2013, and that there is a little over 5 inches of freeboard remaining today (2/01/2013) before any overflow from the waste pond will result. Mr. Joines also stated the following: "we have received a significant amount of rainfall, snow, and frozen precipitation along with freezing weather conditions since December 2012. We land applied a lot in November, emptying the waste pond and had 54 inches of freeboard the first week of December prior to the wet weather. We haven't been able to land apply since due to conditions" Mr. Joines reminded DWQ that there is an existing vegetated catch basin/ditch below the waste pond remnant from a prior event that had occurred during similar weather conditions and circumstances in years past. Mr. Joines indicated that as soon as conditions allow, he will begin land application to lower the waste level, and that if in the event that conditions do not allow land application, he will install additional catch basins/ditches below the waste pond to contain any waste overflow. Mr. Joines also stated that Mr. David Tucker with NRCS had visited the waste pond in early December to review and discuss the potential for upgrade or replacement of the existing waste pond. DWQ reminded Mr. Joines to keep good records of precipitation and freeboard levels. DWQ recommended that Mr. Joines be proactive and go ahead and install additional series of catch basins/ditches below the waste pond. Rock riprap Linings: Practice 6.15, Riprap. 5. PIace filters, beddings, and foundation drains to line and grade in the man- ner specified. Place filter and bedding materials immediately after slope preparation. Spread granular materials in a uniform layer. When more than one gradation is required, spread the layers so there is minimal mixing. Filter material should consist of at least 3 inches of material on all sides of the drain pipe. The drain pipe conduit should be a minimum of 4 inches in diameter. Ac- ceptable materials include perforated, continuous, closed joint conduits of clay, concrete, metal, plastic, or other suitable material (Practice 6.81, Sub -Surface Drain). 6. Perform all channel construction to keep erosion and water pollution to a minimum. Immediately upon completion of the channel, vegetate all disturbed areas or otherwise protect them against soil erosion. Where channel construc- tion will take longer than 30 days, stabilize channels by reaches. Maintenance Inspect channels at regular intervals as well as after major rains, and make repairs promptly. Give special attention to the oudet and inlet sections and other points where concentrated flow enters. Carefully check stability at road cross- ings and look for indications of piping, scour holes, or bank failures. Make repairs immediately. While the animal waste application records were in excellent order, there are continuing water quality concerns and violations that warrant your immediate attention and action. , As discussed during the inspection, DWQ staff observed evidence of accumulated sludge and organic matter in the section of an unnamed tributary (UT) to Bledsoe Creek (class C-trout waters of the State) that flows through your property. A visual inspection of the tributary also revealed that cattle have uncontrolled access to waters of the State and that the buffer area along the waterway is void of vegetation due to cattle traffic. Enough sediment and waste was observed to have washed into the UT to impact at least 600 feet of water. Vegetation needs to be established in the buffer area along the UT to help prevent further run-off. Waste from the silo and concrete barn lot areas near the road also appears to be washing into the freshwater drain on a frequent basis. The unpermitted discharge of animal waste into waters of the State is a violation of North Carolina General Statute (NCGS) 143-215.1 and the Cattle Waste Permit. Individually or together, the issues described above are affecting the water quality in the UT located on your farm. These situations allow for a probable water quality standard violation (biochemical oxygen demand, turbidity, pH, dissolved oxygen, etc.) in the future, particularly if conditions deteriorate. Be advised that the non -permitted discharge of any type of waste into waters of the State is illegal as per NCGS 143- 215.1 and could subject you to civil penalties of up to $25,000 per day for violations of environmental regulations and water quality standards. A written response is expected within thirty (30) days of receipt of this Notice, indicating the actions you are taking to correct the noted problems. Your response is to include statements and specific descriptions of how and when the water quality concerns are to be/have been addressed. After much discussion and review of your last three inspections from the Division of Water Quality and the Division of Soil and Water Conservation, it was mentioned that most of the items cited were maintenance items including: mowing on back slope of waste storage structure, getting rid of groundhogs and back -filling the holes, and repairing or replacing any loose boards that might allow discharge from the tongue -and - groove structure. In addition, you voiced concerns about surface runoff entering the concrete lot of your operation. Mention was made of $40,000 of cost share funds that had been set aside in 1997 should your operation require roofing in order to meet .0200 requirements for storage. Your operation was later certified for 90 days of storage for 130 cows. The board and staff explained again that the NC Ag Cost Share staff had told them that animal waste funds could not be approved for roofing on a .0200 operation that was certified without it. The staff agreed to visit the farm that afternoon to look at any water quality concerns. Jasper Cave and Jim Wooten with NRCS and I visited the farm on the afternoon of the 161h. The following is a summary of what was discussed on the farm and what our recommendations for cost share assistance will be to the soil and water district board: While walking the area of the concrete holding lot, the waste storage pond, and road above the waste system we discussed runoff from the road, the function of diversions and culverts to carry clean water and required maintenance of the waste storage structure. We found the existing diversion on the upper side of the concrete lot had filled in with sediment and was not functioning properly. The culvert that carried the water from this diversion also appeared to be blocked and unable to function as it should as was the culvert on the lower side of the lot that carried the clean water from part of the roofed building(s). There appeared to be a need for curbing around the concrete lot to contain any runoff and help prevent surface water • Page 2 January23, 2001 from coming onto the lot. The area where the cattle are coming onto the lot, from the pasture, was denuded and needed improvements. The waste storage structure appeared to be functioning properly. The liquid level was approximately 1 foot below the maximum as marked on the steel post. It was noticed that a board had been placed over a small hole from the inside of the structure as previously recommended. The tongue -and -groove boards above ground appeared to have a small amount of moisture seeping where the boards come together, probably due to the boards drying out. The moisture appeared to run down the board not more than one to two inches. No seepage was noticed on the ground. After leaving your operation, our office contacted Melissa Rosebrock with the Division of Water Quality (DWQ) to discuss our findings and to see if she had any additional concerns or comments. Ms.. Rosebrock was in agreement with the following recommendations: As part of the maintenance for your operation routine checks should be made of all the items mentioned above to be sure they are functioning properly. When your waste is pumped down check to see if there are any loose or damaged boards that need to be repaired or replaced. Mow the back slopes as recommended and check for and repair any groundhog holes. Keep livestock off the back slopes to prevent erosion problems. Keep the liquid waste level below maximum at all times. We feel like you qualify for NC Ag Cost Share Assistance for the following concerns: Curbing around the concrete lot to prevent waste from leaving the lot, repair to the existing diversion and culverts, and a stock trail to correct the area where the cattle enter the lot from the pasture. We also feel water quality would benefit by installing a stream protection system including fencing, a spring development, and watering tank(s). If there are no springs that would be suitable to develop for alternative water, the cost share program will allow cost sharing for a tank and piping from an established water source (well, milk parlor, etc.). These are the recommendations we plan to present to the district board at our February 13`� board meeting. Please contact our office if you want cost share on the items listed. However, there was not a lack of vegetation problem -noted. The Atwood Farm also had a leaking waste pond which has been repaired however, there was a vegetation problem noted on their inspection form. I had thought maybe the Joines and Atwood Farms had been confused with one another. I have since spoken with Ron and he says the farm in question is one that is not registered ...... however, both of the ones noted above are registered and certified. He says the farm with bare ground is located at one end of the road or other on Spicer Mtn. Road. Rocky will be in that area soon and I'll ask him to take a look on that road when he's doing the Joines Farm inspection. Let me know if you need further information. Melissa Rosebrock and Matt Czahor of the Winston-Salem Regional Office performed both evaluations. On the date of the compliance inspection the waste storage pond was found to be seeping. The area of discharge (about 1 foot wide and 5 foot long) was on the west side of the waste storage pond, approximately in the middle, and at the point where the wood (tongue and grooved) wall meets the soil. The discharge was almost undetectable due to the high vegetation surrounding that side of the waste pond. Additionally, the pond was found to have approximately 8 inches of total freeboard remaining. It was difficult for staff to make an accurate freeboard assessment since there was no gauge marker present. The above mentioned discharge and high freeboard posed an immediate threat to the environment due to the potential for discharge to surface waters of the State. A follow-up evaluation was then performed on June 13, 2000. On the date of this visit, staff found that the" vegetation had been mowed and/or removed around the waste storage pond and that a permanent marker had been set. In addition, it was noted that waste had been pumped well below the pond's maximum level mark. It was observed that soil had been filled in around the section that was previously seeping so as to stop the discharge. This office appreciates the concern which you have shown as exhibited by your prompt response in addressing the above issues. Skvarla, III Secretary As you may recall, on May 28, 2013 at approximately 5:30 pm Mr. Allen Joines notified staff with the North Carolina Division of Water Quality, Winston-Salem Regional Office (DWQ) via a voicemail message of an incident where liquid manure waste was released from the waste storage structure serving Joines Dairy Farm and was discharged to surface waters. In this notification Mr. Joines reported the following details: "waste had leaked over the spillway"; "some waste had bypassed the catch ditches (previously installed) and entered the creek"; "we stopped the leak as soon as it was noticed." On May 29, 2013 DWQ staff members Mr. Patrick Mitchell and Ms. Melissa Rosebrock made a site visit to investigate this incident. This Notice has been divided into two sections in an effort to address the discharge incident investigation separately from any chronic ongoing observations noted. Discha_rp,e Incident Investigation: The following observations and related violations associated with the release and discharge incident were noted during this investigation (also see enclosed photos#7 — 417): 1. Waste had overflowed from the spillway of the storage structure and through the wooden dam wall adjacent to the spillway. Previously constructed catch ditches/basins downslope of the structure had captured a portion of the waste, preventing some waste from discharging into surface waters. Lime had been applied on the remaining waste still present on the ground surface and in the catch ditches/basins in an effort to stabilize the waste. Stream samples were obtained and analyzed to monitor potential' surface water impacts. While the Division recognizes that this unpermitted discharge was caused by conditions presumably out of your control, it still violates NC General Statute NCGS 143-215.1 (a) which states in part that "no person shall...make any outlets into the waters of the State." and Permit Condition I. 1. which discusses failure to operate the facility as a non -discharge system and prevent a discharge of waste that reaches surface waters. 2. In addition to the major waste release and subsequent discharge described above, a minor amount of waste release was also observed at a minimum of five additional locations along the wooden portion of the dam of the structure. Some of these areas appeared to have an ongoing release occurring at the time of the investigation. The waste from these additional releases had traveled approximately two feet to as much as six feet down the embankment of the structure. The release of waste from the storage structure is also a violation of Permit Condition I. 1. - which also discusses the facility being operated and maintained as to contain all waste plus the runoff from a 25-year, 24-hour rainfall event. 3. The waste level in the storage structure was estimated to be approximately 10 inches above the maximum liquid level mark at the time of investigation. This is a violation of Permit Condition V. 2. It should be noted that waste was observed being pumped out of the structure and hauled for land application in an effort to lower the waste level and prevent additional waste release. 4. A review of the onsite facility records indicates that the waste level in the storage structure exceeded the maximum liquid level mark several weeks prior to this release and discharge incident. Our office was not notified at that the time in which inadequate storage capacity was reached. This is a violation of Permit Condition III. 13. - which requires the Permittee to report to the Regional Office at first knowledge of failure to maintain adequate storage capacity in the storage structure. Our files document that this is the second occurrence of inadequate freeboard within the past 12 months. DWQ records also indicate that inadequate freeboard was noted in a Notice of Deficiency (NOD) issued on May 20, 2010 for this same structure. The subject waste release and discharge incident, along with the evidence listed below, suggests that an assessment of the facilities waste collection/storage design, construction, operation and maintenance plan is warranted. This assessment should be conducted by a Technical Specialist and needs to include an evaluation of the waste systems ability to contain all waste produced by the operation. The Division requests that the following concerns be considered: o The frequency of inadequate freeboard in the waste storage structure. ® Inadequate freeboard levels have been documented even with "below design capacity" stocking numbers. The facility's design capacity is 130 head of cattle. Only 64 cows were reported as being Joines Dairy Farm, Facility No. 03-21 June 26, 2013 Page 3 of 3 confined to the waste management system during this investigation and only 79 cows were reported in association with the May 2010 NOD for inadequate freeboard. S Past and present ongoing DWQ observations and documentation of waste seepage and release through the wooden portion of the dam of the waste storage structure. Chronic Ongoing Observations: During the incident investigation silage leachate/waste runoff was observed to be entering Bledsoe Creek (see enclosed photos #1 — #6). This unpermitted discharge is also a violation of General Statute NCGS 143-215.1 (a) and Permit Condition I. 1. Various stream samples were obtained and analyzed at several locations on Bledsoe Creek during the investigation. Of particular interest are the sample results for the following sample locations: #1 "Upstream of Cattle Barn" (i.e. upstream background location), #2 - "Upstream of Discharge" (i.e. location above the incident discharge), and #4 - "Below Leachate Discharge". The sample results are enclosed for your review. These results indicate violations of the State's surface water quality standards for pH, Fecal Coliform, and Dissolved Oxygen. While there is currently no state water quality standard for specific conductance, nutrients, or five-day Biochemical Oxygen Demand (BODS), the attached results indicate that there is a probable impact occurring from the silage leachate/waste runoff. Heavy fungal growth occurring below the discharge is further evidence that the silage leachate/waste runoff is having an impact on the surface waters. We urge your continued cooperation in eliminating this ongoing discharge. Required Actions: This office requests that you initiate a review, as described above, by a Technical Specialist within 30 days of receipt of this Notice. This office also requests that you report weekly freeboard level updates to this office until the waste level is back into compliance. As a reminder, please submit the results of your waste samples that were analyzed for the parameters listed in Permit Condition III. 9. f. to this office. The Division of Water Quality appreciates your cooperation and efforts thus far in these matters. The OIC notified the WSRO via a voicemail message (received on 5128/13 at 5:30 pm) indicating that the waste pond serving the subject facility had leaked over the spillway and discharged into the creek. It was reported that the leakage was stopped as soon as it was noticed. WSRO also received calls from DWQ hotline for reporting by the OIC. Through discussions with the OIC and onsite measurements made on 5/29/13 it was estimated that approximately 2.5 to 3 inches of freeboard waste from the waste pond had been lost during the release. An estimated waste amount of 20,000 gallons or more appears to have entered the creek. The remaining portion of waste released from the waste pond was captured in ditches previously constructed by the OIC to contain any overflow. In an effort to reduce additional impacts to surface waters the OIC had applied lime onto the waste in these ditches and on any waste still remaining on the grounds surface prior to WSRO visit. The primary area of release from the waste pond which resulted in the discharge to surface waters appeared to be from the spillway. In addition, there were five or six areas along the wooden portion of the dam that had seepage occurring at the time of site visit. Waste had traveled approximately 2 feet to as much as 6 feet down the embankment from these seepage areas. WSRO staff recommended that the OIC contact NRCSISoil & Water staff to discuss a site review of the waste pond for structural integrity. At the time of the site visit it was estimated that the waste level in the waste pond was approximately 10 inches above the max level mark on the freeboard marker. Review of onsite facility records suggested that the max waste level in the waste pond was reached on May 20, 2013. The facility did NOT notify the WSRO of the freeboard violation at the time of occurrence as required by the permit. WSRO staff believes the excessively high waste level in the waste pond is the primary cause of the release and subsequent discharge to surface waters. In an effort to lower the waste level back into compliance and prevent further release the subject facility was actively land applying waste during the site visit. WSRO staff discussed the required permit response and associated required timelines for their completion with the Permlttee/OIC. There was an excessive fungal mat present in the stream. The fungal mat was present upstream of the discharge and is believed to be the result of more chronic issues possibly from silage leachate and runoff from the barn areas. Additionally, there was groundwater seepage occurring into the silage storage pit causing excessive runoff of leachate to surface waters. Samples were collected from the subject surface waters to address the waste pond discharge and possibly the chronic issues as well. Results not returned to date.
